2. उपरोक्त 1 (क) और (ख) के अनुसार, ििे ी प्रिाजतयों के 4040 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात वर्षो तक
रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की
िाएगी A
3. 404 वृक्षो को प्रत्यारोपण दकए िाने के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 4040 पौधो का
प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीने के अंिर जनधााररत की गई
भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और उसका
रखरखाव उपभोगी संस्ट्था द्वारा अपने स्ट्वयं की लागत पर दकया िाएगा ।
4. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा ।
5. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना
निीं दकया िाएगा।
6. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोपण उपभोगी संस्ट्था द्वारा िुरू दकया िाएगा और इसे छ: मिीने के अंतराल में पूणा
दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोन ेका बाि एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण
स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (लबंि ुसे लबंि)ु से कम निीं िोनी चाजिए ।
7. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
8. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
िाएगी ।
9. उपभोगी संस्ट्था द्वारा अजतररक्त 500 पौधे प्रजतरोजपत वृक्षों की मृत्यु िर में िोने वाली वृजद्ध की भरपाई के जलए लगाए िाएंगे।
10. वृक्षो को प्रत्यारोपण के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजक्त के िावे के पक्षपात के जबना, िो वृक्षो और भूजम
पर सिी िो सकती िै, िी िा रिी ि ै।
11. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण का काया सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा ।

13. उपभोगी संस्ट्था के द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िायेगा ।

16.09.2020 and in exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi
Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of
2.58 ha. (25800 sqm.) as detailed below for “proposed Expansion and Restoration of Existing Parliament Building” at
Plot No. 118, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. Central Public Works Department (CPWD), herein referred to as User Agency, shall make an advance
deposit of an amount of Rs. 2,30,28,000 /- (Rupees Two Crore Thirty Lakh and Twenty Eight Thousand
Only) towards security deposit for creation and maintenance of compensatory plantation for a period of
Seven years as follows,

Parliament Complex (around 130 No. of trees) and NTPC Eco-Park Badarpur (around 274 No. of trees),
New Delhi with their own funds.
2. 100% Compensatory Plantation of 4040 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
3. 4040 Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10
on non-forest land in lieu of transplantation of 404 no. of trees. The plantation shall be done by following site4 DELHI GAZETTE : EXTRAORDINARY PART IV]
specific plantation techniques with additional measures on identified land within three months of issue of tree
removal permission and maintenance shall be carried out there after by User Agency with their own funds.
4. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
6. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than six months, after which a completion report has to be submitted to the concerned Tree Officer. The
spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
7. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
8. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
9. Additional 500 trees shall be planted by User Agency to offset any increase in mortality of transplanted trees.
10. Permission for transplantation of all tress is being granted at their own risk and without prejudice to the claim
(s) of any other person/s who may be having any rights(s) over the land or the trees.
11. Before the transplantation of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
12. Felling/ Transplantation of any tree apart from 404 trees by User Agency shall constitute an offence.
13. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any
obtained, shall be followed scrupulously.
