Vizianagaram District – Withdrawal of prosecution against the 59 Teachers in
Cr.No.168/2008, under sections 341, 186 read with section 34 of the Indian Penal
Code, 1860 of Vizianagaram I-Town Police Station pending before the Hon’ble
Addl.Judicial First Class Magistrate Court, Vizianagaram, vide CC No.538/2008 –

ORDER:
The Andhra Pradesh Teachers’ Federation in the letter 1st read above, have
represented that as per the call given by the Andhra Pradesh JACTO, some of the
Teachers of Vizianagaram District participated in picketing before the Collectorate,
Vizianagaram on 27.06.2008 to protest against the introduction of CBSE syllabus from
6th and 7th Classes. Accordingly, a case has been registered by the the Vizianagaram
I-Town Police Station, vide Cr.No.168/2008 and charge sheet was also filed against
the Teachers. Further they represented that, in a similar case, Government in
G.O.Rt.No.1895, Law (L.A. & J – Home – Courts-B) Dept., Dated:18.11.2009 have
ordered for withdrawal of prosecution against the Teachers in Cr.No.117/2007, which
was pending before the Hon’ble Court vide CC No.828/2007. They have therefore
requested to withdraw prosecution against the Teachers in Cr.No.168/2008 pending
before the Addl.Judicial First Class Magistrate Court, Vizianagaram, vide CC
No.538/2008.
2. The Director General of Police, Andhra Pradesh, Hyderabad in the letter 3rd
read above, for the reasons mentioned therein, based on the report of the
Superintendent of Police, Vizianagaram and the opinion of the Legal Advisor,
Vizianagaram has recommended for withdrawal of prosecution against the following 59
Teachers in Cr.No. 168/2008, under sections 341, 186 read with section 34 of the
Indian Penal Code, 1860 (Central Act 45 of 1860) of Vizianagaram I-Town Police
Station pending before the Hon’ble Addl.Judicial First Class Magistrate Court,
Vizianagaram, vide CC No.538/2008;

3. The Government after careful examination of the matter, have decided to
withdraw prosecution against the 59 Teachers mentioned in para (2) above, in
Cr.No.168/2008, under sections 341, 186 read with section 34 of the Indian Penal
Code, 1860 (Central Act 45 of 1860) of Vizianagaram I-Town Police Station pending
before the Hon’ble Addl.Judicial First Class Magistrate Court, Vizianagaram, vide CC
No.538/2008.
4. The Collector and District Magistrate, Vizianagaram District is therefore directed
to instruct the Assistant Public Prosecutor concerned to apply his mind and take
appropriate steps to file a petition under section 321 of the Code of Criminal
Procedure, 1973 (Central Act 2 of 1974) for withdrawal of prosecution against the 59
Teachers mentioned in para (2) above, in Cr.No. 168/2008, under sections 341, 186
read with section 34 of the Indian Penal Code, 1860 (Central Act 45 of 1860) of
Vizianagaram I-Town Police Station pending before the Hon’ble Addl.Judicial First
Class Magistrate Court, Vizianagaram, vide CC No.538/2008, under intimation to the
Government
