From CSS&LR, Hyderabad , Rc.No.P1/2058/11. dt 25.05.2011. 2. Government Memo.No.21506/SS-2/2011-2, dt:22.7.2011 3. From CSS&LR, Hyderabad , Rc.No.P1/2058/11,dt 18.08.11. * * * In the reference 1st read above the Commissioner of Survey, Settlements & Land Records, A.P., Hyderabad has informed that the Assistant Director, Survey & Land Records, Visakhapatnam in his Lr.No.A3/2086/10, dt:26.03.2011 has stated that the VIIth Additional District Judge, Visakhapatnam delivered its judgment in MOP.No.465/2006 and MOP.No.466/2006 filed by Sri Ch.Abhishek and Mounicalahari in regard to the accident caused by the vehicle of Assistant Director, Survey & Land Records, Visakhapatnam and another private vehicle. In MOP.No.465/2006 the Court granted compensation of Rs.94,911/- with interest @ 7.5% per annum and deposit the same. In MOP.No. 466/06 the Court granted compensation of Rs.62,762/- with interest @ 7.5% Per annum. The Hon’ble Court also directed to deposit the said amount in one month. 2. The Commissioner of Survey, Settlements & Land Records, A.P., Hyderabad has further submitted that the Assitant Director, Survey & Land Records, Visakhapatnam vide in his Lr.No.2088/10/A3, dt: 04.05.2011 has informed that the Government Pleader for Arbitration (High Court) has opined that an amount of Rs.25,000/- has to be deposited in each MOP in the Court to file an appeal in said MOPs and requested to provide an amount of Rs.50,000/- to enable him to file appeal in High Court of Andhra Pradesh. He has, therefore, requested the Government to allot an amount of Rs.50,000/- under Head of Account MH-2029- Land Revenue (Non-Plan), MH-102-Survey and Settlement Operations, SH 07 District Survey Establishment by way of Supplementary Grants to enable the Assitstant Director, Survey & Land Records, Vishakhapatnam to file appeal in High Court of A.P. by depositing the amount in Court of Law. 3. In the reference 3rd read above, the Commissioner of Survey, Settlements & Land Records, A.P., Hyderabad has submitted that, the Assistant Director, Survey and Land Records, Visakhapatnam vide Rc.No.A3/2086/2010, Dt.06.08.2011 and Rc.No.A3/2086/2010, Dated:26.03.2011 has submitted that the Hon’ble VIIth Additional District Judge (FTC), Visakhapatnam issued instruction to pay the Compensation amount of Rs.94,911/- and Rs.62,762/- with interest at 7.5% per annum on P.T.O -2-or before 25.08.2011 without fail in MOP No.465/2006 and MOP No. 466/2006. He has, therefore, requested the Government immediately to allot budget for an amount of Rs.1,82,100/- (Rupees One Lakh eighty two Thousand one hundred only) in the following Head of Account as the Court directed to pay the amount on or before 25-08-2011:- MH-2029-Land Revenue (Non-Plan) MH-102-Survey Settlement operations SH-07-District Survey Establishment DH-280/284-Other Payments. 4. Government after careful examination of the matter have decided to comply with the directions of the Hon’ble VIIth Additional District Judge (FTC), Visakhapatnam in MOP No.465/2006 and MOP No. 466/2006 and accordingly hereby sanction an amount of Rs.1,82,100/- (Rupees One Lakh eighty two Thousand one hundred only) in favour of the Commissioner of Survey, Settlements & Land Records, A.P., Hyderabad. 5. The expenditure sanctioned above at para 4 shall be debited to the Head of the Account - MH-2029-Land Revenue (Non-Plan) - MH-102-Survey Settlement Operations - SH-07-District Survey Establishment - 500 Other Charges - 501 Compensation (Charged) and shall initially be met by way of an advance from the contingency fund, orders regarding which will be issued by Finance (BG-I) Department separately. 6. The Commissioner of Survey, Settlements & Land Records, A.P., Hyderabad will submit necessary supplementary proposal to Government at appropriate time during current financial year to recoup the above sanctioned amount to contingency fund account. 7. The Commissioner of Survey, Settlements & Land Records, A.P., Hyderabad District shall take necessary action in the matter. 8. This order issues with the concurrence of Finance (Exp. Rev.) Department vide their U.O.No.0531/011/A1/Exp.Rev/2012, Dated: 27.01.2012.
