वृक्षो का िस गुना) अथाात 6510 पौधो का (क) प्रस्ट्ताजवत प्रिाजतयााँ नीम, अमलतास, पीपल, 3,71,07,000 /- ¼िजक्षण½@ou जपलखन, गलू र, बरगि, ििे ी कीकर, अिुान एव ं 6510 vf/kdkjh अन्य ििे ी प्रिाजतयााँ का उत्सव मागा, सेक्िन-34 एवं 35, रोजिणी, दिल्ली में दकया िाएगा A (ख) उपभोगी संस्ट्था द्वारा 632 वृक्षों का प्रत्यारोपण िो साइट पर खड़े ि,ै उसी पररयोिना स्ट्थल पर अपनी स्ट्वयं की लागत पर दकया िाएगाA 2. उपरोक्त 1 (क) व (ख) के अनुसार, ििे ी प्रिाजतयों के 6510 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात वर्षो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी A उपभोगी संस्ट्था द्वारा फोटोग्रादफक/ वीजडयोग्रादफक साक्ष्य यथासमय mi& ou laj{kd (िजक्षण) को प्रस्ट्तुत दकए िाएंगे । 3. 664 वृक्षो को िटाए िाने के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 6510 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीने के अिं र जनधााररत की गई भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा । उपभोगी संस्ट्था द्वारा अगले सात वर्षो तक वृक्षारोपण का रखरखाव स्ट्वय की लागत दकया िाएगा । 4. उपभोगी संस्ट्था द्वारा अजतररक्त साइट सुधार खचों को िमा दकया िाएगा िो दक वृक्ष अजधकारी द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुक्त बनाने के जलए आव‍यक िो सकता ि ै। 5. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो । 6. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया िाएगा । 7. उपभोगी संस्ट्था द्वारा वृक्षों को काटने/ प्रत्यारोपण का काया िुरू करने से पूवा दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में जवस्ट्तृत वृक्षारोपण अनुसूची को वृक्ष अजधकारी ¼िजक्षण½ के कायाालय में प्रस्ट्तुत दकया िाएगा । 8. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में प्रस्ट्तुत की िाएगी । 9. उपभोगी संस्ट्था द्वारा वृक्षो को काटने/ प्रत्यारोपण का काया िुरू करने से पूवा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा । 10. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा । 11. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे तीन मिीने के अंतराल में पूणा दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का बाि एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम निीं िोनी चाजिए । 12. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा । 13. वृक्षो को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजक्त के िावे के पक्षपात के जबना, िो वृक्षो और भूजम पर सिी िो सकती िै, िी िा रिी िै ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 14. उपभोगी संस्ट्था द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई/ प्रत्यारोपण से पूवा कोई लंजबत मुकिमेबािी या स्ट्थगन आििे दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो । 15. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण/ काटने का काया सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा । 16. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा । 17. उपभोगी संस्ट्था द्वारा वृक्षो को िटाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के खाते मे रािस्ट्व के रूप में िमा की िाएगीA 18. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds Ik'pkr izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud “konkgks a es a iz;ksx gsrq सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (िजक्षण) को भी िी िाएगी । 19. उपभोगी संस्ट्था द्वारा वृक्षो को काटने के स्ट्थल से लकजड़यों को ys tkus l s iwo Z o`{k vf/kdkjh ¼िजक्षण½ ls <qykbZ vuqefr izkIr djuh gksxhA 20. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावािजनक ‍मिान मे 90 दिनों के अंिर पूरा दकया िाएगा । 21. उपभोगी संस्ट्था द्वारा 32 वृक्षो को काटने से पूवा प्रत्यारोपण दकया िाएगा । 32 वृक्षो की अनुमजत 632 वृक्षो के सफल प्रत्यारोपण और mi& ou laj{kd (िजक्षण) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी । 22. उपभोगी संस्ट्था द्वारा 664 वृक्षो के अलावा दकसी भी वृक्ष की प्रत्यारोपण/ कटाई दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 के अंतगात एक अपराध िोगा । 23. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की िाएगी । 24. यदि दकसी वृक्ष में पजक्षयों का ंोंसला पाया िाता िै, तो उस वृक्ष को ंोंसला स्ट्थानांतररत करने के पिात िी काटा िाएगा । 25. उपभोगी संस्ट्था द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का FORESTS AND WILDLIFE NOTIFICATION Delhi, the 6th October, 2021 F.No.16/TO(S)/TC/Felling/20-21/5558-66.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 10.1097 ha. approx. as detailed below for redevelopment of General Pool Residential Colony (Phase-I) at Kasturba Nagar, New Delhi, from the provision of sub-section (3) of section 9 of the said Act. Central Public Works Department (CPWD), herein referred to as User Agency, shall make an advance deposit of an amount of Rs. 3,71,07,000 /- (Three Crores Seventy One Lakh Seven Thousand only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows, Sl.No. Location of Compensatory plantation. (b) Transplantation of 632 no. of trees which are standing on site shall be done by User Agency at the same project site with their own funds. 2. 100% Compensatory Plantation of 6510 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above. Photographic / videographic evidence in due course shall be submitted to DCF (South). 3. 6510 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of removal of 664 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out thereafter, by user agency with their own funds. 4. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits). 5. Land owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation. 6. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of State Government. 7. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of Delhi Preservation of Trees Act, 1994 before initiating felling/ transplantation. 8. User Agency shall maintain plantation journal as prescribed by Department of Forests and Wildlife, Govt. of NCT of Delhi and submit a copy of same at end of each financial year. 9. The User Agency shall submit a detailed plan for site preparation and plantation before initiating felling/ transplantation. 10. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation / transplantation site. 11. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than three months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. 12. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency. 13. Permission for transplantation/ felling of all tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees. 14. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees.[PART IV DELHI GAZETTE : EXTRAORDINARY 5 15. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency. 16. The User Agency shall ensure that the plan of this proposal shall not be changed. 17. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. 18. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (South) by User Agency. 19. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (South) by User Agency. 20. Transplantation/ felling of trees and transportation of forest produce arising threfrom to the public crematorium shall be completed within 90 days. 21. The transplantation shall be carried out prior to felling of 32 nos. of trees permitted herein. The 32 trees shall be removed/ felled after successful transplantation of 632 no. of trees and submission of compliance certificate to DCF (South). 22. Transplantation/ felling of any tree apart from 664 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act, 1994. 23. The progress report of transplantation shall be submitted through inspection officer concerned along with complete details of trees. 24. If any tree is found to have nest of birds it should not be felled tiil the same is abandoned by the birds. 25. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, and other clearances, if any obtained, shall be followed scrupulously.
