From CC&RCS, A.P., Hyderabad Rc.Lr.No.36464/AP1, dated.04-02-2012. &&&&&&& ORDER: In the reference 4th read above, Government, after detailed examination of the proposal of Commissioner for Cooperation &Registrar of Cooperative Societies, A.P., Hyderabad, vide reference 3rd read above, have accorded permission to the Commissioner for Cooperation & Registrar of Cooperative Societies, A.P., Hyderabad to take necessary action for payment of interest of Rs.15,865/- (Fifteen thousand Eight hundred and Sixty Five Only) on delay payment of Gratuity to Sri K.Sreerama Murthy, Deputy Registrar of Cooperative Societies (Rtd), Srikakulam. 2. In the reference 7th read above, the Commissioner for Cooperation & Registrar of Cooperative Societies, A,P, Hyderabad has stated that an amount of Rs. 17,475/- (Rupees seventeen thousand four hundred and seventy five only) was paid to the Retired Deputy Registrar through D.D. bearing No. 641024, dt:3.06.2000 for Rs.1615/- and Banker Cheque bearing No. 042280, dated. 28-12-2011 for Rs. 15,865/- in compliance to the Government Orders. He has further stated that the Government Pleader opined that in view of the specific orders of the Hon’ble High Court to grant interest at the rate of 6% from 7.8.1990, the individual is entitled for the payment of interest both for gratuity and monthly pension. Restricting the payment of interest only to gratuity amounts to partial compliance and therefore non compliance of the orders of the Hon’ble court in full which attracts contempt proceedings. 3. The Government Pleader, A.P. High Court, Hyderabad has also stated that the directions of the Hon’ble High court is on all terminal benefits which includes all other payments an employee is entitled but paid belatedly and requested to furnish compliance report. 4. The Commissioner for Cooperation & Registrar of Cooperative Societies, A.P., Hyderabad further submitted that the interest on gratuity amounting to Rs. 17,475/- was already paid to the petitioner in two spells and regarding payment of interest on other pensionary benefits, the particulars are furnished below calculated basing on the records of STO, Srikakulam and Joint Registrar/The District Cooperative Officer, Visakhapatnam: P.T.OSl. In view of the above circumstances the Commissioner for Cooperation &Registrar of Cooperative Societies,A.P., Hyderabad has requested the Government to issue appropriate orders regarding payment of interest on the above mentioned items 6. Government after careful examination of the matter in consultation with Finance (Pen-I) Department, hereby accord permission to the Commissioner for Cooperation &Registrar of Cooperative Societies, A.P., Hyderabad to take necessary action for payment of the balance amount of interest of Rs.57,518/- on delayed payment of terminal benefits to Sri K.Sree Rama Murthy, Deputy Registrar (Retd) for compliance of the Orders of Hon’ble High Court. 7.
