O R D E R:
It is proposed to hold an enquiry against Dr.Meesala Venu Gopal, Civil
Assistant Surgeon, S/o. Late Narayana Naidu, Mother and Child Health Hospital
(Ghosha Hospital), Vizianagaram in accordance with the procedure laid down in
Rule 20 of he Andhra Pradesh Civil Services (Classification, control and Appeal)
Rules, 1991.
2. The substance of the imputation of misconduct or misbehaviour in respect of
which the inquiry is proposed to be held is set out in the enclosed statement of
articles of charges (Annexure-I). A statement of imputations of misconduct or
misbehaviour in support of each article of charge is enclosed (Annexure-II). A list of
documents by which, and a list of witnesses by whom the articles of charges are
proposed to be sustained are enclosed (Annexure-III and IV).
3. Dr.Meesala Venu Gopal, Civil Assistant Surgeon, S/o. Late Narayana Naidu,
Mother and Child Health Hospital (Ghosha Hospital), Vizianagaram is directed to
submit his written statement of defence within 15 days from the receipt of this
order.
4. Dr.Meesala Venu Gopal, Civil Assistant Surgeon, S/o. Late Narayana Naidu,
Mother and Child Health Hospital (Ghosha Hospital), Vizianagaram is informed that
an inquiry will be held only in respect of those articles of charges as are not
admitted. He should, therefore, specifically admit or deny each articles of charge.
5. Dr.Meesala Venu Gopal, Civil Assistant Surgeon, S/o. Late Narayana Naidu,
Mother and Child Health Hospital (Ghosha Hospital), Vizianagaram is further
informed that if he does not submit his written statement of defence on or before
the date specified in para-3 above further action will be processed based on the
material available.
6. Attention of Dr.Meesala Venu Gopal, Civil Assistant Surgeon, Mother and
Child Health Hospital (Ghosha Hospital), Vizianagaram is invited to Rule 24 of the
Andhra Pradesh Civil Services (Conduct) rules, 1964, under which no Government
servant shall bring or attempt to bring any political or outside influence to bear
upon any superior authority to further his interest in respect of matters pertaining
to his service under the Government. If any representation is received on his
behalf from another person in respect of any matter dealt with in these
proceedings, it will be presumed that Dr.Meesala Venu Gopal, Civil Assistant
Surgeon, Mother and Child Health Hospital (Ghosha Hospital), Vizianagaram is
aware of such representation and that, it has been made at his instance and action
will be taken against him for violation of Rule 20 of A.P.Civil Services (Conduct)
Rules, 1964.

DR.MEESALA VENUGOPAL, S/O. LATE NARAYANA NAIDU, CIVIL ASSITANT
SURGEON, MOTHER AND CHILD HEALTH HOSPITAL (GHOSHA HOSPITAL),
VIZIANAGARAM
That Dr.Meesala Venu Gopal, S/o. Late Narayana Naidu Joined Government
Service as Civil Assistant Surgeon in Andhra Pradesh Vaidya Vidhana Parishad on
16-09-1992 and worked at PH Centre, Laveru upto 31-01-2001 Later he was
selected to PG Course in DGO, at Rangaraya Medical College, Kakinada, PG lien
drawn at PH Center, Donubail and he was posted at MCH Hospital, Vizinagaram on
01-02-2003 and worked there till date. While working as Civil Assistant Surgeon he
has committed the following grave misconduct in as much as.
CHARGE NO.1.
That Dr.Meesala Venu Gopal, S/o. Late Narayana Naidu violated the rules of
Government Memo. No.1734/M1/99-3, HM & FW (M1) Deptt., dated.05-10-1999
and accepted an amount of Rs.1,000.00 from the complainant towards duly doctor
night allowance diet charges instead of taking meals.
CHARGE NO.2
That Dr.Meesala Venu Gopal, S/o. Late Narayana Naidu did not submit his
Annual Property Return Statements to the competent authority during his tenure
and failed to maintain absolute integrity and there by violated the provisions of
APCS (Conduct) Rules, 1964.
Thus Dr.Meesala Venu Gopal by his above mentioned acts has exhibited lack
of integrity, devotion to duty and conduct unbecoming of Government servant and
thereby contravened rule 9(7) r/w 3(1)(2) of APCS (Conduct) Rules, 1964.

NARAYANA NAIDU, CIVIL ASSITANT SURGEON, MOTHER AND CHILD HEALTH
HOSPITAL (GHOSHA HOSPITAL), VIZIANAGARAM
That Dr.Meesala Venu Gopal, S/o. Late Narayana Naidu is a native of
Rallivalasa of Vizianagaram District. His date of birth is 08-11-1960. He joined
Government service as Civil Assistant Surgeon in Andhra Pradesh Vidya Vidhana
Parishad on 16-09-1992 and worked at PH Centre, Laveru upto 31-01-2001. Later
he was selected to PG Course in DGO, at Rangaraya Medical College, Kakinada, PG
lien drawn at PH Center, Donubai and he was posted at MCH Hospital, Vizinagaram
on 01-02-2003 and worked there till date. He was drawing a basic of Rs.41,550/-.
He is due to retire on attaining the age of superannuation is on 30-11-2018 (He is
hereinafter referred to as Government Servant).
CHARGE NO.1:
That Dr.Meesala Venu Gopal, S/o. Late Narayana Naidu violated the rules of
Government Memo. No.1734/M1/99-3, HM & FW (M1) Deptt., dated.05-10-1999
and accepted an amount of Rs.1,000.00 from the complainant towards duty doctor
night allowance diet charges instead of taking meals.
CHARGE NO.2:
That Dr.Meesala Venu Gopal, S/o. Late Narayana Naidu did not submit her
Annual Property Return Statements to the competent authority during her tenure
and failed to maintain absolute integrity and there by violated the provisions of
APCS (Conduct) Rules, 1964.
The brief facts of the case are that a case in Cr. No.16/RCT-ACB/VZM/2010
U/s. 7, 13(2) r/w 13(1)(d) of P.C.Act, 1988 was registered on 19-11-2010 at 9.00
A.M. against Smt. Dr. Vompulu Subhadra, W/o. Veerabrahma Chari, 54 years, RMO
(I/c), Mother and Child Health Hospital (Ghosha Hospital), Vizianagaram (A.O.) for
demand of bribe amount of Rs.8,000/- and she was trapped on 19-11-2010 at 1.10
PM for accepting tainted amount of Rs.8,000/- from Sri Gudla Satyanaryana, S/o.
Ramanayya, 42 years, Diet Contractor, R/o. Parapathi Veedhi, Vizianagaram for
doing official favour i.e. “for recommending in diet bills for the period from
27-10-2010 to 14-11-2010 and 17-11-2010 to 18-11-2010 and the payment
received towards the diet bills for the period from 4/2010 to 10/2010.CHARGE-1:
During the course of investigation in that case the A.O. was trapped when
she demanded and accepted a brie of Rs.8,000/- Sri Gudla Satynarayana with her
right hand and counted them with both her both hands and called Dr.A.V.S.Usha
Rani, Dr. Kiranmai, Dr. M.Venugopal to her room, mean while Dr. B.V.Ravichandra,
Hospital Superintendent also came to her room, then she handed over an amount
of Rs.5,000/- to Sri G.Satyanarayana, died contractor and instructed him to
distribute the amount of Rs.1,500/-, Rs.2,500/- and Rs.1,000/- to Smt. Dr.
A.V.S.Usharani, Dr. Kiranmai, Dr. M.Venugopal respectively. Accordingly he
distributed the same in the presence of Hospital Superintendent Dr.
B.V.Ravichandra and the A.O. Dr. Subhadra Kept the remaining amount of
Rs.3,000/- in the diet distribution book which was lying on her table.
Further the Government servant admitted before the mediators (1) Sri
Magnati Arjuna Rao S/o. Venkateswara Rao, 44 years, Asst. Labour Officer, Cricle-
1, O/o. Asst. Labour Officer, Vizianagaram. (2) Sri Pakki Jagadeswara Rao, S/o.
Sambasiva Rao, 50 years, Junior Assistant O/o. Asst. Labour Officer, Circle-1,
Vizianagaram that he received a tainted amount of Rs.1,000/- from the
complainant Sri Gudla Satyanaryana as diet charges only and handed over the said
amount to the DSP in the presence of the mediators. The DSP seized the tainted
amount of Rs.1,000/- which was tallied with the currency mentioned in pre-trap
proceedings.
Dr.B.Venkata Ravi Chanra, S/o. Ram Murthy Naidu, Medical
Superintendent, Mother and Child Hospital (Ghosha Hospital ), Vizianagaram R/o.
Flat No.212/A, Anand Enclave, Near Fort Junction, Vizianagaram on examination
stated that while he was present in the room of RMO on 19-11-2010, the RMO Smt.
Dr. Vompulu Subhadra, handed over an amount of Rs.5,000/- to diet contractor Sri
Satayanaryana, keeping some money with her and instructed him to pay
Rs.2,500/- to Dr. Kiranmai, Rs.1,500/- to Dr. Usha Rani and Rs.1,000/- to Dr.
Venugopal towards diet charges. Accordingly the diet contractor Sri Satyanaryana
distributed the amounts. Though the night duty doctors should take common diet
during night duty as per Govt. rules in general the doctors are taking money of
Rs.500/- per month from the diet contractor instead of taking diet in mutual
understanding etc., facts.Sri Gudla Satyanaryana, S/o. Ramanayya, 42 years, Diet Contractor, R/o.
Parapathi Veedhi, Vizianagaram on examination stated that he has been acting as
Diet Contractor from 5 years. Being Diet contractor he has to provide common diet
to the inpatients and night duty doctors. But no duty doctors took meals in the
hospital during their duty hours, he has been paying money instead of meals @
Rs.500.00 per month, as per the directions of the doctors. As per the directions of
the A.O., he paid an amount of Rs.1,000/- to the Government Servant on the day
of trap towards duty doctor night allowance diet charges.
The investigation disclosed that the diet contractor is supplying the diet to
the inpatients and duty doctors of the Hospital for the last 5 years. But no duty
doctors took meals in the hospital during their duty hours but receive the money
instead of meals @ Rs.500.00 per month as common understanding in between the
doctors and contractor. As such the doctors viz. Dr.A.V.S.Usha Rani, Dr. Kiranmai,
Dr. M.Venugopal were accepted the tainted amount of Rs.1,500/-, Rs.2,500/- and
Rs.1,000/- respectively from the complainant as duty doctor nigh allowance diet
charges. As per the Govt. Memo.No.17343/M1/99-3, Dt,5-10-1999, HM& FW(M1)
Dept, the diet contractor should provide common diet, to the duty Medical Officers,
as such the duty doctors should take common diet only from the diet contractor,
but not money. Hence the Government Servant violated the
Memo.No.17343/M1/99-3, Dt,5-10-1999, HM& FW(M1) Dept.
CHARGE.2:
The Medical Superintendent, MCH Hospital, Vizianagaram vide his
Rc.No.91/EXMCH/2010, dt. 04-12-2010 informed that the A.O. did not file Annual
Property Returns during her entire service, hence she violated the APCS (Conduct)
Rules, 1964.
Thus the Government servant by his above mentioned acts has exhibited lack of
integrity, devotion to duty, conduct unbecoming of a Government servant, and thereby
contravened rule 9(7) r/w 3(1)(2) of APCS (Conduct) Rules, 1964.
Thus the Government Servant therefore rendered himself liable for regular
Departmental action for major penalty.
