O R D E R:
It was brought to the notice of the Government that Sri P.V.Satyanarayana
Murthy, while working as Senior Assistant, Office of the District Backward Classes
Welfare Officer, Krishna District was trapped by the officials of Anti-Corruption
Bureau on 17-10-2002 when he demanded and accepted the bribe of Rs.1,000/- from
Sri N.Madhusudhana Rao, husband of Smt. B.M.S.Ratna Bai, Hostel Welfare
Officer, Government Backward Classes Girls Hostel , Gudlavalleru, Krishna District
to hand over proceedings of joining orders, after availment of sick leave by the said
Hostel Welfare Officer and recommended to place the Accused Officer Sri
P.V.Satyanarayana Murthy, Senior Assistant, on his defense before the Tribunal for
Disciplinary Proceedings. The Tribunal for Disciplinary Proceedings, had
recommended for major punishment. After following due procedure Government
have issued orders, imposing the punishment of dismissal from service against Sri
P.V.Satyanaryana Murthy, Senior Assistant, Office of the District Backward
Classes Welfare Officer., Krishna District vide reference 1st read above.
2. Sri P.V.S.N.Murthy, Senior Assistant( Dismissed) approached the Hon’ble
Tribunal by filing O.A.No.6512 of 2007, and O.A.No.7576/2007 in Hon’ble Andhra
Pradesh Administrative Tribunal against the orders of G.O.Ms.No.27 Backward
Classes Welfare (Vig.Cell) Department, Dated: 18-09-2007.
3. In the reference 3rd read above, the Hon’ble Tribunal, in its orders in
O.A.No.7576/2007 Dated 17-12-2008, set aside the impugned proceedings
No.5067/Vig.Cell/2002-11, Dated 15-11-2006, and the consequential orders in
G.O.Ms.No.27, Backward Classes Welfare Department Dated 18-9-2007, and
directed the respondents to reinstate the Applicant into service within 8 weeks from
the date of receipt of a copy of the order, and also ordered that, this order does not
prevent the Respondents from taking fresh action, following the procedure, if any,
against the Applicant. “ Government have filed W.P.No.4582/2009 against the
orders of the Andhra Pradesh Administrative Tribunal in the reference 4th read
above.
(P.T.O)4. The Hon’ble High Court in its orders Dated:10-03-2010 in W.P.No.4582 of
2009, has set aside the Show Cause Notice Dated:15-11-2006 and G.O.Ms.No.27,
Backward Classes Welfare (Vig.cell) Department, Dated:18-09-2007 and orders of
the Hon’ble Tribunal Dated:17-12-2008 in OA No.7576/2007 due to the reason that
the applicant was not given opportunity and he was not supplied with a copy of the
enquiry report, and the matter is remanded to the Government to consider the same
afresh and to take further action on the report of the Tribunal for Disciplinary
Proceedings within two months from the date of receipt of a copy of the order.
Government after careful examination of the orders in W.P.No.4582/2009, Dated:
10-03-2010 filed a Review Writ Petition in the Hon’ble High Court against the
orders of the Hon’ble High Court, in the reference 6th read above.
5.. The Hon’ble High Court of Andhra Pradesh, in its Judgment in
REV.W.P.M.P.NO:5582 of 2011 in W.P.No:4582 of 2009 dated 8-2-2011,
dismissed the review petition and granted two months time to comply with the order
of this court. These orders were received on 17-09-2011.
6. The Government on consideration of the circumstances of the case decided to
consider the case of the applicant afresh by conducting further enquiry as directed by
the High Court.
7. Now therefore the Government, hereby to place Sri P.V.S.N.Murthy, Senior
Assistant, Office of the District Backward Classes Welfare Officer, Krishna District
under deemed suspension with effect from 18-09-2007 under sub-rule(4) of rule 8 of
the Andhra Pradesh Civil Services (CC&A) Rules , 1991 and he shall continue to
remain under suspension until further orders.
8. The Director, Backward Classes Welfare, A.P., Hyderabad, / the District
Collector, Krishna District shall take necessary action accordingly.
