O R D E R:
Dr.B.Vijaya Saradhi while working as District Medical & Health Officer,
Srikakulam (now retired from service), the services of four (4) Medical Officers
have been kept under suspension. Aggrieved by the above orders, one of the
Medical Officer viz., Dr.M.Jaya, Medical Officer, Government Hospital, Ponduru,
Srikakulam District has filed O.A. before the Hon’ble Tribunal and the Hon’ble
Tribunal in its order vide reference 1st read above, have suspended the
suspension orders issued against the above Medical Officer.
2. Since the Hon’ble Tribunal has passed strictness against Dr.B.Vijaya
Saradhi, the then District Medical & Health Officer, Srikakulam, a Charge Memo
was issued vide G.O. 3rd read above and called for explanation. Accordingly, he
has submitted his explanation vide reference 4th cited.
3. In his explanation, Dr.B.Vijaya Saradhi has submitted that as per the
instructions received from the District Collector, Srikakulam, he has visited the
Government Hospital, Ponduru, Srikakulam District and found none of the four (4)
Medical Officers are available till the evening. Accordingly, he has submitted his
report to the District Collector and as per the orders of the District Collector,
Srikakulam, he has kept the said (4) four Medical Officers under suspension.
4. He has also submitted that in G.O.Ms.No.77, General Administration
Department, dated 27-02-1996 and Government Memo.No.24313/Ser.C/2000,
General Administration Department, dated 26-07-2001, the District Collector as
declared as the Nodal Officer and empowered the District Collector with
disciplinary powers and initiate disciplinary proceedings against any officer of any
department in the District concerned. And also under clause 17(v) of Rule 11 of
Andhra Pradesh Civil Services (Classification, Control & Appeal) Rules, 1991, the
District Medical & Health Officer may impose on Civil Assistant Surgeons working
in the Hospitals in the Districts other than those working in the District
Headquarters Hospitals, any of the penalties specified in clauses (i), (ii) and (iv) or
Rule 9.
5. The Government after examination of the matter and taking into
consideration of the explanation submitted by Dr.B.Vijaya Saradhi, District Medical
& Health Officer, Srikakulam (Retired), the Government have decided to drop
further action against him. Accordingly, further action against Dr.B.Vijaya
Saradhi, District Medical & Health Officer, Srikakulam (Retired) is hereby dropped.

6. The Director of Public Health & Family Welfare, A.P. Hyderabad shall take
further action accordingly.
