From the GA (COI) Dept., D.O.Lr.No.124/COI-KPC/A1/2011, dated: 04.07.2011. * * * * * ORDER: In the reference 2nd read above, the Director General, Anti Corruption Bureau, A.P., Hyderabad has furnished draft article of charges, statement of imputations etc. in respect of Sri A.Narasinga Rao, formerly Deputy Tahsildar (CS), Integrated Civil Supplies Check Post, Purushothapuram, Itchapuram Mandal, Srikakulam District for initiating departmental action against him on the allegation of committing grave misconduct in as much as engaging a private person at the check post to collect illegal gratification from the crew of transport vehicles pass through the check post, who was found having collected an amount of Rs.400/- during the surprise check conducted on Integrated Civil Supplies Check Post, Purushothapuram, Itchapuram Mandal, Srikakulam District on 05.05.2003. 2. In the G.O. 3rd read above, sanction was accorded under Sub-Clause (i) of Clause (b) of Sub-Rule (2) of Rule-9 of Andhra Pradesh Revised Pension Rules, 1980 to initiate departmental proceedings against the said Sri A.Narsinga Rao, Deputy Tahsildar (Retired). Orders were also issued framing the following article of charge against the Accused Officer vide G.O.4th read above: CHARGE: “That Sri Anantapalli Narasinga Rao joint Government Service during the year 1972 as Junior Assistant, he promoted as U.D. Revenue Inspector on 19.10.1984 and promoted as Deputy Tahsildar on 10.10.1995. He worked as Deputy Tahsildar from 31.01.2001 to 28.2.2005 at Integrated Check Post, Purushottapuram, Ichapuram Mandal, Srikakulam District. While working as such he has committed grave misconduct in as much as engaged Private person at the check post to collect illegal gratification from the crew of transport vehicles passes through the check post, who collected an amount of Rs.400/- on 05.05.2003 and thus he violated the provisions of Andhra Pradesh Civil Services (Conduct) Rules, 1964. Thus, Sri Anantapalli Narasinga Rao by his above mentioned acts has exhibited lack of integrity, devotion to duty, conduct unbecoming of a Government Servant and there by contravened the Rule 3(1) & (2) of Andhra Pradesh Civil Services (Conduct) Rules, 1964.”3. Being not convinced with the explanation of the charged officer, Government, in exercise of the powers conferred by Sub Rule (2) of Rule 20 of the Andhra Pradesh Civil Services (CCA) Rules, 1991, appointed Sri K.Pradeep Chandra, IAS, Commissioner of Inquiries as an Inquiring Authority to inquire into the charges framed against the said Sri A.Narasinga Rao, Deputy Tahsildar (Retd.) vide G.O.9th read above, in place of Smt Chandana Khan, IAS, Commissioner of Inquiries appointed as Inquiring Authority to inquire into the charge framed against the Accused Officer in the reference 6th read above. Sri P.Srinivas Reddy, Advocate was already appointed as Presenting Officer to present the case, on behalf of the Government, before the Inquiring Authority vide G.O.7th read above. 4. In the reference last read above, the General Administration (COI) Department has furnished the enquiry report of Sri K.Pradeep Chandra, IAS, Commissioner of Inquiries wherein the Inquiring Authority has observed that though (26) witnesses were listed, the Presenting Officer had examined only (4) to (6) witnesses (depending on the dept. to which the cadre related) and none of the independent witnesses spoke about the charged officer directly collecting mamools, that the Anti Corruption Bureau staff had said that they were in mufti and watched the check post for a while and it is alleged that one Sri A.Kumar collected the money on behalf of Charged Officer. He has also observed that even the Anti Corruption Bureau staff had not stated that they saw the said A.Kumar collecting mamools and handing over it to the Charged Officer. He has further observed that there was no variation in personal cash and Government cash, also no excess amount was found with the charged officer or in the premises of the Civil Supplies counter at the check post, on verification of government cash as well as personal cash with the Charged Officer and no evidence was adduced to show that the charged officer accepted any money from the members of any crew. Therefore, the Inquiring Authority was finally inclined to disregard the argument made by the Defense Counsel for the charged officer that PW4 did not take prior approval of the Director General, Anti Corruption Bureau before conducting the surprise raid and hence this is a technical matter and there is not enough material available to decide the case on merits and found that the charge against Sri A.Narsinga Rao, Deputy Tahsildar (Retired) is not proved. 5. After careful examination of the entire matter, Government hereby observe that the charge is not held proved during the inquiry and therefore Government hereby drop further action against Sri A.Narasinga Rao, formerly Deputy Tahsildar (CS), Integrated Civil Supplies Check Post, Purushothapuram, Itchapuram Mandal, Srikakulam District and now retired from service and exonerate him from the charges. 6. The Special Chief Secretary and Chief Commissioner of Land Administration, A.P., Hyderabad / District Collector, Srikakulam shall take necessary further action in the matter accordingly.
