और (ख) प्रत्येक पोत, भारतीय पोत से जभन्न, िब वह भारत म ेंदकसी पत्तन या स्ट्थान पर ह,ै जिसके अंतगतग तटीय िल भी ह ै ककंतु, यह युद्धपोतों, नौसेना सहायक या दकसी राज्य की सरकार के स्ट्वाजमत्व या संचाजलत अन्य पोतों पर लाग ू नहीं होगा, जिसका उपयोग तत्समय केवल गैर-वाजणजज्यक प्रयोिनों के जलए दकया िाता ह।ै 5205 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. पररभाषाए ँ - (1) इन जनयमों म,ें िब तक दक संिभ ग अन्यथा अपेजक्षत न हो, - (क) "अजधजनयम" से वाजणज्य पोत पररवहन अजधजनयम, 2025 (2025 का 24) अजभप्रेत ह;ै (ख) "नागररक िाजयत्व अजभसमय" का अथग ह ै तले प्रिषू ण से क्षजत पर अतं रागष्ट्रीय नागररक िाजयत्व अजभसमय, 1992, यथा संिोजधत अजभप्रेत ह;ै (ग) "प्ररूप" से इन जनयमों स े सलं ग्न एक प्ररूप अजभप्रेत ह;ै और (घ) "टन भार" स े सकल टन भार अजभप्रेत ह,ै जिसकी गणना अजधजनयम के अधीन बनाए गए लागू जनयमों के अनुसार की िाती ह।ै (2) इन जनयमों म ेंप्रयुि और अपररभाजषत ककंतु अजधजनयम म ेंपररभाजषत, िब्िों और अजभव्यजियों का वही अथग होगा, िो अजधजनयम म ेंक्मिः उनके ह।ैं 4. अजनवाय ग बीमा या अन्य जवत्तीय सरु क्षा- (1) प्रत्येक पोत का स्ट्वामी, माल के रूप म ें िो हिार टन स े अजधक तले भारी मात्रा म ेंल े िान े वाले पोतों के संबंध में अजधजनयम की धारा 181 के अधीन जवजनर्िगष्ट रकम के जलए प्रिषू ण क्षजत हते ु अपन े िाजयत्व को कवर करने के जलए एक बीमाकता ग स े बीमा या अन्य जवत्तीय सुरक्षा बनाए रखगे ा। (2) माल के रूप म ेंथोक म ेंिो हिार टन तक तले ले िान ेवाले प्रत्येक पोत का स्ट्वामी ऐसे पोत के संबंध म,ें नागररक िाजयत्व अजभसमय के उपबंधों के अधीन जवजनर्िगष्ट रकम के जलए प्रिषू ण क्षजत के जलए अपने िाजयत्व को कवर करने के जलए बीमा या अन्य जवत्तीय सुरक्षा बनाए रखगे ा। (3) प्रत्येक पोत, जिस पर उपजनयम (1) या (2) लागू होत े ह,ैं अजधजनयम की धारा 188 के अधीन जवजनर्िगष्ट िाजयत्व की सीमाओं स े कम रकम के जलए बीमा का प्रमाण पत्र या अन्य जवत्तीय सुरक्षा बनाए रखगे ा। 5. बीमा प्रमाणपत्र या अन्य जवत्तीय सरु क्षा िारी करन ेया नवीनीकरण के जलए आविे न- (1) भारतीय पोत का स्ट्वामी, जिसन े अजधजनयम की धारा 188 की उपधारा (2) के उपबधं ों के अनसु ार ऐसे पोत के संबंध म ें बीमा या अन्य जवत्तीय सुरक्षा बनाए रखी ह,ै बीमा प्रमाणपत्र या अन्य जवत्तीय सुरक्षा िारी करने या नवीनीकरण के जलए संबंद्ध समुद्री वाजणजज्यक जवभाग के प्रधान अजधकारी को, िहां ऐसा पोत रजिस्ट्रीकृत ह,ै प्ररूप-क म ेंआवेिन करेगा। (2) भारतीय पोत स े जभन्न दकसी अन्य पोत का स्ट्वामी या अजभकताग िो ऐस े िेि म ें रजिस्ट्रीकृत ह,ै िहां नागररक िाजयत्व अजभसमय का पक्षकार नहीं ह ैऔर जिसने ऐस ेपोत के संबंध म ेंबीमा या अन्य जवत्तीय सुरक्षा बनाए रखी ह,ै वह बीमा प्रमाण पत्र या अन्य जवत्तीय सुरक्षा िारी करने या नवीनीकरण के जलए प्ररूप - क म ें महाजनििे क को आवेिन करेगा, जिसकी िांच महाजनिेिक द्वारा िारी करन े के जलए संबद्ध वाजणजज्यक समद्रु ी जवभाग के प्रधान अजधकारी को भेि े िान े स े पहल े की िाएगी। (3) उपजनयम (1) और (2) के अधीन प्रत्येक आवेिन म ें प्ररूप-क म ें जवजनर्िगष्ट जववरण िाजमल होंग े और ऐस े बीमा या अन्य जवत्तीय सुरक्षा के रखरखाव के संबंध म ें िस्ट्तावेिी साक्ष्य और जनयम 10 म ेंयथाजवजनर्िगष्ट लाग ू फीस के संिाय की पुजष्ट करन े वाली रसीि भी साथ होगी। 6. बीमा प्रमाणपत्र या अन्य जवत्तीय सरु क्षा िारी करना -(1) जनयम 5 के उप-जनयम (1) या (2) के अधीन आवेिन प्राप्त होन े के बाि, संबंद्ध वाजणजज्यक समद्रु ी जवभाग का प्रधान अजधकारी, संबद्ध पोत के संबंध म ें बीमा या अन्य जवत्तीय सुरक्षा के रखरखाव के संबंध में समाधन होने पर, प्ररूप-ख म ें जवजनर्िगष्ट अनुसार बीमा या अन्य जवत्तीय सुरक्षा का प्रमाण पत्र िारी करेगा। (2) िहां प्रधान अजधकारी बीमा या अन्य जवत्तीय सुरक्षा का प्रमाण-पत्र िारी करता ह,ै वहा ंऐसे प्रमाण-पत्र म ें जनम्नजलजखत जवजिजष्टयां, िहां लागू हो, िाजमल दकए िाएगं े, अथागत्: (क) िहां जवत्तीय सेरक्षा की कुल रकम एक स े अजधक स्रोतों द्वारा प्रस्ट्तुत की िाती ह,ै वहा ं प्रत्येक द्वारा उपबंजधत रकम को पथृ क रूप स ेउपिर्ितग दकया िाएगा; (ख) िहा ं जवत्तीय सुरक्षा कई प्ररूपों म ेंप्रस्ट्ततु की िाती ह,ै ऐसे प्ररूपों को प्रमाण पत्र म ेंजगना िाएगा; और (ग) जवत्तीय सुरक्षा की अवजध, उस अवजध को जवजनर्िगष्ट करेगी जिसके जलए ऐसी बीमा या अन्य जवत्तीय सुरक्षा जवजधमान्य ह।ै 7. अनजु लजप प्रमाणपत्र - (1) िहा ं जनयम 6 के अधीन िारी प्रमाण पत्र खो गया ह,ै नष्ट हो गया ह,ै चोरी हो गया ह,ै जवकृत हो गया ह,ै जवरूजपत हो गया ह ैया अपिनीय हो गया ह,ै वहा ंयथाजस्ट्थजत, स्ट्वामी या अजभकताग, जनयम 10 म ें यथाजवजनर्िगष्ट फीस के संिाय पर एक अनुजलजप प्रमाण पत्र िारी करन े के जलए, संबद्ध वाजणजज्यक समुद्री जवभाग के प्रधान अजधकारी को प्ररूप - ग म ेंआवेिन कर सकता ह,ै िहां मूल प्रमाण पत्र िारी दकया गया था ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (2) िहां उप-जनयम (1) में यथाजवजनर्िगष्ट खोया हुआ प्रमाण पत्र बाि म ें स्ट्वामी या उसके अजभकता ग द्वारा खोिा या पाया िाता ह,ै तो इस े वाजणजज्यक समुद्री जवभाग के प्रधान अजधकारी को लौटा दिया िाएगा, िहां ऐसा प्रमाण पत्र िारी दकया गया था। (3) इस जनयम के उपबंध इलेक्ट्रॉजनक रूप म ेंिारी दकए गए प्रमाणपत्रों पर लागू नहीं होंगे। 8. अनजु लजप प्रमाणपत्र िारी करन ेकी प्रदक्या - (1) िहा ंइन जनयमों के अधीन िारी दकया गया प्रमाण पत्र खो िाता ह,ै नष्ट हो गया ह,ै चोरी हो गया ह,ै जवकृत हो गया ह,ै जवरूजपत हो गया ह ै या अपिनीय हो गया ह,ै वहा ं स्ट्वामी या अजभकता,ग यथाजस्ट्थजत, जबना दकसी िेरी के संबद्ध वाजणजज्यक समुद्री जवभाग के प्रधान अजधकारी को जलजखत म ें इसकी सूचना िेगा। (2) प्रमाणपत्र खो िाने या नष्ट हो िाने या चोरी हो िान े की जस्ट्थजत म,ें स्ट्वामी या अजभकता ग जनकटतम पुजलस स्ट्टेिन म ें जिकायत या हाजन ररपोटग ििग करेगा और उसकी एक प्रजत सबं द्ध वाजणजज्यक समुद्री जवभाग के प्रधान अजधकारी को प्रस्ट्ततु करेगा। (3) यथाजस्ट्थजत, उप-जनयम (1) या (2) के अधीन प्रस्ट्तुत कोई भी ररपोटग, स्ट्पष्ट रूप से पोत का नाम और पोत की जवजिजष्टयां, खोए हुए प्रमाण पत्र का प्रकार, नाम और संख्या, और ऐसी हाजन की पररजस्ट्थजतयों, तारीख और स्ट्थान का कथन करेगी। (4) प्रमाण पत्र के जवरूजपत या अपिनीय होने की जस्ट्थजत म,ें मूल प्रमाण पत्र संबद्ध वाजणजज्यक समुद्री जवभाग के प्रधान अजधकारी को अभ्यर्पगत दकया िाएगा। (5) उप-जनयमों (1), (2) और (3) के अनुपालन के पश्चात, संबद्ध पोत का स्ट्वामी या अजभकता ग जनयम 10 म ें यथाजवजनर्िगष्ट फीस के साथ एक अनुजलजप प्रमाण पत्र िारी करन े के जलए आवेिन कर सकता ह,ै और ऐसे आवेिन के साथ जनम्नजलजखत िस्ट्तावेि होंग,े अथागत:् - (क) उपजनयम (1) और (2) म ें जवजनर्िगष्ट ररपोटग की एक प्रजत; और (ख) इस प्रभाव का एक वचनपत्र दक मूल प्रमाण पत्र के बाि म ें पता लगन े या बरामि होने की जस्ट्थजत म,ें उस े संबंजधत वाजणजज्यक समुद्री जवभाग के प्रधान अजधकारी को अभ्यर्पगत दकया िाएगा। (6) िहां संबद्ध पोत का स्ट्वामी या अजभकता ग उपजनयम (1) या (2) के अधीन ररपोटग प्रस्ट्ततु करन े म ें असफल रहता ह,ै यथाजस्ट्थजत, ऐसा स्ट्वामी या अजभकता गगुम हुए प्रमाण पत्र के दकसी भी िरुु पयोग, कपटपूण गप्रजतजनजधत्व या अनुजचत उपयोग के जलए िायी रहगे ा। (7) इन जनयमों के अधीन िारी दकए गए अनुजलजप प्रमाण पत्र म ें मूल प्रमाण पत्र के समान जवजधक िजि और जवजधमान्यता होगी और इसम ेंएक अनुमोदित कथन होगा- " अनुजलजप - मूल के गुम हो िाने के बिल ेिारी दकया गया"। 9. जविेिी जनणयग ों के प्रवतनग की प्रदक्या - अजधजनयम की धारा 192 की उपधारा (1) के अधीन मान्यता प्राप्त कोई भी जनणगय, जसजवल प्रदक्या संजहता, 1908 और नावजधकरण (समुद्री िावा की अजधकाररता और जनपटारा) अजधजनयम, 2017 के उपबंधों के अनुसार भारत म ेंलाग ू होगा। 10. फीस- (1) जनयम 5 के अधीन बीमा या अन्य जवत्तीय सुरक्षा के प्रमाण पत्र िारी करन े के जलए प्रत्येक आवेिन के साथ धारा 188 की उपधारा (2) के उपबंधों के अनुसार िस हिार रुपय े की फीस भी साथ होगी। (2) जनयम 5 के अधीन बीमा प्रमाणपत्र या अन्य जवत्तीय सुरक्षा के नवीकरण के जलए प्रत्येक आवेिन के साथ धारा 188 की उपधारा (2) के उपबंधों के अनसु ार िस हिार रुपय ेकी फीस भी साथ होगी। (3) जनयम 7 के अधीन अनुजलजप प्रमाण पत्र के जलए प्रत्येक आवेिन, िो हिार रुपय ेकी फीस का संिाय करने पर, स्ट्वामी या अजभकता ग को िारी दकया िाएगा। (4) इस जनयम म ेंउजल्लजखत फीस म ें केंद्रीय सरकार द्वारा अजधसूजचत रकम स ेपुनरीजक्षत दकया िा सकता ह।ै 11. खात ेकी इकाइया-ँ (1) नागररक िाजयत्व अजभसमय म ेंजनर्िगष्ट खाते की इकाइया,ँ अतं राष्ट्रग ीय मुद्रा जनजध द्वारा पररभाजषत जविेष आहरण अजधकार ह।ैं (2) अजधजनयम की धारा 182 के अधीन जनजध के गिन की तारीख को भारतीय ररिव ग बैंक द्वारा अवधाररत अनुसार जविेष आहरण अजधकार म ेंलेखा इकाइयों को भारतीय रुपय े म ें आजधकाररक मूल्य म ेंरूपए के अनुसार पररवर्ततग दकया िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्ररूप - क (जनयम 5 िेजखए) वाजणज्य पोत पररवहन अजधजनयम, 2025 की धारा 188 के अधीन बनाए गए बीमा या अन्य जवत्तीय सुरक्षा के प्रमाण पत्र के जलए आवेिन का प्ररूप: 1. पोत का नाम: 2. जवजिष्ट संख्या या अक्षर: 3. रजिस्ट्री का पत्तन: 4. स्ट्वामी या अजभकताग का नाम और पता: 5. Short title and commencement. — (1) These rules may be called the Merchant Shipping (Civil Liability for Oil Pollution Damage) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application. — Unless otherwise specified, these rules shall apply to, — (a) every Indian ship, wherever it may be; and (b) every ship, other than an Indian ship, while it is at any port or place in India, including the coastal waters, but shall not apply to warships, naval auxiliary or other ships owned or operated by the Government of any State and used for the time being, only for non-commercial purposes. 3. Definitions. — (1) In these rules, unless the context otherwise requires, - (a) “Act” means the Merchant Shipping Act, 2025 (24 of 2025); (b) “civil liability convention” means the International Convention on Civil Liability for Oil Pollution Damage, 1992, as amended; (c) “Form” means a Form appended to these rules; and (d) “tonnage” means the gross tonnage, calculated in accordance with the applicable rules made under the Act. (2) The words and expressions used in these rules and not defined, but defined in the Act shall have the same meanings respectively assigned to them in the Act. 4. Compulsory insurance or other financial security. — (1) The owner of every ship carrying more than two thousand tons of oil in bulk as cargo shall in respect of such a ship maintain an insurance or other financial security from an insurer to cover their liability for pollution damage for the amount specified under section 181 of the Act. (2) The owner of every ship carrying up to two thousand tons of oil in bulk as cargo shall in respect of such a ship maintain an insurance or other financial security to cover their liability for pollution damage for the amount specified under the provisions of the civil liability convention. (3) Every ship to which sub-rules (1) or (2) apply shall maintain a certificate of insurance or other financial security for an amount not less than the limits of liability specified under section 188 of the Act. 5. Application for issue or renewal of a certificate of insurance or other financial security. — (1) The owner of an Indian ship, who has maintained insurance or other financial security in respect of such ship, in accordance with the provisions of sub-section (2) of section 188 of the Act, shall make an application in Form - A to the principal officer of the concerned Mercantile Marine Department where such ship is registered, for issue or renewal of certificate of insurance or other financial security. (2) The owner or agent of any ship, other than an Indian ship, registered in a country which is not a party to the civil liability convention, and who has maintained insurance or other financial security in respect of such ship, shall make an application in Form - A to the Director-General for issue or renewal of a certificate of insurance or other financial security, which shall be examined by the Director-General prior to being forwarded to the principal officer of the concerned Mercantile Marine Department for issuance. (3) Every application under sub-rules (1) and (2) shall contain such particulars as specified in Form - A and be accompanied by documentary evidence regarding maintenance of such insurance or other financial security and a receipt confirming payment of the applicable fee as specified in rule 10. 6. Issuance of certificate of insurance or other financial security. — (1) After receipt of an application under sub- rules (1) or (2) of rule 5, the principal officer of the concerned Mercantile Marine Department shall, on being satisfied about the maintenance of insurance or other financial security in respect of the ship concerned, issue a certificate of insurance or other financial security as specified in Form - B. (2) Where the principal officer issues a certificate of insurance or other financial security, the following particulars, where applicable, shall be included in such certificate, namely:— (a) where the total amount of financial security is furnished by more than one source, the amount provided by each shall be separately indicated;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (b) where the financial security is furnished in several forms, such forms shall be enumerated in the certificate; and (c) the duration of the financial security which shall specify the period for which such insurance or other financial security is valid. 7. Duplicate certificate. — (1) Where the certificate issued under rule 6 is lost, destroyed, stolen, mutilated, defaced or rendered illegible, the owner or the agent, as the case may be, may apply in Form - C to the principal officer of the concerned Mercantile Marine Department where the original certificate was issued, for issuance of a duplicate certificate on payment of the fee as specified in rule 10. (2) Where a lost certificate, as specified in sub-rule (1), is subsequently traced or found by the owner or his agent, it shall be returned to the principal officer of the Mercantile Marine Department where such certificate was issued. (3) The provisions of this rule shall not apply to certificates issued in electronic form. 8. Procedure for issuance of a duplicate certificate. — (1) Where a certificate issued under these rules is lost, destroyed, stolen, mutilated, defaced or rendered illegible, the owner or the agent, as the case may be shall, without delay, report the same in writing to the principal officer of the concerned Mercantile Marine Department. (2) In the event of the certificate being lost or destroyed or stolen, the owner or the agent shall lodge a complaint or loss report with the nearest police station and shall submit a copy thereof to the principal officer of the concerned Mercantile Marine Department. (3) Any report furnished under sub-rules (1) or (2), as the case may be, shall clearly state, inter alia, the name and particulars of the ship, the type, name and number of the lost certificate, and the circumstances, the date and place of such loss. (4) In the event of the certificate being defaced, mutilated, or rendered illegible, the original certificate shall be surrendered to the principal officer of the concerned Mercantile Marine Department. (5) After compliance with sub-rules (1), (2), and (3), the owner or agent of the concerned ship may apply for issuance of a duplicate certificate, along with the fee as specified in rule 10, and such application shall be accompanied with the following documents, namely:— (a) a copy of the report specified in sub-rules (1) and (2); and (b) an undertaking to the effect that, in the event the original certificate is subsequently traced or recovered, the same shall be surrendered forthwith to the principal officer of the concerned Mercantile Marine Department. (6) Where the owner or agent of the concerned ship fails to submit a report under sub-rules (1) or (2), as the case may be, such owner or agent shall remain liable for any misuse, fraudulent representation or improper use of the lost certificate. (7) A duplicate certificate issued under these rules shall have the same legal force and validity as the original certificate and shall bear an endorsement stating “Duplicate - Issued in lieu of Original Lost”. 9. Procedure for enforcement of foreign judgments. — Any judgment, recognised under sub-section (1) of section 192 of the Act, shall be enforceable in India in accordance with the provisions of the Code of Civil Procedure, 1908 and the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017, as applicable. 10. Fees. — (1) Every application for the issue of a certificate of insurance or other financial security under rule 5 shall be accompanied by a fee of ten thousand rupees, in accordance with the provisions of sub-section (2) of section 188. (2) Every application for the renewal of the certificate of insurance or other financial security under rule 5 shall be accompanied by a fee of ten thousand rupees, in accordance with the provisions of sub-section (2) of section 188. (3) Every application for a duplicate certificate under rule 7 shall be issued to the owner or agent, as the case may be, on payment of a fee of two thousand rupees. (4) The fees referred to in this rule may be revised by the Central Government by such amount as may be notified. 11. Units of account. — (1) The units of account referred to in the civil liability convention are the Special Drawing Rights, as defined by the International Monetary Fund.
