गूलर, बरगद, ईप-वन संरक्षक (क) देसी कीकर, ऄजुान एव ं ऄन्य देिी प्रजाजतया ाँ 05,13,000/- (ईत्तर) कामकान संख्या-एफ-1/81 के सामने पाका, 90 एमसीडी पाका, सुल्तानपुरी (20 पौधे) और एनएचपी पाका, सुल्तानपरु ी, जलेबी चौक के पास, सुल्तानपुरी, ददल्ली में दकया जाएगा। ईपभोगी संस्ट्था द्वारा पररयोजना स्ट्थल से 9 वृक्षों का प्रत्यारोपण मकान संख्या-एफ-1/81 के सामने पाका, (ख) एमसीडी पाका, सुल्तानपरु ी, ददल्ली में ऄपन ेस्ट्वयं की लागत पर दकया जाएगा। जनयम एव ंित ें 1. ईत्तरी ददल्ली नगर जनगम (नॉथ ा एमसीडी),जो दक ईपभोगी संस्ट्था के रूप में संदर्भभत ि,ैकोसात वर्षोंकी ऄवजध के जलए पौधों के सम्पूणा जवकास एवं रखरखाव िते ुईपरोिानुसार05,13,000/-रुपय े (पांच लाख तेरि िजार मात्र @ रु. 57000/- प्रजत वृक्ष) की राजि ऄजिम रूप से जमा करवानी िोगी और यदद ईपभोगी संस्ट्थाद्वारा2, 3और 4 म ें ईजल्लजखतजनयमों और ितों का पालन निीं दकया जाता ि,ै तो आस राजिकोजब्त कर जलया जाएगा और आस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए ईपयोग दकया जाएगा । 2. ईपभोगी सस्ट्ं था द्वारा वक्षृ ोंका प्रत्यारोपण िरूु करन ेस ेपिल ेपरू ी की जान ेवाली अवश्यक ितें:- a. ददल्ली वृक्ष संरक्षण ऄजधजनयम, 1994 की धारा 12 के ऄनुपालन म ें ईपभोगी सस्ट्ं था द्वारा सबं ंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को जवस्ट्तृत वृक्षारोपण कायाक्रम प्रस्ट्ततु दकया जाएगा। b. ईपभोगी संस्ट्था द्वारा साआट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योजना प्रस्ट्तुत दकया जाएगा। c. ईपभोगी संस्ट्था केद्वारा यि सुजनजित दकया जायेगा दक वृक्षो की कटाइ/प्रत्यारोपण स े पूवा कोइ लंजबत मुकदमा या स्ट्थगन अदेि दकसी भी न्यायालय/ऄन्य प्राजधकरण द्वारा पाररत न हुअ िो। d. ईपभोगी संस्ट्था द्वारा वृक्षो को कटाइ/प्रत्यारोपण का काया सभी वैधाजनक मंजूररयों को लेन े के बाद िी िुरू दकया जाएगा। e. ईपभोगी संस्ट्था के द्वारा वनमंजरू ी म ें और ऄन्य मंजरू ी म ें ईजल्लजखत सभी ितों, यदद कोइ िो, का जनष्ठापूवाक पालन दकया जाएगा। 3. वक्षृ ों केप्रत्यारोपणके दौरान परू ी की जान ेवाली अवश्यक ित:ें- a. क्र.स.ं 2 म ें ितों के ऄनुपालन िोने के तुरंत बाद ईपभोगी संस्ट्था द्वारा वृक्षो का प्रत्यारोपण िुरू दकया जाएगा और आस े तीन मिीन े के ऄंतराल म ें पणू ा दकया जाएगा। प्रत्यारोपण प्रदक्रया के पूण ा िोन े का बाद एक सम्पूण ा ररपोट ा सम्बंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को प्रस्ट्ततु की जायेगी। प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की दरू ी 4 मीटर (बबद ुस ेबबद)ु से कम निीं िोनी चाजिए। b. ईपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत, 2020 में ईजल्लजखत सभी ितों का पालन दकया जाएगा। c. ईपभोगी संस्ट्था प्रजतरोजपत वृक्षों का न्यूनतम तीन वर्षों तक ईसी प्रत्यारोपण एजेंसी के माध्यम से ऄनुरक्षण करेगी जजनके द्वारा प्रत्यारोपण दकया गया था। d. ईपभोगी संस्ट्था द्वारा प्रत्यारोपण दकए जाने वालेवृक्षों की प्रगजत ररपोटा संबंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को वृक्षों के पूण ा जववरण के साथ प्रस्ट्ततु की जाएगी।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 e. यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया जाता ि ैतो ईस ेतब तक निीं काटा/प्रत्यारोपण दकया जाएगा जब तक दक पक्षी ईसे स्ट्वतः छोड़ न दें। f. ईपभोगी संस्ट्था द्वारा 9 वृक्षो के ऄलावा दकसी भी वृक्ष की कटाइ/प्रत्यारोपण ददल्ली वृक्ष संरक्षण ऄजधजनयम, 1994 के ऄन्तगात एक ऄपराध िोगा। g. ईपभोगी संस्ट्था द्वारा वृक्षो को िटाए जान े के ईपरान्त प्राप्त लकजड़यों की नीलामी की जाएगी और ईससे प्राप्त धनराजि को सरकार के खाते म ेराजस्ट्व के रूप में जमा की जाएगी। h. ईपभोगी संस्ट्था द्वारा वृक्षों के उपरी िाखाओं को काटे जान े के ईपरान्त प्राप्त लकजड़यों को मुफ्त म ें जनकटतम सावाजजनक िवदािों म ें प्रयोग िते ु सौपी जाएगी और आसकी सम्बंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को भी दी जाएगी। i. ईपभोगी संस्ट्था द्वारा वृक्षो को िटाए जाने के स्ट्थल से लकजड़यों को को ल े जाने स े पूवा सम्बंजधत वक्षृ ऄजधकारी/ईप-वन संरक्षक से ढुलाइ ऄनुमजत प्राप्त करनी िोगी। j. ईपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण और ईसम ें पैदा िोने वाली वन ईपज को सावाजजनक श्मिान में 90 ददनों के ऄदं र पूरा दकया जाएगा। k. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत निीं दकया जाएगा। l. ईपभोगी संस्ट्था के द्वारा वन मजं ूरी में और ऄन्य मंजरू ी में ईजल्लजखत सभी ितों ितों, यदद कोइ िो, का जनष्ठापूवाक पालन दकया जाएगा। m. ईपभोगी संस्ट्था के द्वारा ऄनुमोददत वृक्ष सरं क्षण योजना के ऄतं गात प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठापूवाक पालन दकया जाएगा। n. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक वृक्षप्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के ऄंतगता सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया ि ै और आसका सम्बंजधत वृक्षऄजधकारी/ ईप-वन संरक्षक को प्रस्ट्तुत दकया जाएगा। o. ईपभोगी संस्ट्था के द्वारा यि सजु नजित दकया जाएगा दक सभी प्रजतरोजपत वृक्षों के जलए जो 15 फीट उंचाइ और कम से कम 6 आंच व्यास वाले स्ट्वदेिी वृक्ष प्रजाजतयों म ें जीजवत निीं रिपाते ि,ैं तो ईन्ि ें1:5 के ऄनुपात म ें लगाया जाएगा। अवश्यक ऄजतररि भूजम ईपभोगी संस्ट्था द्वारा प्रदान की जाएगी और वृक्षारोपण स्ट्वयं की लागत पर दकया जाएगा। 4. वक्षृ ऄजधकारी/ईप-वन सरं क्षक द्वारा सफलतापवू का वक्षृ ारोपण और सरु क्षा जमा राजि जारी करन े पर जवचार करन े के जलए अवश्यक ित:ें- a. ईपरोि ताजलका के ऄनुसार, दिे ी प्रजाजतयों के 90 पौधो का 100 % प्रजतपूरक वृक्षारोपण और ईनका सात वर्षो तक रखरखाव ईपभोगी संस्ट्थाद्वारा दकया जायगे ा। आस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाद ईपभोगी संस्ट्था द्वारा जनगरानी की जाएगी। b. 9 वृक्षो के प्रत्यारोपण/काटे जाने के बदल े म ें 1:10 के ऄनुपात म े स्ट्वदिे ी प्रजाजतयों के 6-8 फीट की उाँचाइ वाल े 90 पौधो का प्रजतपूरक वृक्षारोपण गरै -वन भूजम पर दकया जाएगा। वृक्षारोपण की ऄनुमजत के जारी िोन े के तीन मिीने के ऄंदर जनधााररत की गइ भूजम पर ऄजतररि ईपायों के साथ वृक्षारोपण स्ट्थल के ऄनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया जाएगा और ऄजिम सात (7) वर्षों के जलए रखरखाव तथा ईसके बाद ईनका रखरखाव ईपभोगी संस्ट्था द्वारा ऄपनी स्ट्वयं की लागत पर दकया जाएगा। c. यदद ईपभोगी संस्ट्था सफलतापवू ाक प्रजतपूरक वृक्षारोपण करन े में जवफल रिती ि।ै ईपभोगी सस्ट्ं था द्वारा ऄजतररि साआट सुधार खचों को जमा दकया जाएगा जोदक सम्बंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक द्वारा गणना के ऄनुसार वृक्षारोपण के जलए ईपयुि बनाने के जलए अवश्यक िो सकती ि।ै d. जो भूजम प्रजतपूरक वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए अवरं टत िै, ईसका ईपयोग दकसी ऄन्य कायो के जलए राज्य सरकारकी स्ट्वीकृजत के जबना निीं दकया जाएगा।4 DELHI GAZETTE : EXTRAORDINARY PART IV] e. ईपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षत्रे ददल्ली सरकार को जनधारा रत करेंगी और आसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के ऄंत में सम्बंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को प्रस्ट्तुत की जाएगी। प्रारूप की एक प्रजत https://www.treeremoval.delhigovt.nic.in पर ईपलब्ध ि।ै f. भजू म स्ट्वाजमत्व एजेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोइ ऄजतक्रमण न िो । g. ईपभोगी संस्ट्था द्वारा प्रजतपरू क वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण काया की गजतजवजधयों को दकया जाएगा। h. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत निीं दकया जाएगा। 5. यदद ईपरोि में स े कोइ भी िता ईपभोगी संस्ट्था द्वारा परू ी निीं की जाती िै, तो संबंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक द्वारा ददल्ली वृक्ष सरं क्षण ऄजधजनयम, 1994 की धारा 12 के ऄनुसार कारावाइ की जाएगी। 6. 9 वृक्षो के प्रत्यारोपण के जलए ऄनुमजत ईनके स्ट्वयं के जोजखम पर और दकसी भी ऄन्य व्यजि के दावे के पक्षपात के जबना, जो वृक्षो और भूजम पर सिी िो सकती ि,ै दी जा रिी ि।ै राष्ट्रीय राजधानी क्षेत्र ददल्ली के ईपराज्यपाल के अदेि स ेतथा ईनके नाम पर, ए. No. 138/WFD/COT/18-19/dcfpm/18-25.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territory of Delhi, hereby, in public interest exempts an area of 2.25 hafor construction of Road Over Bridge (ROB) / Road Under Bridge (RUB)at Sultanpuri, Near Nangloi, Delhi from the provision of sub-section (3) of section 9 of the said Act. (b) Transplantation of 9numbers of trees which are standing on site shall be done by User Agency at Park Opp. H.No.F-1/81, MCD Park, SultanpuriDelhi with their own funds. TERMS AND CONDITIONS 1. North Delhi Municipal Corporation (North MCD) herein referred to as User Agency, shall make an advance deposit of an amount of Rs.05,13,000/- (Five Lakh Thirteen Thousand Only, i.e., /- @ Rs. 57000/- per tree) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency. 2. The conditions required to be fulfilled before starting transplantationof trees by User Agency:- a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer/Deputy Conservator of Forests in compliance with Section-12 of Delhi Preservation of Trees Act, 1994. b. User Agency shall submit a detailed plan for site preparation and plantation. c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees. d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be obtained by the User Agency. e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other clearances, if any obtained, shall be followed scrupulously. 3. The conditions required to be fulfilled during the transplantationof trees:- a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and should be completed not later than three (03) months of such date, after which a completion report has to be submitted to theconcerned Tree Officer/Deputy Conservator of Forests. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by User Agency. c. User Agency shall maintain the transplanted trees for minimum three years by engaging the same transplantation agency which has carried out the transplantation. d. The progress report of transplantationshall be submitted to concerned Tree Officer/Deputy Conservator of Forests along with complete details of trees by the User Agency. e. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by the birds. f. Transplantation/felling of any tree apart from 9 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994. g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. h. The lops& tops of the trees shall be sent/supplied to the nearest crematorium free of cost and the same should be reported to concernedTree Officer/Deputy Conservator of Forests by User Agency. i. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the concerned Tree Officer/Deputy Conservator of Forests by User Agency. j. Transplantation of trees and transportation of forest produce arising there from to the public crematorium shall be completed within 90 days. k. The User Agency shall ensure that the plan of this proposal shall not be changed. l. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other clearances, if any obtained, shall be followed scrupulously. m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.6 DELHI GAZETTE : EXTRAORDINARY PART IV] n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have been followed and details of the same should be submitted to the Tree Officer/Deputy Conservator of Forests concerned. o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by User Agency & plantation has to be done at own cost. 4. The conditions required to be fulfilled for considering successful plantation & release of Security Deposit by the Tree Officer/Deputy Conservator of Forests :- a. 100% Compensatory Plantation of 90 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as mentioned on table above. b. 90 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of transplantation 9 numbers of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer/Deputy Conservator of Forests concerned (as deposits). d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other purpose without the approval of the State Government. e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Government of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer / Deputy Conservator of Forestsat the end of every financial year. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation/ transplantation. g. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site. h. The User Agency shall ensure that the plan of this proposal shall not be changed. 5. If any of the above condition is not fulfilled by the User Agency, concerned Tree Officer/Deputy Conservator of Forests shall initiate action as per section 12 of Delhi Preservation of Trees Act, 1994. 6. Permission for transplantation of 9 numbers of tress is being granted to the User Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or the trees.
