193(अ).—उपजवजधयों का प्रारूप, अर्ाात् सागर छावनी बोड ा ठोस अपजिष्ट प्रबंधन उपजवजध, 2024 भारत सरकार के रक्षा मंत्रालय द्वारा का.जन.आ 57(अ) तारीख 24 िलु ाई, 2024 के द्वारा भारत के रािपत्र असाधारण, भाग 2, खंड 4 म,ें उससे प्रभाजवत होन े वाल े व्यजियों स े आपजियााँ और सझु ाव आमंजत्रत करने हते ,ु उस तारीख स े तीस दिन की अवजध के अवसान स े पूवा जिस तारीख को उि अजधसूचना को अतं र्वाष्ट करने वाली रािपत्र की प्रजतयााँ िनता को उपलब्ध कराई गई र्ी, प्रकाजित दकया गया र्ा; और, उि अजधसूचना को अंतर्वाष्ट करन े वाली रािपत्र की प्रजतया ाँ िनता को सागर छावनी बोडा की अजधकाररक वेबसाइट पर 29 अगस्ट्त, 2024 को और नोरटस बोड ा पर 29 अगस्ट्त, 2024 को उपलब्ध कराई गई र्ी। और स्ट्र्ानीय समाचार पत्रों म ें भी 29 अगस्ट्त, 2024 को प्रकाजित हुई र्ी। और, िनता स े जवजनर्िाष्ट अवजध के भीतर प्राप्त आपजियों या सुझावों पर बोड ा द्वारा जवचार दकया गया और छावनी बोडा समाधान पररपत्र कायासूची स0ं 01 तारीख 30 जसतम्बर, 2024 द्वारा उनका उपयुि रूप स े जनपटान दकया गया। अब, इसजलए सागर छावनी बोडा, ठोस अपजिष्ट प्रबंधन जनयम, 2016 के जनयम 15 के सार् परठत छावनी अजधजनयम, 2006 (2006 का 41) की धारा 348 द्वारा प्रिि िजियों का प्रयोग करत े हुए केंद्रीय सरकार के अनुमोिन स े जनम्नजलजखत उपजवजधयां बनाता ह,ै अर्ाात:् - 7516 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] अध्याय I साधारण 1. संजक्षप्त नाम और प्रारंभ- (1 ) इन उपजवजधयों का संजक्षप्त नाम सागर छावनी बोडा ठोस अपजिष्ट प्रबंधन उपजवजधयां, 2024 ह।ै (2 ) य ेरािपत्र म ेंउनके प्रकािन की तारीख को प्रवृि होंगे। 2. लागू होना - य ेउपजवजधयां सागर छावनी की क्षेत्राजधकार सीमाओं के भीतर लागू होंगी। 3. पररभाषाए-ं (1) इन उपजवजधयों, म ें िब तक दक संिभ ा स ेअन्यर्ा अपेजक्षत न हो, - (क ) “अजधजनयम” स ेछावनी अजधजनयम, 2006 (2006 का 41) अजभप्रेत ह;ै (ख ) “बोडा” स े सागर छावनी बोडा अजभप्रेत ह;ै (ग ) "उद्यान और बागवानी अपजिष्ट ढरे ” स े उपवनों तर्ा बगीचों स े अपजिष्ट का ढेर, जिसम ें घास की कतरन, खरपतवार, ‘ब्राउन' काबान युि सामग्री िैस े छंटाई, िाखाएं, टहजनयााँ, लकडी की छीलन, पुआल (स्ट्रा), सूखे पिे, पडे ों की कांट-छांट और ऐस े अन्य अपजिष्ट िाजमल ह,ैं जिन्ह ें िैव -अवकषाणीय अपजिष्ट के जलए िैजनक संग्रहण प्रणाली म ेंसमायोजित नहीं दकया िा सकता अजभप्रेत ह;ै (घ ) "अपजिष्ट ढेर उत्पािक" का वही अर् ा होगा िो ठोस अपजिष्ट प्रबंधन जनयम, 2016 के जनयम 3 के उप जनयम (1) के खंड 8 म ें दिया गया ह ै और मुख्य कायाकारी अजधकारी द्वारा समय-समय पर अजधसूजचत कोई अन्य अपजिष्ट उत्पािक ह;ै (ड ) "संग्रहण" स े अपजिष्ट उत्पािक के स्रोत, सग्रं हण स्ट्र्ल या दकसी अन्य स्ट्र्ान स े ठोस अपजिष्ट को उठाना तर्ा हटाना अजभप्रेत ह;ै (च ) "सक्षम प्राजधकारी" स े बोड ा का मुख्य कायाकारी अजधकारी या उसके द्वारा प्राजधकृत कोई अन्य व्यजि अजभप्रेत ह;ै (छ ) "सजिमााण और जवध्वंस अपजिष्ट" का वही अर्ा होगा िो जनमााण और जवध्वंस अपजिष्ट जनयम,2016 के जनयम 3 के उप जनयम (1) के खंड (ग) म ेंउसे दिया गया ह;ै (ि ) "स्ट्वच्छ क्षत्रे " स े दकसी पररसर के सामने या उसके चारों ओर या उससे लगा हुआ कबा साइड तक जवस्ट्ताररत सावािजनक स्ट्र्ान अजभप्रेत ह ै तर्ा इन उपजवजधयों के अनुसरण म ें स्ट्वच्छ और अनरु जक्षत नाले, पगडडं ी और कब ा भी िाजमल ह;ै (झ ) "सामुिाजयक अपजिष्ट भंडारण पात्र" स,े यर्ाजस्ट्र्जत, बोड ा या एक या इससे अजधक पररसरों के स्ट्वाजमयों या अजधभोजगयों, रीजत म,ें द्वारा अपने पररसरों म ें सामूजहक रूप स े सडक के दकनारे या ऐसे दकसी एक स्ट्वामी या अजधभोगी के पररसर म ें पृर्क्कृत रीजत म ें ठोस अपजिष्ट के भडं ारण के जलए सक्षम प्राजधकारी द्वारा प्राजधकृत दकसी एक पररसर म ें स्ट्र्ाजपत और अनुरजक्षत भडं ारण सुजवधा (जिसे इसम ें इसके पश्चात ढलाव कहा गया ह)ै अजभप्रेत ह;ै (ञ ) "कंटेनर रूपी हर्ठेला" स े ठोस अपजिष्ट स्ट्र्लों स े उसके संग्रहण के जलए बोडा या उसके द्वारा जनयुि अजभकरण या अजभकता ा द्वारा प्रिान दकया गया हर्ठेला अजभप्रेत ह;ै (ट ) "पररिान" स े बोडा के कमाकार को दकसी प्रवगा का ठोस अपजिष्ट सौंपना या ऐसे अपजिष्ट का पररिान लेन े के जलए बोड ा द्वारा जनयिु , प्राजधकृत या अनुज्ञप्त कोई अन्य व्यजि या ऐसा करन े के जलए इसके द्वारा या बोडा द्वारा कोई अन्य प्राजधकृत, अजभकरण या अनुज्ञातधारी द्वारा प्रिान दकए गए दकसी वाहन म ें उसे िमा करना अजभप्रेत ह;ै (ठ ) "ई-अपजिष्ट" का वही अर्ा होगा िो ई-अपजिष्ट (प्रबंधन) जनयम, 2016 के जनयम 3 के उप जनयम (1) के खंड (ि) म ें उस े दिया गया ह;ै (ड ) "दिक्सड कॉम्पेक्टर अतं रण स्ट्टेिन" स े पर्ृ क्कृत ठोस अपजिष्ट को िबाने के जलए जडिाइन की गई और प्रचालन के िौरान जस्ट्र्र रहन े वाली एक िजििाली मिीन अजभप्रेत ह ै तर्ा प्रचालन के िौरान कॉम्पेक्टर गजतिील भी रह सकता ह,ै जिसे मोबाइल अंतरण स्ट्टेिन कहा िा सकेगा;[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 3 (ढ ) "कूडा" स े इन उपजवजधयों के अधीन यर्ा प्रजतजषद्ध समस्ट्त अवजिष्ट और इसम ें सजम्मजलत िेंका गया या िमा दकया गया कोई भी अन्य अपजिष्ट पिार्ा, िो दकसी भी व्यजि, िानवर, पयाावरण या सावािजनक स्ट्वास्ट््य, सुरक्षा और कल्याण के जलए बाधा या खतरा उत्पि कर सकता ह,ै अजभप्रेत ह;ै (ण ) "कूडा िेंकना" स े दकसी ऐस े स्ट्र्ान पर कूड े का ढरे लगाना जिससे कूडा जगरे, जखसके, उडे, धुल,े टपके अन्यर्ा िषे रह े या जगरन,े िैलने, उडने, धुलने, टपकने या अन्यर्ा िेष रहने की संभावना हो या दकसी खुले या सावािजनक स्ट्र्ान पर कूडा डालने, रखन,े िबाने की अनुमजत िने ा या अनज्ञु प्त करना अजभप्रेत ह;ै (त ) "स्ट्वामी" स े कोई भी व्यजि दकसी भी भवन, या भूजम या उसके दकसी भाग पर माजलकाना अजधकारों का प्रयोग करता ह,ै अजभप्रेत ह;ै (र् ) "अजधभोगी" स े िो कुछ भी प्रयोिन हो, दकसी भूजम या भवन या उसके दकसी भाग का अजधभोग या कब्िा करने वाला व्यजि तर्ा इसम ें कुछ समय के जलए उपयोग करने वाला कोई व्यजि भी िाजमल ह,ै अजभप्रते ह;ै (ि ) "गोली बनाना" स े वह प्रदिया अजभप्रेत ह ै जिसम ें ठोस अपजिष्ट स े छोटी घन या बेलनाकार टुकडे वाली गोली बनाई िाती ह ैतर्ा इसम ें ईंधन गोली भी िाजमल ह ैंजिन्ह ें अवजिष्ट िजनत ईंधन भी कहा िाता ह;ै (ध ) "सावािजनक स्ट्र्ल" स े िनता के उपयोग और मनोरंिन के जलए कोई खुला स्ट्र्ान, चाह े वह िनता द्वारा वास्ट्तव में उपयोग दकया िाए या नहीं, अजभप्रेत ह;ै (न ) "भंडारण" स े ठोस अपजिष्ट का अस्ट्र्ाई समाजवष्ट इस रीजत म ें दकया िाना अजभप्रेत ह ै जिससे कूडा िेंकना, रोगवाहक कीटाणुओं, आवारा पिओंु और अत्यजधक िगु ंध स े बचाव संभव हो; (प) "सिाई कमाकार" स े ठोस अपजिष्ट के संग्रहण या उसे हटाने या सागर छावनी क्षत्रे म ें नाजलयों की सिाई के जलए बोड ा या इसके द्वारा प्राजधकृत अजभकरण द्वारा जनयोजित व्यजि अजभप्रेत ह;ै (ि ) "अनुसूची" स ेइन उपजवजधयों स े उपाबद्ध अनुसूची अजभप्रेत ह;ै (ब ) "उपयोिा िीस या प्रभार" स े सक्षम प्राजधकारी के साधारण या जविेष आििे द्वारा ठोस अपजिष्ट संग्रहण, ढुलाई, प्रसंस्ट्करण और जनपटान सेवाओं के जलए पणू ा या आंजिक लागत को पूरा करने के जलए अपजिष्ट उत्पािकों पर समय-समय पर बोडा द्वारा अजधरोजपत िीस या प्रभार अजभप्रेत ह;ैं और (भ ) "खाली प्लॉट" स े दकसी व्यजि या जनजि अजभकरण या सरकारी अजभकरण या सरकारी जवभाग या सावािजनक उपिम के प्रबंधनाधीन या उसके पास कोई भूजम या खुला स्ट्र्ान ह ै जिस पर कोई कब्िा नहीं ह,ै अजभप्रेत ह;ै (2 ) प्रयुि िब्ि और अजभव्यजिया ं जिन्ह ें इसम ें पररभाजषत नहीं दकया गया ह,ै उनका वही अर् ा होगा िो छावनी अजधजनयम, 2006, ठोस अपजिष्ट प्रबधं न जनयम, 2016 तर्ा जनमााण और जवध्वंस अपजिष्ट प्रबधं न जनयम, 2016 म ें िी गई पररभाषा म ेंउन्ह ें दिया गया ह।ै अध्याय 2 ठोस अपजिष्ट का पर्ृ क्करण और प्रार्जमक भंडारण 4. स्रोत पर ठोस अपजिष्ट का पृर्क्करण और भडं ारण- (1) सभी अपजिष्ट उत्पािकों का यह कताव्य होगा दक वे अपन े िजमक स्ट्र्ानों स े जनयजमत रूप स े जनकलन े वाले ठोस अपजिष्ट का तीन चरणों म ें पर्ृ क्करण और भंडारण करें, अर्ाात:- (क ) अिैव-अवकषाणीय या सूखा अपजिष्ट; (ख ) िैव-अवकषाणीय या गीला अपजिष्ट; (ग ) घरेलू पररसंकटमय अपजिष्ट और इस े ढके हुए कूडािानों म ें िमा करना, और बोड ा द्वारा समय-समय पर िारी जनिेिों के अनुसार पर्ृ क्कृत अपजिष्ट को अजभजहत अपजिष्ट संग्रहकता ाको सौंपना। (2 ) प्रत्येक ढेर अपजिष्ट उत्पािक को अपन े स्ट्र्ानों से जनकलन े वाले ठोस अपजिष्ट का तीन चरणों म ें पृर्क्करण तर्ा भंडारण करना होगा, अर्ाात:- (क ) अिैव-अवकषाणीय या सूखा अपजिष्ट;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (ख ) िैव-अवकषाणीय या गीला अपजिष्ट; (ग ) पररसंकटमय अपजिष्ट को उपयुि कूडािानों और पर्ृ क्कृत अपजिष्ट को बोड ा द्वारा समय-समय पर जवजनर्िाष्ट ढुलाई प्रभार के संिाय द्वारा प्राजधकृत अपजिष्ट सग्रं हण अजभकरण के माध्यम स े प्राजधकृत अपजिष्ट प्रसंस्ट्करण या जनपटान सुजवधाओं या िमा केंद्रों को सौंपना। (3 ) पृर्क्कृत अपजिष्ट के भंडारण के जलए िैव-अवकषाणीय अपजिष्ट के कूडािानों का रंग हरा, अिैव- अवकषाणीय या सूख े अपजिष्ट के कूडािानों रंग नीला और घरेल ू पररसंकटमय अपजिष्ट के कूडािानों का रंग काला होगा। (4 ) सभी आवासीय कल्याण और बािार संगम बोड ा के सार् भागीिारी स े उत्पािकों द्वारा स्रोत पर अपजिष्ट का पृर्क्करण सुजनजश्चत करेंगे, पर्ृ क्कृत अपजिष्ट के संग्रहण के जलए अलग-अलग चरणों को सुकर बनाएंग,े ररसाइदकल योग्य सामग्री को प्राजधकृत कूडा बीनन े वाले या प्राजधकृत ररसाइदकल प्रदिया करने वालों को सौंपगें े। (5 ) िहा ं तक संभव हो, िैव-अवकषाणीय कूड े का प्रसंस्ट्करण, उपचार और जनपटान पररसर के भीतर कंपोजिटटंग या िैव-जमर्ेनीकरण के माध्यम स े दकया िाएगा तर्ा अवजिष्ट कचरा, बोडा द्वारा जनिेजित अपजिष्ट संग्रहकता ा या अजभकरण को प्रिान दकया िाएगा। (6 ) सभी गेटबंि समुिायों और 5,000 वगामीटर स े अजधक क्षत्रे िल वाली संस्ट्र्ाएं, बोड ा के सार् भागीिारी स े उत्पािकों द्वारा स्रोत पर अपजिष्ट का पर्ृ क्करण सुजनजश्चत करेंग;े पर्ृ क्कृत अपजिष्ट के संग्रहण हते ु अलग-अलग चरणों को सुकर बनाएंग,े ररसाइदकल योग्य सामग्री प्राजधकृत कूडा बीनन े वाल े या प्राजधकृत ररसाइदकल प्रदिया करने वालों को सौंपेंगे। (7 ) सभी होटल और रेस्ट्तरां बोड ा के सार् भागीिारी स े स्रोत पर अपजिष्ट का पृर्क्करण सुजनजश्चत करेंग,े पृर्क्कृत अपजिष्ट के सग्रं हण के जलए अलग-अलग चरणों को सुकर बनाएंगे, ररसाइदकल योग्य सामग्री को प्राजधकृत कूडा बीनने वाले या प्राजधकृत ररसाइदकल प्रदिया करन े वालों को सौपेंगे। (8 ) कोई भी व्यजि, कम स े कम तीन काय ा दिवस पहल े पहली अनसु ूची म ें जवजनर्िाष्ट उपयोिा िीस के संिाय सजहत बोडा को ऑनलाइन या भौजतक रूप स े सूजचत दकए जबना गैर अनुज्ञप्त, दकसी भी स्ट्र्ान पर सौ स े अजधक व्यजियों को इकट्ठा करते हुए समारोह या कायािम आयोजित नहीं करेगा और ऐसा व्यजि या ऐसे समारोह के आयोिक स्रोत पर अपजिष्ट का पृर्क्करण सुजनजश्चत करेगा तर्ा बोड ा द्वारा जनिेजित अपजिष्ट संग्रहण या अजभकरण को पृर्क्कृत अपजिष्ट सौंपगे ा। (9 ) प्रयुि स्ट्वच्छता अपजिष्ट को इन उत्पािों के जवजनमााताओं या ब्रांड स्ट्वाजमयों द्वारा उपलब्ध कराए गए पाउच या समाचारपत्र या उपयुि िैव-अवकषाणीय रैपपगं सामग्री म ें सुरजक्षत तरीके से लपेटा िाता ह ै और इस े अिैव- अवकषाणीय या सूखे अपजिष्ट के जलए रखे हुए कूडािानों म ेंडाला िाता ह।ै (10 ) प्रत्येक िेरीवाला अपन े दियाकलापों िैसे खाद्य अपजिष्ट, त्याज्य (जडस्ट्पोिेबल) प्लेट, कप, कैन, रैपर, नाररयल के खोले, िेष बचा भोिन, सजब्िया ं या िल स े उत्पाद्य पर्ृ क्कृत अपजिष्ट के भडं ारण के जलए उपयुि पात्र रखेगा और ऐसे अपजिष्ट को बोडा द्वारा यर्ा अजधसूजचत अपजिष्ट भंडारण जडपो या कंटेनर या वाहन म ें िमा करेगा। (11 ) उद्यानों के उत्पािक और पररसरों स े उत्पि बागवानी अपजिष्ट को पररसर स्ट्वामी स्ट्वय ं अपने पररसर म ें अलग- अलग भडं ाररत करेगा और बोड ा द्वारा समय-समय पर िारी जनिेिों अनुसार इसका जनपटान करेगा। (12 ) घरेल ू पररसंकटमय अपजिष्ट का भंडारण दकया िाएगा और प्रत्येक अपजिष्ट उत्पािक द्वारा इस े बोडा या इसके द्वारा प्राजधकृत दकसी अन्य अजभकरण या मध्य प्रििे राज्य सरकार या मध्य प्रिेि राज्य प्रिषू ण जनयंत्रण बोडा द्वारा प्राजधकृत ऐसे अपजिष्ट के संग्रहण के जलए समय-समय पर दिए गए आवजधक संग्रहण वाहन को सौंपा िाएगा, या ऐसे अपजिष्ट का जनपटान संग्रहण के जलए जडिाइन दकए गए केंद्र म ें मध्य प्रििे राज्य सरकार या मध्य प्रििे राज्य प्रिषू ण जनयंत्रण बोड ा द्वारा जनिेजित रीजत अनुसार दकया िाएगा। (13 ) संजिमााण और जवध्वंस अपजिष्ट प्रबंधन जनयम, 2016 के अधीन उपबंजधत अनुसार संजिमााण और जवध्वंस अपजिष्ट को अलग स ेभंडाररत तर्ा पररित दकया िाएगा। (14 ) दकसी भी अनुपचाररत िैव-जचदकत्सा अपजिष्ट, ई-अपजिष्ट, पररसंकटमय रसायन और औद्योजगक अपजिष्ट को ठोस अपजिष्ट के सार् जमजित नहीं दकया िाएगा और ऐस े अपजिष्ट का जनपटान पयाावरण (संरक्षण) अजधजनयम, 1986 (1986 का 29) के उपबंधों तर्ा उसके अधीन बनाए गए जनयमों या जवजनयमों के अनुसार दकया िाएगा।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 5 (15 ) अजभजहत बूचडखानों और बािार स े जभि दकसी भी पररसर के प्रत्येक स्ट्वामी या अजधभोगी, िो दकसी भी वाजणजज्यक दियाकलाप के पररणामस्ट्वरूप मगु ी पालन, मछली और बूचडखाना अपजिष्ट के उत्पािक ह,ैं उन्ह ें ऐसा अपजिष्ट अलग स े बंि, स्ट्वच्छ जस्ट्र्जत म ें संग्रहीत करना होगा तर्ा इस े एक जवजनर्िाष्ट समय पर बोडा द्वारा िैजनक आधार पर इस प्रयोिन के जलए दिए गए संग्रहण वाहन को सौंपा िाएगा: परंत ु दक ऐसे अपजिष्ट को दकसी भी सामुिाजयक अपजिष्ट के कूडािान म ें नहीं डाला िाएगा और इस प्रकार कूडा डालना प्रजतजषद्ध ह।ै (16 ) यदि उत्पािक पर्ृ क्कृत िैव-अवकषाणीय ठोस अपजिष्ट स े खाि नहीं बनाता ह ै तो इस े उसके पररसर के भीतर भंडाररत दकया िाएगा और बोडा के कमाकार या वाहन; या कूडा बीनने वाल े या अपजिष्ट संग्रहकता ा या ऐसे समय बहुतायत िैव-अवकषाणीय अपजिष्ट उत्पि करने वाल े जवजनर्िाष्ट वाजणजज्यक उत्पािकों के जलए अपजिष्ट के संग्रहण के जलए दिए गए प्रिि वाहन म ें इसकी जडलीवरी सुजनजश्चत की िाएगी; िैसा दक बोडा द्वारा समय-समय पर अजधसूजचत दकया िाएगा। अध्याय 3 ठोस अपजिष्ट संग्रहण 5. ठोस अपजिष्ट का सग्रं हण– (1) ठोस अपजिष्ट प्रबंधन जनयम, 2016 के अनुपालन म,ें बोड ा के सभी क्षेत्रों या वाडों, स्ट्लम और अनौपचाररक बजस्ट्तयों सजहत प्रत्येक घर से िैजनक आधार पर अपजिष्ट एकत्रण हते ु घर-घर िाकर सग्रं हण की अनौपचाररक प्रणाली को बोडा संग्रहण प्रणाली के सार् एकीकृत करके प्रत्येक घर िाकर पर्ृ क्कृत ठोस अपजिष्ट के सग्रं हण को कायााजन्वत दकया िाएगा। (2 ) प्रत्येक घर स े कूडा एकजत्रत करने हते ,ु क्षेत्रवार जवजनर्िाष्ट समय स्ट्लॉट तैयार दकए िाएंग े और उस क्षत्रे के सहििश्ृ य भागों तर्ा बोडा की वेबसाइट पर प्रकाजित दकया िाएगा। (3 ) घर-घर िाकर अपजिष्ट संग्रहण का समय प्रातः 6 स े प्रातः 11 बि े तक जनयत दकया िाएगा। (4 ) व्यापाररक स्ट्र्ापनों, वाजणजज्यक क्षेत्रों की िकु ानों या दकसी अन्य संस्ट्र्ागत अपजिष्ट उत्पािकों से अपजिष्ट संग्रहण का समय सामान्यत: प्रातः 7 बि े स े िोपहर 12 बिे तक होगा। (5 ) घरों, संस्ट्र्ाओं और वाजणजज्यक इकाइयों अपजिष्ट संग्रहक को कूडा सौंपेगें। (6 ) ढेर अपजिष्ट उत्पािकों स े अवजिष्ट ठोस अपजिष्ट के संग्रहण की व्यवस्ट्र्ा की िाएगी,िो अपजिष्ट को स्ट्व- स्ट्र्ाने संसाजधत कर रह े ह।ैं (7 ) सब्िी, िल, िूल, मांस, मुगी और मछली बािार स े अवजिष्ट ठोस अपजिष्ट को दिन-प्रजतदिन आधार पर सग्रं जहत दकया िाएगा। (8 ) बागवानी तर्ा उद्यान अपजिष्ट को अलग स े एकजत्रत करके सप्ताह में जनधााररत एक या िो बार उसका जनपटान दकया िाएगा। (9 ) िल और सब्िी मंडी, मांस और मछली बािार, र्ोक बागवानी और उद्यान अपजिष्ट के िैव- अवकषाणीय अपजिष्ट का अजधकतम उपयोग करने और सग्रं हण और ढुलाई की लागत को कम करन े के जलए ऐसे अपजिष्ट को उस क्षत्रे के अंिर संसाजधत या उपचाररत दकया िाएगा िहा ाँ स े यह अपजिष्ट उत्पि होता ह।ै (10 ) कंटेनरों में अपजिष्ट की मनै ुअल हडैं पलंग प्रजतजषद्ध होगी और; यदि अप्रत्याजित बाधाओं के कारण ऐसा करना अपररहाया हुआ, तो कमाकारों की संरक्षा के जलए उपयुि सुरक्षा के अधीन मैनुअल हडैं पलगं की िाएगी। (11 ) अपजिष्ट उत्पािक बोडा या अजधसूजचत प्राजधकृत अपजिष्ट संग्रहकताा द्वारा तैनात ऑटो-रटप्पसा या ररक्िा आदि को अपना पर्ृ क्कृत अपजिष्ट सौंपने के जलए उिरिायी होंगे। (12 ) बहु-मंजिला इमारतों, अपाटामेंटों, हाउपसंग कॉम्प्लेक्स स े पर्ृ क्कृत अपजिष्ट को प्रवेि द्वार या सक्षम प्राजधकारी द्वारा जनिेजित दकसी अन्य अजभजहत स्ट्र्ान स े एकजत्रत दकया िाए। (13 ) समय-समय पर सग्रं हण उपस्ट्करों और वाहनों के चयन के जलए प्रौद्योजगकी की पररवर्तात आवश्यकताओं तर्ा अजग्रम रूपों को ध्यान म ेंरखा िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (14 ) ऑटो-रटप्पर या हाइड्रॉजलक रूप स े संचाजलत हॉपर सजहत जवजनर्िाष्ट क्षमता वाल े हूटर लगे वाहनों, जिनम ें िैव-अवकषणा ीय एव ं अिैव- अवकषाणीय अपजिष्ट के जलए छत स े ढके हुए िो अलग-अलग कूडािानों की व्यवस्ट्र्ा होती ह,ै को अपजिष्ट सग्रं हण के जलए तनै ात दकया िाएगा। (15 ) अपजिष्ट सग्रं हकतााओं द्वारा आवाि ररकॉडा दकया गया स्ट्वचाजलत उपकरण, घंटी या हॉना या अन्य उपयुि युजि, जिसम ें ध्वजन का स्ट्तर अनुमत स े अजधक नहीं हो, प्रयोग म ें लाए िा रह े प्रत्येक अपजिष्ट संग्रहण पर लगाया िाएगा। (16 ) बोडा या अजधसूजचत प्राजधकृत अपजिष्ट संग्रहकता ा द्वारा प्रत्येक प्रार्जमक सग्रं हण और ढुलाई वाहन के जलए माग ा योिनाए ं(रूट प्लान) उपबंजधत की िाएंगी। (17 ) बोडा द्वारा सम्पि रुप स े अनमु ोदित सारणीबद्ध (टेबुलर) और भौगोजलक सूचना प्रणाली मानजचत्र प्रारूप म ें इन मागों के प्रारम्भ स्ट्र्ान, आरंजभक समय, प्रतीक्षा स्ट्र्ान, मागा पर प्रतीक्षा समय, अंजतम स्ट्र्ान और जवजनर्िाष्ट रूट के अंजतम समय का उल्लेख दकया िाएगा। (18 ) बोडा या अजधसूजचत प्राजधकृत अपजिष्ट संग्रहकता ा प्रत्येक गली म ें एक ‘बोडा’ लगाएगा जिस पर वहा ाँ के जनवाजसयों को जवजनर्िाष्ट समय पर इस सुजवधा का लाभ उठाने के जलए प्रार्जमक संग्रहण तर्ा ढुलाई वाहनों की समय-सारणी उपिर्िात की िाएगी और ऐसी िानकारी बोडा की वेबसाइट पर भी अपलोड की िाएगी। (19 ) संकरी गजलयों म,ें िहां ऑटो रटपर या वाहन द्वारा सेवा प्रिान नहीं की िा सकती, वहा ाँ मोबाइल स्ट्र्ानांतरण स्ट्टेिन जतपजहया वाहन या हाइड्रॉजलक रूप स े सचं ाजलत हॉपर सजहत छोटा मोटर चाजलत हूटर लगा वाहन तैनात दकया िाएगा, जिसम ें छत स े ढके हुए गीले एवं सूखे अपजिष्ट के जलए िो अलग- अलग कूडािानों की व्यवस्ट्र्ा होती ह।ै (20 ) व्यस्ट्त और संकरी गजलयों म,ें िहां जतपजहया वाहन या दकसी भी उपयुि छोटे वाहन द्वारा सेवा प्रिान नहीं की िा सकती, वहा ाँ साइदकल ररक्िा या दकसी अन्य प्रकार का उपयुि उपस्ट्कर तनै ात दकया िाएगा। (21 ) छोटी, संकरी या व्यस्ट्त गजलयों या लेनों िहााँ जतपजहया वाहन या ररक्िा या अन्य प्रकार का कोई उपयुि वाहन भी नहीं चल सकता ह,ै वहा ाँ मोहल्ला या गली के आरंजभक स्ट्र्ान पर सुजवधा पबंिओंु का जनधाारण करके सग्रं हण वाहन खडा दकया िाएगा और वाहन का हल्े पर या ड्राइवर अपन े पास एक सीटी रखेगा तर्ा ठोस अपजिष्ट के एकत्रण के जलए वाहन के आगमन की घोषणा करन े हते ु इलाके म ेंघूमगे ा। (22 ) ऐसी संग्रहण प्रणाली के जलए समय-सारणी सूचना पट्ट पर उपिर्िात की िाएगी और बोडा की वेबसाइट पर अपलोड की िाएगी। (23 ) प्रत्येक घर यह सुजनजश्चत करन े हते ु जिम्मेिार होगा दक अलग दकया हुआ अपजिष्ट अजभजहत स्ट्र्ान पर संग्रहकताा को प्रिान कर दिया गया ह।ै (24 ) इस सेवा म ें तनै ात ऑटो रटपर, जतपजहया वाहन, ररक्िा तर्ा अन्य दकस्ट्म का कोई भी सग्रं हण वाहन केवल घरों स े ही अपजिष्ट एकजत्रत करेंगे और दकसी अन्य स्रोत िैसे ढलावों, खुले स्ट्र्ान, मैिान, कूडािानों या नाले स ेअपजिष्ट एकजत्रत नहीं करेंगे। (25 ) बोडा या इसके अजधसूजचत प्राजधकृत अपजिष्ट संग्रहकता ा प्रत्यके िोन की सभी गजलयों या लने ों से ठोस अपजिष्ट का प्रार्जमक सग्रं हण करने के जलए उिरिायी होंगे। अध्याय 4 ठोस अपजिष्ट का जद्वतीयक भडं ारण 6. जद्वतीयक भडं ारण स्ट्र्लों पर ठोस अपजिष्ट का भंडारण– (1 ) घर-घर िाकर एकजत्रत दकए गए ठोस अपजिष्ट को अपजिष्ट भंडारण जडपो, सामुिाजयक भंडारण कूडािानों या दिक्स्ट्ड या मोबाइल अंतरण स्ट्टेिनों या बोडा द्वारा जद्वतीयक भंडारण के जलए जवजनर्िाष्ट स्ट्र्लों पर ले िाया िाएगा। (2 ) ऐसे जद्वतीयक भंडारण स्ट्र्लों पर अलग-अलग भंडारण के जलए ढके हुए, जवजनर्िाष्ट रंग वाल,े जनम्नजलजखत कंटेनर होंग,े अर्ाता :- (क ) अिैव-अवकषाणीय या सूखा अपजिष्ट;[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 7 (ख ) िैव- अवकषाणीय या गीला अपजिष्ट; (ग ) घरेल ू पररसंकटमय अपजिष्ट। (3 ) बोड ा द्वारा सीमांदकत क्षेत्रों म ें पर्ृ क्कृत अपजिष्ट डालन े हते ु जवजभि रंगीन कंटेनरों का उपयोग जनम्नजलजखत तरीके स ेदकया िाएगा, अर्ाता :- (क ) िैव-अवकषणा ीय अपजिष्ट के जलए हरा रंग; (ख ) अिैव- अवकषणा ीय अपजिष्ट के जलए नीला रंग; (ग ) घरेल ू पररसंकटमय अपजिष्ट के जलए काला रंग। (4 ) ठोस अपजिष्ट प्रबंधन जनयम 2016 म ें उपबंजधत अनुसार अधीन बोडा जवजभि प्रकार के ठोस अपजिष्ट के भंडारण तर्ा जवतरण हते ु जवजनर्िाष्ट पात्रों की अजनवाय ा कलर कोपडंग तर्ा अन्य जविेष जववरण के जलए अलग स े समय-समय पर अजधसूजचत करेगा, जिससे दक जबना दकसी जमिण या अपजिष्ट के ररसाव स े सुरजक्षत और आसान संग्रहण सभं व हो और जवजभि अपजिष्ट उत्पािकों को इनका पालन करना होगा। (5 ) बोडा स्ट्वयं अपन े या आउटसोर्संग अजभकरणों के माध्यम स े ठोस अपजिष्ट के भडं ारण स्ट्र्लों का रखरखाव ऐसी रीजत स ेकरेगा जिससे इनके आस-पास अस्ट्वच्छता तर्ा गिं गी नहीं िैल पाए। (6 ) बोडा या इसके दकसी प्राजधकृत अजभकरण द्वारा जद्वतीयक भंडारण जडपो म ें जवजभि आकार और इन उपजवजधयों म ें उजल्लजखत जवजभि रंगों के कंटेनर उपलब्ध कराए िाएंगे। (7 ) भंडारण स्ट्र्लों का जनमााण और स्ट्र्ापना दकसी क्षत्रे म ें अपजिष्ट उत्पािन की मात्रा तर्ा िनसंख्या घनत्व को ध्यान म ें रखते हुए की िाएगी और ऐसी भंडारण सुजवधाएं उपयोिा के अनुकूल होंगी तर्ा इन्ह ें इस तरह स े जडिाइन दकया िाएगा दक य े सुजनजश्चत हो दक अपजिष्ट का संघनन (कॉम्पैक्िन) दकया िाए और संग्रहीत अपजिष्ट खुल े वातावरण के संपका म ेंनहीं आ पाए। (8 ) सभी आवासन सहकारी सजमजतयों, संगमों, कॉलोजनयों, आवासीय और वाजणजज्यक स्ट्र्ापनों या गेट लग े समुिायों की यह जिम्मेिारी होगी दक व े अपने कॉम्प्लेक्स म ें समुजचत स्ट्र्ानों पर इन उपजवजधयों में जनधााररत रंग के स्ट्वय ं द्वारा खरीिे गए साि-सुर्रे और अच्छी जस्ट्र्जत वाल े कूडािान पयााप्त संख्या म ें रखें, जिससे दक वहा ाँ उत्पि िैजनक अपजिष्ट को यर्ोजचत िमा दकया िा सके। (9 ) बोडा या उसके िवारा प्राजधकृत अजभकरण जनयजमत रूप स े सभी कूडािानों की धुलाई और उनका कीटाणुिोधन करेगा। 7. सूखे अपजिष्ट (अिैव-अवकषाणीय अपजिष्ट) हते ु ररसाइदकल केंद्र- (1) बोडा आवश्यकतानुसार अपन े जवधमान ढलावों को पररवर्तात कर िगे ा या 'ररसाइकपलंग केंद्र' के जलए जवजनर्िाष्ट स्ट्र्ानों का पता लगाएगा जिसका प्रयोग गजलयों या घर-घर िाकर अपजिष्ट एकत्रण सेवा के माध्यम स े प्राप्त सखू े अपजिष्ट के पृर्क्करण हते ु दकया िाएगा। (2 ) सूखे अपजिष्ट की प्राप्त मात्रानसु ार ररसाइदकल केंन्द्रों की संख्या बढ़ाई िाएगी। (3 ) गजलयों या घर-घर िाकर अपजिष्ट संग्रहण प्रणाली और वाजणजज्यक संस्ट्र्ापनाओं स े प्राप्त सखू े (अिैव- अवकषाणीय अपजिष्ट) अपजिष्ट को केवल इन्हीं अजभजहत ‘ररसाइदकल केंद्रों’ म ें अंतररत दकया िाएगा और ये अजभजहत केंद्र केवल सूखा अपजिष्ट ही प्राप्त करेंगे। (4 ) घरों के जलए प्रावधान होगा दक वे इन ररसाइदकल केंद्रों पर अपने ररसाइदकल योग्य अपजिष्ट को पूवा- जनधााररत िरों पर बोडा के, यर्ाजस्ट्र्जत प्राजधकृत अजभकताओंा या प्राजधकृत अपजिष्ट व्यवहाररयों को सीधे िमा करवा या बेच सकत ेह।ैं (5 ) इस प्रयोिन के जलए व्यवहारी प्रत्येक ररसाइपक्लंग इकाई म ें अनुज्ञात स्ट्र्ान पर तौल पमै ाना एक काउंटर स्ट्र्ाजपत करेंगे। (6 ) ठोस अपजिष्ट प्रबंधन जनयम, 2016 के उपबंधों के अनुरूप, यर्ाजस्ट्र्जत प्राजधकृत अजभकता ा प्राजधकृत अपजिष्ट व्यवहाररयों, को केवल जद्वतीयक बािार या ररसाइदकल इकाइयों म ें ररसाइदकल योग्य अपजिष्ट के जनपटान या जबिी की अनुमजत होगी। (7 ) प्राजधकृत अजभकता ा या प्राजधकृत अपजिष्ट व्यवहारी ही जबिी की वसूली करन े हते ु हकिार होंगे। 8. जवजनर्िाष्ट घरेल ू पररसंकटमय अपजिष्ट हते ु जनक्षपे केंद्र-(1) घरेलू पररसंकटमय अपजिष्ट के संग्रहण और जवजनर्िाष्ट घरेल ू पररसंकटमय अपजिष्ट को प्राप्त करन े के जलए उपयुि स्ट्र्ान पर एक िमा (जडपोिीिन) केंद्र स्ट्र्ाजपत दकया8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] िाएगा। सरकार द्वारा जवजनजश्चत रीजत अनुसार ऐसी सुजवधा प्रत्येक वाडा म ें स्ट्र्ाजपत की िाएगी और ऐस े अपजिष्ट की प्राजप्त का समय अजधसूजचत दकया िाएगा। (2 ) बोडा दकसी प्राजधकृत अजभकता ा या ररयायती संस्ट्र्ा को भी सभी अपजिष्ट उत्पािकों स े पृर्क्कृत घरेल ू पररसंकटमय अपजिष्ट को एकजत्रत करने की जिम्मेिारी ि े सकता ह ै और ऐसा अपजिष्ट सरकार द्वारा स्ट्र्ाजपत पररसंकटमय अपजिष्ट जनपटान सुजवधा स्ट्र्ल पर अलग स ेल ेिाया िाएगा। अध्याय 5 ठोस अपजिष्ट की ढुलाई 9. ठोस अपजिष्ट की ढुलाई- ठोस अपजिष्ट की ढुलाई जनम्नजलजखत रीजत म ेंकी िाएगी, अर्ाात:् - (i ) अपजिष्ट की ढुलाई के जलए प्रयिु वाहनों को ऐसी रीजत म ें कवर दकया िाएगा दक एकजत्रत दकया हुआ अपजिष्ट खुल े वातावरण के संपका म ें नहीं आ पाए तर्ा वाहनों म ें बोडा द्वारा प्रौद्योजगकी के जवकल्प के आधार पर कॉम्पैक्टर तर्ा मोबाइल अंतरण स्ट्टेिन भी सजम्मजलत दकए िाएंग;े (ii ) बोडा द्वारा स्ट्र्ाजपत भडं ारण स्ट्र्लों को अपजिष्ट हटाने के पश्चात प्रजतदिन साि दकया िाएगा और जिस स्ट्र्ान पर कूडािान या कंटेनर रखे िाते ह,ैं उसके आसपास के क्षेत्रों की भी साि-सिाई की िाएगी; (iii ) आवासीय और अन्य क्षेत्रों स े एकजत्रत पृर्क्कृत िैव-अवकषणा ीय अपजिष्ट को प्रसंस्ट्करण संयंत्रों िैसे खाि संयंत्र, बायो-जमर्ेनीकरण संयंत्र या ऐसे दकसी भी अन्य सुजवधा स्ट्र्ल तक ढककर अंतररत दकया िाएगा; (iv ) िैव-अवकषणा ीय अपजिष्ट के जलए, िहा ं भी लाग ू हो, स्ट्र्ल पर ही (ऑन-साइट) ऐस े अपजिष्ट के प्रसंस्ट्करण को प्रार्जमकता िी िाएगी; (v ) एकजत्रत अिैव-अवकषाणीय अपजिष्ट को संबंजधत प्रसंस्ट्करण स्ट्र्ल या जद्वतीयक भडं ारण के स्ट्र्ान तक पहुचाँ ाया िाएगा; (vi ) सजिमााण और जवध्वंस अपजिष्ट प्रबंधन जनयम, 2016 के उपबंधों के अनुसार सजिमााण और जवध्वंस अपजिष्ट की ढुलाई की िाएगी; (vii ) बोडा उजचत रीजत म ें इनर्टस ा (inerts) की ढुलाई के जलए व्यवस्ट्र्ा करेगा। काय ा समाप्त होते ही गजलयों की सिाई स े उत्पि अपजिष्ट और नाली की हटन े योग्य गाि को तुरंत हटा दिया िाएगा; (viii ) ढुलाई वाहनों को इस प्रकार स े जडजाइन दकया िाएगा दक अंजतम जनपटान स े पहल े अपजिष्ट की बार- बार हडैं पलगं स े बचा िा सके; (ix ) ढुलाई कायों म ें तैनात संग्रहण वाहन केवल मोबाइल अतं रण स्ट्टेिन या दिक्स्ट्ड कॉम्पेक्टर अतं रण स्ट्टेिन, िहां कहीं भी उपबंजधत ह,ैं म ें ही अपजिष्ट िमा या अंतररत करेंग;े (x ) यदि दकसी कारण स े उस समय अजभजहत स्ट्र्ान पर मोबाइल अंतरण स्ट्टेिन या दिक्स्ट्ड कॉम्पेक्टर अंतरण स्ट्टेिन अवजस्ट्र्त नहीं ह,ै तो 'भरा हुआ वाहन' मोबाइल अंतरण स्ट्टेिन या दिक्स्ट्ड कॉम्पेक्टर अंतरण स्ट्टेिन के अगले अजभजहत स्ट्र्ान या बोडा द्वारा जवजनर्िाष्ट स्ट्र्ल पर अपजिष्ट खाली करेगा; (xi ) दिक्स्ट्ड कॉम्पेक्टर अंतरण स्ट्टेिन की ढुलाई हुक लोडर के माध्यम स े की िाएगी; (xii ) मोबाइल अंतरण स्ट्टेिन या दिक्स्ट्ड कॉम्पेक्टर अंतरण स्ट्टेिन अपजिष्ट की ढुलाई सीध े खाि संयंत्र अपजिष्ट से, ऊिाा संयंत्र या बोड ा द्वारा अजभजहत दकसी अन्य स्ट्र्ल या संयंत्र पर करेगा; (xiii ) अपजिष्ट की ढुलाई के िौरान जवजभि स्रोतों स े प्राप्त अपजिष्ट को आपस म ें जमजित नहीं दकया िाएगा; (xiv ) गजलयों से अपजिष्ट संग्रहण और अपजिष्ट ढुलाई की सेवाए ं प्रजतदिन प्रिान की िाएगं ी; (xv ) इस सेवा म ें तैनात मोबाइल अतं रण स्ट्टेिन केवल अजभजहत ऑटो रटपर, थ्री व्हीलसा या वाहन या गली स्ट्तर पर प्रचालन स ेसंग्रहीत अपजिष्ट के कूडािानों स ेही अपजिष्ट प्राप्त करेंगे; (xvi ) गली स्ट्तर पर तैनात, जतपजहया वाहन या ररक्िा स े अपजिष्ट प्राप्त करने के जलए जवजनर्िाष्ट स्ट्र्ानों पर समर्पात मोबाइल अंतरण स्ट्टेिन की तैनाती की िाएगी और स्ट्वीकृत मागा योिना के अनुसार घर-घर िाकर घरों और वाजणजज्यक स्ट्र्ापनों से ठोस अपजिष्ट का संग्रहण दकया िाएगा;[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 9 (xvii ) मोबाइल अंतरण स्ट्टेिन या दिक्स्ट्ड कॉम्पेक्टर अंतरण स्ट्टेिन का जडिाइन इस प्रकार स े तैयार दकया िाएगा जिससे प्रार्जमक सग्रं हण वाहनों स े अपजिष्ट को कम समय म ें तर्ा जबखेरे बगैर खाली करन े म ें सहायता जमले; (xviii ) ठोस अपजिष्ट को अंतररत करत े समय, मोबाइल अंतरण स्ट्टेिन या दिक्स्ट्ड कॉम्पेक्टर अंतरण स्ट्टेिन के आसपास जबखरा हुआ अपजिष्ट साि दकया िाएगा जिससे दक ऐसा कोई अपजिष्ट िेष नहीं बचे। साि- सिाई के पश्चात उस स्ट्र्ान पर कीटाणुनािक का प्रयोग दकया िाएगा; (xix ) बोडा या इसका प्राजधकृत अजभकता ा या अजभकरण सभी जद्वतीयक भंडारण स्ट्र्लों पर क्लोि सर्काट टेलीजवजन कैमरे (सीसीटीवी) स्ट्र्ाजपत करेगा। अध्याय 6 ठोस अपजिष्ट का प्रसंस्ट्करण (प्रोसेपसंग) 10. ठोस अपजिष्ट का प्रसंस्ट्करण- (1) बोड ा ठोस अपजिष्ट प्रसंस्ट्करण सुजवधाओं और सहबद्ध अवसंरचनाओं के सजिमााण, संचालन तर्ा अनरु क्षण को उपयुि प्रौद्योजगकी को अगं ीकार करते हुए ठोस अपजिष्ट के जवजभि घटकों के अनुकूलतम उपयोग के जलए स्ट्वय ं या दकसी अजभकरण के माध्यम स े सुकर बनाएगा, जिसके अंतगात जनम्न प्रौद्योजगकीयों सजम्मजलत ह,ैं िो केन्द्रीय सरकार के िहरी जवकास मंत्रालय द्वारा समय-समय पर िारी मागाििाक जसद्धांतों और केंद्रीय प्रिषू ण जनयंत्रण बोडा द्वारा जवजहत मानकों का पालन करती ह:ैं- (क ) ढुलाई लागत और पयाावरणीय प्रभावों को कम करन े हते ु जवकेन्द्रीकृत प्रसंस्ट्करण िैसे बायो- जमर्ेनीकरण, सूक्ष्मिीव खाि, वमी-खाि, अवायवीय पाचन या िैव-अवकषाणीय अपजिष्ट के िैव-जस्ट्र्रीकरण के जलए दकसी अन्य उपयिु प्रसंस्ट्करण को वरीयता िी िाएगी; (ख ) केंद्रीकृत स्ट्र्लों पर मध्यम या बडे खाि संयंत्र या बायो-जमर्ने ीकरण संयंत्रों के माध्यम से; (ग ) अपजिष्ट के िहनिील अंि के जलए अवजिष्ट स े प्राप्त ईंधन द्वारा ऊिाा प्रदियाओं के जलए अपजिष्ट के माध्यम स े या ठोस अपजिष्ट आधाररत जबिली संयंत्रों को िीडस्ट्टॉक के रूप म ें आपूर्ता; (घ ) सजिमााण और जवध्वंस अपजिष्ट प्रबंधन संयंत्रों के माध्यम से; और (ड ) िहां तक संभव होगा, अपजिष्ट स े प्राप्त ईंधन की खपत के जलए एक माकेट तैयार करने के सभी प्रयास करेगा। (2 ) प्रत्यक्ष भस्ट्मीकरण द्वारा ऊिाा संयंत्र में अपजिष्ट प्रिान करन े के जलए पूण ा पृर्क्करण अजनवाय ा होगा और सुसंगत संजविाओं के जनबंधनों और ितों का जहस्ट्सा होगा। (3 ) बोडा का प्रयास रहगे ा दक रीसाईकल योग्य वस्ट्तुए ं िैसे कागि, प्लाजस्ट्टक, धात,ु कांच और वस्त्र प्राजधकृत ररसाइकलसा के पास पाँहुच पाएं। 11. ठोस अपजिष्ट के प्रसंस्ट्करण हते ु अन्य मागाििाक जसद्धांत– (1) बोड ा सभी जनवासी कल्याण संगमों, ग्रुप हाउपसंग सोसायरटयों, बािारों, सिस्त्र बलों के भोिनालयों और अन्य अजभकरणों, गेटबंि समुिायों और 5000 वग ा मीटर स े अजधक क्षत्रे रखन े वाले संस्ट्र्ाओं, सभी होटलों और रेस्त्राओं, बेंक्वेट हालों और इस तरह के अन्य स्ट्र्लों पर यर्ासंभव कम्पोपस्ट्टंग या बायो-जमर्ेनेिन के माध्यम स े िैव-अवकषाणीय अपजिष्ट के उत्पि होने के स्ट्र्ान पर ही प्रसंस्ट्करण करन े की व्यवस्ट्र्ा करेगा तर्ा अपजिष्ट उत्पि करने वाले अन्य अपजिष्ट उत्पािकों को भी िैव- अवकषाणीय अपजिष्ट के स्ट्व-स्ट्र्ाने प्रसंस्ट्करण को वरीयता िी िायगी। (2 ) बोडा यह प्रवृि करेगा दक सब्िी, िल, िूल, मांस, कुक्कुट और मछली व्यापार मंजडयों द्वारा अपन े िैव- अवकषाणीय अपजिष्ट का प्रसंस्ट्करण करत े समय स्ट्वच्छ जस्ट्र्जतयां बनाए रखी िाएं। (3 ) बोडा यह प्रवृि करेगा दक बागवानी उपवनों और उद्यानों स े उत्पि अपजिष्ट का जनपटान अलग स े यर्ासंभव उपवनों और उद्यानों म ें दकया िाए। (4 ) बोडा अपजिष्ट प्रबंधन म ें समुिायों को िाजमल करने और घर पर ही कम्पोपस्ट्टंग, बॉयोगैस उत्पािन सामुिाजयक स्ट्तर पर अपजिष्ट के जवकेंद्रीकृत प्रसंस्ट्करण को प्रोत्साजहत करेगा परंत,ु ऐसा करते समय बिब ू को जनयंजत्रत रखना और तत्संबधी सुजवधा स्ट्र्ल के आसपास स्ट्वच्छता जस्ट्र्जत बनाए रखना अजनवाय ा होगा।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] अध्याय 7 ठोस अपजिष्ट का जनपटान 12. ठोस अपजिष्ट का जनपटान- (1) बोडा अवजिष्ट अपजिष्ट और गजलयों म ें झाडू लगान े स े उत्पि कचरे तर्ा नाजलयों स े जनकलने वाली गाि का जनपटान ठोस अपजिष्ट प्रबंधन जनयम, 2016 म ें उपबंजधत ऐसी रीजत और तत्समय प्रवृि दकसी अन्य जवजध द्वारा अजधरोजपत दकसी अन्य बाध्यताओं के अनुरूप रीजत स े स्ट्वंय या दकसी अन्य अजभकरण के माध्यम स े सेजनटरी लडैं दिल और सहबद्ध ढांच े का सजिमााण, प्रचालन और रखरखाव करेगा। (2 ) उप-परै ा (1) म ें अतं र्वाष्ट दकसी बात के होते हुए भी, बोडा अपने उिरिाजयत्व वाले क्षत्रे म ें अवजिष्ट अपजिष्ट, गजलयों म ें झाडू लगाने स े उत्पि अपजिष्ट, नाजलयों स े जनकलन े वाली गाि और अन्य स्रोतों स े उत्पि अपजिष्ट को लडैं दिल म ें जनपटान के जलए दकसी भी अन्य नगर जनगम जनकाय या नगर जनगम जनकाय समूहों के सार् करार कर सकता ह,ै ऐसे नगर जनकाय तर्ा नगर जनगम जनकाय समूह जिन्होंने संबद्ध अवसंरचनात्मक ढांचा का सजिमााण, संचालन तर्ा रखरखाव दकया ह।ैं अध्याय 8 उपयोिा िीस और िाजस्ट्त 13. ठोस अपजिष्ट का संग्रहण, ढुलाई और जनपटान हते ु उपयोिा िीस- (1) अपजिष्ट उत्पािकों स े अपजिष्ट सग्रं हण, ढुलाई और जनपटान हते ु सेवाए ं प्रिान करन े के जलए बोड ा द्वारा उपयोिा िीस जनधााररत की िाएगी। उपयोिा िीस की िरें प्रर्म अनुसूची म ेंयर्ा जवजनर्िाष्ट ह।ैं (2 ) अपजिष्ट उत्पािकों स े यर्ा जनयत उपयोिा िीस का सग्रं ह बोडा या इस जनजमि सामान्य या जविषे आिेि स े सक्षम प्राजधकारी द्वारा प्राजधकृत अजभकरण या दकसी प्राजधकृत व्यजि द्वारा दकया िाएगा। (3 ) बोडा इन उपजवजधयों की अजधसूचना की तारीख स े छह मास के भीतर, उपयोिा िीस लगान े के प्रयोिन के जलए अपजिष्ट उत्पािकों का डाटाबेस तैयार करेगा और उपयोिा िीस की जबपलंग या संग्रहण या वसलू ी के जलए समुजचत व्यवस्ट्र्ा जवकजसत करेगा और डाटाबेस को जनयजमत रूप स े अद्यतन दकया िाएगा। (4 ) बोडा ऑनलाइन संिाय सजहत उपयोिा िीस की वसूली के जलए जवजभि पद्धजतया ं अपना सकेगा। ऐसे उपयोिा िीस के संग्रहण के जलए मास म ें जवजिष्ट दिन जनयत दकए िाएंग,े जिसम ें प्रत्येक मास के पहल े सप्ताह को वरीयता िी िाएगी। (5 ) वार्षाक या छह माजसक संिाय की भी प्रणाली अपनाई िाएगी। (6 ) यदि उपयोिा िीस सम्पूणा वषा के जलए अजग्रम अिा दकया िाता ह,ै तो बारह मास की बिाए िस मास की रकम ली िाएगी। इसी प्रकार, उपयोिा िीस छह मास का अजग्रम संिाय दकया िाता ह,ै तो िीस की मांग की रकम छह मास के बिाए साढे पांच मास के जलए वसूल की िाएगी। (7 ) उपयोिा िीस के संिाय म ें व्यजतिम होने की ििा म ें सक्षम प्राजधकारी, अजधजनयम की धारा 101, धारा 102 और धारा 324 के अधीन उसकी वसूली व्यजतिमी स े कर की बकाया रकम के रूप म ें कर सकेगा। 14. उल्लघं न के जलए िाजस्ट्त- (1) ठोस अपजिष्ट प्रबंधन जनयम, 2016 या इन उपजवजधयों के दकसी भी उपबंधों के उल्लघं न या अनुपालन करने म ें जविलता के जलए िसू री अनुसूची म ें यर्ाजवजनर्िाष्ट िाजस्ट्त अजधरोजपत की िाएगी। (2 ) उप-परै ा (1) म ें यर्ा उजल्लजखत उल्लघंन िारी रखने या गैर-अनपु ालन की जस्ट्र्जत म ें ऐसी प्रत्येक व्यजतिम के जलए प्रजतदिन आधार पर िाजस्ट्त लगाई िाएगी जिसे पााँच सौ रुपए तक बढ़ाया िा सकता ह।ै अध्याय 9 पणधाररयो के उिरिाजयत्व 15. अपजिष्ट उत्पािकों के उिरिाजयत्व - (1 ) कूडा िैलान े पर प्रजतषेध:-[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 11 (क ) प्राजधकृत सावािजनक या जनिी कूडिानों के जसवाय कोई व्यजि दकसी सावािजनक स्ट्र्ल पर कूडा नहीं िैलाएगा। कोई भी व्यजि इन जविेष प्रयोिनों के जलए उपबधं दकए गए ऐसे सावािजनक सुजवधाओं के जसवाय दकसी सावािजनक स्ट्र्ल पर वाहनों की मरम्मत, बतान या कोई अन्य उपकरण धोन े या साि करने का काय ानहीं करेगा या दकसी प्रकार का संग्रहण नहीं करेगा। (ख ) प्राजधकृत जनिी या सावािजनक कूडेिानों के जसवाय कोई व्यजि दकसी खुली या खाली पडी सम्पजि पर कूडा नहीं डालगे ा। (ग ) दकसी वाहन के ड्राइवर या यात्री के रूप म ें कोई भी व्यजि दकसी गली, सडक, िुटपार्, खले के मैिान, उद्यान, रैदिक आइलडैं या अन्य सावािजनक स्ट्र्ान पर कूडा नहीं िेंकेगा। (घ ) कोई व्यजि तब तक दकसी रक या अन्य मालवाहक वाहन को नहीं चलाएगा, िब तक की ऐस ेवाहन का जनमााण और लिान इसजलए ना दकया गया हो तादक सडक, िुटपार्, खले के मिै ान, उद्यान, रैदिक आइलडैं या अन्य सावािजनक स्ट्र्लों पर कोई लोड, पिार्ा या गंिगी डालने या िमा करने का जनवारण दकया िा सके। (ड ) कुिा, जबल्ली सजहत या ऐस े अन्य दकसी पालत ू िानवरों के स्ट्वाजमयों का यह भी उिरिाजयत्व होगा दक गली या दकसी सावािजनक स्ट्र्ल पर ऐसे िानवर द्वारा की गई दकसी प्रकार की गंिगी को तत्काल उठाएगा या साि करेगा तर्ा इस तरह दकए गए अपजिष्ट के उजचत जनपटान हते ु समुजचत उपाय करेगा, जिनम ें स्ट्वयं की सीवेि प्रणाली स े जनपटान को वरीयता िी िाएगी। (च ) कोई व्यजि दकसी नाली, निी, खुले तालाब या िल जनकायों म ेंकूडा नहीं डालेगा। (2 ) अपजिष्ट को िलाना:- सावािजनक स्ट्र्ानों पर या दकसी जनिी स्ट्र्ान पर या सावािजनक सम्पजि पर ठोस अपजिष्ट के दकसी भी प्रकार को िला कर जनपटान करना पूणातया प्रजतजषद्ध ह।ै (3 ) स्ट्वच्छ क्षत्रे :- (क ) प्रत्येक व्यजि यह प्रयास करेगा दक िुटपार् और खलु ी नाजलयां या गटर तर्ा सडक दकनारे सजहत उसके स्ट्वाजमत्व या कब्ि े वाले पररसर के सामने कोई भी सावािजनक स्ट्र्ान या आस पास का क्षत्रे दकसी भी तरह के ठोस या तरल अपजिष्ट स े मुि रहकर स्ट्वच्छ रह।े (ख ) सावािजनक सभाओं और दकसी कारण (िलु ूस, प्रििना , सकास, मले े, रािनीजतक रैजलयां, वाजणजज्यक, धार्माक, सामाजिक-सांस्ट्कृजतक कायािमों, जवरोध प्रििानों और प्रििना ों तर्ा इसी प्रकार की समान घटनाओं सजहत) स े सावािजनक स्ट्र्लों पर आयोजित की िाने वाली गजतजवजधयों, िहां यर्ाजस्ट्र्जत, पुजलस जवभाग या बोडा स े अनुमजत अपेजक्षत हो, के मामले में ऐसी गजतजवजधयों या सभा के आयोिनकताा का यह िाजयत्व होगा दक वह उस क्षत्रे और आसपास के क्षेत्रों की स्ट्वच्छता सुजनजश्चत करें। (ग ) कायािम आयोिक स े बोड ा द्वारा यर्ा अजधसूजचत प्रजतिाय योग्य स्ट्वच्छता धरोहर राजि कायािम की अवजध के जलए प्राजधकृत अजधकारी द्वारा प्राप्त की िाएगी। (घ ) यह िमा राजि कायािम पूरा होने के पश्चात प्रजतिाय की िाएगी लेदकन उससे पहले यह िांच की िाएगी दक उि सावािजनक स्ट्र्ल की स्ट्वच्छता बहाल कर िी गई ह,ै और कायािम के पररणामस्ट्वरूप उत्पि अपजिष्ट सग्रं जहत करके अजभजहत स्ट्र्लों तक पहुचं ा दिया गया ह।ै (ड ) बोडा द्वारा सग्रं हीत यह धरोहर राजि केवल सावािजनक स्ट्र्ल की स्ट्वच्छता अनरु क्षण के जलए होगी और इसम ें सम्पजि को पहुचं ाई गई दकसी प्रकार की क्षजत का हिााना िाजमल नहीं होगा। यदि आयोिनकताा कायािम के आयोिन के पररणामस्ट्वरूप उत्पि अपजिष्ट की सिाई, संग्रहण और ढुलाई म ें बोडा की सेवाए ं प्राप्त करना चाहत े हों, तो उन्ह ें बोडा के संबंजधत जवभाग या अनुभाग को आवेिन करना होगा तर्ा इस प्रयोिन के जलए सक्षम प्राजधकारी द्वारा जनयत दकए गए अपेजक्षत प्रभारों का सिं ाय करना होगा। (च ) खाली प्लाट पर ठोस अपजिष्ट डालना तर्ा गैर-अजभजहत स्ट्र्ानों पर जनमााण और जवध्वसं अपजिष्ट डाले िाने की जस्ट्र्जतयों स े बोड ा जनम्नजलजखत रीजत स े जनपटेगा, अर्ाात:-12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (i ) बोडा दकसी पररसर के स्ट्वामी या अजधभोगी को नोरटस भेि सकेगा जिससे ऐस े स्ट्वामी या अजधभोगी स े उि पररसर पर डाल े गए दकसी भी प्रकार के अपजिष्ट को नोरटस म ें यर्ा जवजनर्िाष्ट रीजत तर्ा समय के भीतर साि करना अपेजक्षत होगा। (ii ) यदि नोरटस पाने वाला व्यजि नोरटस म ें वर्णात अजधरोजपत अपेक्षाएं परू ी करन े म ें जविल रहता ह ै तो ऐसा व्यजि सक्षम प्राजधकारी के आििे या उि प्रयोिन के जलए सक्षम प्राजधकारी द्वारा अजभजहत कमाचारी के आिेि स े प्रत्येक ऐसी जविलता के जलए िाजस्ट्त का िायी होगा। (iii ) ऐसा नोरटस पान े वाला व्यजि िाजस्ट्त संिाय के अजतररि यदि नोरटस म ें वर्णात अपेक्षाए ं पूण ा करने म ें जविल रहता ह,ै तो सक्षम प्राजधकारी या उसके द्वारा अजभजहत व्यजि ऐसे पररसर म ें प्रवेि कर अपजिष्ट को साि कर सकेगा तर्ा इस प्रयोिन में अजधभोगी स े अपजिष्ट साि करन े पर दकए गए व्यय की वसूली कर सकेगा। 16. जनपटान योग्य उत्पािों और सेजनटरी नपे दकन तर्ा डायपसा के जवजनमााताओं या ब्रांड स्ट्वाजमयों के कताव्य- (1 ) जनपटान योग्य उत्पािों िैस े रटन, कांच, प्लाजस्ट्टक पैकेपिंग तर्ा इसी प्रकार की समान वस्ट्तओंु के सभी जवजनमााताओं या बोडा की अजधकाररता म ें आने वाल े बािारों म ें ऐसे उत्पाि प्रारंभ करने वाले ब्रांड स्ट्वाजमयों को अपजिष्ट प्रबंधन प्रणाली की स्ट्र्ापना के जलए बोडा को आवश्यक जविीय सहायता प्रिान करनी होगी। (2 ) बोडा इन उपबधं ों के कायाान्वयन के जलए केंद्रीय सरकार और मध्य प्रिेि राज्य सरकार के संबि ् जवभागों के सार् भी समन्वय स्ट्र्ाजपत करेगा। (3 ) ऐसे सभी ब्रांड स्ट्वाजमयों को िो अिैव-अवकषणा ीय पैकेपिंग सामग्री म ें अपने उत्पाि बेचते या जवपणन करते ह,ैं उन्ह ें ऐसी प्रणाली कायम करनी होगी, जिसम ें उनके उत्पािन के कारण उत्पि पैकेपिंग अपजिष्ट को वापस जलया िा सके। (4 ) सेजनटरी नेपककंस और डायपसा जवजनमााता या ब्रांड स्ट्वामी या जवपणन कंपजनयां इस बात की संभावनाओं का पता लगाएगं ी दक उनके उत्पािों म ें सभी पुनचा िण योग्य पिार्ों का प्रयोग दकया िाए या वे अपने सेजनटरी उत्पािों के पैकेट के सार् एक ऐसा पाउच या रैपर उपलब्ध कराए ं जिनमें ऐस े नेपदकन या डायपर का जनपटान दकया िा सके। (5 ) ऐस े सभी जवजनमााताओं, ब्रांड स्ट्वाजमयों या जवपणन कंपजनयों की यह जिम्मेिारी होगी दक वे अपन े उत्पािों की रैपपंग और जडस्ट्पोिल के जलए िनता को जिजक्षत करें। (6 ) ईधन प्रयोग करने वाली और ठोस अपजिष्ट आधाररत प्लांट के एक सौ दकलोमीटर के िायरे जस्ट्र्त सभी औद्योजगक इकाइया ं अपनी ईधन की िरूरत का कम स े कम पााँच प्रजतित भाग इस प्रकार उत्पादित ररफ्यूज्ड डरे ाइव्ड फ्यूल स े परू ा करेंगी। 17. बोड ा के उिरिाजयत्व- (1) बोडा अपने अजधकार क्षत्रे म ें आने वाले भू-भाग म ें सभी समान क्षेत्रों, यर्ा गजलयों या सडकों, सावािजनक स्ट्र्लों, अस्ट्र्ायी बजस्ट्तयों, स्ट्लम क्षेत्रों, बािारों, स्ट्वय ं के उपवनों, बागों या नाजलयों आदि की सिाई की जनयजमत प्रणाली सुजनजश्चत करन े के जलए उिरिायी होगा। वह इसके जलए मानव संसाधन और मिीन ें लगाएगा तर्ा घोजषत भंडारण कंटेनरों स े अपजिष्ट संग्रजहत करने और उस े प्रजतदिन बंि वाहनों म ें अंजतम जनपटान स्ट्र्ल तक पहुचं ान े के जलए बाध्य होगा, जिसके जलए बोडा अपने सिाई कमाचारीवृंि और वाहनों के अलावा, संजविा के आधार पर जनिी पक्षों या अजभकरणों को काम पर लगा सकेगा या सरकारी-जनिी भागीिारी व्यवस्ट्र्ा लागू कर सकेगा। अपने स्ट्वय ं के सिाई कमाचारीवृंि तर्ा वाहनों के अजतररि बोडा सभी वाजणजज्यक क्षेत्रों की पहचान करेगा िहा ं दिन म ेंिो बार झाडू लगान े की आवश्यकता हो। (2 ) बोड ा या उसके द्वारा प्राजधकृत कोई अजभकरण सावािजनक सडकों, रेलव े स्ट्टेिनों, बस अड्डों, धार्माक स्ट्र्लों और वाजणजज्यक क्षेत्रों आदि के आसपास पयााप्त संख्या म ें और पयााप्त आकार के कूडिे ानों, यदि आवश्यक हो, की व्यवस्ट्र्ा तर्ा रखरखाव करेगा। (3 ) सक्षम प्राजधकारी जवकेंद्रीकृत और जनयजमत रीजत स े ठोस अपजिष्ट प्रबंधन दियोकलापों के प्रयोिन के जलए प्रत्येक वाड ा म ें एक कार्माक या कमाचारी अजभजहत करेगा, तादक वह कंटेनरों, सावािजनक िौचालयों, सामुिाजयक िौचालयों या सावािजनक स्ट्र्ानों पर बन े पेिाबघरों, सावािजनक अपजिष्ट के जलए बनाए गए अंतरण स्ट्टेिन, लडैं दिल प्रसंस्ट्करण यूजनटों तर्ा इसी प्रकार के अन्य स्ट्र्लों का पयावेक्षण कर सके।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 13 (4 ) सक्षम प्राजधकारी ठोस अपजिष्ट के पृर्क्ककरण, संग्रहण, ढुलाई, प्रसंस्ट्करण और जनपटान कायों की प्रगजत की मानीटरी करन े के जलए पयााप्त संख्या म ें वररष्ठ अजधकाररयों को नोडल अजधकारी जनयुि करेगा, िो सहायक सिाई जनरीक्षक के रैंक या समतुल्य स ेनीच े का अजधकारी नहीं होगा। (5 ) प्रत्येक वाडा जवजहत मानिडं के आधार पर बुहारन े के हलके म ें जवभाजित दकया िाएगा और उसम ें तिनुरूप स्ट्वय ं के कार्माक या आउटसोसा द्वारा तैनात दकए िाएंगे या जवधमान तनै ाती को युजिसंगत बनाया िाएगा तर्ा उपयुि प्रौद्योजगकी का प्रयोग करते हुए उनके काया की मानीटरी की िाएगी तर्ा बोडा उपयुि समझे तो वह अपने क्षेत्राधीन सीमा के दकसी भाग में उि प्रयोिन के जलए सावािजनक जनिी साझेिारी कर सकेगा। (6 ) पयावेक्षण पिधाररयों द्वारा प्रत्येक हलके का जनरीक्षण समय-समय पर दिए गए जनिेिों अनसु ार िैजनक आधार पर दकया िाएगा। (7 ) बोडा सडक या गली साि करन े वाली मिीनों, यांजत्रक झाडूकिों या अन्य उपस्ट्करों का इस्ट्तेमाल करेगा, जिससे झाडू लगाने तर्ा नाजलयों की सिाई की सक्षमता म ेंसुधार होगा। (8 ) बोडा सूचना, जिक्षा और संसूचना अजभयान के माध्यम स े िागरूकता तर्ा संवेिनिीलता पिै ा करेगा और अपजिष्ट उत्पािकों और अन्य पणधाररयों को ठोस अपजिष्ट प्रबंधन जनयम, 2016 और इन उपजवजधयों के जवजभि उपबंधों के बारे म ें जिजक्षत करेगा जिसम ें उपयोिा िीस और िाजस्ट्त संबंधी उपबंधो की िानकारी पर जविषे बल दिया िाएगा। (9 ) बोडा अपजिष्ट उत्पािकों को इस बात के जलए प्रोत्साजहत करेगा दक वे गीले अपजिष्ट को स्रोत पर ही जनपटाए और वह जवकेंद्रीकृत प्रौधोजगदकयां िैसे बायो-जमर्ेनेिन, कम्पोपस्ट्टंग तर्ा इसी प्रकार की अन्य जवजधया अपनाने के जलए प्रोत्साहन िेन े पर भी जवचार करेगा। (10 ) इन प्रोत्साहनों म ें पररवारों, जनवासी कल्याण संगमों और संस्ट्र्ाओं को ईनाम तर्ा मान्यता िेना तर्ा इसी प्रकार के अन्य परु स्ट्कार, प्रमाण-पत्र एव ं सम्मान प्रिान करना, उनके नाम संबद्ध वेबसाइटों पर प्रकाजित करना या सम्पजि कर म ेंछूट प्रिान करना, आदि िाजमल होंगे। (11 ) बोडा स्ट्वयं द्वारा रखरखाव दकए िा रह े सभी उपवनों, उद्यानों और िहां कहीं संभव हो, अपन े अजधकाररता वाल े अन्य स्ट्र्ानों पर कम्पोस्ट्ट का उपयोग करेगा। (12 ) अनौपचाररक अपजिष्ट ररसाइकल सेक्टर द्वारा दकए िाने वाले ररसाइकल उपायों के जलए प्रोत्साहन भी प्रिान दकए िाएगं े। (13 ) बोडा ठोस अपजिष्ट प्रबंधन प्रणाजलयों को सुचारू और औपचाररक बनान े के उपाय करेगा और यह प्रयास करेगा दक अपजिष्ट प्रबंधन म ें अनौपचाररक क्षत्रे के िजमकों (कूडा बीनने वालों) को वरीयता िी िाए, तादक उनकी कायाजस्ट्र्जत को उित बनाया िा सके और उन्ह ें ठोस अपजिष्ट प्रबंधन की औपचाररक प्रणाली म ें समाजहत और एकीकृत दकया िा सके। (14 ) बोडा यह सुजनजश्चत करेगा दक स्ट्वच्छता सेवा के सुजवधा प्रचालन द्वारा अपने उन सभी कमाकारों को व्यजिगत सरु क्षा उपकरण सजहत विी, फ्लोरेसेंट िैकेट, िस्ट्तान,े रैनकोट, समुजचत िुटजवयर और मास्ट्क प्रिान दकए िाए,ं िो ठोस अपजिष्ट पररचालन का काय ा करते ह ैं और यह भी दक ऐस े कमाकारों द्वारा इन वस्ट्तुओं का प्रयोग दकया िाए। (15 ) बोडा कचरे के संग्रहण, ढुलाई और रखरखाव म ें िाजमल स्ट्वय ं के और बाहरी अजभकरण के कमाचारीवृंि की व्यावसाजयक सुरक्षा सुजनजश्चत करेगा और इसके जलए उन्ह ेंव्यजिगत सरं क्षा के उपयुि तर्ा समुजचत उपस्ट्कर प्रिान करेगा। (16 ) दकसी ठोस अपजिष्ट प्रसंस्ट्करण या उपचार या जनपटान केंद्र या लैंडदिल स्ट्र्ल पर कोई िघु ाटना होने की जस्ट्र्जत म,ें उस केंद्र का प्रभारी अजधकारी तत्काल बोडा को ररपोटा करेगा, िो जस्ट्र्जत की समीक्षा करन े के पश्चात उस केंद्र के प्रभारी अजधकारी को आवश्यक अनिु ेि, यदि कोई हो, िारी करेगा। (17 ) मुख्य कायाकारी अजधकारी या उनके द्वारा प्राजधकृत कोई अन्य अजधकारी वाडा के जवजभि भागों और ठोस अपजिष्ट के संग्रहण, ढुलाई, प्रसंस्ट्करण और जनपटान स े संबंजधत अन्य स्ट्र्ानों की जनयजमत िांच करेगा तर्ा ठोस अपजिष्ट प्रबंधन जनयम, 2016 और इन उपजवजधयों के जवजभि उपबंधों के अनुपालन का पयावेक्षण करेगा । (18 ) बोडा अपने मुख्यालय म ेंकॉल सेंटर की स्ट्र्ापना द्वारा िन जिकायत जनवारण प्रणाली जवकजसत करेगा।14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (19 ) इस िन जिकायत जनवारण प्रणाली म ें एसएमएस यर्ाजस्ट्र्जत मििरू ी या पाररिजमक के सार् एकीकृत करन े के प्रयास करेगा। (21 ) अजधक पारिर्िाता और सावािजनक पहुचं सुजनजश्चत करन े के जलए बोड ा अपनी वेबसाइट के माध्यम स े सभी आवश्यक सूचनाए ं उपलब्ध कराएगा। (22 ) बोडा ठोस अपजिष्ट प्रबंधन जनयम, 2016 के अधीन उपबंजधत सभी अन्य काय ा करेगा तर्ा सभी अन्य कताव्यों का जनवाहन करेगा, िो इन उपजवजधयों म ें जवजनर्िाष्ट रूप स े उजल्लजखत नहीं दकए गए ह।ैं अध्याय the draft of bye-laws, namely the Sagar Cantonment Board Solid Waste Management Bye-Laws, 2024 were published by the Ministry of Defence, Government of India vide S.R.O. 57(E) dated 24th July, 2024 in the Gazette of India, Extraordinary, Part II, Section 4 for inviting objections and suggestions18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] from all the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Gazette containing the said notification were made available to the public; AND, WHEREAS, the copies of the Gazette containing the said notification were made available to the public on the official website of the Sagar Cantonment Board on 29th August, 2024 and on the Notice Board on 29th August, 2024 and also published in the local newspapers on the 29th August, 2024; AND, WHEREAS, objections or suggestions so received from the public within the specified period were considered by the Board and suitably disposed of, vide Cantonment Board Resolution No. 01 dated 30th September, 2024; NOW, THEREFORE, in exercise of the powers conferred by section 348 of the Cantonments Act, 2006 (41 of 2006) read with rule 15 of the Solid Waste Management Rules, 2016, the Sagar Cantonment Board with the approval of the Central Government, hereby makes the following bye-laws namely:- CHAPTER I GENERAL 1. Short title and commencement.––(1) These bye-laws may be called the Sagar Cantonment Board Solid Waste Management Bye-laws, 2024. (2 ) They shall come into force on the date of their publication in the Official Gazette. 2. Applicability.––These bye-laws shall be applicable within the territorial limits of the Sagar Cantonment. 3. Definitions.––(1) In these bye-laws, unless the context otherwise requires,–– (a) “Act” means the Cantonments Act, 2006 (41 of 2006); (b) “Board” means the Sagar Cantonment Board; (c) “bulk garden and horticultural waste” means bulk waste from parks and gardens including grass clippings, weeds, woody brown carbon-rich material such aspruning, branches, twigs, wood chipping, straw, dead leaves, tree trimmings and suchother waste, which cannot be accommodated in the dailycollection system for bio-degradable waste; (d) “bulk waste generator” shall have the same meaning as assigned to it inclause 8 of sub-rule (1) of rule 3 of the Solid Waste Management Rules, 2016 and any other waste generator notified by the Chief Executive Officer from time to time; (e) “collection” means lifting and removal of solid waste from source of waste generation, collection points or any other location; (f) “competent authority” means the Chief Executive Officer of the Board or any other person authorised by him; (g) “construction and demolition waste” shall have the same meaning as assigned to it in clause (c) of sub-rule (1) of rule 3 of the Construction andDemolition Waste Rules, 2016; (h) “clean area” means the public place in front of and all around or adjacent to any premises extending to the kerbside and including the drain, foot path and kerb cleaned and so maintained in accordance with these bye-laws; (i) “community waste storage bin” means any storage facility set up andmaintained by the Board or collectively by owners or occupiers, as the case may be, of one or more premises for storage of solid waste in a segregated manner on the roadside or in the premises of any one of such owners or occupiers or in their common premises as authorised by the competent authority (hereafter referred to as the dhalao); (j) “containerised hand cart” means the hand cart provided by the Board or the agency or the agent appointed by it for point-to-point collection of solid waste; (k) “delivery” means handing over any category of solid waste to worker of the Board or any other person appointed, authorised or licensed by the Board for taking deliveryof such waste or depositing the same in any vehicle provided by it or by any other authorised agency or licensed by the Board to do so; (l) “e-waste” shall have the same meaning as assigned to it in clause (r) of sub-rule (1 ) of rule 3 of the E-Waste (Management) Rules, 2016;[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 19 (m) “fixed compactor transfer station” means a powered machine which is designed to compact segregated solid waste and remains stationary when in operation and the compactor may also be mobile when in operation, which may be called mobile transfer station; (n) “litter” means all refuse and includes any other waste material which, if thrown or deposited as prohibited under these bye-laws, tends to create nuisance or danger to any person, animal, environment or public health, safety andwelfare; (o) “littering” means causing, putting, burying, permitting or allowing litter in such a location that it falls, descends, blows, is washed, percolates or otherwise escapes or is likely to fall, descend, blow, be washed, percolate or otherwise escape into or onto any open or public place; (p) “owner” means any person who exercises the rights of an owner of any building, or land, or part thereof; (q) “occupier or occupant” means any person who is in occupation of or in possession and includes any person who for the time being is using, any land or building or part thereof, for any purpose whatsoever; (r) “pelletisation” means a process whereby pellets are prepared which are small cubes or cylindrical pieces made out of solid waste and includes fuel pellets which are also referred as refuse derived fuel; (s) "public place” means any place which is open to the use and enjoyment of the public, whether it is actually used or enjoyed by the public or not; (t ) "storage" means the temporary containment of solid waste in a manner so as to prevent littering, attraction to vectors, stray animals and excessive foul odor; (u) “sanitaryworker” means a person employed by the Board or the agency authorised by it for collecting or removing solid waste or cleansing the drains in the Sagar Cantonment areas; (v) “Schedule" means the Schedule annexed to these bye-laws; (w) “user fee or charges” means fees or charges imposed by the Board, through general or special order of the competent authority from time-to-time, on the waste generator to cover full or part cost of providing solid waste collection, transportation,processing and disposal services;and (x ) “vacant plot” means any land or open space, belonging to or under the management of any person or private agency or Government agency or Government department or public undertaking, which is not occupied. (2) The words and expressions used but not defined herein shall have the same meaning as respectively assigned to them in the Cantonments Act, 2006, the Solid Waste Management Rules, 2016, and the Construction and Demolition Waste Management Rules, 2016. CHAPTER II SEGREGATION AND PRIMARY STORAGE OF SOLID WASTE 4. Segregation and storage of solid waste at source.–– (1 ) It shall be the duty of all waste generators to separate and store the solid waste coming out of their respective places regularly into three streams, namely:–– (a ) non-biodegradable or dry waste; (b ) biodegradable or wet waste; (c ) domestic hazardous waste and deposit it into covered waste bins, and handover segregated waste to designated waste collectors as directed by the Board from time to time. (2 ) Every bulk waste generator is to separate and store the solid waste coming out of their own places into three streams, namely:–– (a ) non-biodegradable or dry waste; (b ) biodegradable or wet waste;20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (c ) hazardous waste in suitable bins and handover segregated waste to authorised waste processing or disposal facilities or deposition centres through the authorised waste collection agency by paying the carrying charges specified by the Board from time to time. (3 ) The colour of bins for storage of segregated waste shall be green for biodegradable waste, blue for non biodegradable or dry waste and black for domestic hazardous waste. (4 ) All resident welfare and market associations shall, in partnership with the Board, ensure segregation of waste at source by the generators, facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorised waste pickers or the authorised recyclers. (5 ) The biodegradable waste shall be processed, treated and disposed off through composting or bio-methanation within the premises as far as possible and the residual waste shall be given to the waste collectors or agency as directed by the Board. (6 ) All gated communities and institutions with more than 5,000 square meters area shall, in partnership with the Board, ensure segregation of waste at source by the generators; facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorised waste pickers or the authorised recyclers. (7 ) All hotels and restaurants shall, in partnership with the Board, ensure segregation of waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorised waste pickers or the authorised recyclers. (8 ) No person shall organise an event or gathering of more than one hundred person atany unlicensed place without intimating the Board, either by physically or through online, along with payment of user fee as specified in the First Schedule, at least three working days in advance and such person or the organiser of such event shall ensure segregation of waste at source and handing over of segregated waste to waste collector or agency as directed by the Board. (9 ) Used sanitary waste are to be securely wrapped as and when generated in the pouches provided by the manufacturers or brand owners of these products or in a newspaper or suitable biodegradable wrapping material and place the same in the bin meant for non- biodegradable waste or dry waste. (10 ) Every street vendor shall keep suitable containers for storage of segregated waste generated during the course of his activity such as food waste, disposable plates, cups, cans, wrappers, coconut shells, leftover food, vegetables or fruits, and shall deposit such waste at waste storage depot or container or vehicle as notified by the Board. (11 ) Waste generator of garden and horticulture waste generated from his premises shall store such waste separately in his own premises and dispose of the same as per the directions of the Board from time to time. (12 ) Domestic hazardous waste shall be stored and delivered by every waste generator to the collection vehicle which shall be provided periodically by the Board or any other agency authorised by it or the Government of Madhya Pradesh or the Madhya Pradesh Pollution Control Board for collection of such waste, or to a centre designed for collection of such waste for disposal in such manner as may be directed by the Government of Madhya Pradesh or the Madhya Pradesh Pollution Control Board. (13 ) Construction and demolition waste shall be stored and delivered separately as provided under the Construction and Demolition Waste Management Rules, 2016. (14 ) No untreated bio-medical waste, e-waste, hazardous chemicals and industrial waste shall be mixed with solid waste andsuch waste shall be disposed of in accordance with the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules or regulations made thereunder. (15 ) Every owner or occupier of any premises other than designated slaughter houses and markets, who generates poultry, fish and slaughter waste as a result of any commercial activity, shall store the same separately in closed, hygienic condition and deliver it at a specified time, on a daily basis to the collection vehicle provided by the Board for this purpose: Provided that there shall not be any depositing of such waste in any community waste bin and such deposition is strictly prohibited. (16 ) Segregated bio-degradable solid waste if not composted by the generators, shall be stored by them within their premises and its delivery shall be ensured to the worker of the Board or vehicle; or waste picker or waste collector or to the waste collection vehicle provided for specified commercial generators of bulk biodegradable waste at such times as may be notified by the Board from time to time.[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 21 CHAPTER III SOLID WASTE COLLECTION 5. Collection of solid waste.–– (1 ) In compliance with the Solid Waste Management Rules, 2016, door to door collection of segregated solid waste shall be implemented in all areas or wards of the Board, to collect garbage from every house, including slums and informal settlements on a daily basis by integrating the informal door to door collection system with Boards collection system. (2 ) In order to collect garbage from every house, area-wise specific time slot shall be set and published at conspicuous parts of that area and on the website of the Board. (3 ) The time for house to house garbage collection shall be set from 6 am to 11 am. (4 ) For collection of garbage from trading establishments, shops in commercial areas or any other institutional waste generators, commonly the time shall be from 7 am to 12 noon. (5 ) The household, institution and commercial entities shall hand over the garbage to waste collector. (6 ) Arrangements shall be made for collection of residual solid waste from bulk waste generators, which are processing waste in-situ. (7 ) Residual solid waste from vegetable, fruit, flower, meat, poultry and fish market shall be collected on day to day basis. (8 ) Horticulture and garden waste shall be separately collected and disposed of once or twice in a week. (9 ) To make optimum use of biodegradable waste from fruits and vegetable markets, meat and fish markets, bulk horticulture and garden waste and to minimise the cost of collection and transportation, such waste shall be processed or treated within the area where waste is generated. (10 ) Manual handling of waste in the containers shall be prohibited and; if it is unavoidable due to unexpected constraints, manual handling shall be carried out under proper protection with due care for safety of workers. (11 ) Waste generators shall be responsible to deposit their segregated waste in the auto-tippers or rickshaws deployed by the Board or by the notified authorised waste collector. (12 ) Segregated waste from multi-storied buildings, apartments, housing complexes may be collected from the entry gate or any other designated location as directed by the competent authority. (13 ) Changing needs and advances in technology shall be taken into consideration for selection of collection equipment and vehicles from time to time. (14 ) Auto-tippers or vehicles of specific capacity with-hydraulically operated hopper covering mechanism from top having two compartments for carrying biodegradable and non-biodegradable waste separately with a hooter shall be deployed for collection of waste. (15 ) Automatic voice recorded device, bell or horn or other suitable device having sound not more than the permissible noise level shall be installed on every garbage collection vehicle used by the waste collectors. (16 ) Route plans for each primary collection and transportation vehicle shall be provided by the Board or by the notified authorised waste collector. (17 ) These route plans in tabular as well as geographical information system map form, duly approved by the Board shall mention starting point, starting time, waiting points, waiting time on route, end point and end time of the specified route. (18 ) The Board or the notified authorised waste collector shall provide a display board at each street to display the time-table of primary collection and transportation vehicles to allow residents avail the facility at specified time and such information shall also be uploaded on the website of the Board. (19 ) In narrow streets where it is not possible to provide service by auto tipper or the vehicle, a three- wheeler or smaller motorised vehicle with hydraulically operated hopper covering mechanism from top having two compartments for carrying wet and dry waste separately with a hooter, compatible with mobile transfer station shall be deployed. (20 ) In congested and narrower streets where it is not possible to provide service by a three-wheeler or any suitable smaller vehicle, cycle rickshaws or any other type of suitable equipment shall be deployed.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (21 ) Smaller, narrow or congested streets or lanes where even a three-wheeler or rickshaw or any other type of suitable vehicles may not be in a position to deploy, vantage points shall be designated at the start of the locality or street, where the collection vehicle shall be parked and the helper or driver of the vehicle shall carry a whistle and walk in the locality to announce arrival of the vehicle for collecting solid waste. (22 ) Time table for such collection system shall be displayed at the display board and uploaded on the website of the Board. (23 ) Every household shall be responsible to ensure to handover segregated waste to the collector at the designated place. (24 ) Auto tippers, three-wheelers, rickshaws and any other type of collection vehicles engaged in the service shall collect waste only from households and not from any other source, such as, dhalaos, open sites, ground, bins or drains. (25 ) The Board or its notified authorised waste collectors shall be responsible to cover all the streets or lanes of each zone for the primary collection of solid waste. CHAPTER IV SECONDARY STORAGE OF SOLID WASTE 6. Storage of solid waste in the secondary storage points.–– (1) Segregated solid waste collected from doorsteps shall be taken to waste storage depots, community storage bins or fixed mobile transfer stations or the locations specified by the Board for secondary storage of waste. (2 ) The secondary storage points shall have covered containers, of specified colour, for separate storage of the following, namely:–– (a) non-biodegradable or dry waste; (b) biodegradable or wet waste; (c) domestic hazardous waste. (3 ) Different coloured containers shall be used in the areas demarcated by the Board to keep segregated waste in the following manner, namely:–– (a ) green for biodegradable waste; (b) blue for non-biodegradable waste; (c ) black for domestic hazardous waste. (4 ) The Board shall, from time to time, notify mandatory colour coding and other specifications of containersas provided in the Solid Waste Management Rules, 2016 for storage and delivery of different types of solid waste to enable safe and easy collection without any mixing or spillage of waste, which generators of different types of solid waste shall adhere to. (5 ) The Board on its own or through outsourcing agencies shall maintain the storage facilities for solid waste in a manner that does not create unhygienic and unsanitary conditions around it. (6 ) Containers of various sizes in the secondary storage depots shall be provided by the Board or any agency authorised by it in different colours as specified in these bye-laws. (7 ) Storage facilities shall be created and established by taking into account quantities of waste generation in a given area and the density of population and such storage facilities shall be user friendly and shall be so designed to ensure compaction of waste and not exposed to open atmosphere. (8 ) All the housing co-operative societies, associations, colonies, residential and commercial establishments or gated communities shall have the responsibility to put colored bins as specified in these bye-laws and to keep adequate number of containers in clean and good condition in appropriate places in their own complexes at their own cost, so that the daily waste generated there can be properly deposited. (9 ) The Board or the agency authorised by it shall carry out washing and disinfection of all the bins on a regular basis.[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 23 7. Recycling centres for dry waste (Non-biodegradable waste).–(1 ) The Board shall convert its existing dhalaos or identify specific locations as per requirement, as ‘recycling centres’ which shall be used for segregation of dry waste received through street or door to door waste collection service. (2 ) Recycling centres may be increased depending on the quantity of dry waste received. (3 ) Dry (non-biodegradable) waste collected through street or door- to-door collection system and from commercial establishments shall be transferred to the designated recycling centres and such designated centres shall receive only dry waste. (4 ) The households may also directly deposit or sell their recyclable dry waste to the authorised agents or authorised waste dealers, as the case may be, of the Board at these recycling centres at pre-- notified rates. (5 ) The dealers shall maintain weighing scale and a counter at a permitted place at each recycling unit for this purpose. (6 ) The authorised agents or, as the case may be, the authorised waste dealers shall be allowed to dispose of or sell the recyclable waste to the secondary market or recycling units only in consonance with the provisions of the Solid Waste Management Rules,2016. (7 ) The authorised agents or authorised waste dealers shall be entitled to retain sales realisation thereof. 8. Deposition centre for specified domestic hazardous waste.––(1) For the collection of domestic hazardous waste, a deposition centre shall be set up at a suitable location for receiving the specified domestic hazardous waste and such facility shall be set-up in each ward in such manner as may be decided by the Government and notify the timing of receiving of such waste. (2 ) The Board may also give the responsibility to authorised agent or concessionaire to collect domestic hazardous waste from all waste generators in segregated manner and such waste shall be transported separately to the hazardous waste disposal facility set up by the Government. CHAPTER V TRANSPORTATION OF SOLID WASTE 9. Transportation of solid waste.–– The transportation of solid waste shall be done in the following manner, namely:– (i ) vehicles used for transportation of waste shall be covered in such manner that the collected waste is not exposed to open environment and the vehicles may also include compactors and mobile transfer stations depending upon choice of technology by the Board; (ii) the storage facilities set up by the Board shall be attended daily for clearing waste and the areas surrounding the place where the bins or containers are kept shall also be cleaned; (iii ) the collected and segregated bio-degradable waste from residential and other areas shall be transferred to the processing plants like compost plants, bio- methanation plants or any such other facilities in a covered manner; (iv ) wherever applicable, for biodegradable waste, preference shall be given for on-site processing of such waste; (v ) collected non-bio-degradable waste shall be transported to the respective processing facilities or secondary storage facilities; (vi ) construction and demolition waste shall be transported as per the provisions of the Construction and Demolition Waste Management Rules, 2016; (vii ) the Board shall make arrangements for transportation of inserts in a proper manner. The street sweeping waste and removable drain silt shall be removed immediately after the work is over; (viii ) transportation vehicles shall be so designed that multiple handling of waste, prior to final disposal, is avoided; (ix ) the collection vehicles engaged for transportation purpose shall deposit or transfer the waste only at the mobile transfer station or fixed compactor transfer station wherever provided; (x ) in case mobile transfer station or fixed compactor transfer station are not stationed at the designated location at that point of time for any reason, then the loaded vehicle shall go to the next designated location of the mobile transfer station or fixed compactor transfer station or the site specified by the Board to unload the waste;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (xi ) fixed compactor transfer station shall be transported through hook loader; (xii ) the mobile transfer station or fixed compactor transfer station shall transport the waste directly to compost plant, waste to energy plant or any other site or plant as may be designated by the Board; (xiii ) there shall not be any inter-mixing of waste from various sources during the transportation of waste; (xiv ) the services of street level collection and transportation of waste shall be provided every day; (xv ) the mobile transfer station engaged in this service shall receive waste only from designated auto tippers, three-wheelers or vehicles or bins collecting waste from street level operations; (xvi ) the dedicated mobile transfer station shall be deployed at specified locations to receive waste from the auto-tippers, three-wheelers or rickshaws engaged in street-level and door-to-door collection of solid waste from households and commercial establishments as per the approved route plans; (xvii ) the design of mobile transfer station or fixed compactor transfer station shall allow unloading of waste from primary collection vehicles by consuming minimum time and without littering waste; (xviii ) the garbage spilled near mobile transfer station or fixed compactor transfer station, while transferring the solid waste, shall be cleaned so that no spillage is left. Disinfectant shall be used after cleaning process at that location; (xix ) the Board or its authorised agent or agency shall install closed circuit television cameras at all secondary storage facilities. CHAPTER VI PROCESSING OF SOLID WASTE 10. Processing of solid waste.–– (1 ) The Board shall facilitate construction, operation and maintenance of solid waste processing facilities and associated infrastructure on its own or through any agency for optimum utilisation of various components of solid waste adopting suitable technology including the following technologies and adhering to the guidelines issued by the Central Government in the Ministry of Urban Development from time to time and standards prescribed by the Central Pollution Control Board, namely:– (a ) to minimise transportation cost and environmental impacts, preference shall be givento decentralised processing such asbio-methanation, microbial composting, vermi- composting, anaerobic digestion or any other appropriate processing for bio-stabilisation of biodegradable waste; (b ) through medium or large composting or bio-methanation plants at centralised locations; (c ) through waste to energy processes by refuse derived fuel for combustible fraction of waste or supply as feedstock to solid waste-based power plants; (d ) through construction and demolition waste management plants; and (e ) to make all endeavours to create a market for consumption of refuse derived fuel to the extent it is possible. (2 ) In waste to energy plant by direct incineration, absolute segregation shall be mandatory and be part of the terms and conditions of the relevant contracts. (3 ) The Board shall endeavour that recyclables such as paper, plastic, metal, glass, or textile material go to authorised recyclers. 11. Other guidelines for processing of solid waste.– (1) The Board shall enforce processing of bio-degradable waste on site of generation of such waste through composting or bio-methanation, as far as possible, at resident welfare associations, group housing societies, markets, messes of armed forces and other agencies, gated communities and institutions with more than 5000 square metres. areas, all hotels and restaurants, banquet halls and places of such nature and preference shall be given for on-site processing of biodegradable waste generated by other waste generators as well. (2 ) The Board shall enforce that markets dealing with vegetables, fruits, flowers, meat, poultry and fish waste while processing bio-degradable waste ensure hygienic conditions. (3 ) The Board shall enforce processing of horticulture, parks and garden waste separately in the parks and gardens as far as possible.[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 25 (4 ) The Board shall take all steps to involve communities in waste management and promote home composting, bio-gas generation, decentralised processing of waste at community level, subject to control of odor and maintenance of hygienic conditions around the facility. CHAPTER VII DISPOSAL OF SOLID WASTE 12. Disposal of Solid waste.–– (1) The Board shall undertake on its own or through any other agency, the construction, operation and maintenance of sanitary landfill and associated infrastructure for disposal of residual waste and inert street sweepings and silt from surface drains in such manner as may be provided in the Solid Waste Management Rules, 2016, and any other obligation imposed by any other law for the time being in force. (2 ) Notwithstanding anything contained in sub-paragraph (1), the Board may enter into agreement with any other municipal body or group of municipal bodies so as to get the residual waste, inert street sweeping waste, silt from surface drains and others generated within the area of responsibility of the Board are disposed in landfill and associated infrastructure constructed, operated and maintained by such municipal body or group of municipal bodies. CHAPTER VIII USER FEE AND PENALTY 13. User fee for collection, transportation and disposal of solid waste.–– (1) There shall be a user fee fixed for providing services for garbage collection, transportation and disposal from waste generators by the Board. The rates of user fee are as specified in the First Schedule. (2 ) The Board shall collect the user fee so fixed from waste generators or the authorised agency or any person authorised by the competent authority by a general or special order in this behalf. (3 ) The Board shall prepare the database of all the waste generators for the purpose of levying user fee, and evolve appropriate mechanism for billing or collection or recovery of such user charges, within six months from the date of notification of these bye-laws andthe database shall be updated regularly. (4 ) The Board may adopt different methods for collection of user fee including online payment, on particular days in a month, preferably in first week of each month, shall be fixed for collection of such user fee. (5 ) There shall also be a system of yearly or half yearly payment. (6 ) In case the user fee is paid in advance for the entire year, then amount for ten months shall be charged instead of twelve months. Similarly, for six months advance payment, five and half months demand amount shall be charged instead of six months. (7 ) In case of default of payment of user fee, the competent authority may recover the same from the defaulter as an arrears of tax under sections 101,102 and 324 of the Act. 14. Penalty for contravention.–(1 ) Whosoever contravenes or fails to comply with any of the provisions of the Solid Waste Management Rules, 2016 or these bye-laws shall be imposed with penalty as specified in the Second Schedule. (2 ) In case of contravention continues or non-compliance as mentioned in sub-paragraph (1) for every such default, penalty which may extend to five hundredrupees shall be imposed on per day basis. CHAPTER IX RESPONSIBILITIES OF STAKEHOLDERS 15. Responsibilities of waste generators. –– (1 ) Prohibition of littering:–– (a ) no person shall litter in any public place except in authorised public or private litter receptacles. No person shall repair vehicles, wash or clean utensils or any other object or keep any type of storage in any public place, open or vacant space, except in such public facilities or conveniences specifically provided for any of these purposes. (b ) no person shall litter on any open or vacant property except in authorised private or public receptacles.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (c ) no person, whether a driver or passenger in a vehicle, shall litter upon any street, road, sidewalk, playground, garden, traffic island or other public place. (d ) no person shall drive or move any truck or other goods vehicle unless such vehicle is so constructed and loaded as to prevent any load, contents or litter from being blown off or deposited upon any road, sidewalks, traffic island, playground, garden or other public place. (e ) it shall be the responsibility of the owner of any pet animal including dog, cat or such other animal to promptly scoop or clean up any litter created by such pet on the street or any public place and take adequate steps for the proper disposal of such waste preferably by their own sewage system (f ) no person shall litter in any drain, river, open pond or in water bodies. (2 ) Burning of waste:–– Disposal by burning of any type of solid waste at public places or at any private or public property is strictly prohibited. (3 ) Clean Area:–– (a) every person shall endeavour that any public place in front of or adjacent to any premises owned or occupied by him including the footpath and open drain or gutter and kerb is free of any waste, either in solid or liquid form; (b ) for public gatherings and events organised in public places for any reason (including for processions, exhibitions, circuses, fairs, political rallies, commercial, religious, socio- cultural events, protests and demonstrations, and other similar things) where permission from the police department or from the Board, as the case may be, is required, it shall be the responsibility of the organiser of the event or gathering to ensure the cleanliness of that area as well as all appurtenant areas; (c ) refundable cleanliness deposit, as notified by the Board, shall be collected by the authorised officer for the duration of the event from the organiser. (d ) the deposit shall be refunded on the completion of the event after it is noted that the said public place has been restored back to a clean state, and any waste generated as a result of the event has been collected and transported to designated sites. (e ) thedeposit collected by the Board is only for maintenance of cleanliness of the public place and does not cover any damage to property. In case the organisers of the event wish to avail of the services of the Board for the cleaning, collection and transport of waste generated as a result of that event, they may requestby making an application to the concerned department or section in the Board and pay the necessary charges as may be fixed by the competent authority for this purpose. (f ) dumping of solid waste on vacant plot and depositing construction and demolition waste at non-designated locations shall be dealt with by the Board in the following manner, namely:–– (i ) The Board may serve a notice on the owner or occupier of any premises requiring such owner or occupier to clear any waste on such premises in such manner and within such time as may be specified in such notice; (ii ) if, the person on whom the notice has been served fails to comply with the requirements imposed by the notice, such person shall be liable to pay penalty for each such failure, as ordered by the competent authority or by an employee as designated by the competent authority for the said purpose; (iii ) apart from paying the penalty on whom the aforementioned notice is served fails to comply with the requirement imposed by such notice, the competent authority or a person designated by him may, enter on the premises and clear the waste and recover from the occupier the expenditure incurred in having do so. 16. Duty of manufacturers or brand owners of disposable products and sanitary napkins and diapers.–(1) All manufacturers of disposable products such as, tin, glass, plastic packaging, and other similar things or brand owners who introduce such products in the market within the jurisdiction of the Board shall provide necessary financial assistance to the Board for establishment of waste management system.[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 27 (2 ) The Board may also coordinate with the concerned departments in the Central Government and with the Government of Madhya Pradesh for implementation of these provisions. (3 ) All such brand owners who sell or market their products in such packaging materials which are non-biodegradable shall put in place a system to collect back the packaging waste generated due to their production. (4 ) Manufacturers or brand owners or marketing companies of sanitary napkins and diapers shall explore the possibility of using all recyclable materials in their products or they shall provide a pouch or wrapper for disposal of each napkin or diapers along with the packet of their sanitary products. (5 ) It shall be the responsibility of all such manufacturers, brand owners or marketing companies to educate the masses for wrapping and disposal of their products. (6 ) All industrial units using fuel and located within one hundred kms’ from a solid waste based refuse derived fuel plant shall make arrangements to replace at least five percent of their fuel requirement by refused derived fuel so produced. 17. Responsibility of Board.– (1 ) The Board shall, within its territorial area, be responsible for ensuring regular system of surface cleaning of all common areas, such as streets or roads, public places, temporary settlements, slum areas, markets, parks owned by it, gardens or drains by employing human resources and machines and shall be bound to collect the garbage from the declared storage containers, and transport it every day to the final disposal point in closed vehicles for which the Board may engage private parties or agencies on contract or public private partnership mechanism, apart from its own cleaning staff and vehicles and the Board shall also identify all the commercial areas for carrying out sweeping twice a day, if needed. (2 ) The Board or any agency authorised by it shall provide and maintain sufficient number of community litter bins of proper size on public roads, in surroundings of railway stations, bus stops, religious places and in commercial areas, if found necessary. (3 ) The competent authority shall, for the purpose of managing solid waste activities in decentralised and regular manner, designate one official or an employee in every ward to supervise the spots of containers, public toilets, community toilets or urinals in public places, transfer station for public garage, landfill processing units, and other similar things. (4 ) The competent authority shall designate adequate number of senior officials, preferably not below the rank of Assistant Sanitary Inspector or equivalent, as Nodal Officers to monitor the progress of segregation, collection, transportation, processing and disposal of solid waste. (5 ) Each ward shall be divided into sweeping beats based on the prescribed parameter and deploy its own or outsourced manpower accordingly or rationalise the existing deployment and monitor their work by using latest and suitable technology and the Board may also enter into public private partnership for the said purpose as it deems fit for a portion of its area of responsibility (6 ) Each beat shall be inspected by the supervising officials on daily basis as per the directions given from time to time. (7 ) The Board shall employ latest road or street cleaning machines, mechanical sweepers or other equipment which improves the efficiency of sweeping and drainage cleaning. (8 ) The Board shall create awareness and sensitisation through information, education and communication campaign and educate the waste generators and other stakeholders about the various provisions of the Solid Waste Management Rules, 2016 and this bye-laws with special emphasis on user fee and penalties. (9 ) The Board shall encourage waste generators to treat wet waste at source and it may consider creating systems for incentives for adoption of decentralised technologies such as bio-methanation, composting, and other similar things. (10 ) Incentives may be like awarding and recognising the households, Resident Welfare Associations and institutions, etc., by giving certificates, by publishing their names on respective websites or rebate in property tax, and other similar things. (11 ) The Board shall undertake use of compost in all parks, gardens maintained by it and wherever possible, in other places under its jurisdiction. (12 ) Incentives may be provided to recycling initiatives by informal waste recycling sector.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (13 ) The Board shall make efforts to streamline and formalise solid waste management systems and make all endeavour that the informal sector workers in waste management (waste pickers) are given priority to upgrade their work conditions and are enumerated and integrated into the formal system of solid waste management. (14 ) The Board shall ensure that the operator of a facility provides personal protection equipment including uniforms, fluorescent jackets, hand gloves, raincoats, appropriate foot wear and masks to all workers handling solid waste and the same are used by the workforce. (15 ) The Board shall ensure occupational safety of its own staff and staff of outsourced agency involved in collection, transport and handling of waste by providing appropriate and adequate personal protective equipments. (16 ) In case of an accident at any solid waste processing or treatment or disposal facility or landfill site, the officer- in- charge of the facility shall report to the Board immediately which shall review and issue instructions, if any, to the in- charge of the facility. (17 ) The Chief Executive Officer or any other officer authorised by him shall conduct regular checks in various parts of the wards and other places of collection, transportation, processing and disposal of solid waste and supervise compliance of various provisions of the Solid Waste Management Rules, 2016 and this bye-laws. (18 ) The Board shall develop a public grievance redressal system by setting up of call centre at its headquarter. (19 ) The public grievance redressal system may include short message service based service, mobile application or web based services. (20 ) The Board shall install bio-metric or smart card technologies or Information and Communication Technology System for tracking and recording attendance of employees associated with the working of the Solid Waste Management Rules, 2016 and the bye-laws at their headquarters, all zonal offices and ward offices and shall make an endeavor to integrate such system with wages or remuneration, as the case may be. (21 ) To ensure greater transparency and public accessibility, the Board shall provide all necessary information through its website. (22 ) The Board shall perform all other functions and discharge all other duties provided under the Solid Waste Management Rules, 2016, which have not been specifically mentioned in this bye-laws. CHAPTER-X MISCELLANEOUS 18. Miscellaneous.–The Board shall co-ordinate with all other government agencies and authorities, to ensure compliance of these bye-laws within areas under the jurisdiction or control of such bodies THE FIRST SCHEDULE [See Paragraphs 4(8), 13(1)] USER FEE FOR SOLID WASTE MANAGEMENT S.
