REVENUE (VIG.VI) DEPARTMENT G.O.Rt.No.297. Dated: 18.02.2012. Read the following: 1. Representation of Sri K.Bhanoji Rao, dated: 15.07.2011. 2. Govt. Memo.No.30505/Vig.VI (2)/2011-1, dated: 08.08.2011. 3. From the CCLA, A.P., Hyderabad, Lr.No.VS.III(3)/733/2011, dated: 23.12.2011. ORDER: In the reference 3rd read above, the Special Chief Secretary & Chief Commissioner of Land Administration, A.P., Hyderabad has brought to the notice of the Government that Sri K.Bhanoji Rao, formerly Deputy Tahsildar (CS), O/o Tahsildar, Itchapuram, Srikakulam District and now retired from service was placed under suspension by the Collector, Srikakulam District on the allegation of negligent behaviour in discharging his duties and for not attending to duty on 20.10.2009, and subsequently he was reinstated into service, pending finalization of disciplinary action on 10.12.2009 and the following two article of charges were framed against the Accused Officer: CHARGE-1: “That the said Sri K.Bhanoji Rao while functioning as Civil Supplies Deputy Tahsildar, Ichapuram failed to follow the procedures and instructions issued with regard to filing of 6-A cases deliberately. Thus he derelicted his duty and failed to maintain integrity and exhibited conduct unbecoming of a Government servant. Thus he violated Rule 3(1) and 3(2) of the Andhra Pradesh Civil Services (Conduct) Rules.” CHARGE-2: “That the said Sri K.Bhanoji Rao while functioning as Civil Supplies Deputy Tahsildar, Ichapuram absconded from duty on 20.10.2009. He has not applied for Casual Leave nor has he obtained permission of superior officers for absenting himself on that day. Hence he failed to maintain discipline and behaved irresponsibility. Thus he violated Rule-3(1) of the Andhra Pradesh Civil Services (Conduct) Rules.” 2. Being not satisfied with the explanation of the charged officer, the Additional Joint Collector, Srikakulam was appointed as Enquiry Officer to enquire into charges framed against the Accused Officer and the Enquiry Officer had submitted his enquiry report on 24.06.2011. As the Accused Officer retired from service on 31.10.2010, the Chief Commissioner of Land Administration, A.P., Hyderabad has sent proposals to Government for finalizing the disciplinary proceedings initiated against the Accused Officer under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980.3. Government have examined the matter in the light of the findings of Regular Enquiry Officer and the representation of the Accused Officer 1st read above and observe that the Enquiry Officer, in his report, held that the Charge-1 is proved to the extent of procedural irregularity as the Accused Officer cannot handover the seized vehicle to a dealer and the Charge-2 is not proved. Government have also observed that neither the Tahasildar, Itchapuram who sent report to the Tahasildar, Srikakulam regarding the incident, nor the Joint Collector, Srikakulam District in whose Court the 6-A case booked against the culprit was heard, has made any observations / remarks on procedural irregularities against the Accused Officer who retired from service on 31.10.2010. 4. In the light of the above, Government after careful consideration of the matter, hereby drop further action against Sri K.Bhanoji Rao, formerly Deputy Tahsildar (C.S), Tahsildar Office, Itchapuram, Srikakulam District and now retired from service. 5. The Special Chief Secretary & Chief Commissioner of Land Administration, Hyderabad / Collector, Srikakulam District shall take necessary further action in the matter accordingly.
