**1. Executive Summary:**
This report analyzes the Directorate of Prosecution, Government of National Capital Territory of Delhi, Assistant Public Prosecutor, Recruitment Rules 2021, as published in the official Gazette. This is a new policy that establishes the rules governing the recruitment process for the position of Assistant Public Prosecutor. The key findings relate to eligibility criteria (including potential disqualifications), the recruitment method (primarily direct recruitment, with provisions for deputation), and the role of the Union Public Service Commission (UPSC) in the selection process. The policy aims to regulate the recruitment process for Assistant Public Prosecutors in Delhi.
**2. Introduction:**
This report provides an informative overview and analysis of the Directorate of Prosecution, Government of National Capital Territory of Delhi, Assistant Public Prosecutor, Recruitment Rules 2021, based solely on the text of the official notification. The purpose is to inform the affected industry about the policy and its implications.
**3. Policy Overview:**
This is a *new* policy establishing recruitment rules. The core objective, as inferred from the text, is to regulate the method of recruitment for the post of Assistant Public Prosecutor in the Directorate of Prosecution, Government of National Capital Territory of Delhi. This includes specifying eligibility criteria, procedures, and responsibilities of involved bodies.
**4. Background and Rationale:**
This appears to be a new policy, as it explicitly states it is establishing rules for recruitment. The likely problem the policy addresses is the lack of a standardized or updated recruitment process for Assistant Public Prosecutors in the National Capital Territory of Delhi. The policy likely aims to ensure a fair, transparent, and efficient recruitment process, attracting qualified candidates to these positions. The notification also states that it supersedes a previous recruitment rule from 2004 (No.F.131794DOPHPII344350 dated 19.01.2004), indicating a need for updated regulations.
**5. Key Provisions:**
The policy establishes the following key provisions:
* **Short Title and Commencement:** The rules are called the "Directorate of Prosecution, Government of National Capital Territory of Delhi, Assistant Public Prosecutor, Recruitment Rules 2021" and come into effect on the date of their publication in the official Gazette.
* **Application:** The rules apply to the posts specified in column 1 of the Schedule annexed to the rules (Assistant Public Prosecutor).
* **Number of Posts, Classification, and Pay Level:** The number of posts, their classification (General Central Service, Group 'B', Non-Ministerial), and pay level (Level 8 in the pay matrix: Rs. 47600-151100) are specified in columns 2-4 of the Schedule.
* **Method of Recruitment, Age Limit, Qualifications:** Recruitment methods, age limits, qualifications, and other related matters are detailed in columns 5-13 of the Schedule. Key requirements include:
* Age not exceeding 30 years (relaxable for government servants).
* A degree in Law from a recognized University/Institute.
* Three years of experience at the Bar.
* **Disqualification:** Individuals with more than one living spouse are ineligible for appointment, subject to potential exemptions by the Government of National Capital Territory of Delhi.
* **Power to Relax:** The Government reserves the right to relax any provision of these rules, in consultation with the Union Public Service Commission (UPSC), for specific categories of persons, with reasons recorded in writing.
* **Saving:** The rules do not affect existing reservations, age relaxations, and other concessions for Scheduled Castes, Scheduled Tribes, ex-servicemen, Other Backward Classes, and other special categories, as per government orders.
* **Deputation:** Vacancies arising due to deputation, long-term illness, study leave, or other circumstances for a year or more can be filled on a deputation basis from officers of the Central Government/State Governments/Union Territories. The maximum age limit for appointment by deputation is 56 years. Specific criteria for eligibility via deputation are also outlined, including holding analogous posts regularly or having 3 years of service in posts in level 6 of the pay matrix and possessing qualifications and experience prescribed for direct recruits.
* **Consultation with UPSC:** Consultation with the Union Public Service Commission is necessary.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders include:
* Candidates aspiring to become Assistant Public Prosecutors in the Directorate of Prosecution, Government of National Capital Territory of Delhi.
* The Directorate of Prosecution, Government of National Capital Territory of Delhi, responsible for implementing the recruitment process.
* The Union Public Service Commission (UPSC), involved in the selection process and consultations.
* The Home Department and Services Department of the National Capital Territory of Delhi Government.

**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Directorate of Prosecution, Government of National Capital Territory of Delhi, is primarily responsible for implementing the rules. The Union Public Service Commission (UPSC) plays a consultative and potentially selective role. The Home Department and Services Department of the Delhi government are also involved.
* **Timelines/Procedures:** While specific timelines are not detailed, the rules come into effect upon publication in the official Gazette, suggesting an immediate application to future recruitment processes. The schedule outlines the specific qualifications, experience, and age limits. The detailed procedures for shortlisting, examination, and interview would likely be defined separately by the implementing agencies.
**8. Expected Outcomes / Impact of Changes:**

* Attraction of qualified and competent legal professionals to the position.
