No. 303 भाग IV PART IV राष्ट्रीय रािधानी राज्य क्षत्रे दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI Je foHkkx अजधसचू ना दिल्ली, 24 अक् तूबर, 2025 फा.स.ं 1/31/1052/एलसी/स्ट्था./2020/3803-3806.— गृह मंत्रालय, भारत सरकार की दिनांक 13 िुलाई,1959की अजधसूचना संख्या एफ.27/59-एचआईएम (i) के साथ पठित संजिधान के अनुच्छेि 309 के परन्तुक द्वारा प्रित्त िजियों का प्रयोग करत े हुएतथा इस संबंध म ें उन्ह ें सक्षम बनान े िाली समस्ट्त अन्य िजियों तथा इस सरकार की दिनांक 26.4.2005की अजधसचू ना संख्या फा.-01/03(05)/99-एलसी/स्ट्था./खंड-II/105के अजधक्रमण म,ें ऐसे अजधक्रमण स े पूिव की गई या जिलोप की िाने िाली बातों को छोड़कर, राष्ट्रीय रािधानी क्षत्रे दिल्ली के उपराज्यपाल, संघ लोक सेिा आयोग के परामि व सेएति द्वाराश्रम जिभाग, राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार म ें उप-श्रमायुि के पि की भती की पद्धजत को जिजनयजमत करने के जलए जनम्नजलजखत जनयम बनात े ह,ैं अथावत ्ः 1. सजं क्षप्त िीर्कव एि ंप्रारंभ्ः i) इन जनयमों को “उप-श्रमायुि” भती जनयमािली, 2025 कहा िाए। ii) य े दिल्ली रािपत्र म ेंअपन े प्रकािन की जतजथ स ेप्रिृत्त होंगे । 2. अनप्रु योग्ः ये जनयम इन जनयमों से संलग्न अनुसचू ी के कॉलक1 में जिजनर्िवष्ट पिों पर लागू होंगे। 7203 DG/2025 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 3. पिों की सख्ं या, िगीकरण तथा िते न मठै रक्स म ेंस्ट्तर:-पि की संख्या, इनका िगीकरण तथा िते न मैठरक्स म ें स्ट्तर इन जनयमों के साथ सलं ग्न अनुसूची के कॉलम2 स े 4 म ेंयथाजिजनर्िवष्ट होंगे। 4. भती पद्धजत, आय ु सीमा, योग्यता इत्यादि:- उि पिों की भती पद्धजत, आय ु सीमा, योग्यताए ं एि ं इससे संबंजधत अन्य मामले उि अनुसूची के कॉलम (5) स(े 13) म ें यथाजिजनर्िवष्ट होंगे। 5. अयोग्यता:- िह व्यजि, (क) जिसने ऐस े व्यजि से जिसका पजत या जिसकी पत्नी िीजित ह,ै जििाह दकया ह ै या जििाह की संजििा की ह;ै अथिा (ख) िो एक िीजित पजत/पत्नी के होते हुए दकसी व्यजि से जििाह कर चुका ह ै या जििाह की संजििा कर चुका ह,ै िह उि पि पर जनयुजि हते ु पात्र नहीं होगा। ित व यह ह ै दक यदि सरकार संतष्टु ह ै दक ऐसा जििाह ऐसे व्यजि एिं जििाह के अन्य पक्ष पर लाग ू व्यजिगत कानून के अंतगतव अनुमत ह ै और ऐसा करन े के जलय े अन्य आधार ह,ैं तो िह दकसी ऐस े व्यजि को इस जनयम के प्रितवन की छूट ि े सकती ह।ै 6. जिजथल करन े की िजि:- िहां सरकार का यह मत हो दक ऐसा करना आिश्यक अथिा समीचीन ह,ै तो िह कारणों को जलजखत म ें अजभलेखबद्ध करते हुए संघ लोक सेिा आयोग के परामि व स े आििे द्वारा व्यजियों की दकसी श्रेणी के सम्बंध म ें इन जनयमों के उपबंध में स े दकसी भी उपबंध को जिजथल कर सकती ह।ै 7. बचाि:- इन जनयमों म ें सरकार द्वारा इस संबंध म ें समय-समय पर िारी दकए गए आििे ों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, अन्य जपछड़ा िगों, भूतपूि व सैजनकों तथा अन्य जििेर् िगों के व्यजियों के जलए उपबंजधत दकए िाने िाले अपेजक्षत आरक्षण, आय-ु सीमा म ें छूट और अन्य ठरयायतों पर कोई प्रभाि नहीं पड़ेगा। 1. पि का नाम उप-श्रमायुि 2. या ii.) मूल संिगव या जिभागम ें िेतन मैठरक्स के स्ट् तर -09 म ें जनयजमत आधार पर पि पर जनयुजि के उपरान् त प्रित् त 02 िर्व की सेिा सजहत; या iii.) मूल संिगव या जिभागम ें िेतन मैठरक्स के स्ट् तर -08 म ें जनयजमत आधार पर पि पर जनयुजि के उपरान् त प्रित् त 04 िर्व की सेिा सजहत; या iv.) मलू संिगव या जिभाग म ें िेतन मैठरक्स के स्ट्त र -07 म ें जनयजमत आधार पर पि पर जनयुजि के उपरान् त प्रित् त 05 िर्व की सेिा सजहत; तथा (ख) कॉलम संख्या 07 के अन्त गवत सीधी भती हते ु जनधावठरत योग्यताए ं और अनुभि रखता हो।[PART IV DELHI GAZETTE : EXTRAORDINARY 5 मानक टीप: जिन कजनष्ठ अजधकाठरयों न े अपनी अहकव /पात्रता सेिा पूरी कर ली ह ै िे पिोन्नजत के जलए जिचारणीय ह।ै उनके िठरष्ठ अजधकारी भी पिोन्नजत के जलए जिचारणीय होंग े बितें दक उनके जलए अपेजक्षत अहकव /पात्रता सेिा स े न्यून न हो या िो िर्व, िो भी कम हो, उन्होंने आगामी उच्च ग्रेड पर पिोन्नजत के जलए अपनी पठरिीक्षा अिजध अपन े कजनष्ठ अजधकाठरयों के साथ सफलतापूिवक पूरी कर ली हो, जिन्होंने ऐसी अहकव / पात्रता पहले ही पूरी कर ली ह।ै भरक श्रेणी के जिभागीय अजधकारी िो दक पिोन्नजत की सीधी श्रृखंला म ें ह ै िे प्रजतजनयुजि पर जनयुजि हते ु जिचारणीय नहीं होंगे। इसी तरह, प्रजतजनयुजि िाले भी पिोन्नजत द्वारा जनयुजि हते ु जिचारणीय नहीं होंगे। प्रजतजनयुजि (अल्पकाजलक संजििा सजहत) की अिजधम ें केन्द्र सरकार के उसी या अन्य सगं िन/जिभाग म ें इस जनयुजि स े तरु न्त पूिवधाठरत दकसी अन्य गैर संिग व पि म ें प्रजतजनयुजि (अल्पकाजलक संजििा सजहत) की अिजध भी सजम्मजलत ह,ै यह सामान्यत्ः तीन िर्ों स े अजधक नहीं होगी। प्रजतजनयुजि द्वारा जनयुजि हते ु अजधकतम आय ु सीमा आिेिन प्राजप्त की अजन्तम तारीख को छप्पन (56) िर्ों स ेअजधक नहीं होंगी। 12. यदि कोई जिभागीय पिोन्नजत सजमजत जिद्यमान जिभागीय पिोन्नजत सजमजत:- हो, तो उसकी संरचना क्या ह।ै 1. संघ लोक सेिा आयोग का अध्यक्ष/सिस्ट्य - अध्यक्ष 2. मुख्य सजचि, राष्ट्रीयरािधानीक्षेत्रदिल्ली सरकार - सिस्ट्य 3. राष्ट्रीय रािधानी क्षत्रे दिल्ल ी सरकार म ें संबंजधत प्रिासजनक सजचि - सिस्ट्य जिभागीय पिोन्नजत सजमजत:- अपर मुख्य सजचि (गृह)/प्रधानसजचि(गृह) - अध्यक्ष 1. संबंजधत प्रिासजनक सजचि – सिस्ट्य 2. जििेर्/अपर सजचि (ि0 जि0) - सिस्ट् य 13. िे पठरजस्ट्थजतयााँ जिनम ें भती के जलए संघ लोक सीधी भती तथा पिोन्नजत के मामले म ें संघ लोक सेिा आयोग स े सेिा आयोग का परामि वजलया िाना ह।ै परामिव आिश्यक ह।ै jk"Vªh; Governor of the National Capital Territory of Delhi, in consultation with the Union Public Service Commission, is pleased to make the following rules regulating the method of recruitment to the post of Deputy Labour Commissioner in the Labour Department, Government of National Capital Territory of Delhi, namely: 1. Short title and commencement: i) These rules may be called “Deputy Labour Commissioner” Recruitment Rules, 2025. ii) They shall come into force on the date of their publication in the Delhi Gazette. 2. Application: These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules. 3. Number of post, classification and Level in the Pay Matrix. - The number of post, its classification and the Level in the Pay Matrix attached thereto shall be a specified in columns 2 to 4 of the Schedule annexed to these rules. 4. Method of recruitment, age-limit, qualifications etc.: The method of recruitment to the said posts, age-limit, qualifications and other matters connected therewith, shall be as specified in column (5) to (13) of the said schedule. 5. Disqualifications: No person, a) Who has entered into or contracted a marriage with a person having a spouse living, or b) Who having a spouse living, has entered into or contracted a marriage with a person, Shall be eligible for appointment to the said post: Provided that the Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule. 6. Power to relax: Where the Government is of the opinion that it is necessary expedient so to do, it may by order,and for reasons to be recorded in writing, relax any of the provisions of this rule with respect of any class or category of persons in consultation with UPSC. 7. Saving: Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen or any other special category of persons in accordance with the orders issued by the Government from time to time in this regard. SCHEDULE-I Deputy Labour Commissioner 1 Name of the post 25* (2025) 2 Number of Posts * Subject to variation dependent on workload General Central Service,Non Ministerial Gazetted Group 3 Classification ‘A’ 4 Pay Level in the Pay Matrix Level -10 (Rs. 56100-177500)in the Pay Matrix. 5 Whether selection post/ Non- selection post Selection Post 6 Age limit for Direct Recruits Not exceeding 35 years. (Relaxable for govt. servants upto 5 years in accordance with the instructions or orders issued by the Central Government) Note: The crucial date for determining the age limit shall be as advertised by the UPSC.[PART IV DELHI GAZETTE : EXTRAORDINARY 7 7 Educational and other qualification required for Essential: Direct Recruits 1. Degree of a Recognized University and; 2. Post Graduate Degree with specialization in Industrial Relations or Personnel Management or Human Resource Development from a Recognized University/ Institution. OR 02 years Post Graduate Diploma with specialization in Industrial Relations or Personnel Management or Human Resource Development from a Recognized University/ Institution and; Experience:- Three years’ experience of working as Officers of the Central Government/State Government/Union Territories/Autonomous or Statutory Organization/ PSUs /Universities/ Recognized Research Institutions handling administrative, Labour Law or Human Resource or Personnel management related issues in Executive or Managerial capacity. OR Three years’ experience of Working in Private organization which is covered under ESI/EPF Act and dealing in administrative, Labour Law or Human Resource or Personnel management related issues in Supervisory or Managerial capacity. Desirable: Knowledge of Hindi and/or English. Qualification Standard Note Qualifications are relaxable at the discretion of the UPSC for reasons to be recorded in writing, in the case of candidates otherwise well qualified. Experience Standard Note:- The qualification(s) regarding experience is/are relaxable at the discretion of UPSC, for reasons to be recorded in writing in case of candidates belonging to Schedule Castes or Schedule Tribes if at any stage of selection the UPSC, is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them. Note:- Labour Officer who has completed combined regular service of 10 years as Inspecting officer in Pay Level-6 (35400-1,12,400) and as Labour officer in pay level-7 (44900-1,42,400) will also be eligible for promotion. Deputation (ISTC):- Officers of the Central Government/ State Government/ Union territories/Autonomous or Statutory Organization /PSUs/ Universities/ Recognized Research Institutions: a). i.) Holding analogous post on a regular basis in the parent cadre or department; OR ii.) With 02 years’ service rendered after appointment to the post on a regular basis in the Level-09 of pay matrix in the parent cadre or department; OR iii.)With 04 years’ service rendered after appointment to the post on a regular basis in the Level-08 of pay matrix in the parent cadre or department; OR iv.) With 05 years’ service rendered after appointment to the post on a regular basis in the Level-07 of pay matrix in the parent cadre or Department; and b). Possessing the qualifications and experience prescribed for direct recruitment under Col. No. 07. Standard Note: Where Juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of requisite qualifying/eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/ eligibility service. The departmental officers in the feeder grade who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion. The Period of Deputation (ISTC) including the period of deputation (ISTC) in another ex-cadre post held immediately preceding this appointment in the same or another organization/ department of the Central Government. shall ordinarily not exceed three years.
