No. F. 11/17/2020/H-DOP/RR-II/158 to 166.—In exercise of the powers conferred by proviso to
article 309 of the Constitution of India, read with the Government of India, Ministry of Home Affairs,
Notification No. F.24/78/68-DH(S) dated the 24th September, 1968, and in supersession of the
No.F.13/17/94/DOP/HP-II/344-350 dated the 19th January, 2004 Recruitment Rules in so far as they relate to
the post of the Chief Prosecutor, and anything done or omitted to be done before such supersession, the
Lieutenant Governor of the National Capital Territory of Delhi, after prior consultation with Union Public
Service Commission, hereby makes the rules regulating the method of recruitment to the post of the ‘Chief
Prosecutor’ in the Directorate of Prosecution, Government of National Capital Territory of Delhi as
following, namely:-
1. Short title and commencement :–
(a) These rules may be called the Directorate of Prosecution, Government of National Capital
Territory of Delhi, Chief Prosecutor Recruitment Rules -2022.
(b) They shall come into force on the date of their publication in the Official Gazette.
2. Application:- These rules shall apply to the posts specified in column 1 of the Schedule annexed to
these rules.
3. Number of posts, its classification and Pay level in the pay matrix:- The number of said posts, its
classification and pay scale of pay attached thereto shall be as specified in columns (2) to (4) of the
Schedule annexed to these rules.
4. Method of recruitment, age-limit, other qualification, etc- The method of recruitment, age-limit,
qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of
the said Schedule.
5. Disqualification :- No person;-
(a) Who has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post;
Provided that the Government of National Capital Territory of Delhi, may, if satisfied that such
marriage is permissible under the personal law applicable to such person and the other party to the
marriage and that there are other grounds for doing so, exempt any person from the operation of these
rules.
6. Power to Relax:- Where the Government is of the opinion that it is necessary or expedient so to do,
it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public
Service Commission, may relax any of the provisions of these rules with respect to any class or
category of persons.
7. Saving:- Nothing in these rules shall affect reservations, relaxations of age limit and other concessions,
required to be provided for the Schedule Castes, the Schedule Tribes, ex-servicemen, Other Backward
Classes and other special categories of persons in accordance with the orders issued by the
