## Report on Exemption Under the Delhi Preservation of Trees Act, 1994 Regarding the Redevelopment of New Delhi Railway Station
**1. Executive Summary:**
This report analyzes a notification issued by the Government of the National Capital Territory of Delhi regarding an exemption under Section 29 of the Delhi Preservation of Trees Act, 1994. The exemption pertains to the redevelopment project of the New Delhi Railway Station. The notification grants an exemption from subsection 3 of section 9 of the Act for a designated area of approximately 38.7524 hectares. Key findings include the requirement for compensatory plantation, transplantation of existing trees, and adherence to specific conditions to mitigate the environmental impact of the project. The User Agency, Rail Land Development Authority (RLDA), is responsible for implementing these measures.
**2. Introduction:**
This report aims to provide an informative overview of a government notification regarding an exemption under the Delhi Preservation of Trees Act, 1994, as it relates to the redevelopment of the New Delhi Railway Station. This analysis is based solely on the information provided in the policy text.
**3. Policy Overview:**
This is *not* an amendment; it is a *specific exemption* granted under the existing Delhi Preservation of Trees Act, 1994.
* **Core Objective(s):** The core objective is to facilitate the redevelopment of the New Delhi Railway Station while mitigating the environmental impact associated with tree felling and transplantation. This is achieved through a compensatory afforestation plan and specific conditions imposed on the User Agency. The public interest is cited as justification for the exemption.
**4. Background and Rationale:**
As this is not an amendment but a specific exemption, the policy likely addresses the conflict between development projects and environmental preservation. The redevelopment of the New Delhi Railway Station requires the removal or relocation of trees, which would normally be subject to the provisions of the Delhi Preservation of Trees Act, 1994. This notification offers a legal pathway to proceed with the development while adhering to environmental safeguards.
**5. Key Provisions / Changes:**
As this is a specific exemption, the key provisions outline the conditions under which the exemption from the Act is granted. These include:
* **Area Exemption:** An area of 38.7524 ha is exempted from subsection 3 of section 9 of the Delhi Preservation of Trees Act, 1994, specifically for the New Delhi Railway Station redevelopment project.
* **Tree Impact:** The project involves the felling of 921 trees after transplantation of 885 trees.
* **Compensatory Plantation:** The User Agency (RLDA) must deposit Rs. 5,18,70,000 for the creation and maintenance of compensatory plantation for a period of seven years. 9210 saplings of native species, including Neem, Amaltas, Peepal, Pilkhan, Gular, Bargad, and Arjun must be planted.
* **Transplantation:** 885 trees must be transplanted by the User Agency at the same project site using their own funds.
* **Plantation Maintenance:** The User Agency is responsible for raising and maintaining the compensatory plantation for seven years and ensuring its successful establishment.
* **Plantation Ratio:** A compensatory plantation must occur in the ratio of 1:10 (10 saplings for every tree felled or transplanted).
* **Timeline:** Transplantation must begin immediately after the permission is issued and completed within three months.
* **Compliance:** The User Agency must comply with the Tree Transplantation Policy 2020.
* **Other Conditions:** Numerous other conditions related to land use, plantation schedules, maintenance journals, soil moisture conservation, timber disposal, and adherence to environmental clearances are imposed.
**6. Target Audience and Stakeholders:**
The primary target audience is the Rail Land Development Authority (RLDA), designated as the User Agency for the redevelopment project. Other stakeholders include:
* Department of Forests and Wildlife, Govt. of NCT of Delhi
* Tree Officer (Central)
* Residents and businesses in the vicinity of the New Delhi Railway Station redevelopment project.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** Rail Land Development Authority (RLDA) is primarily responsible for implementing the conditions of the exemption.
* **Timeline:** Transplantation must be initiated immediately after permission is issued and completed within three months. Compensatory plantation must be done within six months of tree removal permission.
* **Procedures:** The User Agency must deposit funds, prepare and submit plantation schedules, maintain plantation journals, obtain necessary clearances, and adhere to specified environmental safeguards.
* The User Agency has to provide a compliance certificate after the successful transplantation of trees to the DCF Central before the 36 trees are removed.
**8. Expected Outcomes / Impact of Changes:**
The intended outcomes of this exemption are:
* Facilitation of the New Delhi Railway Station redevelopment project.
* Mitigation of the environmental impact of tree felling through compensatory afforestation.
* Ensuring the survival and growth of transplanted trees.
* Adherence to environmental regulations and sustainable practices.
* Demonstrates a balance between development and environmental concerns.
**9. Conclusion:**
The notification outlines the terms and conditions under which the Rail Land Development Authority (RLDA) is granted an exemption from certain provisions of the Delhi Preservation of Trees Act, 1994, for the New Delhi Railway Station redevelopment project. While enabling the project to move forward, the notification emphasizes the importance of environmental responsibility by mandating compensatory plantation, tree transplantation, and adherence to a variety of specific conditions. The successful implementation of these conditions will be crucial in mitigating the project's environmental impact.
