O R D E R:
It was brought to the notice of Government that in the trap case against
Sri P.C.S.Prasad, Commissioner, Jaggaiahpet Municipality, the Anti Corruption Bureau took
the services of Sri D. Nageswara Rao, Senior Assistant, A.M.C. Kodad, Nalgonda District, as
one of the mediators. During the course of trial, the said Senior Assistant failed to support in
the prosecution case, resulting in acquittal of the Accused Officer Sri P.C.S.Prasad,
Commissioner, Jaggaiahpet Municipality in the trap case. Accordingly, the Case was
entrusted to Tribunal for Disciplinary Proceedings to inquire into the allegations of
misconduct of Sri D. Nageswara Rao, Senior Assistant, A.M.C. Kodad, Nalgonda District.
2. The Chairman, Tribunal for Disciplinary Proceedings, after conducting the regular
inquiry, has submitted the Inquiry Report concluding that the charge framed against Sri D.
Nageswara Rao, former Senior Assistant is held proved.
3. In the reference 5th read above, while communicating a copy of the Tribunal for
Disciplinary Proceedings Report, Sri D. Nageswara Rao, former Senior Assistant(Retired)
was requested to submit his representation, if any, on the findings of the Tribunal for
Disciplinary Proceedings.
4. Sri D. Nageswara Rao, former Senior Assistant(Retired), A.M.C., Kodad, Nalgonda
District has submitted his representation denying the findings of the Tribunal for Disciplinary
Proceedings in their inquiry report and requested to drop the charge against him.
5. Government have examined the matter and provisionally decided to impose a penalty
of withholding of 3% pension permanently against Sri D. Nageswara Rao, former Senior
Assistant(Retired), A.M.C., Kodad, Nalgonda District for the charge held proved against him
under Rule 9 of the A.P.Revised Pension Rules, 1980.
6. In the reference 7th read above, Show Cause Notice was issued to Sri D. Nageswara
Rao, former Senior Assistant(Retired), A.M.C., Kodad, Nalgonda District with a direction to
show-cause as to why the penalty of withholding of 3% pension permanently should not be
imposed against him for the charge held proved against him. Accordingly, Sri D. Nageswara
Rao, former Senior Assistant(Retired), A.M.C., Kodad, Nalgonda District has submitted his
representation to the Show Cause Notice requesting to drop further action against him.
7. Government have examined the matter carefully with reference to the record of inquiry
and the representation submitted by the Charged Officer to the Show Cause Notice and
decided to impose a penalty of withholding of 3% pension permanently against Sri D.
Nageswara Rao, former Senior Assistant, A.M.C., Kodad and Secretary Grade-II(Retired),
A.M.C., Alair, Nalgonda District under Rule 9 of the A.P. Revised Pension Rules, 1980, in the
(PTO)--:2:--
above disciplinary case. Accordingly, in the reference 10th read above, the A.P.Public
Service Commission was addressed for their concurrence. In the reference 11th read above,
the Andhra Pradesh Public Service Commission, Hyderabad have agreed with the proposal
of the Government.
8. Government, after careful examination of the entire matter, hereby order to impose a
penalty of withholding of 3% pension permanently against Sri D. Nageswara Rao, former
Senior Assistant, A.M.C., Kodad and Secretary Grade-II(Retired), A.M.C., Alair, Nalgonda
District under Rule 9 of the A.P. Revised Pension Rules, 1980, in the above disciplinary
case.
9. The Commissioner and Director of Agricultural Marketing, Hyderabad shall take
necessary action in the matter, accordingly.
