L.-33004/99 सी.जी.-डब्लू.बी.-अ.-12112021-231041 xxxGIDHxxx CG-WB-E-12112021-231041 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4331] नई कदलली, बृहस्ट्प जतवार, नवम्ब र 11, 2021/कार्तका 20, 1943 No. 4331] NEW DELHI, THURSDAY, NOVEMBER 11, 2021/KARTIKA 20, 1943 वस्त्र मत्रं ालय (पटसन आयक्तु का कायाला य) आदिे कोलकाता, 10 नवम् बर, 2021 का. आ. 4696 (अ).—खंड 5 और 6 (2) में उजललजखत कारकों पर जवचार करने के बाद और िूट और िूट वस्त्र जनयंत्रण आदिे , 2016 के खंड 6 (1) (त्त्त्) और खंड 5 द्वारा मुझे प्रदान की गई िजक्तयों का प्रयोग करते हुए, म,ैं मलय चंदन चक्रवती, िूट आयुक्त, एतदद्वारा जनदिे दते ा ह ूँ कक आप ककसी भी समय अपने खाते में और/या तीसरी पार्टायों के खाते में नीचे दी गई ताजलका में जनधााररत मात्रा से अजधक कच्चा िूट नहीं रखेंगे:- क्र .सं. कच्चा िूट व्यापाररयों/डीलरों/एिेंजसयों/स्ट्टॉककस्ट्टों/जमलों की श्रेणी धाररत ककए िाने वाले कच्चे िूट की अजधकतम मात्रा (क) (ख) (ग) 1 बेलर जिनके पास एक ही पररसर में कच्चा िूट बेललंग प्रेस है और 1500 किण्टल जिन्होंने 31.10.2021 के अंदर इस कायाालय में पंिीकरण के जलए आवेदन ककया है। 2 कच्च े िूट के अन्य सभी श्रेजणयों के व्यापाररयों/डीलरों/एिेंजसयों/ 300किण्टल स्ट्टॉककस्ट्ट, जिन्होंने 31.10.2021 के अंदर इस कायाालय में पंिीकरण के जलए आवेदन ककया है। 3 जिन्होंने इस कायाालय आदिे कदनांक 18.06.2021 के अनुसरण म ें 500 ककलोग्राम* कदनांक 31.10.2021 के अंदर पंिीकरण के जलए इस कायाालय में (5 किण्टल) आवेदन नहीं ककया है। 6519 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 4 िूट जमलें / कच्च ेिूट से िूट के उत्त्पाद बनाने वाली इकाइयां। वतामान उत्त्पादन दर के अनुसार एव ंपाइपलाइनों में कोई भी स्ट्टॉक सजहत सप्ताह की खपत 6 * पंिीकरण के जलए इस कायाालय में आवेदन नहीं ककया ह ै ऐसे व्यापाररयों/स्ट्टॉककस्ट्टों द्वारा कच्च े िूट का वाजणजययक स्ट्टॉककंग और लेनदने (एक िूट वर्ा में 500 ककलोग्राम से अजधक) एस.ओ. सं. 2523(ई) एफ.एन. िूट(माकेटटंग)/160/80-IV कदनांक 18 िून 2021 के मार्ात कदनांक 01.11.2021 से प्रजतबंजधत कर कदया गया ह ैऔर आवश्यक वस्ट्तु अजधजनयम, 1955 के अधीन एक अपराध के रूप में घोजर्त ककया गया था। 2. मैं आग े जनदिे दते ा ह ं कक आप इस आदिे की तारीख से 10 (दस) कदन के भीतर कच्च े िूट की अजतररक्त मात्रा को बेचेंगे अगर यह धाररत ककये िा रह े कॉलम (बी) में उजललजखत कच्च े िूट व्यापाररयों की श्रेणी के अनुरूप कॉलम (सी) में उजललजखत मात्रा से अजधक होती ह ै और 25 नवंबर, 2021 के भीतर कन्साइनी को उक्त मात्रा की जडलीवरी वास्ट्तजवक रूप से करेंगे तथा उसके तुरंत बाद संख्या 033 -23376972 और 23376974 पर फैक्स द्वारा या ईमेल (jcoffice@jutecomm.gov.in) द्वारा सत्त्यापन के जलए समर्थात दस्ट्तावेिी साक्ष्य के साथ कच्च ेिूट की अजधक मात्रा की जबक्री / जडलीवरी का उललेख करते हुए एक अनुपालन ररपोटा भेिेंगे। अगर आपके पास उपयुाक्त सीमा स े ज़्यादा स्ट्टॉक हैं, तो नए स्ट्टॉक की खरीद तुरंत रोक द ें िब तक कक स्ट्टॉक ऊपर उजललजखत सीमा से नीचे ना आ िाए। 3. ऐसे बेलर/व्यापारी/स्ट्टॉककस्ट्ट आकद के अलग-अलग नामों पर ध्यान कदए जबना एक ही पररसर में स्ट्टॉक ककये गए कच्च े िूट को इस आदिे की व्याख्या के उद्देश्य के जलए कुल एकल स्ट्टॉक के रूप में माना िाएगा, जसवाय इसके कक िब उक्त िूट को एक वाजणजययक गोदाम में स्ट्टॉक ककया िाता ह ै और ऐसे व्यापारी/स्ट्टॉककस्ट्ट अलग व्यापार लाइसेंस, अलग पैन, पटसन आयुक्त कायाालय के साथ अलग पंिीकरण (जस्ट्थजत - आवेदन की गइ ह)ै और गोदाम ककराए के जलए अलग ककराया अनुबंध / रसीद सभी एक साथ और सामूजहक रूप से प्रस्ट्तुत करने में सक्षम हैं। 4. यह आदिे उपयुाक्त ताजलका में क्रम संख्या (3) में उजललजखत भाग को छोड़कर, िो कक कदनांक 01.11.2021 से लाग ू हो चुका है, तत्त्काल प्रभाव से लाग ूहोगा और 30.06.2022 तक या अगला आदेि कदए िाने तक, िो भी पहले हो, वैध रहगे ा। 5. मैं आग ेकहता ह ंकक यह आदिे कद िूट कॉपोरेिन ऑफ इंजडया जलजमटेड द्वारा प्राप्त ककये गए कच्चे िूट के स्ट्टॉक पर लाग ूनहीं होगा। 6. इसके अलावा, उपयुाक्त आदिे के खंड 9(1) के उप-खंड (बी) और (सी) के अनुसरण में, मैं अपने अजधकृत प्रजतजनजधयों और कानून लाग ूकरने वाली एिेंजसयों को पररसरों सजहत गोदामों में प्रवेि करने और तलािी लेने के जलए तथा इस आदिे के िवाब में उनके द्वारा रखे गए स्ट्टॉक को सही ढंग से घोजर्त ककया गया ह ैया नहीं, यह सत्त्याजपत करने के जलए उनके कब्ज़ ेके अधीन उनके स्ट्टॉक, बजहयों और अन्य अजभलेखों का जनरीक्षण करने तथा पूव ामें िारी ककए गए और कर्लहाल प्रभावी ककसी भी अन्य आदिे के अनुपालन की िांच करने का एव ं ऐसे कच्च े िूट को ज़ब्त करने का, जिसके बारे में उनके पास यह मानने का कारण ह ै कक उसे इस आदिे या िारी ककए गए और कर्लहाल प्रभावी ककसी भी अन्य आदिे के उललंघन में संग्रजहत/लेनदेन ककया गया है तथा िूट और िूट वस्त्र जनयंत्रण आदिे , 2016 और आवश्यक वस्ट्तु अजधजनयम, 1955 के प्रावधानों के तहत कोई भी कानूनी कारावाई करने के जलए सभी आवश्यक सुजवधाएं प्रदान करने का जनदिे दते ा ह।ूँ 7. अगर आप इस आदिे के ककसी भी या सभी प्रावधानों का पालन करने में असमथा रहते हैं, तो आप आवश्यक वस्ट्तु अजधजनयम, 1955 की धारा 7 के साथ परित िूट और िूट वस्त्र जनयंत्रण आदिे , 2016 के खंड 11 के तहत दजण्डत ककये िायेंगे, जिसमें कारावास और िुमााने का प्रावधान ह।ै [फा. नं.- िूट(माकेटटंग)/106/2018] मलय चंदन चक्रवती, पटसन आयुक्त MINISTRY OF TEXTILES (OFFICE OF THE JUTE COMMISSIONER) ORDER Kolkata, the 10th November, 2021 S.O. 4696(E).—After giving consideration to factors enumerated in Clause 5 and 6(2) & in exercise of the powers conferred on me by Clause 6(1) (iii) & Clause 5 of the Jute and Jute Textiles Control Order, 2016, I, Moloy Chandan Chakrabortty, Jute Commissioner, hereby direct that at no point in time you will hold more than the quantity of raw jute on your own account and / or on account of third parties mentioned in the table below:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 Category of raw jute traders/ dealers/agencies/stockists/Mills Maximum quantity of raw jute to be held (a) (b) (c) 1 Balers who are having raw jute Baling Press in the same premises and who 1500 Quintals have applied for registration to this office within 31.10.2021. 2 All other categories of traders/dealers/agencies/stockist of raw jute who have 300 Quintals applied for registration to this office within 31.10.2021. 3 Those who have not applied to this office for registration in pursuance of this 500 Kilograms* office Order dated 18-06-2021 within 31-10-2021. (5 Quintals) 4 Jute Mills / Manufacturing units of Jute Goods from raw jute 6 weeks consumption as per current production rate including any stock in the pipelines. * Commercial stocking and transaction of raw jute (in excess of 500 kgs in a jute year) by traders/stockists who have not applied to this office for registrations have been prohibited w.e.f. 01.11.2021 vide S.O. No 2523(E) F.No. Jute(Mktg)/160/80-IV dated 18th June 2021 and was declared as an offence under Essential Commodities Act, 1955. 2. I further direct you to sell the quantity of raw jute if it is in excess of the quantity mentioned in column (c) corresponding to the category of raw jute traders mentioned at column (b) being held by you within 10(ten) days from the date of this Order and physically deliver the same to the consignee within 25th November, 2021 and to send a compliance report indicating sale / delivery of the excess quantity of raw jute along with supporting documentary evidence for verification by fax on Numbers 033-23376972 and 23376974 or by email (jcoffice@jutecomm.gov.in) immediately thereafter. If you are holding stock excess to the above limit, purchase of fresh stock shall be stopped forthwith till stock comes below the above mentioned limit. 3. Raw jute stocked in a single premise irrespective of in different names of such balers/traders/stockists etc will be considered as total single stock for the purpose of interpretation of this Order except when such jute is stocked in a Commercial godown and such traders/stockists are able to produce separate trade licence, separate PAN, separate registration with JC office (applied for status) and also separate rent agreement/receipt for godown rent all together and collectively. 4. This order shall come into immediate effect except the part mentioned under serial number(3) in the table above which is already in force w.e.f. 1.11.2021 and shall remain valid till 30.06.2022 or till further orders whichever is earlier. 5. I further state that this Order shall not be applicable to stocks of raw jute procured by The Jute Corporation of India Ltd. 6. Further, in pursuance of sub-clause (b) and (c) of clause 9(1) of the aforesaid Order, I direct to afford necessary facilities to my authorized representatives and law enforcing agencies to enter and search the premises including the godowns and also to inspect their stocks, books and other records under their possession with a view to verifying whether or not stocks held by them have been correctly declared or not in response to this Order and also to check compliance to any other orders previously issued and still in force and to seize raw jute which he/she has reason to believe to have been stored/transacted in contravention to this order or any other orders issued and still in force & to take any legal action within provisions of the Jute and Jute Textiles Control Order, 2016 & Essential Commodities Act, 1955. 7. If you fail to comply with any or all the provisions of this Order, you shall be punishable under clause 11 of the Jute and Jute Textiles Control Order, 2016 read with Section 7 of the Essential Commodities Act, 1955 which provides for imprisonment and fine.
