## Policy Analysis Report: Notification Regarding Competent Authorities for Recycling of Ships Rules, 2021
**1. Executive Summary:**
This report analyzes a notification from the Ministry of Ports, Shipping and Waterways, published in the Gazette of India on June 13, 2025. This notification designates competent authorities for performing duties related to the Recycling of Ships Rules, 2021, as mandated by the Recycling of Ships Act, 2019. The key provision establishes the Maritime Board of the respective State or Union Territory (or the relevant department in their absence) as the competent authority within its geographical jurisdiction. This designation aims to ensure the effective implementation and enforcement of the Recycling of Ships Rules, 2021, at the state and union territory level.
**2. Introduction:**
The purpose of this report is to provide a concise and informative analysis of a notification (S.O. 2582(E)) issued by the Ministry of Ports, Shipping and Waterways, published on June 13, 2025, regarding the designation of competent authorities under the Recycling of Ships Rules, 2021. This analysis is based solely on the provided text of the notification.
**3. Policy Overview:**
* **Core Objective(s):** Based on the provided text, the core objective of this notification is to designate competent authorities at the state and union territory level responsible for executing the duties specified in rule 4 of the Recycling of Ships Rules, 2021. This aims to decentralize and streamline the implementation of these rules.
**4. Background and Rationale:**
* The Recycling of Ships Act, 2019 and the Recycling of Ships Rules, 2021 provide a framework for the environmentally sound and safe recycling of ships. This notification likely addresses the need to clarify and assign specific responsibility for the implementation of these rules at the state and union territory level. This is essential for effective enforcement and compliance. Without designated authorities, enforcement would be difficult.
**5. Key Provisions / Changes:**
* This notification establishes the following:
* **Designated Authority:** The Maritime Board of the respective State or Union Territory is designated as the Competent Authority.
* **Alternative Authority:** Where no Maritime Board exists, the concerned Department of the State or Union Territory dealing with ship recycling matters serves as the Competent Authority.
* **Geographical Area of Expertise:** The jurisdiction of the Competent Authority is limited to the geographical area within the boundaries of the respective State or Union Territory.
* **Legal Basis:** This designation is made in pursuance of Section 4 of the Recycling of Ships Act, 2019.
* **Reference to Existing Rules:** The designated authorities are responsible for performing the duties specified in rule 4 of the Recycling of Ships Rules, 2021.
**6. Target Audience and Stakeholders:**
Based on the provided text, the target audience and stakeholders directly affected by this policy include:
* **Maritime Boards of States and Union Territories:** These bodies are now responsible for specific duties related to ship recycling within their jurisdiction.
* **Departments of States and Union Territories dealing with ship recycling:** These departments become responsible in the absence of a Maritime Board.
* **Ship Recycling Facilities:** These facilities are subject to the regulations and oversight of the designated Competent Authorities.
* **The Shipping Industry:** Ships destined for recycling within India will be subject to the regulations enforced by these authorities.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Maritime Boards or the relevant departments of the State or Union Territory are responsible for implementing the provisions of the Recycling of Ships Rules, 2021, within their respective jurisdictions.
* **Timelines or Procedures:** The text does not specify explicit timelines or procedures beyond referencing the Recycling of Ships Rules, 2021. It can be inferred that the existing rules contain these specifications, and the designated authorities are now responsible for adhering to them.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of this notification are:
* **Improved Enforcement:** Clear designation of competent authorities should lead to more effective enforcement of the Recycling of Ships Rules, 2021 at the state and local levels.
* **Decentralized Implementation:** Delegating responsibility to state and union territory level entities allows for more localized and responsive implementation of the rules.
* **Enhanced Compliance:** Increased oversight and enforcement should encourage greater compliance with the regulations governing ship recycling, leading to safer and more environmentally sound practices.
* **Greater Accountability:** The designation of specific bodies creates a clear line of accountability for the implementation of the Rules.
**9. Conclusion:**
The notification analyzed in this report designates competent authorities for the implementation of the Recycling of Ships Rules, 2021. This is a crucial step towards ensuring effective regulation and enforcement of ship recycling practices within India. By assigning responsibilities to the Maritime Boards or relevant departments at the state and union territory level, the government aims to promote safer and more environmentally sound ship recycling operations, leading to the successful execution of the Recycling of Ships Act, 2019.
