Letter No.40539/Vig.VII(2)/2010-7, Dt.28-01-2012. 15) From the APPSC, Letter No.303/RT-I/1/2012, Dt.13-02-2012. ** ** ** In his letter 2nd read above, the District Collector, Chittoor has informed that one Smt.V.Subbamma, W/o.Sri Venkataseshaiah of Srikalahasti has presented a petition stating that she is having 1.63 acres of land in Sy.No.30/3, etc., at Basavaiahpalem Village and Pattadar Pass Book and Title Deed were granted to her and the land is also under her possession and enjoyment. But, her name has not been entered in the adangal since fasali 1406 and in the enjoyment column Sri Bodugu Ramanaiah’s name was entered by the Village Officers. The complainant requested to take action against the Village Officers. The matter has been enquired into by the Revenue Divisional Officer, Tirupati and as per his instructions the entries made in the adangal for Sy.No.30/3 etc. of Basavaiahpalem village in the name of Sri B.Ramanaiah as enjoyer was cancelled and the Pattadar Pass Book/Title Deed/adangal from Fasali 1406 onwards were issued in favour of Sri V.Sai Ram, S/o.Sri Nagaiah as per the R.O.R.Act. The Revenue Divisional Officer, Tirupati has fixed responsibility on three Officers, viz., (1) Sri B.Ravichandra Babu, VRO, Peddakannali Village, Thottambedur Mandal; (2) Sri P.Venkataprakasam, VRO, Diguvapudi Village, K.V.B.Puram Mandal;and (3) Sri P.Balasankaraish, VRO, Kikkambakam Village, Buchinaidukandriga P.T.O.:: 2 :: Mandal, who worked during the particular periods for making false entries in the records and for issue of false extracts of 10(1) and Adangal for the Sy.No.30/3 of Basavaiahpalem Village, Thottambedu Mandal. Notices were issued to them calling for their explanations. Since, no explanations were received from any of them, the three Village Officers were suspended from service vide Roc.No.A7/ 3370/2007, Dt.04-02-2008. Charges were framed against the three Village Officers vide Roc.A7/3370/2007, Dt.14-04-2008 and subsequently, the R.D.O., Tirupati and the Tahsildar, Thottambedu were appointed as E.O. and P.O. respectively vide Roc.A8/3370/2007, Dated: 27-08-2008 by the District Collector, Chittoor. 2. In the reference first read above, the Revenue Divisional Officer, Tirupati, in his enquiry report Dt.29-06-2009, has reported that Sri P. Venkata Prakasam was the Village Administrative Officer during the crucial fasli 1406 and he worked during the fasli 1401 to 1411 and during his tenure the name of one Sri B. Ramanaiah was entered as enjoyer for the lands and the said Sri P.Venkata Prakasam is held responsible for any entry in the Adangal as the Village Accounts were in his custody from fasli 1401 to 1411, i.e. from the year 1996 and therefore he deserved suitable punishment and further also recommended to impose penalty against Sri P.Balasankaraiah who was the Village Administrative Officer for faslies 1411 to 1415, had signed the abstract of adangals at the time of Jamabandi and had authenticated the wrong entries in the adangal and therefore he was held responsible and accountable for not rectifying the wrong entries made in the adangal; and recommended to drop charges against Sri B.Ravichandra Babu, Village Revenue Officer. 3. In the reference second read above, the Collector, Chittoor District has informed through the Chief Commissioner of Land Administration, that since Sri P.Venkata Prakasam, Village Revenue Officer, Kothapalle Village, Gudipala Mandal was retired from service on 30-06-2008, necessary proposals were submitted to the Government for conclusion of the disciplinary case against him as per Rule-9 of the A.P.R.P.Rules, 1980. In the reference fourth read above, the Collector, Chittoor District has also informed through the Chief Commissioner of Land Administration that since Sri P.Balasankaraiah, formerly Village Revenue Officer, Samaguttapalle, Kuppam Mandal was retired from service on 20-04-2010, necessary proposals were submitted to the Govt. for conclusion of the disciplinary case against him as per Rule-9 of the A.P.Revised Pension Rules, 1980. 4. After receipt of the enquiry report a copy of the Enquiry Report was communicated in terms of Rule 21(4) of the A.P.C.S.(CC&A)Rules, 1991 r/w Rule-9 of the A.P.Revised Pension Rules, 1980 to both the delinquent/ charged officers viz., (1) Sri P.Venkata Prakasam, formerly V.R.O., Kothapalle Village, Gudipala Mandal, retired on 30-06-2008; and (2) Sri P.Balasankaraiah, formerly V.R.O., Samaguttapalle, Kuppam Mandal, retired on 20-04-2010; and they were directed to offer their representations on the findings of the enquiry officer through the reference 5th read above. 5. In the reference 6th read above, the delinquent Sri P.Balasankaraiah, formerly V.R.O., has stated that he had not made any entry in the said village accounts and he may not be held responsible for the charge of preparing false adangals and he was not liable for any penalty as recommended by the Enquiry Officer and requested to drop the charges framed against him. In the reference 7th read above the other delinquent Sri P.Venkata Prakasam, formerly V.R.O. has stated that he is not liable to pay any penalty as the said Sri B. Ramanaiah is the enjoyer of Sy.No.30/3 during the fasli 1401 to 1411 and still he is the enjoyer of the land and therefore requested not to impose any penalty on him. Contd…P-3:: 3 :: 6. After careful examination of the matter keeping in view the findings of the E.O. and the explanations of both the delinquent officers received in the references 6th & 7th read above, which are not convincing, Government have provisionally decided to impose a punishment of a cut of Rs.1,000/- from their gratuity. While informing the said decision, both the delinquent officers were directed to submit their representations as to why the above said punishment should not be imposed against them vide references 8th & 9th read above. Both the delinquent officers submitted their representations through the references 10th & 11th cited. 7. After careful examination of the entire matter keeping in view the findings of the Enquiry Officer and the representations of both the delinquent officers received in the references 10th & 11th read above, which were not convincing, and in consultation with the A.P.Public Service Commission Govt. have decided to confirm the provisional decision i.e., to impose a punishment of a cut of Rs.1,000/- from the gratuity payable to each of the delinquent officers i.e., (1) Sri P.Venkata Prakasam, formerly V.R.O, Kothapalle Village, Gudipala Mandal, who was retired from service on 30-06-2008; and (2) Sri P.Balasankaraiah, formerly V.R.O., Samaguttapalle, Kuppam Mandal, who was retired from service on 20-04-2010. 8. Accordingly, Govt. hereby impose a punishment of cut of Rs.1,000/- from the gratuity due to each of the delinquent officers i.e., (1) Sri P.Venkata Prakasam, formerly Village Revenue Officer, Kothapalle Village, Gudipala Mandal, who was retired from service on 30-06-2008; and (2) Sri P.Balasankaraiah, formerly Village Revenue Officer, Samaguttapalle, Kuppam Mandal, who was retired from service on 20-04-2010. 9. The Collector, Chittoor District is requested to take necessary further action in the matter accordingly.
