HEALTH MEDICAL AND FAMILY WELFARE (B1) DEPARTMENT G.O.Rt.No. 305 Dated.24-02-2012 Read the following:- 1. G.O.Rt.No.1841, HM&FW (B) Department, dated 05-11-2011. 2. A.P.A.T. orders dated 30-12-2011 in O.A.No.8686/2011 filed by Dr.Y.Narasimhulu, Additional DM&HO, Kurnool. *** O R D E R: In the G.O. 1st read above, Government have issued transfer and posting orders to Dr.Ch.Venkatapathi, Zonal Malaria Officer, Kadapa as District Medical & Health Officer, Kurnool in the existing vacancy. 2. As aggrieved by the above orders, Dr.Y.Narasimhulu, Additional District Medical & Health Officer, Kurnool who was holding full additional charge of the post of District Medical & Health Officer, Kurnool has filed O.A. No.8686/2011 before A.P.A.T., with a request to set aside the Government Order, stating that he is senior than Dr.Ch.Venkatapathi. The Hon’ble A.P. Administrative Tribunal in its final orders dated 30-12- 2011 in the above O.A. has passed orders as follows:- “it cannot be said that the applicant i.e. Dr. Y.Narasimhulu has been negligent of his duties as District Medical & Health Officer (FAC) necessitating the official respondents to disturb him from the post and posting the third unofficial respondent i.e. Dr.Ch.Venkatapathi as DM&HO, Kurnool. It is held that on account of the applicant being senior to the 3rd unofficial respondent, he also worked by taking necessary timely actions to control the epidemic in the district and keeping in view the fact that the third unofficial respondent was recently promoted as Civil Surgeon and did not complete even one year of active service as Civil Surgeon at the present station i.e. Cuddapah, it is held that impugned orders issued in G.O.Rt.No.1841, HM&FW (B1) Department, dated 5-11-2011 are illegal and invalid and liable to be set aside and the impugned orders are accordingly set aside. The OA is allowed. CA and VMAs stand closed” 3. Government after careful re-examination of the matter have decided to implement the A.P.A.T. order dated 30-12-2011 in O.A.No. 8686/2011 filed by Dr. Y.Narasimhulu. 4. Accordingly, Government hereby cancel the orders issued in the G.O. 1st read above, with immediate effect and Dr.Ch.Venkatapathi, Civil Surgeon (GL) is directed to report before the Government for further posting. 5. The Director of Public Health & Family Welfare shall take necessary action accordingly.
