ORDER
The Director General of Police, A.P., Hyderabad in his letter read above, for the
reasons mentioned therein, based on the report of the Commissioner of Police,
Vijayawada has recommended for withdrawal of prosecution against the accused Sri
Pappala Anji Babu, S/o.Krishna in Cr.No. 408/2009 of Suryaraopet P.S., u/s. 309 of the
IPC pending before the Hon’ble III Addl.Chief Metropolitan Magistrate Court,
Vijayawada;
2. The Government after careful examination of the matter, have decided to
instruct the Collector & District Magistrate, Krishna District to request the Assistant
Public Prosecutor concerned to initiate immediate action in accordance with law for
withdrawal of prosecution against the accused mentioned in para (1) above in
Cr.No.408/2009 of Suryaraopet P.S., under section 309 of the Indian Penal Code,
1860 (Central Act 45 of 1860) pending before the Hon’ble III Addl.Chief Metropolitan
Magistrate Court, Vijayawada, by duly following the procedure prescribed under
section 321 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) and the
guidelines issued in G.O.Ms.No.54, Law (L.A. & J-Home –Courts-B) Department,
Dated:30.03.2000, under intimation to the Government.
