ORDER:
On certain allegations, the following charges were framed by the
Deputy Inspector General, Registration & Stamps, Warangal against Sri
K.Komaraiah former Senior Assistant, Registrar Office, Warangal (retired as
Sub Registrar) vide reference 1st read above.
CHARGE-I:
“That after registration of society, the certificate must be handed over
to the person presented for registration i.e. president of society who is
nominee or it can be sent by post on the request of the party. But in
this case, there is no nominee or request made from Rajender to send
the certificate by the post through the same person. There is
circumstantial evidence to prove that the certificate was sent through
a person after knowing that a complaint was made by Sri Rajender for
which Sri K.Komuraiah is held responsible”
CHARGE-II:
“That as In charge of the section, he has demanded two hundred
rupees as bribe in society registration No.459/2005, dated:
05.07.2005 from Sri Rajender”.
2. In reply to the above charges, the Charged Officer submitted his
Written Statement of Defence in the reference 2nd cited read above. After
examination of the written Statement of Defence, a regular inquiry was
ordered by appointing the District Registrar (Audit), Warangal as Regular
Enquiry Officer to inquire into the charges. The Regular Enquiry Officer has
submitted his findings in the reference 3rd read above, holding the Charge-I
as proved and the Charge-II as not proved. The Regular Enquiry Officer’s
report was communicated to the Charged Officer and the Charged Officer
submitted his representation on the findings of the Regular Enquiry Officer in
the reference 5th read above.
3. On the above representation of the Charged Officer, the Deputy
Inspector General, Registration & Stamps, Warangal has sent a report in thereference 6th read above, proposing to impose a penalty of 3% cut in pension
for a period of one year against the Charged Officer under Rule 9 of Andhra
Pradesh Revised Pension Rules, 1980. Finally, the Deputy Inspector General,
Registration & Stamps, Warangal has sent the proposal through
Commissioner & Inspector General for taking further action in the matter
under Andhra Pradesh Revised Pension Rules, 1980.
4. Government after examining the matter in detail, have agreed with the
proposal of the Deputy Inspector General, Registration & Stamps, Warangal
and provisionally decided to impose a penalty of 3% in pension for a period
of one year against Sri K.Komaraiah, Sub Registrar (Retired) under Rule 9 of
Andhra Pradesh Revised Pension Rules, 1980. Accordingly, a show cause
notice was issued to the Charged Officer in the reference 7th read above.
5. In reply to the show cause notice, the Charged Officer has submitted
his explanation in the reference 8th read above, while reiterating his earlier
contents given at the time of submission of explanation to the Charges,
requested the Government to drop the proposals of imposition of 3% cut in
pension for a period of one year. After examining the explanation of the
Charged Officer, Government have observed that the contents raised by the
Charged Officer in his explanation, are the same when he has submitted in
his final written statement of defence, which were already examined earlier.
Therefore, there are no fresh grounds adduced by the Charged Officer to
consider.
6. The Government after careful consideration of the representation
submitted by the Charged Officer, have decided to impose a penalty of 3%
cut in pension for a period of one year against Sri K.Komaraiah, former
Senior Assistant, Registrar Office, Warangal (now retired as Sub Registrar)
for the charges held proved.
7. Therefore, Government hereby impose a penalty of 3% cut in pension
for a period of one year against Sri. K.Komaraiah, Sub Registrar (Retired).
8. The Commissioner and Inspector General, Registration & Stamps
Department, Hyderabad is requested to take necessary further action
accordingly in the matter.
