ORDER:
The Director General of Police, Andhra Pradesh, Hyderabad in his letter read
above, for the reasons mentioned therein, based on the report of the Superintendent of
Police, Warangal District has recommended for withdrawal of prosecution against the
accused person Sri Pothula Laxman, S/o Komuraiah, r/o Neckonda, in Cr.No.
39/2010 of Neckonda Police Station, under sections 295 and 427 of the Indian Penal
Code, 1860 pending before the Hon’ble Judicial First Class Magistrate Court,
Narsampet, vide CC No.397/2010;
2. The Government after careful examination of the matter, have decided to
instruct the Collector and District Magistrate, Warangal District to request the Assistant
Public Prosecutor concerned to initiate immediate action in accordance with law for
Withdrawal of the prosecution under section 321 of the Code of Criminal Procedure,
1973 ( Central Act 2 of 1974) and guidelines issued in G.O.Ms.No.54, LAW (LA&J-
Home Courts-B) Department Dated: 30.03.2000, against the accused person
mentioned in para (1) above, in Cr.No.39/2010 of Neckonda Police Station, under
sections 295, 427 of the Indian Penal Code, 1860 pending before the Hon’ble Judicial
First Class Magistrate Court, Narsampet, vide CC No.397/2010, under intimation to the
Government.
