Prabhakar, Sub-Registrar (Retired), Explanation of the CO dated: 28.09.2010. 9) Letter No.54383/Vig.VI (1)/2009-6., Dated: 24.10.2011. 10) From the Secretary, APPSC, Hyderabad, Lr.No.1697/RT-I/3/2011, dated: 09.12.2011. * * * * * ORDER: On certain allegations, after conducting a preliminary inquiry, the following charges were framed by the Deputy Inspector General, Registration & Stamps, Warangal against Sri A.Prabhakar, former Joint Sub-Registrar-II, Registrar Office, Adilabad (now retired) vide reference 1st cited:- Charge-I: “That Sri A.Prabhakar working as a Joint Sub Registrar-II at Registrar Office, Adilabad has failed to discharge his duties as Officer in faithful manner and with honest. On 21.06.1999, Doc.No.1933/99 to 1935/99 were accepted for Registration and the property involved in the document is quite opposite to his working office. He has not insisted the parties to put forth the correct information in the schedule of the property and blindly registered (3) documents without examination of its genuineness. He failed to obtain the land marks of the property and colluded with the registering parties with a fraudulent view to cause loss of revenue to the Government and also to have monetary benefit from the parties. The property involved in above (3) documents were quite opposite to Registrar Office, Adilabad and located on the adjacent to the National Highway Road. He has violated the provision of Section 21 of Indian Registration Act, 1908 read with Commissioner & Inspector General of Registration & Stamps Circular Memo.No.G1/19464/98, dated 21.09.1998. Due to his carelessness total Government Revenue and he has ignored the item 4(D) of CARD Cir.No.38, dated 22.01.2009.” Charge-II:“That Sri A.Prabhakar, Joint Sub-Registrar-II of Adilabad Registrar Office (OB), Adilabad District has registered Doc.No.2519/99 which was executed by Sri Kanaka Ganesh. As per the report Sri Kanaka Ganesh was holding an agricultural lands in Sy.No.248/1 and 248/2 of Adilabad Revenue (Village). The department has fixed a rate of Rs.100/- per Sq. yard. For the Sy.No.248/1 and 248/2 of Adilabad Revenue (Village). The party has shown Sy.No.248 and alienated total land of Ac.5.13 guntas in Doc.No.2519/99. The Joint Sub-Registrar-II Sri A.Prabhakar has failed to compare the Sy. Nos. with reference to the pattadar pass books, and it is not known whether the party has produced the pass books for attesting the signatures of the registering officer and also for verification of the records. He was very careless and irresponsible in his discharging his duties as registering officer on account of which he caused loss of total of Rs.2,35,155/- to the Government Exchequer with a fraudulent view to favour the parties concerned.” Charge-III: “That Sri A.Prabhakar, Joint Sub-Registrar-II, Registrar Office (OB), Adilabad District has accepted the Doc.Nos.441/99 & 442/99 for registration without causing any elaborate enquiries to elicit the facts from the registering parties. He has colluded with the Document Writer and Purchaser for gaining monitory benefit from the Purchaser. In the schedule of the property the Document Writer has written the total measurement in the mode of square feet. The Sub-Registrar without examining the facts, he has simply registered the document. Thus he intentionally caused provisional loss of Rs.26,420/- in both the documents.” Charge-IV: “That Sri A.Prabhakar, Joint Sub Registrar-II, Registrar Office (OB), Adilabad District was very irresponsible in discharging his duties. He spoiled the image of the post as well as the department and he has violated Rule 3 of Andhra Pradesh Civil Services (Conduct) Rules, 1964.” 2. After examining the Written Defence Statement of the Charged Officer received in the reference 2nd read above, a regular enquiry was ordered by the Deputy Inspector General, Registration & Stamps Department, Warangal by appointing the District Registrar, Karimnagar as Regular Enquiry Officer vide reference 3rd read above. 3. Accordingly, the Regular Enquiry Officer submitted his findings, holding the Charges-II & IV are proved vide reference 4th read above. 4. A copy of the Regular Enquiry Officer report was communicated to the Charged Officer, calling for his representations vide reference 5th read above. In the reference 6th read above, the Charged Officer submitted his final written statement of defence on the Regular Enquiry Officer’s report. Since the Charged Officer retired from service, the proposal was sent to the Government for taking further action under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980. 5. After examining the matter in detail, a provisional decision was taken to impose a punishment of withholding 5% in pension permanently on Sri A.Prabhakar, Sub-Registrar (Retired) under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980. Accordingly, a show cause notice was issued to the Charged Officer vide reference 7th read above. 6. In reply to the show cause notice, the Charged Officer has not submitted his explanation within time limit of 15 days though he has receivedthe Show Cause Notice on 15.07.2010. However the Deputy Inspector General, Registration & Stamps Department, Karimnagar by his Letter No.S/281/2008, dated 21.12.2010 has forwarded a representation of the Charged Officer dated 28.09.2010 wherein he has stated that O.A.No.2885/2010 was filed by him challenging the Enquiry Report and that once the very Enquiry Report including charge memo is under challenge for seeking to set-aside the same, and therefore at this stage to proceed with it, is not within the jurisdiction of this honorable Authority, except this no point has been raised by him rebutting the charge leveled against him neither pointing out any deficiencies in the process of enquiry conducted against him. In his explanation he has also not brought to record any interim orders passed by Andhra Pradesh Administrative Tribunal prohibiting the Government to pass order pursuant to the Show Cause Notice issued in the reference 7th cited. 7. In view of the above and after examining the enquiry report, Government have decided to confirm the provisional punishment of withholding 5% of pension permanently on Sri A.Prabhakar, Sub Registrar (Retired). Therefore, a penalty of withholding 5% of pension permanently is hereby imposed on Sri A.Prabhakar, Sub Registrar (Retired). 8. The Deputy Inspector General, Registration & Stamps Department, Karimnagar is requested to take necessary further action accordingly in the matter.
