Representation from Sri K.Kiran Kumar, Junior Assistant, O/o. P&ES, Proddatur, Kadapa District, dated:25.8.2008. 2. From the CPE Cr.No.3428/2009/CPE/H4, dt.15.5.2010 and 3.5.2011. 3. From the APAT orders dt.09.06.2011 in O.A.No.4408/2011 4. Memo.No.17861/Ex.I(2)/2009-9, dated:04.08.2011. 5. From the CPE Cr.No.3428/2009/CPE/H4, dt.22.09.2011. * * * O R D E R: In the reference first read above, Sri K.Kiran Kumar, Junior Assistant, O/o.the Proh.& Excise Superintendent, Proddatur, Y.S.R. Kadapa District has stated that he is physically handicapped and he had his education at Kadapa as his father was an employee in Electricity Department at Kadapa Town and on retirement he left for the native village Penugonda and settled there. He is finding much difficulty in staying alone at Proddururu. Therefore he has requested to transfer him to West Godavari District so as to enable him to look after his aged parents. He has also stated that if the transfer is considered he is willing forgo the seniority and TTA. 2. In the reference second and fifth read above, the Commissioner of Prohibition & Excise, A.P., Hyderabad has informed that Sri K.Kiran Kumar, Junior Assistant, O/o the Prohibition & Excise Superintendent, Proddatur studied up to degree at Kadapa Town as his father worked as Field Mastry in Electricity Department, Kadapa, during that period. The District Collector, Kadapa vide procds.Rc.No.A3/1573/2002, dt.22.3.2005 allotted Sri K.Kiran Kumar, S/o. Kanaka Durga Rao, Y.S.R. Kadapa District as an Orthopaedically Handicapped candidate in a backlog vacancy in Prohibition & Excise Department, Kadapa. Accordingly, the Prohibition & Excise Superintendent, Kadapa gave him posting in Proh. & Excise Department, Kadapa on 31.03.2005. 3. The Commissioner of Proh. & Excise, A.P., Hyderabad has further stated that after retirement, Sri K.Kiran Kumar’s father settled at Penugonda Village and Mandal in West Godavari District and obtained the F.P. shop Card No.PAPO 54000200442 with family members details. He has also produced the Community, Nativity and Date of Birth certificate issued by the M.R.O., Penugonda of West Godavari District and the Medical Certificate as an Orthopaedically handicapped candidate issued by Nizam’s Institute of Medical Sciences, Hyderabad. He has further informed that there are 7 existing vacancies of Junior Assistant at West Godavari District. 4. In the reference third read above, the Hon’ble Andhra Pradesh Administrative Tribunal in its order dated 9th June, 2011, has passed orders to consider the representation of the applicant wherein he sought for transfer to native district of West Godavari by passing orders in pursuance of Memo No. 7861/Ex.I(2)/09-5, dated:5.2.2011 of the Government by keeping in view para 5 (2)(c) of the A.P. Pubic Employment (Organization of Local Cadres & Regulation of Direct Recruitment) Order, 1975, with in a period 4 weeks from the date of receipt of the copy of the order. (Contd…2nd p…..):: 2 :: 5. Keeping in view the above Government have examined the matter in detail and decided to consider the request of Sri K.Kiran Kumar (Physically Handicapped), Junior Assistant, O/o.the Proh. & Excise Superintendent, Proddatur, Y.S.R. Kadapa District for his transfer to West Godavari District as a special case in relaxation of Presidential Order since he is a physically handicapped person. 6. Accordingly, Sri K.Kiran Kumar, Junior Assistant, O/o.the Proh. & Excise Superintendent, Proddatur, Y.S.R. Kadapa District is hereby transferred to West Godavari District in relaxation of para 5 (2) (C) of Presidential Order subject to the following conditions:- 1. that he should take last rank in the cadre of Junior Assistant at West Godavari Dist; and 2. he will not be eligible to draw TTA. 7. The Commissioner of Prohibition & Excise, Andhra Pradesh, Hyderabad shall take necessary action in the matter.
