Read the following 1. CCTs Ref No.DX2/1344/2010, dated.29.12.2010. 2. The Addl.Secretary, APPSC Lr.No.1749/DTM/2001, dt.26.05.2011. * * * O R D E R: In the reference 1st read above, the Commissioner of Commercial Taxes has reported that Sri P.Tulasi Ram was selected in Group.II services in Notification No.10/99 in the year 2005 through the APPSC and appointed as ACTO and allotted to Kurnool Division. Accordingly he joined in Kurnool division on 04.03.2005 as ACTO and he has not passed the prescribed departmental tests within the period of probation of two years within a continuous period of three years i.e. on or before 03.03.2008. But, the said individual has passed the last departmental test i.e. Local Fund Audit Paper.IV in July, 2010 i.e. beyond the period of probation and requested the Govt. to issue appropriate orders/instructions in this regard. 2. Government have examined the matter carefully and observe that Sri P.Tulasi Ram, DR ACTO has passed the last departmental exam i.e. LF Audit Paper.IV in July, 2010. As per APPSC schedule for Jan, 2008 (session) notification was issued by the APPSC on 10.06.2009 instead of Jan, 2008; with a delay of 17 months; exam was conducted on 24.08.2009 instead of May, 2008; with a delay of 15 months and results were published in July, 2010 instead of last Thursday of July, 2008 i.e. 31.07.2008; with delay of 24 months from the scheduled period. 3 . In the above circumstances, it is considered that the delay in passing the departmental test by the individual is not due to his fault but due to delay in conducting of departmental tests and publication of results by the APPSC though it is beyond three years from the date of joining. Hence it cannot be attributed to the individual. It is therefore decided in terms of Rule 16(h) of APS & SS Rules, 1996 and in partial relaxation of its provisions in favour of the individual by invoking the powers conferred under Rule 31 of APS & SS Rules, 1996. 4. Accordingly, and in terms of rule 16(h) of the APS & SS Rules, 1996, Government hereby order that Sri P.Tulasi Ram, ACTO(DR), shall be deemed to have commenced his probation two years anterior to the deemed date of publication of results by the APPSC i.e. 31.07.2008. Thus his probation would be deemed to have commenced on 01.08.2006. 5. The Commissioner of Commercial Taxes, Hyderabad shall take necessary further action in the matter accordingly.
