(16,400 वगा 5330 मीटर) और सावन पाका रेलवे भूजम क्षेत्र (48854 वग ा मीटर), नई दिल्ली में दकया िाएगा A उपभोगी संस्ट्था द्वारा 210 वृक्षों का प्रत्यारोपण िो साइट पर खड़े िै, नरेला रेलवे स्ट्टेिन पर (16,400 वगा मीटर) और सावन पाका रेलवे (ख) भूजम क्षेत्र (48854 वगा मीटर), नई दिल्ली में स्ट्वयं की लागत पर दकया िाएगाA प्रस्ट्ताव “वृक्ष प्रत्यारोपण नीजत” की ितों को पूरा करता िAै 2. उपरोक्त 1 (क) व (ख) के अनुसार, ििे ी प्रिाजतयों के 5330 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात वर्षो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी A 3. 533 वृक्षो को काटे/ प्रत्यारोपण दकए िाने के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 5330 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोन ेके तीन मिीने के अंिर जनधााररत की गई भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा । उपभोगी संस्ट्था द्वारा अगले सात वर्षो तक रखरखाव स्ट्वय की लागत पर करेंगी । पौधों के खराब रखरखाव या पौधों के नुकसान या िाजन के मामले म ें उपभोगी संस्ट्था िी जिम्मेिार िोगी । 4. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा । 5. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया िाएगा । 6. उपभोगी संस्ट्था द्वारा वृक्षों को काटने/ प्रत्यारोपण का काया िुरू करने से पूवा दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में जवस्ट्तृत वृक्षारोपण अनुसूची को वृक्ष अजधकारी ¼पजिम½ के कायाालय में प्रस्ट्तुत दकया िाएगा । 7. उपभोगी संस्ट्था द्वारा वृक्षो को काटने/ प्रत्यारोपण का काय ा िुरू करने से पूवा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा । 8. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में प्रस्ट्तुत की िाएगी । 9. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा । 10. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ: मिीने के अंतराल में पूणा दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोन ेका बाि एक सम्पणू ा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम निीं िोनी चाजिए । 11. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा । 12. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की िाएगी ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 13. वृक्षो को प्रत्यारोपण/ काटन े के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजक्त के िावे के पक्षपात के जबना, िो वृक्षो और भूजम पर सिी िो सकती ि,ै िी िा रिी ि ै। 14. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण/ काटने का काया सभी वैधाजनक मिं ूररयों को लेने के बाि िी िुरू दकया िाएगा । 15. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावािजनक ‍मिान मे 90 दिनों के अिं र पूरा दकया िाएगा । 16. उपभोगी संस्ट्था द्वारा 323 वृक्षो को काटने से पूवा प्रत्यारोपण दकया िाएगा । 210 वृक्षो को काटने की अनुमजत 323 वृक्षो के सफल प्रत्यारोपण और mi& ou laj{kd (पजिम) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी । 17. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की प्रत्यारोपण/ कटाई स े पूवा कोई लंजबत मुकिमेबािी या स्ट्थगन आििे दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो । 18. उपभोगी संस्ट्था द्वारा 533 वृक्षो के अलावा दकसी भी वृक्ष की प्रत्यारोपण/ कटाई दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 के अतं गात एक अपराध िोगा । 19. उपभोगी संस्ट्था द्वारा वृक्षो को िटाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के खाते मे रािस्ट्व के रूप में िमा की िाएगीA 20. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds Ik'pkr izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud “konkgks a es a iz;ksx gsrq सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (पजिम) को भी िी िाएगी । 21. उपभोगी संस्ट्था द्वारा वृक्षो को काटने के स्ट्थल से लकजड़यों को ys tku s ls iwo Z o`{k vf/kdkjh ¼पजिम½ l s <yq kbZ vueq fr izkIr djuh gksxhA 22. उपभोगी संस्ट्था द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िाएगा । 23. अनुमजत तभी िी िाएगी िब “वृक्ष संरक्षण योिना” को समय पर mi&ou lja {kd (िजक्षण) द्वारा िारी दकए गए पत्र दिनााँक-27.10.2020 के अनुसार वृक्ष अजधकारी/ mi& ou laj{kd (पजिम) को प्रस्ट्तुत की िाएगी । यि माननीय पयाावरण Delhi, the 7th October, 2021 F.No.1508/TO(S)/TC/Felling/18-19/ 5620-28—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of 2.11 ha. approx.as detailed below for redevelopment of Safdarjung Railway Station Jointly by IRCON & RLDA, Delhi from the provision of sub-section (3) of section 9 of the said Act. Total 210 323 533 53304 DELHI GAZETTE : EXTRAORDINARY PART IV] The said exemption is subject to fulfillment of the following conditions:— 1. Rail Land Development Authority, herein referred to as User Agency, shall make an advance deposit of an amount of Rs. 3,03,81,000 /- (Three Crores Three Lakh Eighty One Thousand only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows, Sl. (1) (2) (3) (4) (5) (a) 100% Compensatory Plantation ten times Deputy the number of trees permitted for felling/ Conservator of transplant of 533 trees i.e., number of tree 5330 3,03,81,000 /- Forests (West)/ saplings proposed to be planted of species Tree Officer Neem, Amaltas, Peepal, Pilkhan, Gular, Bargad and Desi Kikkar along with other native species shall be carried out by the User Agency at Narela Railway Station (in 16,400 SQM) & Sawan Park Railway land area (in 48854 SQM), New Delhi. (b) Transplantation of 210 no. of trees which are standing on site shall be done by User Agency at Narela Railway Station (in 16,400 SQM) & Sawan Park Railway land area (in 48854 SQM), New Delhi with their own funds. “The proposal satisfies condition of Tree Transplantation Policy”. 2. 100% Compensatory Plantation of 5330 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above. 3. Plants saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of transplantation/ felling of 533 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out thereafter, by user agency with their own funds. In case of poor maintenance or causality of plants User Agency shall be responsible. 4. The User Agency shall ensure that the plan of this proposal shall not be changed. 5. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval of State Government. 6. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of Delhi Preservation of Trees Act, 1994 before initiating felling/ transplantation. 7. The User Agency shall submit a detailed plan for site preparation and plantation before initiating felling/ transplantation. 8. User Agency shall maintain plantation journal as prescribed by Department of Forests and Wildlife, Govt. of NCT of Delhi and submit a copy of same at end of each financial year. 9. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation / transplantation site. 10. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not later than six months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. 11. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User Agency. 12. The progress report of transplantation shall be submitted through inspection officer concerned along with complete details of trees.[PART IV DELHI GAZETTE : EXTRAORDINARY 5 13. Permission for transplantation/ felling of all tress is being granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees. 14. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency. 15. Transplantation/ felling of trees and transportation of forest produce arising threfrom to the public crematorium shall be completed within 90 days. 16. The transplantation shall be carried out prior to felling of 323 nos. of trees permitted herein. The 323 trees shall be removed/ felled after successful transplantation of 210 no. of trees and submission of compliance certificate to DCF (West). 17. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees. 18. Transplantation/ felling of any tree apart from 533 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act, 1994. 19. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. 20. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same should be reported to DCF (West) by User Agency. 21. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (West) by User Agency. 22. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, and other clearances, if any obtained, shall be followed scrupulously. 23. The permission shall be granted only if “The Tree Preservation Plan” submitted to the Tree Officer (West) as per the letter dated 27.10.2020 issued by DCF (South).
