AG RICULTURE & COOPERATION (COOP.I) DEPARTMENT G.O. Rt. No. 168 Dated: 14- 2-2012 Read the following:- 1. Lr. Rc. No. 1743/2001-C, dated 13.4.2011 of the Divisional Coop. Officer, Ongole addressed to the CC&RCS., A.P., Hyderabad. 2. Lr. Rc. No. 882/2011, dated 25.5.2011, 29.8.2011 & 6.9.2011 of the District Cooperative Officer, Ongole. 3. Legal opinion from the Government Pleader for Cooperation, dated 1.11.2011. 4. From the CC&RCS, AP, Hyderabad Lr Rc. No.8806/2011/LA- 2, dt: 11- 11- 2011 <><><> O R D E R : In the letter read above, the Commissioner for Cooperation & Registrar of Cooperative Societies, AP, Hyderabad has stated that the Divisional Cooperative Officer, Ongole ordered for winding up off the Pavuluru Cooperative Marketing Society Ltd., Pavuluru, Ongole District as it was classified as defunct society in the audit certificate for the year 1993-94 and appointed the Sub-Divisional Cooperative Officer, Chirala as Liquidator U/s 65(1) of the APCS Act, 1965. He has also stated that it was informed by the Divisional Cooperative Officer, Ongole in his letter 1st read above as the Pavulur Cooperative Marketing Society Ltd., Ongole District was under liquidation, the liquidator has sought permission to dispose off the Ac 0.10 Cents of land belonging to the said Cooperative Marketing Society. 2. The Commissioner for Cooperation & Registrar of Cooperative Societies, AP, Hyderabad has further stated that it is reported by the Dist. Cooperative Officer, Ongole in his letter 2nd read above among other things that the society has got Ac 0.10 Cents of vacant land at Pavulur Village, which was donated by Tatipatri Venkata Reddy of Pavulur and the Pavulur Cooperative Marketing Society has no dues to the Govt. Dist Co-op. Marketing Society, MARKFED and Dist. Cooperative Central Bank. Further he has stated that, it is also reported by Sri Gade Venkata Reddy, MLA, Bapatla constituency that the said extent of land is being misused and encroached upon, for that reason he requested to put the land for public auction basing on the report submitted by the Divisional Cooperative Officer and District Cooperative Officer, Ongole. The Hon’ble MLA also requested that the amount so realized in the public auction may be appropriated to the Govt. account. 3. Further the Commissioner for Cooperation & Registrar of Cooperative Societies, AP, Hyderabad has stated that in the letter 3rd read above, the Govt. Pleader for Cooperation gave legal opinion that the liquidator can dispose off the above Ac. 0.10 Cents of land by duly - PTO --2- following the relevant provisions of the APCS Act. 4. The Commissioner for Cooperation & Registrar of Cooperative Societies, AP, Hyderabad has further stated that there are instructions from the Govt. that the Commissioner for Cooperation & Registrar of Cooperative Societies, AP., Hyderabad has to submit all proposals for disposal/lease of properties of DCMS both working and Under liquidation to the Govt. for according clearance. The Commissioner for Cooperation & Registrar of Cooperative Societies, AP, Hyderabad has therefore requested the Govt. to accord permission to the Liquidator, Pavulur Cooperative Marketing Society Ltd, Pavulur, Prakasham district to dispose off the Ac. 0.10 Cents of land belonging to the Pavulur Cooperative Marketing Society Ltd., by observing all usual procedures. 5. Government after careful examination of the proposal of the Commissioner for Cooperation & Registrar of Cooperative Societies, AP, Hyderabad, hereby accord permission to the Liquidator, Pavulur Cooperative Marketing Society Ltd, Pavulur, Prakasham district to dispose off the Ac. 0.10 Cents of land belonging to the Pavulur Cooperative Marketing Society Ltd., by observing all usual procedure as stipulated in G. O. Rt. No.972 A&C(Coop.I) Dept. Dt: 7-8-2008. 6. The Commissioner for Cooperation & Registrar of Cooperative Societies, AP, Hyderabad is requested to take necessary action accordingly in the matter.
