2. प्राजधकरण के अध्र्क्ष और सिस्ट्र् रािपत्र में इस अजधसूचना के प्रकािन की तारीख से चार वर्ा की अवजध के जलए पि धारण करेंगे।

3. प्राजधकरण ऐसी िजिर्ों का प्रर्ोग करेगा और ऐसी प्रदिर्ाओं का पालन करेगा, िो उि अजधसूचना में जवजनर्िाष्ट ह।ै

4. प्राजधकरण अपने जवजनश्चर् इस अजधसूचना के पैरा 6 के अधीन गरठत राज्र् स्ट्तरीर् जविेर्ज्ञ मूल्र्ांकन सजमजत की जसिाररिों के आधार पर करेगा।

5. प्राजधकरण के सभी जवजनश्चर् बैठक में जलए िाएगं े और सवासम्मजत से होंगे: परंत ु र्दि कोई बहुमत स े जलर्ा िाता ह,ै तो उसके पक्ष और जवपक्ष में दिए गए जवचारों का जववरण स्ट्पष्ट रूप विनिश्चय से कार्ावृत्त में ििा दकर्ा िाएगा और उसकी एक प्रजत केंद्रीर् सरकार को भेिी िाएगी।

6. केंद्रीर् सरकार, सरकार के परामिा स,े प्राजधकरण की सहार्ता के प्रर्ोिन से, राज्र् स्ट्तरीर् जविेर्ज्ञ सिक्किम सिक्किम आँकलन सजमजत (जिसे इसम ें इसके सजमजत कहा गर्ा ह)ै का गठन करती है, जिसमें सिस्ट्र् होंगे, पश्चात निम्िसिखित अर्ाात:् -

(1) श्री िंगा बीर सुब्बा, आईएिएस। (सेवाजनवृत्त) अध्र्क्ष; मनबीर कॉलोनी, इंदिरा बाईपास रोड, लोअर बटुाक, गंगटोक, । सिक्किम

(2) श्री धीरेंद्र िी. श्रेष्ठ, सिस्ट्र्; एंटेल मोटर कॉम््लेक्स के सामने, 6ठा मील, ताडोंग, । सिक्किम

7. सजमजत के अध्र्क्ष और सिस्ट्र् रािपत्र म ेंइस अजधसूचना के प्रकािन की तारीख से चार वर्ा की अवजध के जलए पि धारण करेंगे।

8. सजमजत ऐसी िजिर्ों का प्रर्ोग और ऐसी प्रदिर्ाओं का पालन करेगी, िो उि अजधसूचना में जवजनर्िाष्ट ह।ै

9. सजमजत सामूजहक उत्तरिाजर्त्व के जसद्ांत पर कार्ा करेगी और अध्र्क्ष प्रत्र्ेक मामल ेमें आम सहमजत तक पहुचं न ेका प्रर्ास करेगा, और र्दि आम सहमजत नहीं बन पाती ह,ै तो बहुमत का जवचार अजभभावी होगा।

10. जहतों के टकराव से बचन ेके जलए,-

(i) प्राजधकरण के अध्र्क्ष और सिस्ट्र् तर्ा सजमजत के अध्र्क्ष और सिस्ट्र्, (क) र्ह घोजर्त करेंगे दक व ेदकस परामिा सगं ठन और पररर्ोिना प्रस्ट्तावकों से भी िड़ु े हैं; और (ख) प्राजधकरण द्वारा जवजनजश्चत की िान े वाली र्ा सजमजत द्वारा उनके कार्ाकाल के िौरान मूल्र्ांकन की िान े वाली दकसी पररर्ोिना के जलए पर्ाावरण समाघात जनधारा ण और पर्ाावरण प्रबंधन र्ोिना तैर्ार करन े के संबंध में कोई परामिा नहीं िगें े और उससे संबद् नहीं होंग;े और

(ii) र्दि प्राजधकरण र्ा सजमजत के अध्र्क्ष र्ा दकसी सिस्ट्र् न ेजपछले पांच वर्ों के िौरान दकसी पररर्ोिना प्रस्ट्तावक के जलए परामि ा सेवाएं प्रिान की ह ैं र्ा पर्ाावरण समाघात जनधारा ण अध्र्र्न दकर्ा हैं, तो ऐसी जस्ट्र्जत म ें व े ऐसे प्रस्ट्तावकों द्वारा प्रस्ट्ताजवत दकसी भी पररर्ोिना के मल्ू र्ांकन की प्रदिर्ा म ेंप्राजधकरण और सजमजत की बैठकों से स्ट्वर्ं को अलग रखेंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

11. सरकार, प्राजधकरण और सजमजत के जलए सजचवालर् के रूप म ेंकार्ा करन ेके जलए एक अजभकरण को अजधसूजचत सिक्किम करेगी और सजचवालर् उि अजधसूचना के अधीन उनके कार्ों के संबंध में सभी जवत्तीर् और लॉजिजस्ट्टक सहार्ता प्रिान करेगा, जिसमें आवास, पररवहन और ऐसी अन्र् सुजवधाएं िाजमल ह।ैं

12. प्राजधकरण और सजमजत के अध्र्क्ष और सिस्ट्र्ों को बैठक िल्ु क, र्ात्रा भत्ता और महगं ाई भत्ता सरकार के सिक्किम संबंजधत जनर्मों के उपबंधों के अनुसार भगु तान दकर्ा िाएगा।

13. प्राजधकरण और/र्ा सजमजत के अध्र्क्ष र्ा सिस्ट्र् को केंद्रीर् सरकार द्वारा कार्ाकाल की समाजि से पहले, उन जसद् आरोपों के आधार पर हटार्ा िा सकता है, िो उि प्राजधकरण और/र्ा सजमजत के जनष्पक्ष, कुिल और न्र्ार्संगत रीजत से कामकाि को प्रभाजवत करते ह।ैं इन आरोपों में पर्ाावरण समाघात जनधाारण अजधसूचना, 2006 (र्र्ासंिोजधत) में जवजनर्िाष्ट समर् सीमा से परे पर्ाावरणीर् अनापजत्त िेने र्ा अस्ट्वीकार करने के प्रस्ट्तावों के प्रसंस्ट्करण में िरे ी िाजमल हो सकती ह।ै [िा. सं. आईए3-13/3/2023-आईए.III] रित अग्रवाल, संर्ुि सजचव, MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION New Delhi, the 29th September, 2026 S.O. 5349(E).— In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, vide number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority for Sikkim (hereinafter referred to as the Authority) comprising of following Members, namely:-

(1) Shri B.S. Siktel, Chairman;

6thMile Tadong, near Mahindra & Mahindra Motors Showroom, Gangtok, P.O- Tadong-737102, Sikkim.

(2) Prof. Laxuman Sharma, Member; and Professor, Department of Horticulture, Sikkim University, 6th Mile Tadong, Gangtok- 737102, Sikkim.

(3) Chief Conservator of Forest Member Secretary. (Environment and Soil Conservation), Forest and Environment Department, Government of Sikkim, Forest Secretariat, Deorali, Gangtok-737102, Sikkim.

2. The Chairman and Members of the Authority shall hold office for a period of four years from the date of publication of this notification in the Official Gazette.

3. The Authority shall exercise such powers and follow such procedures specified in the said notification.

4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 6 of this notification.

5. All decisions of the Authority shall be taken in a meeting and shall be unanimous:

Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government.

6. The Central Government, in consultation with the Government of Sikkim, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee (hereinafter referred to as the Committee), Sikkim comprising of the following Members, namely: -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(1) Shri Janga Bir Subba, IFS. (Rtd.) Chairman;

Manbir Colony, Indira Bypass Road, Lower Burtuk, Gangtok, Sikkim.

(2) Shri Dhirendra G. Shrestha, Member;

Opposite Entel Motor Complex, 6th Mile, Tadong, Sikkim.

(3) Shri Ganesh Chandra Khanal, Member;

Bahai School Road, Tadong, Gangtok -737102, Sikkim.

(4) Shri Jang Bahadur Basnett, Member;and Below Power Sub-Station, 5th Mile Tadong, Gangtok -737102, Sikkim.

(5) Conservator of Forest, Member Secretary. (Environment and soil conservation), Forest and Environment Department, Government of Sikkim, Forest Secretariat, Deorali, Gangtok -737102, Sikkim.

7. The Chairman and Members of the Committee shall hold office for a period of four years from the date of publication of this notification in the Official Gazette.

8. The Committee shall exercise such powers and follow such procedures as specified in the said notification

9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.

10. In order to avoid any conflict of interest, -

(i) the Chairman and Members of the Authority and the Chairman and Members of the Committee shall, -

(a) declare as to which consulting organisation they have been associated with and also the project proponents; and

(b) not undertake any consultation or associate with regard to preparation of environment impact assessment and environment management plan for a project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and

(ii) if the Chairman or any Member of the Authority or the Committee has provided consultancy services or conducted environment impact assessment studies for any project proponent during the preceding five years, in that event they shall recuse themselves from the meetings of the Authority and the Committee in the process of appraisal of any project proposed by such proponents.

11. The Government of Sikkim shall notify an agency to act as Secretariat for the Authority and the Committee and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification.

12. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee shall be paid in accordance with the provisions of relevant rules of the Government of Sikkim.

13. The Chairmen or Members of the Authority and/or Committee are liable to be removed by the Central Government, prior to expiry of the tenure, on account of proven charges which affect the functioning of the aforesaid Authority and/or Committee in a just, efficient and fair manner. The charges may include delay in processing the proposals for grant or rejection of Environmental Clearance beyond the timelines specified in the Environment Impact Assessment Notification, 2006, as amended.
