As of May 31, 2025, the Ministry of Tribal Affairs (MoTA) reports on the implementation of the Scheduled Tribes and Other Traditional Forest Dwellers Recognition of Forest Rights Act, 2006 (FRA) across 20 States and 1 Union Territory. A cumulative total of 5,123,104 claims were filed at the Gram Sabha level, comprising 4,911,495 individual claims and 211,609 community claims. Of these, 2,511,375 titles (49.02%) were distributed, including 2,389,670 individual titles and 121,705 community titles. 1,862,056 claims (36.35%) have been rejected, and 749,673 claims (14.63%) are pending disposal. Following the Supreme Court's 2019 directions, States are reviewing rejected claims in a time-bound manner. MoTA has urged States to hold State Level Monitoring Committee (SLMC) meetings, chaired by the Chief Secretary, at least once every three months to monitor FRA implementation and review rejected claims.
FRA includes safeguards against forced eviction, with Section 4(5) protecting forest dwellers from eviction until the recognition and verification process is complete. Aggrieved persons can petition to the SDLC and DLC as per Sections 6(2) and 6(4) of FRA. The MoTA forwards grievances regarding FRA violations to the relevant States/UTs. Additionally, MoTA has issued joint advisories with the Ministry of Environment, Forest and Climate Change on March 14, 2024, and July 6, 2021, to resolve field-level issues.
The State Government of Kerala reports granting Individual Forest Rights to 29,422 beneficiaries, covering 38,794.10 acres of land, with no reported legal disputes or administrative delays in FRA implementation.
To enhance benefits for forest right holders, MoTA, under the Dharti Aaba Janjatiya Gram Utkarsh Abhiyan (DAJGUA), supports initiatives such as FRA area mapping, data digitization, support for Community Forest Resource Rights (CFR) Management Plans, and the establishment of dedicated FRA cells at State and district/subdivision levels. Under DAJGUA, MoTA supports FRA patta holders through convergence with schemes of Department of Agriculture, Animal Husbandry and Fisheries. MoTA has approved Rs. 129.89 Lakhs for Kerala to set up FRA Cells at the State and 12 district levels. Kerala has directed District Collectors to convert Scheduled Tribe areas granted individual forest rights under FRA into revenue villages and is implementing livelihood schemes through central and state government programs like PMJANMAN and DAJGUA.
