No. DMS-S015/1/2026-LAC-DM(South)/E-38399/381-388 .— In exercise of the power conferred by sub section (1) of Section 11 read with section 40(1) and (4) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 read with Notification No. S.O st 2740 (E) dated 21 October, 2014 read with S.O. 2014 (E) dated 21.07.2015 of Ministry of Home Affairs, Government of India, it appears to the Lieutenant Governor of National Capital Territory of Delhi being the Appropriate Government that a total of 3406.057 square meters of land is urgently required for public purpose, namely, for SAARC to CAPFIMS Road in Revenue Village Maidan Garhi Sub-Division Chattarpur, District South, Delhi for widening of approach Road leading to Central Armed Police Forces Institute of Medical Sciences (CAPFIMS) for Delhi Development Authority. The Appropriate Government is pleased to authorize Deputy Commissioner, District South, and his staff to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in Section 12 of the said Act. Under Section 11(4) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, etc. or create any encumbrances on such land from the date of publication of such notification without prior approval of the Collector. The Appropriate Government being of the opinion that the provisions of sub section (1), (2) and sub- section (3) of Section 40 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 are applicable to said land under acquisition and since the land is urgently required for the public purpose falling within the purview of section 40(2), the Appropriate Government is further pleased to decide under section 40(4) of the Act and directed that the provisions of Chapters- II, III, Sections 14 to 18, 31, 32, 38, 43, 44 and 47 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act,2013 shall not apply to this acquisition and a declaration may be made under Section 19 in respect of the above land at any time after the date of publication of the preliminary notification under sub-section (1) of Section 11 read with 40(1) and (4) of the Act; The Collector (Deputy Commissioner), District South, Delhi, though no award has been, may, on expiration of thirty days from the publication of the notice mentioned in Section 21 of the Right to Fair8 DELHI GAZETTE : EXTRAORDINARY PART IV] Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, take possession of any land needed for a public purpose and such land shall thereupon vest absolutely in the Government, free from all encumbrances. A plan of the land may be inspected in the office of the Deputy Commissioner/Collector, District South, Delhi and Director (LM)-II, DDA on any working day during the working hours.
