Executive Summary & Key Takeaways

## Report on the Ethylene Glycol Quality Control Order, 2022 **1. Executive Summary:** This report analyzes the Ethylene Glycol Quality Control Order, 2022, as published in the Gazette of India. This order mandates conformity to Indian Standards (IS 5295:1985) for Ethylene Glycol and requires the use of the Standard Mark under a license from the Bureau of Indian Standards (BIS). It supersedes the Ethylene Glycol Quality Control Order, 2021, except for actions already completed under the previous order. The core purpose is to ensure the quality of Ethylene Glycol in the public interest, likely through mandatory standards and certification. Key findings include the delayed enforcement date, the role of BIS as the certifying and enforcing authority, and the penalties for non-compliance. **2. Introduction:** This report provides an informative overview of the Ethylene Glycol Quality Control Order, 2022, based solely on the information presented within the provided policy text. The purpose is to inform affected industries of the key provisions, implications, and implementation aspects of this order. **3. Policy Overview:** * This order supersedes the Ethylene Glycol Quality Control Order, 2021. * **Core Objective(s):** To ensure the quality of Ethylene Glycol and protect the public interest by mandating adherence to Indian Standards. **4. Background and Rationale:** The text indicates a supersession of a previous order (2021). The likely reason for this specific amendment, inferring from the provided text, is to update or refine the existing quality control framework for Ethylene Glycol. The phrase "except as respect, things done or omitted to be done before such supersession" suggests a continuation of responsibility under the prior order for any actions that already occurred. **5. Key Provisions / Changes:** This document represents an amendment to a prior Ethylene Glycol Quality Control Order (2021). The most significant change is a new effective date and an updated, although substantially similar, requirement for compliance. * **What specific part of the original policy is being changed (if discernible from the text):** The supersession clause indicates that *the entirety of the 2021 order* is being replaced by the 2022 order. The change is, in effect, a complete replacement. * **What the *new* rule/provision *is*, based *only* on the amendment text:** * **Short Title, Commencement and Application:** The order is titled "Ethylene Glycol Quality Control Order, 2022," will come into force on March 28th, 2023, and applies to Ethylene Glycol specified in the table, except for goods meant for export. * **Conformity to Standards and Compulsory Use of Standard Mark:** Requires Ethylene Glycol to conform to Indian Standard IS 5295:1985 and bear the Standard Mark under a license from the Bureau of Indian Standards. * **Certification and Enforcement Authority:** Designates the Bureau of Indian Standards (BIS) as the certifying and enforcing authority. * **Penalty for Contravention:** Specifies that violations of the order are punishable under the Bureau of Indian Standards Act, 2016. * **Date of Effect of Amendment in Indian Standards:** Specifies that any amendments to the referenced Indian Standards will apply from the date notified by the BIS. * **Explain the *difference* or the *effect* of this specific change:** The key differences resulting from the supersession appears to be the new compliance date (March 28, 2023) and a reaffirmation of the quality standards and enforcement mechanisms. The 2022 order likely reflects some adjustments or refinements not explicitly detailed in the provided text, but which warrant a full supersession rather than a partial amendment. **6. Target Audience and Stakeholders:** Based on the provided text, the target audience and stakeholders directly affected by this policy are: * Manufacturers and producers of Ethylene Glycol within India (excluding those producing solely for export). * Importers of Ethylene Glycol into India. * Consumers and end-users of Ethylene Glycol in India. * The Bureau of Indian Standards (BIS) as the certifying and enforcing authority. **7. Implementation Aspects (Inferred):** * **Responsible agency/bodies mentioned:** The Bureau of Indian Standards (BIS) is explicitly named as the certifying and enforcing authority. The Ministry of Chemicals and Fertilizers, Department of Chemicals and Petrochemicals, issued the order. * **Any timelines or procedures specified *in the text*?:** The order comes into force on March 28th, 2023. Manufacturers and producers will need to obtain a license from BIS and ensure their products conform to IS 5295:1985 by this date. Any amendments to IS 5295:1985 will take effect from the date notified by BIS. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome of these changes introduced by the amendment text is: * Enhanced quality control and standardization of Ethylene Glycol available in the Indian market. * Increased consumer confidence in the quality and safety of Ethylene Glycol products. * Clearer regulatory framework for manufacturers and importers, with BIS acting as the central authority. * Increased compliance with Indian Standards for Ethylene Glycol. **9. Conclusion:** The Ethylene Glycol Quality Control Order, 2022, is a significant regulatory instrument for ensuring the quality of Ethylene Glycol in India. By mandating conformity to Indian Standards and assigning BIS as the certifying and enforcing authority, the order aims to protect the public interest and promote consistent quality standards. The supersession of the 2021 order suggests a refinement or update to the quality control framework, likely driven by evolving needs or concerns within the industry. Affected industries must familiarize themselves with the provisions of this order and take necessary steps to comply by the March 28, 2023, enforcement date.
