L.-33004/99 सी.जी.-डी.एल.-अ.-21092026-276370 CG-DxLx-xEG-I2D1H0x9x2x0 26-276370 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4983] नई दिल्ली, सोमवार, जसतम्ब र 21, 2026/भार 30, 1948 No. 4983] NEW DELHI, MONDAY, SEPTEMBER 21, 2026/BHADRA 30, 1948 पर्ाावरण, वन एव ं िलवार् ु पररवतना मत्रं ालर् अजधसचू ना नई दिल्ली, 21 जसतम्ब र, 2026 का.आ. 5189(अ).—केन्द्रीर् सरकार न े तत्कालीन पर्ाावरण एव ं वन मंत्रालर् म,ें पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा (3) की उपधारा (1) और उपधारा (2) के खडं (v) के अधीन प्रित्त िजिर्ों का प्रर्ोग करते हुए, अजधसूचना की अनुसूची म ें िाजमल कजतपर् प्रवगो की पररर्ोिनाओं के जलए पूवा पर्ाावरणीर् अनापजत्त अजनवार् ा करन े हते ,ु संख्र्ा का.आ.1533 (अ), तारीख 14 जसतंबर, 2006 द्वारा पर्ाावरण समाघात जनधाारण अजधसूचना, 2006 (जिसे इसम ें इसके पश्चात् उि अजधसूचना कहा गर्ा ह)ै प्रकाजित की ह;ै और पूव ा अनुभवों के आधार पर, केन्द्रीर् सरकार न े समर्-समर् पर जविेष रूप स े उन पररर्ोिनाओं और दिर्ाकलापों के जलए पर्ाावरणीर् अनापजत्त की जवजधमान्द्र्ता अवजध को र्ुजिसंगत बनार्ा ह,ै जिनको परू ा करन ेकी जवकास अवजध, प्रार्ः पररर्ोिना प्रस्ट्तावक के जनर्ंत्रण स ेबाहर जवजभन्न कारणों से अजधक होती ह;ै और मंत्रालर् को पत्तनों और पोताश्रर्ों को अनिु त्त पर्ाावरणीर् अनापजत्त की जवजधमान्द्र्ता अवजध को र्ुजिसगं त बनाने का अनुरोध प्राप्त हुआ ह,ै िो वतामान म ेंप्रारंजभक िस वषों की अवजध के जलए जवजधमान्द्र् ह,ै जिसे एक वषा की अजतररि अवजध के जलए जवस्ट्ताररत दकर्ा िा सकता ह;ै और जवषर् को क्षेत्रीर् जविेषज्ञ आंकलन सजमजत को परीक्षण के जलए जनर्िाष्ट दकर्ा गर्ा था। क्षेत्रीर् जविेषज्ञ आंकलन सजमजत ने सम्र्क् जवचार-जवमि ा के पश्चात् जसफाररि की दक पत्तनों और पोताश्रर्ों को अनिु त्त पर्ाावरणीर् अनापजत्त की 7227 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जवजधमान्द्र्ता अवजध को प्रारंजभक रूप स े पंरह वषों के जलए पुनरीजक्षत रूप से जवजधमान्द्र् बनार्ा िा सकता ह,ै जिसे पााँच वषों के जलए जवस्ट्ताररत दकर्ा िा सकता ह;ै और क्षेत्रीर् जविेषज्ञ आंकलन सजमजत की जसफाररिों को परीक्षण के जलए जविेषज्ञ सलाहकार सजमजत को जनर्िाष्ट दकर्ा गर्ा था। सजमजत का र्ह मत था दक पत्तनों और पोताश्रर्ों पररर्ोिनाओं की लंबी जवकास अवजध और चरणबद्ध जवकास को िेखते हुए, पत्तनों और पोताश्रर्ों को अनिु त्त पर्ाावरणीर् अनापजत्त की जवजधमान्द्र्ता अवजध को र्ुजिसगं त बनाने की आवश्र्कता ह,ै चूंदक जवद्यमान िस+एक वषा की जवजधमान्द्र्ता अपर्ााप्त प्रतीत होती ह;ै और जवस्ट्तृत जवचार-जवमि ाके पश्चात,् जविेषज्ञ सलाहकार सजमजत न ेर्ह भी जसफाररि की दक पत्तनों और पोताश्रर्ों के जलए पर्ाावरणीर् अनापजत्त की जवजधमान्द्र्ता अवजध को प्रारंजभक रूप स े पंरह वषों के रूप म ें पनु रीजक्षत दकर्ा िा सकता ह,ै जिसे क्षेत्रीर् जविेषज्ञ आंकलन सजमजत / राज्र् स्ट्तर जविेषज्ञ आंकलन सजमजत के सम्र्क् परीक्षण और जसफाररिों के पश्चात ् अजधकतम पााँच वषों तक जवस्ट्ताररत दकर्ा िा सकता ह;ै और मंत्रालर् म ेंक्षेत्रीर् जविेषज्ञ आंकलन सजमजत और जविेषज्ञ सलाहकार सजमजत की जसफाररिों का परीक्षण दकर्ा गर्ा। सजमजतर्ों की जसफाररिों के आधार पर, उि अजधसूचना म ें संिोधन करन े के जलए एक प्रारूप अजधसूचना भारत के रािपत्र, असाधारण, भाग-2, खंड 3, उपखंड (ii) म ें संख्र्ा का.आ. 2593(अ) तारीख 20 मई 2026 द्वारा प्रकाजित की गई थी, जिसम ें उि प्रारूप अजधसचू ना अंतर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध कराए िान े की तारीख स े साठ दिनों की अवजध के भीतर इससे प्रभाजवत होन ेवाल ेसभी सामान्द्र् व्यजिर्ों स ेआक्षपे और सुझाव आमंजत्रत दकए गए थ;े उि प्रारूप अजधसूचना के प्रत्र्त्तु र म ें साठ दिनों की अवजध के भीतर प्राप्त आक्षपे ो और सुझावों पर केन्द्रीर् सरकार द्वारा सम्र्क् रूप से जवचार दकर्ा गर्ा ह;ै और मंत्रालर् को पत्तन,पोत पररवहन और िलमाग ा मंत्रालर् के सजचव की अध्र्क्षता के अधीन 16.06.2026 को आर्ोजित पणधारी परामि ा बैठक का कार्ावृत्त प्राप्त हुआ, जिसम ें मंत्रालर् स े खनन पररर्ोिनाओं के अनुरूप पत्तन पररर्ोिनाओं के जलए पररर्ोिना अवजध र्ा तीस वष ा (िो भी अजधक हो) के साथ पर्ाावरणीर् और तटीर् जवजनर्मन क्षेत्र अनापजत्त की जवजधमान्द्र्ता अवजध पर पुनर्वाचार करन े का अनरु ोध दकर्ा गर्ा था;

और पत्तन,पोत पररवहन और िलमाग ा मंत्रालर् के अनुरोध के साथ प्रारूप अजधसूचना पर प्राप्त रटप्पजणर्ों को जविेषज्ञ सलाहकार सजमजत को जनर्िाष्ट दकर्ा गर्ा था। बैठक के िौरान, क्षेत्रीर् जविेषज्ञ आकं लन सजमजत के अध्र्क्ष और प्रजतजनजधर्ों को भी आमंजत्रत दकर्ा गर्ा था। सम्र्क् जवचार-जवमिा के पश्चात,् सजमजत न े जसफाररि की दक पत्तनों और पोताश्रर्ों की जवजधमान्द्र्ता अवजध को जवस्ट्ताररत करके बीस वष ा कर दिर्ा िाए, परंत ु दक, जवजधमान्द्र्ता अवजध को बीस वषा स े आग े पांच वषा तक जवस्ट्ताररत दकर्ा िा सकता ह ै और र्ोग्र् मामलों म ें िहां पररर्ोिना इस जवस्ट्ताररत अवजध के भीतर पररचालनीर् नहीं हो पाई ह,ै वहा ं इस िता के साथ दक, इन िोनों जवस्ट्तारों के िौरान, पर्ाावरण प्रबंधन र्ोिना म ें आवश्र्कतानुसार उपर्िु पर्ावा रण सुरक्षा उपार्ों को िाजमल दकर्ा िाए, पांच वषा की अजतररि अवजध अनुित्त की िा सकती ह;ै और मंत्रालर् म ें जविेषज्ञ सलाहकार सजमजत की जसफाररिों का परीक्षण दकर्ा गर्ा। सजमजतर्ों की जसफाररिों के आधार पर, मंत्रालर् पत्तनों और पोताश्रर्ों को अनुित्त पर्ाावरणीर् अनापजत्त की जवजधमान्द्र्ता अवजध को र्ुजिसंगत बनाना उजचत समझता ह।ै अतः, अब केन्द्रीर् सरकार पर्ावा रण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का) 29 की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v), द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, भारत सरकार के तत्कालीन पर्ाावरण एव ंवन मंत्रालर् की अजधसूचना संख्र्ा का.आ.1533(अ), तारीख 14 जसतंबर, 2006 म ेंजनम्नजलजखत और संिोधन करती ह,ै अथाात्:-

2. उि अजधसूचना के, पैरा 9 म,ें -[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (क) उप-पैरा (ii) के खडं (ग) म,ें "खनन पररर्ोिनाएं" िब्िों के पश्चात् "और पत्तनों/पोताश्रर्ों/ब्रेक वाटर/ड्रेजिगं " िब्ि अंतःस्ट्थाजपत दकए िाएगं े;

(ख) उप-परै ा (iv) के पश्चात,् जनम्नजलजखत को अतं ःस्ट्थाजपत दकर्ा िाएगा, अथाात:् - “(ivक) पत्तनों, पोताश्रर्ों, ब्रेक वाटर और ड्रेजिंग के जलए िी गई पूवा पर्ाावरणीर् अनापजत्त बीस वषों की अवजध के जलए जवजधमान्द्र् होगी। परंत ु दक जवजधमान्द्र् अवजध को बीस वषों स े आग े और पांच वषों के जलए जवस्ट्ताररत दकर्ा िा सकता ह,ै इस िता के अधीन दक जवद्यमान पर्ाावरणीर् अनापजत्त म ेंअजधकजथत पर्ाावरणीर् सुरक्षा उपार्ों की पर्ााप्तता का परीक्षण संबद्ध जविेषज्ञ आंकलन सजमजत र्ा राज्र् स्ट्तर जविेषज्ञ आंकलन सजमजत द्वारा दकर्ा िाएगा तादक पर्ाावरणीर् प्रबंधन र्ोिना में ऐसे अजतररि पर्ाावरण सुरक्षा उपार्ों को िाजमल दकर्ा िा सके, िो आवश्र्क समझे िाए। और र्ोग्र् मामलों म,ें िहा ं पररर्ोिना इस जवस्ट्ताररत अवजध के भीतर पररचालन म ेंनहीं आ सकी ह,ै जविेषज्ञ आंकलन सजमजत र्ा राज्र् स्ट्तर जविेषज्ञ आंकलन सजमजत पररर्ोिना का परीक्षण कर सकती ह ैऔर र्दि उजचत समझा िाए तो पर्ाावरणीर् अनापजत्त को पांच वषों की अजतररि अवजध के जलए जवस्ट्ताररत करने की जसफाररि कर सकती ह,ै इस ित ा के अधीन दक जवद्यमान पर्ाावरणीर् सुरक्षा उपार्ों की पर्ााप्तता का परीक्षण संबद्ध सजमजत द्वारा दकर्ा िाएगा और पर्ाावरणीर् प्रबंधन र्ोिना म ें उपर्ुि पर्ाावरण सुरक्षा उपार्ों को िाजमल दकर्ा िा सकता ह,ै िैसा आवश्र्क समझा िाए।” (ग) उप-पैरा (v) म,ें "और (iv)" िब्िों, कोष्ठक और अंक के स्ट्थान पर ", (iv) और (ivक)" कोष्ठक, अंक, िब्ि और अक्षर रख े िाएाँगे। [फा. सं. आईए3-22/8/2026-आईए.III] रित अग्रवाल, संर्क्ु त सजचव रटप्पण: मूल अजधसूचना, भारत के रािपत्र, असाधारण भाग-II, खंड 3, उपखंड (ii) म ें संख्र्ांक का आ. 1533(अ), तारीख 14 जसतंबर, 2006 को प्रकाजित हुई थी और अंजतम बार अजधसूचना संख्र्ांक का.आ.3862(अ), तारीख 13 िलु ाई 2026 के द्वारा संिोजधत की गई थी।— MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION New Delhi, the 21st September, 2026 S.O. 5189(E).— WHEREAS, the Central Government in the erstwhile Ministry of Environment and Forests, in exercise of its powers under sub-section (1) and clause (v) of sub-section (2) of section (3) of the Environment

(Protection) Act, 1986 has published the Environment Impact Assessment Notification, 2006 (hereinafter referred to as the said notification), vide number S.O.1533 (E), dated the 14th September, 2006 for mandating prior environmental clearance for certain category of projects covered in the schedule of the notification;

And whereas, based on the past experiences, the Central Government from time to time has rationalised the validity period of Environmental Clearances, especially for projects and activities which have high gestation period due to various issues which are often beyond the control of the project proponent;

And whereas, the Ministry has received a request to rationalise the validity period of the Environmental Clearances granted to Ports and Harbours, which is currently valid for an initial period of ten years which may be extended for a further period of one year;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

And whereas, the matter was referred to the Sectoral Expert Appraisal Committee for examination. The Sectoral Expert Appraisal Committee after due deliberation recommended that the validity period of the Environmental Clearances granted to Ports and Harbours may be revised as valid for an initial period of fifteen years, which may be extended for a period of five years;

And whereas, the recommendations of the Sectoral Expert Appraisal Committee was referred to the Expert Advisory Committee for examination. The Committee was of the opinion that, considering the long gestation and phased development characteristic of Port and Harbour projects, the validity period of Environmental Clearances granted to ports and harbours need to be rationalised as the existing ten plus one years validity appears to be insufficient;

And whereas, after detailed deliberation, the Expert Advisory Committee also recommended that the validity period of Environmental Clearances for Ports and Harbours, may be revised as an initial period of fifteen years which may extended for a maximum period of not more than five years after due examination and recommendations of the Sectoral Expert Appraisal Committee /State Level Expert Appraisal Committees;

And whereas, the recommendations of the Sectoral Expert Appraisal Committee and the Expert Advisory Committee were examined in the Ministry. Based on the recommendations of the Committees, a draft notification for making amendments in the said notification was published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 2593(E) dated 20th May 2026, inviting objections and suggestions from all the persons likely to be affected thereby, within a period of sixty days from the date on which copies of the Gazette containing the said draft notification were made available to the public; The objections and suggestions received in response to the said draft notification within the period of sixty days have been duly considered by the Central Government;

And whereas, the Ministry received the minutes of the stakeholder consultation meeting held on 16.06.2026 under the Chairpersonship of Secretary, Ministry of Ports, Shipping and Waterways (MoPSW), wherein the Ministry was requested to re-consider the validity period of environment and Coastal Regulation Zone Clearance concomitant to the project period or thirty years (whichever is more) for Port Projects, in line with Mining Projects;

And whereas, the comments received on the draft notification along with the request of Ministry of Ports Shipping and Waterways was referred to the Expert Advisory Committee. During the meeting, the Chairman and representatives of the Sectoral Expert Appraisal Committee were also invited. After due deliberation, the Committee recommended that the validity of ports and harbors may be increased to a period of twenty years. Provided that, the period of validity may be extended by five years, beyond twenty years and in deserving cases where the project has been unable to be operationalised within this extended period, a further period of five years, may be granted subject to the condition that, suitable environment safeguards in the Environmental Management Plan may be included as may be deemed necessary, during both these extensions;

And whereas, the recommendations of the Expert Advisory Committee were examined in the Ministry. Based on the recommendations of the Committees, the Ministry deems it appropriate to rationalise the validity period of the Environmental Clearances granted to Ports and Harbours.

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment

(Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O.1533(E), dated the 14th September, 2006, namely:-

2. In the said notification, in paragraph 9,-

(a) in sub-paragraph (ii), in clause (c), after the words “Mining projects” the words “and Ports, harbors, break waters, dredging” shall be inserted;

(b) after sub-paragraph (iv), the following sub-paragraph shall be inserted, namely:- “(iva) The prior Environmental Clearance granted for Ports, harbors, break waters and dredging shall be

valid for a period of twenty years: Provided that, the period of validity may be extended by another five years, beyond twenty years, subject to the condition that the adequacy of the existing environmental safeguards laid down in the existing Environmental Clearance shall be examined by the concerned Expert Appraisal Committee or State level Expert Appraisal Committee for incorporating such additional environment safeguards in the Environmental Management Plan, as may be deemed necessary. Further, in deserving cases, where the project has been unable to be operationalised within this extended period, the Expert Appraisal Committee or State level Expert Appraisal Committee may examine the project and recommend the extension of Environmental Clearances for a further period of five years, if deemed appropriate, subject to the condition that the adequacy of the existing environmental safeguards shall be examined by the concerned Committee and[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 suitable environment safeguards in the Environmental Management Plan, may be included as may be deemed necessary.” ;

(c) in sub-paragraph (v), for the words, brackets and figures “and (iv)”, the brackets, figures word and letters “,
