GOVERNMENT OF ANDHRA PRADESH ABSTRACT Revenue Department – Establishment – Direct Recruitment to the post of Village Revenue Officers and Village Revenue Assistants – Filling up of vacancies arising out of non-joining of selected candidates by drawing other candidates from out of the merit list – Orders – issued. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - REVENUE (VA) DEPARTMENT G.O.Rt.No. 385 Dated:13.03.2012 Read the following: From the Special Chief Secretary and the Chief Commissioner of Land Administration, A.P., Hyderabad letter No.A2/1236/2010 dated 27.01.2012 <<<>>> O R D E R: The Special Chief Secretary and Chief Commissioner of Land Administration, A.P., Hyderabad, in his letter read above, has sent a proposal seeking permission to keep the merit lists of Village Revenue Officers / Village Revenue Assistants, selected in the recently held recruitment test, alive for a period of one year from the date of publication of the results for filling up of vacancies arising out of non-joining of selected candidates and resignations of newly joined candidates. 2. Government have examined the proposal carefully. The Supreme Court of India, in Gujarat State Deputy Executive Engineer’s Association Vs State of Gujarat has ordered as follows: “A waiting list prepared in an examination conducted by the Commission does not furnish a source of recruitment. It is operative only for the contingency that if any of the selected candidates does not join, then the person from the waiting list may be pushed up and be appointed in the vacancy so caused or if there is some extreme exigency the Government may as a matter of policy decision pick up persons in order of merit from the waiting list” Again the Apex Court, in A.V.Bhogeswarudu Vs Andhra Pradesh Public Service Commission held that; “We accordingly dispose of this appeal by directing that the number of vacancies remaining to be filled up on account of non-joining of selected candidates for whatever reason shall be out of the present list” 3. In terms of the provisions of Rule – 11 (a) of the A.P. State and Subordinate Service Rules a candidate selected for appointment by direct recruitment shall be required to join in the post within 30 days taking the date of dispatch by registered post of the appointment order as crucial date for reckoning the time limit. If he/she does not join the post within the above stipulated period the offer of appointment shall be treated as automatically cancelled and the name of the candidate shall be deemed to have been omitted from the list of selected candidates. 4. Only in the above type of cases of non-joining of selected candidates (VROs/VRAs), to whom offer of appointment has been sent, the vacancy can be offered to the next meritorious candidate of the same roster category in the merit list drawn up on the basis of the recently held recruitment test for Village Revenue Officer / Village Revenue Assistant posts.:: 2 :: 5. Government, accordingly order that notwithstanding anything contained in any other G.O in force the non-joining vacancies remaining unfilled in respect of Village Revenue Officer / Village Revenue Assistant posts notified in December, 2011 shall be filled by drawing candidates of the same roster category in the merit list drawn up on the basis of the recently held (February, 2012) recruitment test.
