2. उिरोि 1 (क) और (ख) के अनुसार, ििे ी प्रिाजतयों के 5430 िौधो का 100 % प्रजतिूरक वृक्षारोिण और उनका सात वर्ो तक
रखरखाव उिभोगी संस्ट्था (दिल्ली जवकास प्राजधकरण के बागवानी जवभाग के माध्यम से) द्वारा दकया िायेगाA इस वृक्षारोिण के
सफलतािूवाक स्ट्थािना के बाि उिभोगी संस्ट्था द्वारा जनगरानी की िाएगी A
3. 543 वृक्षो को काटे/ प्रत्यारोिण दकए िाने के बिले मे 1:10 के अनुिात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 5430 िौधो
का प्रजतिूरक वृक्षारोिण गैर-वन भूजम िर दकया िाएगा । वृक्षारोिण की अनुमजत के िारी िोने के तीन मिीने के अंिर जनधााररत की
गई भूजम िर अजतररि उिायों के साथ वृक्षारोिण स्ट्थल के अनुसार जवजिष्ट वृक्षारोिण तकनीकों के द्वारा दकया िाएगा और उसका
रखरखाव उिभोगी संस्ट्था द्वारा दिल्ली जवकास प्राजधकरण के बागवानी जवभाग के माध्यम से अिने स्ट्वयं की लागत िर दकया िाएगा ।
4. यदि उिभोगी संस्ट्था सफलतािूवाक प्रजतिूरक वृक्षारोिण करने में जवफल रिती ि।ै उिभोगी संस्ट्था द्वारा अजतररि साइट सुधार खचों को
िमा दकया िाएगा िो दक वृक्ष अजधकारी ¼केंद्रीय½ द्वारा गणना के अनुसार वृक्षारोिण के जलए उियुि बनाने के जलए आवश्यक िो
सकती ि ै ।
5. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोिण उिभोगी संस्ट्था द्वारा िुरू दकया िाएगा और इसे छःमिीने के अंतराल में िूणा दकया
िाएगा । प्रत्यारोिण प्रदक्रया के िूणा िोने का बाि एक सम्िूणा ररिोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोिण स्ट्थल मे
प्रत्यारोजित वृक्षो की िरू ी 4 मीटर (लबंि ुसे लबंि)ु से कम निीं िोनी चाजिए ।
6. उिभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोिण नीजत 2020 में उजल्लजखत सभी ितों का िालन दकया िाएगा ।
7. िो भूजम प्रजतिूरक वृक्षारोिण के जलया आवंरटत ि,ै उसका उियोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना
निीं दकया िाएगा।
8. उिभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोिण अनुसूची को दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुिालन में वृक्ष अजधकारी
¼केंद्रीय½ को प्रस्ट्तुत दकया िाएगा ।
9. उिभोगी संस्ट्था द्वारा वृक्षारोिण िजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधााररत करेंगी और
इसकी एक प्रजत प्रत्येक जवत्तीय वर्ा के अंत में वृक्ष अजधकारी ¼केंद्रीय½ को प्रस्ट्तुत की िाएगी ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3
10. उिभोगी संस्ट्था द्वारा 263 वृक्षो को काटने से िूवा प्रत्यारोिण दकया िाएगा । 263 वृक्षो की अनुमजत 280 वृक्षो के सफल प्रत्यारोिण और
mi&ou laj{kd (केंद्रीय) को अनुिालन प्रमाण ित्र प्रस्ट्तुत करने के बाि िी िायेगी ।
11. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतिूरक वृक्षारोिण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो ।
12. उिभोगी संस्ट्था द्वारा वृक्षो को काटने/ प्रत्यारोिण का काया िुरू करने से िूवा साइट की तैयारी और वृक्षारोिण के जलए एक जवस्ट्तृत
योिना प्रस्ट्तुत दकया िाएगा ।
13. उिभोगी संस्ट्था द्वारा प्रजतिूरक वृक्षारोिण/ प्रत्यारोिण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा ।
14. 543 वृक्षो को प्रत्यारोिण/ काटने के जलए अनुमजत उनके स्ट्वयं के िोजखम िर और दकसी भी अन्य व्यजि के िावे के िक्षिात के जबना, िो
वृक्षो और भूजम िर सिी िो सकती ि,ै िी िा रिी ि ै।
15. उिभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई/ प्रत्यारोिण से िूवा कोई लंजबत मुकिमेबािी या स्ट्थगन आििे
दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा िाररत न हुआ िो ।
16. उिभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोिण का काया सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा ।
17. उिभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोिण की प्रगजत ररिोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
िाएगी ।
18. उिभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को िररवर्तात निीं दकया िाएगा ।
19. उिभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उिरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के
खाते मे रािस्ट्व के रूि में िमा की िाएगीA
20. उिभोगी संस्ट्था द्वारा वृक्षों के ऊिरी िाखाओं dks dkVs tkus ds उिरान्त izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud “konkgks a es a
iz;ksx gsr q सौिी िाएगी और इसकी सूचना वृक्ष अजधकारी (केंद्रीय) को भी िी िाएगी ।
21. उिभोगी संस्ट्था द्वारा वृक्षो को िटाए िान े के स्ट्थल स े लकजड़यों को ys tkus l s iwoZ o`{k vf/kdkjh ¼केंद्रीय½ l s <qykbZ vueq fr izkIr

22. उिभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोिण/ कटाई और उसमें िैिा िोने वाली वन उिि को सावािजनक श्मिान मे 90 दिनों के अंिर
िूरा दकया िाएगा ।
23. (अ) उिभोगी संस्ट्था द्वारा 543 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोिण दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 के अन्तगात
एक अिराध िोगा ।
(ब) वन और वन्यिीव जवभाग, राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार केवल उिभोगी संस्ट्था (राष्ट्रीय रािधानी क्षेत्र िररविन जनगम) के
साथ ित्राचार करेगा, िालांदक उिभोगी संस्ट्था जवजभन्न एिेंजसयों से कटाई/ प्रत्यारोिण और प्रजतिूरक वृक्षारोिण प्राप्त कर सकती ि।ै
24. यदि दकसी वृक्ष में िजक्षयों का घोंसला िाया िाता ि ैतो उस वृक्ष को घोंसला स्ट्थानांतररत करने के ििात िी काटा िाएगा ।
25. उिभोगी संस्ट्था के द्वारा ियाावरण मंिूरी में उजल्लजखत सभी ितों का िालन दकया िायेगा ।
यि माननीय ियाावरण एवं वन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के िूवा अनुमोिन से िारी दकया िाता ि ै ।

hereby, in public interest exempts an area of 1.6957 ha. approx. as detailed below for the implementation of Regional

The said exemption is subject to fulfillment of the following conditions:-
1. National Capital Region Transport Corporation (NCRTC), herein referred to as User Agency, shall make an
advance deposit of an amount of Rs. 3,09,51,000 /- (Rs. Three Crore Nine Lakh Fifty One Thousand Only))
towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years
as follows,

(b) Transplantation of 280 no. of trees which are standing on site shall be done by User Agency at
Land adjoining DND Flyway on Western Bank of River Yamuna (approx. 1.00 ha.).
2. 100% Compensatory Plantation of 5430 saplings of native species shall be raised and maintained by User
Agency (through Horticulture Department of DDA) for Seven years and monitored till its successful
establishment as indicated at 1 (a) & (b) above.
3. 5430 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of
1:10 on non-forest land in lieu of removal of 543 no. of trees. The plantation shall be done by following site
specific plantation techniques with additional measures on identified land within three months of issue of tree
removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency
through Horticulture Department of DDA with their own funds.
4. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit
extra site improvement expenses which may be required to make the site suitable for plantation as calculated
by Tree Officer concerned (as deposits).[PART IV DELHI GAZETTE : EXTRAORDINARY 5
5. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than six months, after which a completion report has to be submitted to the Tree Officer. The spacing of
the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
6. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
7. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
8. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of
DPTA, 1994 before initiating felling/ transplantation.
9. User Agency shall be responsible to arrange to maintain plantation journals as prescribed by Department of
Forests and Wildlife, Govt. of NCT of Delhi and submit a copy of same at end of each financial year.
10. The transplantation shall be carried out prior to felling of 263 nos. of trees permitted herein. The 263 trees shall
be removed/ felled after successful transplantation of 280 trees and submission of compliance certificate to
DCF (Central).
11. Land Owning agency shall ensue that there is no encroachment in area proposed for compensatory plantation.
12. User Agency shall submit a detailed plan for site preparation and plantation before initiating transplantation/
felling.
13. The User agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation site.
14. Permission for transplantation/ felling of 543 tress is being granted at their own risk and without prejudice to
the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
15. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other
authority before undertaking felling/ transplantation of trees.
16. Before removal of trees from the site is commenced all requisite statutory clearances shall necessarily be
obtained by the User Agency.
17. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
18. The User Agency shall ensure that the plan of this proposal shall not be changed.
19. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the
Government account by the User Agency.
20. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (Central) by User Agency.
21. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (Central) by User Agency.
22. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public
crematorium shall be completed within 90 days.
23. (a) Transplantation/ felling of any tree apart from 543 trees by User Agency shall constitute an offence under
DPTA, 1994.
(b) Department of Forests and Wildlife, Govt. of NCT of Delhi shall make correspondence with User Agency
(NCRTC) only although User Agency may get felling/transplantation and Compensatory Plantation from
different agencies.
24. If any tree is found to have nest of birds it should not be felled/transplant till the same is abandoned by the
birds.
25. It should be ensured by the user agency that all the conditions mentioned in environmental clearance and other
clearances, if any obtained, shall be followed scrupulously
