Order of detention in Rc.No.C1/M/40/2012, dt.11-01-2012 of the Collector & District Magistrate, East Godavari District, Kakinada 2. G.O.Rt. No.339,G.A. (L&O.II) Dept., dated 21-01-2012. 3. From the Advisory Board, Report, dated: 10-02-2012. *** ORDER: WHEREAS the Collector & District Magistrate, East Godavari District, Kakinada has made an order of detention, vide reference first read above under section 3 (1) & (2) of the Andhra Pradesh Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act, 1986 (Act No.1 of 1986) in respect of Smt. Bodapati Simhachalam @ Chilakamma, W/o. Arjuna Rao, Aged 43 years, R/o. Ambedkarnagar, Rajahmundry, East Godavari District., who had been indulged in ‘boot legging’ activities for possession, transportation of I.D. liquor for the purpose of sale/distribution in contravention of A.P. Prohibition (Amendment) Act,1997, with a view to prevent her from further indulging in a manner prejudicial to the maintenance of public order; 2. AND WHEREAS the Government accorded approval to the said detention order under sub-section (3) of section 3 of the Act, vide Government Orders second read above; 3. AND WHEREAS the Advisory Board on Preventive Detentions, constituted under section 9 of the said Act, comprising of Justice Sri T.L.N. Reddy (Retired), Chairman and two other Members, reviewed the case on 10-02-2012 and after having heard the detenu, her aunt, Smt. Veamana Subbalakshmi and the Investigating Officers and also upon perusing the grounds of detention and the connected records, has reported that in its opinion “there is sufficient cause for the detention of the detenu, Smt. Bodapati Simhachalam @ Chilakamma, W/o. Arjuna Rao, Aged 43 years, R/o. Ambedkarnagar, Rajahmundry, East Godavari District District.” 4. WHEREAS, the Govt. on careful examination of the entire record, it is observed that the detenu, Smt. Bodapati Simhachalam @ Chilakamma was involved 6 (six) cases viz. 1) Cr.No.195/2011-12, dt. 20-6-2011, 2) Cr. No. 311/11-12, dt.1-8-2011, 3) Cr.No.388/11-12, dt. 6-9-2011, 4) Cr.No. 490/11-12, dt. 17-10-2011, 5) Cr.No. 540/11-12, dt. 31-10-2011 and 6) Cr.No.633/11-12, dt. 27-11-2011 of Rajahmundry North, Prohibition & Excise Station and in all the cases she was caught red handed while in possession and transportation I. D liquor for the purpose of sale and all the said cases were registered against her under section 7-A r/w. sec.8(e) of A.P. Prohibition (Amendment) Act,1997 by the Prohibition & Excise Police. The Government Chemical Examiner, who had examined the samples of contraband seized has reported that “the samples are illicitly distilled liquor,(pto) -2- unfit for human consumption and injurious to health., as it contain Fusel Oil and Acids etc. It is further observed that though the individual was arrested and sent to judicial custody, she did not mend his activities, and even after her release on bail, she repeatedly resorted to similar offences of possession and transportation of I.D. liquor, which is unfit for human consumption and injurious to public health. The detaining authority, having taken into consideration, the ill effects of I.D. liquor on the general public health and public order, has passed the order of detention, in order to prevent her from further indulging in such offences in the interest of public at large by invoking the provisions under Act 1 of 1986. The object of the Act, is to prevent recurrence of the offences, which affect the public health and public order. As such, the detenu deserves for detention for a maximum period as provided under sec. 13 of the Act. 4. NOW, THEREFORE, after due consideration of the report of the Advisory Board and the material available on record, Government, in exercise of the powers conferred under sub-section (1) of section 12 read with section 13 of the said Act, hereby confirm the order of detention made by the Collector & District Magistrate, East Godavari District, Kakinada, in the ref. 1st read above and direct that the detention of Smt. Bodapati Simhachalam @ Chilakamma, W/o. Arjuna Rao, Aged 43 years, R/o. Ambedkarnagar, Rajahmundry, East Godavari District, be continued for a period of 12 months from the date of her detention, i.e. 19-01-2012.
