O R D E R:
In the reference second and fourth read above, the Commissioner of Prohibition
& Excise, Andhra Pradesh, Hyderabad has stated that Sri Kuchinapudi Durga Rao,
S/o.Pothuraju, R/o.Avanigadda, was appointed as Night Watchman, Arrack Depot,
Avanigadda vide Tahsildar, Divi. Avanigadda proceedings L.Dis.7673/74, dt:29.8.1974
and he joined duty as Night Watchman on 1.9.1974, and the services of the individual
was converted into regular last grade service in terms of G.O.Ms.No.9, Fin. & Plg.
(FW:PRC-VI) Dept., Dt:18.1.1981 w.e.f. 1.4.1981 vide Excise Superintendent, Krishna
Machilipatnam proceedings Rc.No.6777/82, Dt:20.11.1982. The Service of the
individual in the cadre of last grade service i.e. Watchman in Government Arrack
Depot, has been regularized w.e.f. 1.4.1981 and his probation was declared,
satisfactorily w.e.f. 31.3.1983 A.N vide Excise Superintendent, Krishna proceedings
Rc.No.7201/83/A1, Dt:27.11.1983. As per the report of Proh. & Excise
Superintendent, Machilipatnam, Sri Kuchinapudi Durga Rao, worked in Prohibition &
Excise Station, Avanigadda upto 17.5.1999 and later he went to Vijayawada to get
medicines due to ill-health and disappeared w.e.f. 18.5.1999 and he has not returned
back so far. The Avanigadda Police have enquired into the matter and certified that
the individual was missing from 28.05.1998 and treated the case as undetectable on
8.4.2004. Hence closed the case. The Asst. Prohibition and Excise Superintendent,
Machilipatnam conducted enquiry into the contents of the case and recommended for
compassionate appointment.
2. The Commissioner of Prohibition & Excise, Andhra Pradesh, Hyderabad has
requested the Government to communicate suitable orders on the request of
Smt.K.Laxmi, W/o K. Durga Rao, Watchman, Krishna District for compassionate
appointment to her son as per the provisions of G.O.Ms.No.378, General
Administration (Ser.A) Department, dated:24.8.1999.
3. Government have examined the matter and observe that as per the FIR and
the Certificate issued by Police, Smt. K.Lakshmi, wife of the deceased employee has
filed FIR with Avanigadda Police on 07.08.2003 stating that her husband was missing
since 18.05.1998. The prescribed period of 7 years from the date of filing of FIR with
police was completed on 06.08.2010. The date of birth of the missing Government
employee is 16.07.1952 and his date of superannuation would be 31.07.2012, as such
the missing employee has more than (7) years of service from the date of filing of
FIR. Smt. K. Lakshmi wife of the deceased employee has submitted her application
for providing compassionate appointment to her son, Sri K.Srinivas on 02.08.2011
i.e., within a period of one year, from the date of completion of 7 years from the date
of filing of FIR with police. Sri K.Srinivas has passed Intermediate in March, 2008 and
his date of birth is 15.07.1988 and his age is 22 years as on 06.08.2010 i.e., the date
of completion of 7 years from the date of filing of FIR with Police.

4. Government, after careful examination of the matter have decided to consider
the request of Smt. K.Lakshmi, W/o. Sri K.Durga Rao, Watchman, Proh. & Excise
Station, Avanigadda, Krishna District, whose whereabouts are not known since
18.05.1998 for providing appointment to her son, Sri K. Srinivas on compassionate
grounds.
5. Accordingly, the Commissioner of Proh. & Excise, A.P., Hyderabad is hereby
permitted to provide appointment to Sri K. Srinivas, S/o.Sri K.Durga Rao, Watchman,
Proh. & Excise Station, Avanigadda, Krishna District on compassionate grounds
subject to satisfying the conditions prescribed in G.O.Ms.No.378, G.A.(Ser.A) Dept.,
dt.24.08.1999 and also fulfilling all other conditions of the scheme of compassionate
appointment.
6. The Commissioner of Proh. & Excise, A.P., Hyderabad shall take necessary
action accordingly.
