आवेदन की गइ ह)ै और गोदाम दकराए के जलए अलग दकराया अनुबंध / रसीद सभी एक साथ और सामूजहक रूप से प्रस्ट्ततु करने म ेंसक्षम ह।ैं 4. यह आदेि उपयुाक्त ताजलका म ें क्रम संख्या (3) म ें उजल्लजखत भाग को छोड़कर, जो दक ददनाकं 01.11.2021 स े लागू हो चुका ह,ै तत्काल प्रभाव से लाग ूहोगा और क्रमांक (4) के जलए जो दक ददनांक 10.11.2021 से लागू ह ैतथा ददनांक 30.06.2022 तक या अगला आदेि ददए जान े तक, जो भी पहले हो, वैध रहगे ा। 5. मैं आग े कहता ह ं दक यह आदेि दद जूट कॉपोरेिन ऑफ इंजडया जलजमटेड द्वारा प्राप्त दकये गए कच्चे जूट के स्ट्टॉकों पर लाग ूनहीं होगा। 6. इसके अलावा, उपयुाक्त आदेि के खंड 9(1) के उप-खंड (बी) और (सी) के अनुसरण में, मैं अपने अजधकृत प्रजतजनजधयों और कानून लागू करने वाली एजेंजसयों को पररसरों सजहत गोदामों में प्रवेि करने और तलािी लेने के जलए तथा इस आदेि के जवाब में उनके द्वारा रखे गए स्ट्टॉक को सही ढंग से घोजर्त दकया गया ह ैया नहीं, यह सत्याजपत करने के जलए उनके कब्ज़े के अधीन उनके स्ट्टॉक, बजहयों और अन्य अजभलेखों का जनरीक्षण करने तथा पूवा में जारी दकए गए और दर्लहाल प्रभावी दकसी भी अन्य आदेि के अनुपालन की जांच करन े का एवं ऐस े कच्चे जूट को ज़ब्त करन े का, जजसके बारे में उनके पास यह मानने का कारण ह ै दक उसे इस आदेि या जारी दकए गए और दर्लहाल प्रभावी दकसी भी अन्य आदिे के उल्लघं न म ें संग्रजहत/लने देन दकया गया ह ै तथा जूट और जूट वस्त्र जनयंरण आदेि, 2016 और आवश्यक वस्ट्तु अजधजनयम, 1955 के प्रावधानों के तहत कोई भी कानूनी कारावाई करने के जलए सभी आवश्यक सुजवधाएं प्रदान करने का जनदेि देता ह।ूँ 7. अगर आप इस आदिे के दकसी भी या सभी प्रावधानों का पालन करने में असमथा रहते हैं, तो आप आवश्यक वस्ट्तु अजधजनयम, 1955 की धारा 7 के साथ परित जूट और जूट वस्त्र जनयंरण आदेि, 2016 के खडं 11 के तहत दजण्डत दकये जायेंगे, जजसमें कारावास और/अथवा जुमााने का प्रावधान ह।ै [फा. सं. जूट (माकेटटग)/106/2018-II] मलय चंदन चक्रवती, पटसन आयुक्त[भाग II—खण् ड 3(ii)] भारत का राजपर : असाधारण 3 MINISTRY OF TEXTILES (Office of the Jute Commissioner) ORDER Kolkata, the 31st January, 2022 S.O. 418(E).—In partial modification of the Order of even number dated 10-11-2021 issued by the undersigned in exercise of the powers vested under clause Clause 6(1) (iii) & Clause 5 of the Jute and Jute Textiles Control Order, 2016, I, Moloy Chandan Chakrabortty, Jute Commissioner, hereby direct that you shall reduce the stocks of raw jute on your own account and /or on account of third parties mentioned in the table below:- Category of raw jute traders/ dealers/agencies/stokists/Mills Maximum quantity of raw jute to be held (a) (b) (c) 1 Balers who are having raw jute Baling Press in the same 750 Quintals premises and who have applied for registration to this office within 31-10-2021. 2 All other categories of traders/dealers/agencies/stockist of raw 150 Quintals jute who have applied for registration to this office within 31-10-2021. 3 Those who have not applied to this office for registration in Existing stock limit of 500 pursuance of this office Order dated 18-06-2021 within Kilograms (5 Quintals) issued vide 31-10-2021. S.O. 4696(E) dated 10-11-2021 to continue. 4 Jute Mills / Manufacturing units of Jute Goods from raw jute Existing stock limit notified vide S.O. 4696(E) dated 10-11-2021 to continue. *Commercial stocking and transaction of raw jute (in excess of 500 kgs in a jute year) by traders/stockists who have not applied to this office for registration within 30-10-2021 have been declared prohibited w.e.f. 01-11-2021 vide S.O. No. 2523(E) F. No. Jute(Mktg)/160/80-IV dated 18-06-2021 and was declared as an offence under Essential Commodities Act, 1955. 2. I further direct that you to sell the quantity of raw jute if it is in excess of the quantity mentioned in column (c) corresponding to the category of raw jute traders mentioned at column (b) being held by you within 10(ten) days from the date of this Order and physically deliver the same to the consignee within 10th February, 2022 and to send a compliance report indicating sale/delivery of the excess quantity of raw jute along with supporting documentary evidence for verification by email (jcoffice@jutecomm.gov.in) immediately thereafter. If you are holding stock excess to the above limit, purchase of fresh stock shall be stopped forthwith till stock comes below the above mentioned limit. 3. Raw jute stocked in a single premise irrespective of in different names of such traders/stockists etc will be considered as total single stock for the purpose of interpretation of this Order except when such jute is stocked in a Commercial godown and such traders/stockists are able to produce separate trade licence, separate PAN, separate registration with JC office (applied for status) and also separate rent agreement/receipt for godown rent all together and collectively. 4. This Order shall come into force with immediate effect except the part mentioned under Sl. No. (3) in the table above which is already in force w.e.f. 01-11-2021 and for Sl. No. (4) which is already in force w.e.f 10-11-2021 and remain valid till 30-06-2022 or till further order whichever is earlier. 5. I further state that this Order shall not be applicable to stocks of raw jute procured by The Jute Corporation of India Ltd.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 6. Further, in pursuance of sub-clause (b) and (c) of clause 9(1) of the aforesaid Order, I direct to afford necessary facilities to my authorized representatives and law enforcing agencies to enter and search the premises including the godowns and also to inspect their stocks, books and other records under their possession with a view to verifying whether or not stocks held by them have been correctly declared or not in response to this Order & also to check compliance to any other orders previously issued and still in force and to seize raw jute which he/she has reason to believe to have been stored/transacted in contravention to this order or any other order issued and still in force & to take any legal action within provisions of the Jute and Jute Textiles Control Order, 2016 & Essential Commodities Act, 1955. 7. If you fail to comply with any or all the provisions of this Order, you shall be punishable under clause 11 of the Jute and Jute Textiles Control Order, 2016 read with section 7 of the Essential Commodities Act, 1955 which provides for imprisonment and/or fine.
