ORDER:-
In the reference 2nd read above, the Commissioner of Survey,
Settlements & Land Records, A.P., Hyderabad has stated that Sri P.Sankar,
while working as Office Subordinate was expired on 11.4.2007. Sri
P.Sadanand the eldest son of the deceased has submitted an application on
3.7.2007 within the period of one year from the date of demise of the
employee and stated that he studied up to 5th Class. The application of Sri
P.Sadanand were examined for relaxation of Educational Qualification and it
was not rejected. In the meanwhile, the wife of deceased has submitted
another representation dated 8.1.2010 along with ‘No Objection’ in the form
of an affidavit from Notary stating that her elder son Sri P.Sadanand has
left the house and living separately. Therefore, she has requested to
provide appointment on compassionate grounds to her second son Sri
P.Viswanath, who passed 7th Class and completed the age of 18 years and
11 months. But the request was received on 08.01.2010 after 2 years from
the death of his father on 11.04.2007.
2. The Commissioner of Survey, Settlements & Land Records, A.P.,
Hyderabad has further stated that as per the clarification issued at Sl.No.3
& 4 of Annexure to the Government Memo.No.529/G1/ 75-8, dated
19.8.1975. It should not matter if a son has divided himself from the family
and he is already employed. If the family is without a bread winner, one
son/daughter out of the remaining or the wife may be given a job. The
Commissioner of Survey, Settlements & Land Records, A.P., Hyderabad has
requested the Government to clarify whether the second application for
appointment of the 2nd son can be treated as made in time and considered
for appointment.
3. Government after careful examination of the matter hereby accord
permission to the Commissioner of Survey, Settlements & Land Records,
A.P., Hyderabad for providing compassionate appointment to second son of
Late Sri P.Shankar, Office Subordinate who died in harness while in service
namely Sri P.Viswanath, as Office Subordinate subject to availability of
Direct Recruitment Vacancy by following Rule of Reservation and by taking
into consideration the date of application on 03-07-2007 of elder son Sri
P.Sadanand as the date of application of W/o Late P.Shankar, since elder
son has submitted application within the stipulated period of one year from
the date of death of his father and he has left the house and living
separately, duly relaxing the para-2 of G.O.Ms.No.687, GA (Ser.A)
Department, Dt:03.10.1977 relating to submission of application within a
P.T.O.
-2-period of one year from the date of death of the employee, who died while
in service under the scheme of compassionate appointment, as a special
case, without quoting it as a precedent in future.
4. The Commissioner of Survey, Settlements & Land Records, A.P.,
Hyderabad shall take necessary further action in the matter accordingly.
