REGULARISATION OF SERVICES OF GUEST TEACHERS AND TEACHERS ENGAGED UNDER
THE ‘SARVA SHIKSHA ABHIYAN’ BILL, 2017
a) Whereas Article 21A of the Constitution of India mandates the State to provide free and compulsory education
to all children between the age of six and fourteen;
b) And whereas, since 2015, the Directorate of Education of the Government of NCT of Delhi has started, and is
running, several schemes in school education, including,‘Summer Camps’, ‘Reading Campaign’, ‘Chunauti
campaign’, a special campaign to prepare class XII students for board exams, and the learning outcomes
initiative of the NCERT;
c) And whereas, these initiatives of the Directorate of Education have significantly improved the standards of
teaching and education in Directorate of Education schools
d) And whereas, Guest Teachers and teachers engaged under the Sarva Shiksha Abhiyan have been an integral
part of all of the initiatives started and run by the Directorate of Education since 2015;
e) And whereas, the Government of NCT of Delhi has spent considerable time and money in ensuring that Guest
Teachers and teachers engaged under the Sarva Shiksha Abhiyan are trained to be able to carry out its new
initiatives;
f) And whereas, Guest Teachers and teachers engaged under the Sarva Shiksha Abhiyan who have undergone the
training and have acquired the experience of teaching in Directorate of Education schools are best placed to
improve learning and educational standards in Directorate of Education schools;
g) And whereas, new approaches to pedagogy have highlighted the importance of ‘experience’ in teaching;
h) And whereas, Guest Teachers and teachers engaged under the Sarva Shiksha Abhiyan have been engaged in
Directorate of Education schools from 2001 onwards, and unemployed youth have been engaged as Guest
Teachers and under the Sarva Shiksha Abhiyan from 2009-10 onwards;
i) And whereas, in 2014, the engagement of Guest Teachers and teachers engaged under the Sarva Shiksha
Abhiyan was through an open and transparent process – strictly in conformity with Articles 14, 16 and 309 of
the Constitution of India – in which applications were invited from all eligible candidates;
j) And whereas, in 2014, engagement of Guest Teachers and teachers engaged under the Sarva Shiksha Abhiyan
was centralised at the district level; district-wise merit lists of Guest Teachers was generated and maintained in
the public domain and human intervention in the preparation of the merit lists was removed by automating the
preparation of merit lists. And, as a consequence of these steps, the possibility of Guest Teachers being
engaged through the ‘backdoor’ or by the ‘spoils system’ was ruled out in 2014;
k) And whereas, the district-wise merit list created in 2014, provided for reservation and age relaxation for
SC/ST/OBC and Disabled candidates;
l) And whereas, in the absence of law enacted by legislature under Article 309 of the Constitution, Recruitment
Rules have governed procedures for recruitment to the posts of Assistant Teachers, Teachers, Trained Graduate
Teachers and Postgraduate Teachers;
m) And whereas, it is expedient and in the interests of the school education system for Delhi that the skill,
expertise and experience gained by guest teachers and teachers engaged under the Sarva Shiksha Abhiyan is
not lost to Delhi’s education system and that they are regularised and absorbed into the teaching cadre of the
Government of NCT of Delhi;6 DELHI GAZETTE : EXTRAORDINARY PART IV]
Be it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Sixty-eighth
year of the Republic of India as follows: –
Short Title, Extent and Commencement:
1) This Act may be called, ‘Regularisation of Services of Guest Teachers and Teachers engaged under the ‘Sarva
Shiksha Abhiyan’ Act, 2017’.
2) It shall come into force immediately on its publication in the official Gazette.
3) It extends to the whole of the National Capital Territory of Delhi.
4) Definitions: In this act, unless the context otherwise requires –
a. ‘Guest Teacher’ means, every person who has been engaged as a Guest Teacher by the Directorate of
Education for a period of 120 days anytime after April 1, 2016.
b. ‘Teacher engaged under the Sarva Shiksha Abhiyan’ means, every person who has been engaged as
Teacher under the Sarva Shiksha Abhiyan by the Directorate of Education for a period of 120 days
anytime after April 1, 2016.
c. ‘Sanctioned Post’ means, posts sanctioned by the Directorate of Education in Directorate of Education
schools as on date, or at any time in future.
d. ‘Recruitment Rules’ means, the rules notified from time to time for the engagement of teachers
against sanctioned posts by the appropriate authority.
5) All Guest Teachers and Teachers engaged under the Sarva Shiksha Abhiyan in Directorate of Education
schools, stand regularised against sanctioned posts available under the Directorate of Education of the
Government of NCT of Delhi, for which they have qualifications as stipulated under the relevant recruitment
Rules on the date that this act comes into force.
6) All Guest Teachers and Teachers engaged under the Sarva Shiksha Abhiyan presently engaged in Directorate
of Education schools, and in respect of whose qualifications there are no vacancies available in sanctioned
posts of the Directorate of Education of the Delhi government, will continue to be engaged as Guest Teachers
until the relevant sanctioned post falls vacant, and will stand regularised against the relevant sanctioned post
from the day it falls vacant.
7) Nothing in sections 5 and 6 will prevent the appropriate superior authority supervising the work of a Guest
Teacher or a Teacher engaged under the Sarva Shiksha Abhiyan from discontinuing the engagement of the
teacher for disciplinary reasons, or if the performance of the teacher is found to be unsatisfactory.
Provided that, the engagement of the teacher will not be discontinued without following the principles of
natural justice and giving the teacher an opportunity to be heard.
8) Guest Teachers and Teachers engaged under the Sarva Shiksha Abhiyan who do not have the relevant
educational qualifications stipulated in the recruitment rules as on date will not be eligible for regularisation.
9) Guest Teachers and Teachers engaged under the Sarva Shiksha Abhiyan, otherwise qualified under sections 5
and 8 of this act, will not be denied regularisation for not having qualifications stipulated in section 23 of, ‘The
Right of Children to Free and Compulsory Education Act, 2009’, until the time allowed for acquiring such
qualification expires under that act.
10) All Recruitment Rules, in so far as they are contrary to the provisions of this act, stand repealed.
11) All service rules, regulations and notifications applicable to teachers employed against regular sanctioned posts
shall apply to Guest Teachers and Teachers engaged under the Sarva Shiksha Abhiyan from the date their

STATEMENT OF OBJECTS AND REASONS
Article 21A of the Constitution of India mandates the State to provide free and compulsory education to all
children between the age of six and fourteen. Since 2015, the Directorate of Education of the Government of NCT of
Delhi has started, and is running, several schemes in school education, including,‘Summer Camps’, ‘Reading
Campaign’, ‘Chunauti campaign’, a special campaign to prepare class XII students for board exams, and the learning
outcomes initiative of the NCERT. These initiatives of the Directorate of Education have significantly improved the
standards of teaching and education in Delhi government schools and the performance of Delhi government school
students in board exams.
Guest Teachers and teachers engaged under the Sarva Shiksha Abhiyan have been an integral part of all of the
initiatives started and run by the Delhi government since 2015. The Government of NCT of Delhi has spent
considerable time and money in ensuring that Guest Teachers and teachers engaged under the Sarva Shiksha Abhiyan
are trained to be able to carry out its new initiatives. They have undergone the training and have acquired the experience
of teaching in Directorate of Education schools and are best placed to improve learning and educational standards in
Delhi government schools, especially since new approaches to pedagogy have highlighted the importance of
‘experience’ in teaching;
Guest Teachers and teachers engaged under the Sarva Shiksha Abhiyan have been engaged in Delhi
government schools from 2001 onwards, and unemployed youth have been engaged as Guest Teachers and under the
Sarva Shiksha Abhiyan from 2009-10 onwards. In 2014, the engagement of Guest Teachers and teachers engaged under
the Sarva Shiksha Abhiyan was through an open and transparent process – strictly in conformity with Articles 14, 16
and 309 of the Constitution of India – in which applications were invited from all eligible candidates. This engagement
was centralized at the district level; district-wise merit lists of Guest Teachers was generated and maintained in the
public domain and human intervention in the preparation of the merit lists was removed by automating the preparation
of merit lists. And, as a consequence of these steps, the possibility of Guest Teachers being engaged through the
‘backdoor’ or by the ‘spoils system’ was ruled out in 2014. Additionally, the district-wise merit list created in 2014,
provided for reservation and age relaxation for SC/ST/OBC and Disabled candidates. In the absence of law enacted by
legislature under Article 309 of the Constitution, Recruitment Rules have governed procedures for recruitment to the
posts of Assistant Teachers, Teachers, Trained Graduate Teachers and Postgraduate Teachers;
It is expedient and in the interests of the school education system for Delhi that the skill, expertise and
experience gained by guest teachers and teachers engaged under the Sarva Shiksha Abhiyan is not lost to Delhi’s
education system and that they are regularised and absorbed into the teaching cadre of the Government of NCT of
Delhi;
The Bill seeks to achieve the aforementioned objectives.
Hence the Bill.
FINANCIAL MEMORANDUM
The Bill entails no additional financial expenditure to the Government of NCT of Delhi.
