2 द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए, सोमाजलया और इरीररया स े सम्बंजधत संयुक्त राष्ट्र सुरक्षा पररषद संकल्पों को
लाग ू करन े के बाबत आदेि, 2016 का और संिोधन करने के जलए जनम्नजलजखत आदेि िारी करती ह,ै अर्ाात:-
(1) इस आदेि का संजक्षप्त नाम सोमाजलया और इरीररया स े सम्बंजधत संयुक्त राष्ट्र सुरक्षा पररषद संकल्प को लाग ू
करने के बाबत (जद्वतीय संिोधन) आदेि, 2022 ह ै।
(2) यह रािपत्र म ें इसके प्रकािन की तारीख स ेलागू होगा।
2. सोमाजलया और इरीररया स े सम्बंजधत संयुक्त राष्ट्र सुरक्षा पररषद संकल्पों को लागू करने के बाबत आदेि, 2016 (जिसे
इसम ें इसके पश्चात उक्त आदिे कहा गया ह)ै का प्रस्ट्तािना म,ें "और 2244 (2015)" अंको, कोष्ठकों और िब्द के स्ट्र्ान पर
"2244 (2015), 2607 (2021) और 2628 (2022)" िब्द, अंक और कोष्ठक रखे िाएगं े।
3. उक्त आदेि के पैरा 2 के, उप-पैरा (1) के, खंड (क) म ें "और 2244 (2015)" अंक, कोष्ठकों और िब्दों के स्ट्र्ान पर
"2244 (2015), 2607 (2021) और 2628 (2022)" िब्द, अंक और कोष्ठक रख े िाएंगे।

(च) एफिीएस (एसएसएसआई) के अलािा सोमाजलया के सुरक्षा क्षत्रे संबंधी संस्ट्र्ान;"
(ग) मद (vii) के पश्चात, जनम्नजलजखत मद ेंअतं : स्ट्र्ाजपत की िाएंगी, अर्ाात:-
"(viii) रक्षात्मक उद्देश्यों के जलए हजर्यारों और सैन्य उपकरणों को ल े िाने िाले िहािों की अस्ट्र्ायी यात्राओं के जलए
सोमाजलया के बंदरगाहों म ेंप्रििे , परन्तु ऐसी मद ेंहर समय ऐसे िहािों पर ही रह ें[संकल्प 2607 का पैरा 34 (घ)];
(ix) हजर्यारों और सैन्य उपकरणों की जडलीिरी, या तकनीकी सलाह, जित्तीय और अन्य सहायता, और सैन्य गजतजिजधयों
से संबंजधत प्रजिक्षण का प्रािधान, जिसका उद्देश्य परू ी तरह स ेजनम्नजलजखत का जिकास हो:
(i) एफिीए का सोमाली राष्ट्रीय सुरक्षा बल(एसएनएसएफ), सोमाली लोगों को सुरक्षा प्रदान करन े के जलए, संकल्प
2607 के अनुबंध क और ख म ें िाजमल मदों स े संबंजधत मामलों को छोड़कर, िो मामला-दर-मामला आधार पर
सजमजत के पूिा अनुमोदन तर्ा सजमजत की सूचनार्ा क्रमिः संकल्प 2607 के पैरा 21 (क), 23 और 24 म ें अजग्रम
अजधसूचना के अध्यधीन ह]ैं;
(ii) एफिीएस (एसएसएसआई) स े संबंजधत संस्ट्र्ाओं के अलािा सोमाली सुरक्षा क्षत्रे संबंधी संस्ट्र्ान, सोमाली लोगों
को सुरक्षा प्रदान करन े के जलए, संकल्प 2607 के अनुबंध क और ख स े संबंजधत मदों को छोड़कर, िो लागू अनुमोदनों
तर्ा अजधसूचना संबंधी प्रदक्रयाओं के अध्यधीन ह ैं [िैसा दक संकल्प 2607 के परै ा 21 (ख) और (ग), 25 और 26 म ें
जनधााररत दकया गया ह]ै।

हो रह ेजिलंब पर चचंता व्यक्त करते हुए, राष्ट्रीय प्रार्जमकताओं संबंधी प्रगजत के महत्ि को रेखांदकत करते हुए जिसम ेंराष्ट्रीय
सुरक्षा अिसंरचना, सोमाजलया संक्रमण योिना (2021) (एसटीपी), नौिीं राष्ट्रीय जिकास योिना और संयुक्त रूप स े
सम्मत पारस्ट्पररक ििाबदेही संरचना, तर्ा एक संघीय पुजलस एि ंन्याय प्रणाली, जित्तीय संघिाद, िजक्त और संसाधन की
साझेदारी, तर्ा संिैधाजनक समीक्षा पर समझौता करना िाजमल ह,ैं इस संबंध म ें27 मई 2021 को सम्मत रोडमैप का
स्ट्िागत करते हुए, और एफिीएस और एफएमएस स ेइस ेजबना जिलंब लागू करने का आग्रह करते हुए,
अपन े राष्ट्रीय सुरक्षा बलों को जिकजसत करन े म ें इसकी आिश्यकताओं के मद्देनज़र अतं रराष्ट्रीय और क्षेत्रीय सहभाजगयों के
सार् समन्िय करन े के जलए एफिीएस को प्रोत्साजहत करत े हुए, यह संज्ञान म ें लेत े हुए दक इन बलों को अपन े कायों को
प्रभािी ढंग स े करन े के जलए इस संकल्प म ें ददए गए उपायों के अनसु ार हजर्यारों और जििेष उपकरणों तक पहुचं बनाने की
आिश्यकता ह,ै
राष्ट्रीय डब्ल्यूएएम रणनीजत को अपनान े सजहत हजर्यार एि ं गोला-बारूद प्रबंधन (डब्ल्यूएएम) पर एफिीएस द्वारा की गई
प्रगजत का स्ट्िागत करते हुए, हजर्यार एि ंगोला-बारूद प्रबंधन संबंधी नीजतयों को संजहताबद्ध और कायााजन्ित करने के जलए
सतत काय,ा जिसम ें सोमाजलया के समस्ट्त सुरक्षा बल के जलए एक ििाबदेह हजर्यार जितरण और अनरु ेखण प्रणाली का
जिकास करना िाजमल ह,ै हते ु अनुरोध करत े हुए, यह स्ट्िीकार करते हुए दक प्रभािी हजर्यार एि ं गोला-बारूद प्रबंधन
एफिीएस और एफएमएस का दाजयत्ि ह,ै तर्ा एफिीएस और एफएमएस को इसम ें सहयोग प्रदान करन े के जलए
सोमाजलया के सहभाजगयों को प्रोत्साजहत करत े हुए, और सोमाजलया की राष्ट्रीय सुरक्षा अिसंरचना और एसटीपी का
अनुसरण करते हुए,
िस्त्र प्रजतरोध का उल्लंघन करते हुए सोमाजलया को और उसके िररए हजर्यारों और गोला-बारूद की आपूर्त ा की चनंदा
करते हुए, जििेषत: िब िे अल-िबाब और आईएसआईएल स े िुड़े सहयोजगयों तक पहुचं त े ह,ैं और िब िे इस क्षत्रे म ें िांजत
और जस्ट्र्रता के जलए एक गंभीर खतरे के रूप म ें सोमाजलया की संप्रभुता और क्षेत्रीय अखंडता को कमज़ोर करते ह,ैं तर्ा
यमन स े सोमाजलया तक हजर्यारों, गोला-बारूद और आईईडी घटकों की जनरंतर अिैध आपूर्त ा की भी चनंदा करते हुए ,
सोमाजलया और उसके बाहर अल-िबाब के आतंकिादी हमलों की चनंदा करत े हुए, इस जिषय म ें गंभीर चचंता व्यक्त करत े
हुए दक अल-िबाब जििेष रूप स े तात्काजलक जिस्ट्फोटक उपकरण (आईईडी) का उपयोग बढ़ाकर और िधै जित्तीय प्रणाली
का अनुजचत लाभ लेने के माध्यम से सोमाजलया और इस क्षत्रे की िांजत, सुरक्षा और जस्ट्र्रता के जलए एक गंभीर खतरा
बना हुआ ह,ै तर्ा सोमाजलया म ें ‘इस्ट्लाजमक स्ट्टेट इन इराक एंड दद लेिांट’ (आईएसआईएल जिसे दा’ एि के नाम स े भी
िाना िाता ह)ै स े िुड़ े सहयोजगयों की जनरंतर उपजस्ट्र्जत पर भी गंभीर चचंता व्यक्त करत े हुए,
उपयुक्त अतं रराष्ट्रीय मानि अजधकार कानून, अंतरराष्ट्रीय िरणार्ी कानून, और अतं रराष्ट्रीय मानिीय कानून सजहत संयुक्त

उत्पन्न दकया गया ह ै िह इस सगं ठन की पारंपररक सैन्य कारािाई और अजनयजमत युद्ध प्रणाली स े अजधक खतरनाक ह,ै अल-
िबाब की रािस्ट्ि उत्पादन की क्षमता पर गंभीर चचंता व्यक्त करत े हुए िैसादक सोमाजलया (एस/2021/849) पर4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
जििेषज्ञों के पनै ल (दद पनै ल) की अंजतम ररपोट ा म ें दि ा ह,ै सोमाजलया के जित्तीय क्षत्रे को मिबतू करने के जलए एफिीएस के
प्रयासों का स्ट्िागत करत े हुए तादक मनी लॉचन्रंग िोजखमों की पहचान और जनगरानी की िा सके तर्ा आतंकिाद के
जित्तपोषण को रोका िा सके, संस्ट्र्ागत क्षमता जनमााण पर एसटीपी में एफिीएस द्वारा उठाए गए ऐसे कदमों को संज्ञान म ें
लेते हुए िो सोमाजलया के आर्र्ाक भजिष्य को सक्षम बनाने के जलए जित्तीय सेिाओं के महत्ि को ध्यान म ें रखत े हुए इन
क्षमताओं को जिकजसत करन े का प्रयास करते ह,ैं अल-िबाब के जित्त-पोषण को बाजधत करने के उद्देश्य स े एक योिना
जिकजसत करने के जलए एफिीएस, रग्स एंड क्राइम संबंधी सयं ुक्त राष्ट्र कायाालय (यूएनओडीसी) और दद पनै ल द्वारा दकए
गए प्रयासों का भी स्ट्िागत करते हुए, तर्ा इस प्रदक्रया को सहयोग प्रदान करन े के जलए एफिीएस, एफएमएस, सोमाजलया
के जित्तीय संस्ट्र्ानों, जनिी क्षत्रे और अंतरराष्ट्रीय समुदाय स े सहभाजगता का अनरु ोध करत े हुए,
सोमाजलया म ें भ्रिाचार और सािािजनक संसाधनों के जिपर्न की लगातार खबरों पर चचंता व्यक्त करते हुए, भ्रिाचार को
कम करने के जलए एफिीएस द्वारा दकए गए प्रयासों का स्ट्िागत करत े हुए जिसम ें 21 जसतंबर 2019 को भ्रिाचार-रोधी
कानून का प्रितान और भ्रिाचार-रोधी आयोग की स्ट्र्ापना, तर्ा भ्रिाचार के जिरुद्ध संयुक्त राष्ट्र कन्िेंिन का अनुसमर्ान
िाजमल ह,ै सािािजनक जित्तीय प्रबंधन और जित्तीय ररपोर्टिंग केंद्र के सकारात्मक काय ा को सुदढ़ृ करने म ें एफिीएस और
एफएमएस द्वारा की गई प्रगजत का स्ट्िागत करत े हुए, और भ्रिाचार को दरू करने के प्रयास िारी रखन,े और सुधार की गजत
में तेिी लाना िारी रखन े के जलए एफिीएस और एफएमएस का आह्िान करते हुए,
चारकोल के जनयाात को कम करने के जलए एफिीएस,एफएमएस और संयक्तु राष्ट्र के सदस्ट्य राष्ट्रों द्वारा चारकोल गंतव्य
बाज़ारों के सार् दकए गए उपायों का स्ट्िागत करते हुए, जनयाात चबंदओंु पर मौिूदा चारकोल भंडार की जनगरानी और
जनयंत्रण के जलए अनुरोध करते हुए, चारकोल पर सोमाजलया की राष्ट्रीय नीजत, जिसका उद्देश्य चारकोल-भंडार के जनपटान
हते ु अतं देिीय चारकोल उपयोग के स्ट्र्ायी प्रबंधन का जिकास करना ह,ै के जिकास को और अजधक प्रोत्साजहत करत े हुए,
चीनी के व्यापार का अनुजचत लाभ उठाने की अल-िबाब की कजर्त क्षमता पर चचंता व्यक्त करते हुए तर्ा एफिीएस,
एफएमएस और क्षेत्रीय जहतधारकों से इसके समाधान हते ु आग्रह करत ेहुए,
सोमाजलया के क्षेत्राजधकार िाल े समुद्री क्षेत्र म ें अिैध और अजनयजमत मछली पकड़न े की जनरंतर ररपोटों पर चचंता व्यक्त
करते हुए, अिैध रूप स े मछली पकड़ने और अल-िबाब की रािस्ट्ि उत्पादन की क्षमता के बीच संबंध को ध्यान म ें रखत े
हुए, यह सुजनजश्चत करने के जलए दक सोमाजलया के उपयुक्त कानून के अनुसार मछली पकड़ने के लाइसेंस िारी दकए गए ह,ैं
अंतरराष्ट्रीय समुदाय के सहयोग स े सोमाजलया के अजधकाररयों को प्रोत्साजहत करते हुए, समुद्री क्षत्रे संबंधी िागरूकता और
प्रितान क्षमताओं म ें सुधार करने के जलए एफिीएस, एफएमएस और सोमाजलया के अजधकाररयों को यूएनओडीसी, उनके
अंतराष्ट्रा ीय सहभाजगयों और अन्य जहतधारकों के सार् काम करने के जलए और अजधक प्रोत्साजहत करते हुए,
गलमदु गु की जस्ट्र्जत पर चचंता व्यक्त करत े हुए, 2021 के चुनािों स े पहल े और उसके बाद जििादों के िांजतपणू ा समाधान के
महत्ि को दोहराते हुए, तर्ा सोमाजलया म ें दीघाकाजलक िांजत और जस्ट्र्रता सुजनजश्चत करने म ें समािेिी रािनीजत और
लोकतांजत्रक चुनाि के महत्ि की पुजि करते हुए,
सोमाजलया म ें मानिीय जस्ट्र्जत पर गंभीर चचंता व्यक्त करते हुए, बाढ़, सूखे, रटजियों के संक्रमण, िबरन जिस्ट्र्ापन और
कोजिड-19 स े उत्पन्न संयुक्त खतरे को ध्यान म ें रखत े हुए, तर्ा मानिीय सहायता को सुरजक्षत ढंग से पहुचं ान े म ें बाधा
डालन े िाले दकसी भी पक्ष, दकसी मानिीय जनजध या आपूर्ता के दकसी भी प्रकार के जिपर्न अर्िा दरूु पयोग, तर्ा मानिीय
कायाकतााओं के जिरुद्ध चहसं ा की गजतजिजधयों या उत्पीड़न की कड़े िब्दों म ेंचनंदा करते हुए,
सोमाजलया म ें यौन और चलगं -आधाररत चहसं ा के चचंतािनक स्ट्तरों का दस्ट्तािेिीकरण करन े िाली ररपोटों, महासजचि की
ररपोटा सजहत, को ध्यान म ें रखते हुए, इस े भी चचंता के सार् ध्यान म ें रखते हुए दक सोमाजलया बच्चों के जलए सबस े घातक
युद्ध क्षेत्रों म ें स े एक ह,ै िैसा दक बच्चों और सिस्त्र संघषा पर महासजचि की 2021 की ररपोट ा म ें उजल्लजखत ह,ै अंतरराष्ट्रीय[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
कानून का उल्लंघन करत े हुए सिस्त्र संघष ा म ें बच्चों की भती के उच्च स्ट्तर तर्ा अपहरण के उच्च स्ट्तर को भी चचंता के सार्
संज्ञान म ें लेते हुए, जिसम ें अल-िबाब मुख्य अपराधी बना हुआ ह,ै और सोमाजलया के अजधकाररयों स े आग्रह करते हुए दक
संकल्प 2467 (2019) के अनसु ार उपायों को लागू करन े के सार्, बच्चों के जिरुद्ध इन "छह गंभीर अपराधों " िैसादक
महासजचि द्वारा जचजह्नत दकया गया ह,ै के समाधान के प्रयासों को और मिबूत दकया िाए,
सोमाजलया म ें जस्ट्र्रता के जलए समािेिी संिाद और स्ट्र्ानीय मध्यस्ट्र्ता संबंधी प्रदक्रयाओं के महत्ि को दोहराते हुए ,
एफिीएस और एफएमएस दोनों के बीच तनाि को कम करने के जलए उन्ह ें रचनात्मक िाता ा म ें िाजमल करने के महत्ि की
पुजि करते हुए, और यह भी दोहराते हुए दक 2021 म ें चुनाि को सफलतापूिाक और िांजतपूण ा ढंग से संपन्न करान े स,े
िैसादक जनयोजित और सम्मत ह,ै सोमाजलया अन्य बातों के सार्-सार् मुख्य समस्ट्याओं पर पुन: ध्यान केंदद्रत कर पाएगा
जिनमें अल-िबाब द्वारा उत्पन्न खतरा, हजर्यारों और गोला-बारूद की तस्ट्करी, मानिीय आिश्यकताए,ं बाढ़, सखू े और
कोजिड-19 की समस्ट्याए ं िाजमल ह ैं तर्ा सोमाजलया की राष्ट्रीय प्रार्जमकताओं को परू ा करन े म ें सभी पक्षों को सक्षम बना
पाएगा,
पैनल की अंजतम ररपोट ा को ध्यान म ें रखत े हुए, पैनल और एफिीएस के बीच बढ़े हुए सहयोग का स्ट्िागत करत े हुए और यह
स्ट्मरण करत े हुए दक जििेषज्ञों के पैनल सुरक्षा पररषद के अजधदेि के अनुसार काम करत े ह,ैं
दिे के पुनर्नामााण, आतंकिाद के खतरे का मुकाबला करने और हजर्यारों और गोला-बारूद की तस्ट्करी को रोकने के प्रयासों
में एफिीएस के जलए समर्ान व्यक्त करत े हुए, यह सुजनजश्चत करन े के अपन े इराद े को दफर स े व्यक्त करत े हुए दक इस संकल्प
में ददए गए उपायों एफिीएस को इन उद्देश्यों की प्राजप्त म ें सक्षम बनाएंग,े यह देखते हुए दक सोमाजलया में सुरक्षा की जस्ट्र्जत
में इन उपायों की आिश्यकता बनी हुई ह,ै जिसम ें हजर्यारों की आिािाही पर सख्त जनयंत्रण िाजमल ह,ै लेदकन यह पुजि
करते हुए दक इससे सोमाजलया म ें जस्ट्र्जत जनरंतर समीक्षाधीन रहगे ी और यह इस संकल्प म ें जनजहत उपायों की उपयुक्तता की
समीक्षा करन े के जलए तैयार दकया िाएगा जिसम ें हाजसल की गई प्रगजत और इस संकल्प के अनपु ालन के आलोक म ें
यर्ािश्यक संिोधन, संभाजित बेंचमाका, जनलंबन या उपायों को िापस लेना िाजमल ह,ै
संकल्प 2444 (2018) के पैराग्राफ 1 स े 8 को स्ट्मरण करत े हुए, यह पुनः पुजि करत े हुए दक यह इरीररया और जिबूती के
बीच संबंधों को सामान्य बनाने स े संबंजधत घटनाक्रमों पर दजृ ि रखना िारी रखगे ा और इन मामलों के सद्भािनापूण ा
समाधान के जलए दोनों दिे ों का समर्ान करेगा।
इस संबंध म ें सोमाजलया म ें राष्ट्र- और िांजत-जनमााण के अपन े उद्देश्य को रेखांदकत करत े हुए, जिसम ें सोमाजलया और इस
क्षत्रे म ें अल-िबाब द्वारा िांजत और सुरक्षा के जलए उत्पन्न खतरे को कम करना और अल-िबाब की गजतजिजधयों के
जिघटनकारी प्रभाि को कम करना और सोमाजलया का सुरक्षा क्षत्रे के सुधारों, जििेष रूप स े हजर्यारों और गोला-बारूद
प्रबंधन और और जनम्नजलजखत पररचालन पैराग्राफ म ें उजल्लजखत उपायों और तंत्रों के माध्यम स े समर्ान करना िाजमल ह,ै
यह जनधााररत करत े हुए दक सोमाजलया के हालात इस क्षत्रे म ेंअंतराष्ट्रा ीय िांजत और सुरक्षा के जलए खतरा बने हुए ह,ैं
संयुक्त राष्ट्र चाटार के अध्याय VII के अधीन काया करत े हुए,
भाग 1: अल-िबाब के प्रभाि को कम करना
1. यह दोहरात े हुए दक अल-िबाब िांजत और सरु क्षा के जलए खतरा ह ै और इसकी आतंकिादी एि ं अन्य गजतजिजधयों का
सोमाजलया और इस क्षत्रे म ें जिघटनकारी प्रभाि पड़ा ह,ै और अल-िबाब के जित्तपोषण को जनिाना बनान,े समुद्री क्षत्रे
िागरूकता म ें सुधार करन,े चारकोल की जबक्री सजहत अिैध रािस्ट्ि सृिन को रोकने तर्ा आईईडी द्वारा उत्पन्न खतरे को

1क: अिधै जित्तपोषण का जनिाना बनाना
2. अल-िबाब की रािस्ट्ि और धनिोधन, संसाधनों का भंडारण एि ं हस्ट्तांतरण की क्षमता को चचंता के सार् नोट करत े
हुए, एफिीएस स े सोमाली जित्तीय प्राजधकरणों, जनिी क्षत्रे के जित्तीय संस्ट्र्ानों और अंतरााष्ट्रीय समुदाय के सार् मनी
लॉचन्रंग, आतंकिादी जित्तपोषण खतरों की पहचान करन,े उनका मल्ू यांकन करन े और उपिमन करन,े अनुपालना (अपन े
ग्राहक को िान ें और उपयुक्त अध्यिसायी प्रदक्रयाओं सजहत) म ें सुधार के जलए काम िारी रखने का आह्िान करता ह ै और
पयािेक्षण एि ं प्रितना को सुदढ़ृ करता ह ै जिसम ें सोमाजलया के सेंरल बैंक और जित्तीय ररपोर्टिंग केंद्र को एंटी-मनी लॉचन्रंग
एड काउंटर द फाइनेंचसंग ऑफ टेरररज्म एक्ट (2016) और सार् ही मोबाइल मनी रेगलु ेिन (2019), के अनरूु प बढ़ी हुई
ररपोर्टिंग करना, एक राष्ट्रीय पहचान (आईडी) जबल पर हस्ट्ताक्षर करन े के जलए एफिीएस की सराहना करता ह ै और
जित्तीय पहुचं और अनुपालन म ें सुधार एि ं आतंकिाद के जित्तपोषण का मुकाबला करने के जलए एक प्रार्जमकता के मामल े
के रूप म ें एक अजद्वतीय सोमाली आईडी के जिकास को प्रोत्साजहत करता ह,ै इसके अलािा, इन खतरों के समाधान के जलए
अंतराष्ट्रा ीय समुदाय स े सहायता लेन े को प्रोत्साजहत करता ह ै और एफिीएस, यूएनओडीसी और पैनल स े अल-िबाब के
जित्तपोषण के बारे म ें सूचनाओं का आदान-प्रदान िारी रखने और अल-िबाब के जित्तपोषण को बाजधत करने और कानूनी
जित्तीय प्रणाली के उपयोग की योिना तैयार करने के जलए जहतधारकों के सार् काम करना िारी रखना िाजमल ह;ै
3. एफिीएस स े संयुक्त राष्ट्र के सदस्ट्य राष्ट्रों, जििेष रूप स े इस क्षत्रे के अन्य सदस्ट्य राष्ट्रों और अंतराष्ट्रा ीय भागीदारों के सार्
संकल्प 1373 (2001), संकल्प 2178 (2014), संकल्प 2462 (2019) और प्रासंजगक घरेल ू और अतं रााष्ट्रीय कानून के
अनुपालन सजहत आतंकिाद के जित्तपोषण को रोकने और उसका मुकाबला करने के जलए सहयोग और समन्िय को मिबूत
करने का अनरु ोध करता ह ै और एफिीएस स े अनुरोध करता ह ै दक पररषद को अपनी जनयजमत ररपोर्टिंग म ें आतंकिाद के
जित्तपोषण का मुकाबला करन े के जलए सोमाली प्राजधकाररयों द्वारा की गई जिजिि कारािाइयों पर अद्यतन जस्ट्र्जत स े
अिगत कराए;ं

4. समुद्री अपराध संबंधी चहदं महासागर मंच के तहत यूएनओडीसी के ितामान अजधदेि के अधीन इस े सोमाजलया म ें अिधै
समुद्री दव्यु ाापार पर कारािाई करने और आतंकिादी गजतजिजधयों को जित्तपोषण करन े िाल े िैध और अिैध सभी प्रकार के
सामानों की तस्ट्करी को बाजधत करन े के जलए क्षेत्रीय सहयोग बढ़ान े हते ु यरू ोपीय नौसेना बल ऑपरेिन अटलांटा, संयुक्त
समुद्री बल (सीएमएफ) और इस क्षत्रे म ें अन्य नौसैजनक बलों सजहत प्रासंजगक राष्ट्रीय एि ं अतं रााष्ट्रीय सगं ठनों को एक सार्
लाने के जलए प्रोत्साजहत करता ह,ै और तस्ट्करी और अिैध व्यापार म ें मछली पकड़ने िाले िहािों की भूजमका सजहत
एफिीएस और एफएमएस को उनकी समुद्री क्षत्रे िागरूकता और प्रितान म ें सुधार करने के जलए सहायता करता ह;ै
5. 15 निंबर 2022 तक संकल्प 2182 (2014) के पैरा 15 म ें जनधााररत उपबंधों को निीनीकृत और जिस्ट्ताररत करने का
जनणाय करता ह ै और सदस्ट्य राष्ट्रों को एफिीएस के सहयोग स े राष्ट्रीय स्ट्तर पर या स्ट्िैजछछक बहुराष्ट्रीय नौसैजनक भागीदारी
िैसे "संयुक्त समुद्री बलों" के माध्यम स े काय ा करने के जलए अजधकृत करता ह ै और जिसे एफिीएस ने महासजचि को
अजधसूजचत दकया ह ै और जिस े महासजचि न े बाद म ें सभी सदस्ट्य राष्ट्रों को अजधसूजचत दकया ह,ै तादक सोमाजलया पर
हजर्यारों पर प्रजतबंध के सख्त कायाान्ियन को सुजनजश्चत दकया िा सके और िे सोमाली समुद्र क्षेत्रीय िल म ें और
सोमाजलया के तट स े दरू अरब सागर और फारस की खाड़ी तक फैले हुए समुद्र म ें सोमाजलया आने िाले या िहा ाँ स े िाने
िाले िहािों, जिनके बारे म ें यह जिश्वास करने के जलए पयााप्त आधार ह ैं दक िे जनम्नजलजखत गजतजिजधयों म ें संलग्न ह,ैं पर
चारकोल प्रजतबंध, और आईईडी कल-पुिों पर प्रजतबंध लगाएगं े और जबना दकसी अनुजचत देरी के जनरीक्षण करेंग:े
(i) चारकोल प्रजतबंध के उल्लंघन म ें सोमाजलया स े चारकोल ल ेिाना;
(ii) सोमाजलया पर हजर्यारों के प्रजतबंध के उल्लघं न म ें सोमाजलया म ें प्रत्यक्ष या अप्रत्यक्ष रूप से हजर्यार या सैन्य
उपकरण ल ेिाना;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7
(iii) संकल्प 751 (1992) के अनुसरण म ें सजमजत द्वारा जनर्दिा व्यजक्तयों या संस्ट्र्ाओं को हजर्यार या सैन्य
उपकरण पहुचाँ ाना; अर्िा
(iv) आईईडी संघटकों पर प्रजतबंध के उल्लंघन म ें इस संकल्प के उपाबंध ग के भाग I म ें जचजह्नत आईईडी कल-
पुिों को ले िाना;

6. सोमाजलया स े चारकोल के जनयाात संबंधी पूणा प्रजतबंध के उल्लघं न म ें दकसी भी जनयाात की चनंदा करता ह,ै सोमाजलया
के चारकोल के आयात एि ं जनयाात पर प्रजतबंध के संबंध म ें अपन े जनणाय की पुजि करता ह ै िैसा दक इसके संकल्प 2036
(2012) के अनुछछेद 22 ("चारकोल प्रजतबंध") और संकल्प 2182 (2014) के अनछु छेद 11 से 21 म ें जनर्दिा दकया गया ह;ै
7. सोमाजलया से चारकोल के जनयाात को कम करन े के जलए एफिीएस, एफएमएस और सदस्ट्य राष्ट्रों द्वारा दकए गए उपायों
का स्ट्िागत करता ह,ै अपन े इस अनुरोध को दोहरात े हुए दक सोमाजलया म ें अफ्रीकी संघ जमिन (एएमआईएसओएम)
सोमाजलया स े चारकोल के जनयाात पर पूण ा प्रजतबंध को लाग ू करन े म ें एफिीएस और एफएमएस को समर्ान और सहायता
करता ह,ै घरेल ू चारकोल उपयोग के सतत प्रबंधन के जिकास के जलए सोमाजलया की राष्ट्रीय चारकोल नीजत म ें और बेहतरी
करन े को प्रोत्साजहत करता ह,ै एफिीएस की राष्ट्रीय चारकोल नीजत को जिकजसत करन े स े संबंजधत सूचना प्रदान करन े के
जलए एफिीएस को घरेल ू चारकोल उत्पादन संबंधी आंकड़े और उन्नत जिश्लेषण उपलब्ध कराने के के जलए, खाद्य एि ं कृजष
संगठन (एफएओ) को प्रोत्साजहत करता ह ै और चारकोल जनयाात करने िाले बंदरगाहों तक पैनल की जनयजमत पहुचं की
सुजिधा के जलए एएमआईएसओएम का आह्िान करता ह ै
8. सोमाजलया को और सोमाजलया स े चारकोल के जनयाात और आयात की जनगरानी और उसे रोकन े के जलए यूएनओडीसी
और इसके अंतरााष्ट्रीय सहभाजगयों के प्रयासों के महत्ि की पुजि करता ह;ै

9. अल-िबाब द्वारा दकए गए आईईडी हमलों म ें िृजद्ध को देखते हुए, जनणाय जलया दक सभी राष्ट्र इस संकल्प के अनुबंध ग के
भाग I म ें उजल्लजखत सामग्री के उनके भूक्षेत्रों से या उनके अपन े भूक्षेत्रों के बाहर उनके नागररकों, या अपन े ध्िि िहािों या
जिमानों का उपयोग करके सोमाजलया को दकए िाने िाले प्रत्यक्ष या अप्रत्यक्ष रूप स े जबक्री, आपूर्त ा या हस्ट्तांतरण को
रोकेंग,े यदद यह प्रमाजणत करने के पयााप्त सबूत ह ैं दक ऐसी सामग्री का उपयोग सोमाजलया म ें तात्काजलक जिस्ट्फोटक
उपकरणों के जनमााण म ेंदकया िा सकता ह ैया उनके उपयोग से इस तरह का बड़ा िोजखम हो सकता ह;ै
10. यह भी जनणाय करता ह ै दक िब इस संकल्प के अनुबंध ग के भाग I म ें उजल्लजखत कोई सामग्री पैराग्राफ 9 के अनुरूप
सोमाजलया को प्रत्यक्ष या अप्रत्यक्ष रूप स े जबक्री, आपूर्त ा या हस्ट्तांतररत की िाती ह,ै तो संबंजधत राष्ट्र ऐसी जबक्री, आपूर्त ा
या हस्ट्तांतरण के बाद 15 काया ददिसों के भीतर सजमजत को ऐसी जबक्री, आपूर्त ा या हस्ट्तांतरण के बारे म ेंअजधसूजचत करेगा,
और इस अनुछछेद के अनुसरण म ें िारी अजधसूचनाओं के महत्ि पर बल देता ह,ै जिसम ें सामग्री के उपयोग का उद्देश्य,
अंजतम उपयोगकता,ा तकनीकी जिजनदेि और भेिी गई सामग्री की मात्रा सजम्मजलत ह;ै

12. एफिीएस जिस्ट्फोटक आयधु जनपटान दलों के जनरंतर जििेषज्ञ प्रजिक्षण और जिस्ट्फोटकों के जिश्लेषण म ें सोमाली क्षमता
को सुदढ़ृ करने के जलए उपयुक्त उपकरण और समन्िय सहायता प्रदान करने के जलए सोमाजलया के अंतरराष्ट्रीय और क्षेत्रीय
भागीदारों को प्रोत्साजहत करता ह;ै

2क: सरु क्षा क्षत्रे म ेंसधु ार और अतं रराष्ट्रीय काननू का अनपु ालन
13. एफएमएस के सार् समन्िय में राष्ट्रीय सुरक्षा ढााँच े और एसटीपी के कायाान्ियन म ें गजत लान े के जलए एफिीएस का
आह्िान करता ह,ै और 27 मई 2021 रोडमैप को लाग ू करन े के जलए एफिीएस और एफएमएस स ेआग्रह करता ह;ै
14. इसके अलािा एफिीएस और एफएमएस स े उनके सुरक्षा तंत्र की नागररक जनगरानी बढ़ाने, मानिाजधकारों की समीक्षा
सजहत सभी रक्षा और सुरक्षा कर्मायों संबंधी उपयुक्त िांच प्रदक्रयाओं को अपनान े और लाग ू करना िारी रखन,े और िांच
करना और, िैसा उपयुक्त हो, अंतरराष्ट्रीय मानिीय कानून और मानिाजधकार कानून सजहत अंतरराष्ट्रीय कानून के उल्लघं न
और युद्ध एि ं युद्ध पश्चात ् जस्ट्र्जतयों म ें यौन और चलंग आधाररत चहसं ा के जलए जिम्मेदार व्यजक्तयों पर मुकदमा चलान े का
आह्िान करता ह,ै और इस संदभा में संयुक्त राष्ट्र द्वारा सोमाली सुरक्षा बलों और एएमआईएसओएम को ददए गए समर्ान के
संबंध म ेंमहासजचि की मानिाजधकार और उपयुक्त अध्यिसाय की नीजत के महत्ि को पुनः स्ट्मरण करता ह;ै
15. सोमाली सुरक्षा बलों को जिश्वसनीय, पेिेिर और प्रजतजनजध क्षमता िाले बलों के रूप म ें जिकजसत करन े म ें मदद करन े
के जलए एसटीपी के कायाान्ियन का समर्ान करने हते ु अंतरााष्ट्रीय समुदाय का आह्िान करता है;
16. सोमाजलया म ें संघषारत सभी पक्षों स े अंतरराष्ट्रीय मानिीय कानून का पालन करन े का आह्िान करता ह,ै और सैन्य
अजभयानों के पररणामस्ट्िरूप नागररक हताहतों की सूचना जमलन ेपर त्िररत और पूण ा िांच िारी रखन ेका आग्रह करता ह;ै

17. हजर्यारों और गोला-बारूद प्रबंधन म ें हुई प्रगजत का स्ट्िागत करता ह ैऔर हजर्यारों, गोला-बारूद और अन्य सैन्य
उपकरणों और उनके जितरण के सुरजक्षत और प्रभािी प्रबंधन, भंडारण और सुरक्षा सुजनजश्चत करने के जलए एफिीएस और
एफएमएस की जिम्मेदारी को रेखांदकत करता ह,ै जिसम ें एक ऐसी प्रणाली का कायाान्ियन िाजमल ह ै जिसमें इकाई स्ट्तर
पर ऐसे सभी सैन्य उपकरणों और आपूर्त ा को रैक करने की व्यिस्ट्र्ा ह;ै
18. यह पुनः पुजि करता ह ै दक एफिीएस, एफएमएस और एएमआईएसओएम के सहयोग स े आक्रामक हमल े के जहस्ट्से के
रूप म ें या उनके अजधदेि को पूरा करन े के दौरान िब्त दकए गए सभी हजर्यारों और सैन्य उपकरणों का दस्ट्तािेज़ीकरण
और पंिीकरण करेगा, जिनम ें हजर्यार और/या गोला-बारूद की प्रकृजत और क्रम संख्या को ररकॉडा करना, सभी सामजग्रयों
की फोटोग्राफी करना तर्ा उन्ह ें सुसंगत रूप स े जचजह्नत करना तर्ा सभी सैन्य सािो-सामानों के पुनः जितरण अर्िा उन्ह ें
नि करन ेसे पहल े पैनल द्वारा उनके जनरीक्षण की सुजिधा प्रदान करना िाजमल ह;ै
19. एफिीएस और एफएमएस की हजर्यारों और गोला-बारूद प्रबंधन क्षमता को जिकजसत करन े के जलए अजतररक्त एि ं
समजन्ित समर्ान प्रदान करने के जलए अंतराष्ट्रा ीय समुदाय स े अजतररक्त और प्रदान करने का आह्िान करता ह ै जिसम ें
प्रजिक्षण, भंडारण, बुजनयादी ढांच े और जितरण के जलए समर्ान, तकनीकी सहायता एि ं क्षमता जनमााण पर जििेष ध्यान
ददया गया ह ै और इस संकल्प की अपेक्षाओं के कायाान्ियन के जलए प्रभारी एफिीएस जनकायों को सुदढ़ृ बनान े म ें समर्ान के
प्रयासों के समन्िय हते ु अंतरराष्ट्रीय एिं क्षेत्रीय भागीदारों को प्रोत्साजहत करता ह;ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9
20. इस बात पर िोर ददया गया है दक कारगर हजर्यार और गोला बारूद प्रबंधन स े अल-िबाब और अन्य सिस्त्र समूहों
की सोमाजलया और इस क्षत्रे म ें हजर्यार प्राप्त करने की क्षमता घटेगी और इस प्रकार से इससे िांजत और सुरक्षा के जलए
खतरा कम होगा और इस बात की पुजि करता ह ैदक सभी राष्ट्र सोमाजलया म ें िांजत और जस्ट्र्रता स्ट्र्ाजपत करने के प्रयोिनों
के जलए सोमाजलया को हजर्यारों और सैन्य उपकरणों की सभी प्रदायगी पर एक सामान्य और पूण ा प्रजतबंध लाग ू रखेंग,े
जिसमें सभी प्रकार के हजर्यारों और सैन्य उपकरणों की आपूर्ता और इनके अजधग्रहणों के जलए जित्तपोषण पर रोक लगाना
तर्ा प्रत्यक्ष या अप्रत्यक्ष रूप स े तकनीकी सलाह, जित्तीय और अन्य सहायता देना और सैन्य गजतजिजधयों से संबंजधत
प्रजिक्षण प्रदान करना िाजमल ह,ै िब तक दक पररषद अन्यर्ा जनणाय नहीं लेती (िैसा दक इसके संकल्प 733 (1992) और
के पैरा 5 और संकल्प 1425 (2002) के पैरा 1 और 2 द्वारा प्रारजम्भक रूप स े अजधरोजपत दकया गया र्ा, इसके बाद "िस्त्र
प्रजतबंध" संदर्भात दकया गया;
21. यह स्ट्िीकार करत े हुये दक एफिीएस (एसएसएसआई) तर्ा सोमाली राष्ट्रीय सुरक्षा बल (एसएनएसएफ) और सोमाली
सुरक्षा क्षत्रे संस्ट्र्ानों को अपन े कायों को प्रभािी ढंग से करन े के जलए सोमाजलया की राष्ट्रीय सुरक्षा ढांचे और एसटीपी के
अनुरूप हजर्यारों और जििेषज्ञ उपकरणों के एक्सेस की आिश्यकता होगी और यहपुजि करत ेहुये दक िस्त्र प्रजतबंध जनम्न पर
लाग ूनहीं होगा:
(1) सोमाजलयाई लोगों को सुरक्षा प्रदान करने के जलए एसएनएसएफ के जिकास के जलए हजर्यारों और सैन्य उपकरणों
की आपूर्त,ा या तकनीकी सलाह, जित्तीय और अन्य सहायता तर्ा सैन्य गजतजिजधयों स े संबंजधत प्रजिक्षण प्रदान
करना, इस संकल्प के अनुबंध क और ख के मदों को छोड़कर, िो इस संकल्प के पैरा 23 और 24 म ें जनधााररत
अनुमोदनों और अजधसूचना प्रदक्रयाओं के अध्यधीन ह;ैं
(2) सोमाजलयाई लोगों को सुरक्षा प्रदान करन े के जलए एसएसएसआई के जिकास के जलए हजर्यारों और सैन्य उपकरणों
की आपूर्त,ा इस संकल्प के अनबु ंध क और ख के मदों को छोड़कर, िो इस संकल्प के पैरा 25 और 26 म ें जनधााररत
अनुमोदनों और अजधसूचना प्रदक्रयाओं के अध्यधीन ह;ैं
(3) सोमाजलयाई लोगों को सुरक्षा प्रदान करन े के जलए एसएसएसआई के जिकास के जलए तकनीकी सलाह, जित्तीय और
अन्य सहायता तर्ा सैन्य गजतजिजधयों स े संबंजधत प्रजिक्षण प्रदान करना, िो इस संकल्प के जनम्न पैरा 26 म ें जनधााररत
अनुमोदनों और अजधसूचना प्रदक्रयाओं के अध्यधीन ह;ैं
22. पुजि करता ह ैदक इस संकल्प के पैरा 21 म ें छूट के अनुसार बेचे या आपूर्त ा दकए गए हजर्यारों और सैन्य उपकरणों को
ऐसे दकसी भी व्यजक्त या संस्ट्र्ा या बेचने िाले या आपूर्ता करने िाला राष्ट्र या अंतरााष्ट्रीय, क्षत्रे ीय या उपक्षेत्रीय संगठन को
दोबारा बेचा या हस्ट्तांतररत नहीं दकया िाएगा और उनके उपयोग के जलए उपलब्ध नहीं कराया िाएगा, िो सोमाली
नेिनल सुरक्षा बल या सोमाली सुरक्षा क्षत्रे की संस्ट्र्ा की सेिा म ें नहीं ह,ै जिसे इन्ह ें मूल रूप से बेचा या आपूर्त ा की गई
र्ी,;
िस्त्र प्रजतबधं के तहत आिश्यक स्ट्िीकृजतया ं और सचू नाएं
23. पुन: पुजि करता ह ै दक सोमाजलयाई लोगों को सुरक्षा प्रदान करन े के जलए एसएनएसएफ के जिकास के जलए इस संकल्प
के अनुबंध क के अनुसार िस्ट्तओंु की जडलीिरी के जलए मामला-दर-मामला आधार पर सजमजत द्वारा अजग्रम अनुमोदन की
आिश्यकता होती ह,ै जिसके जलए अनुरोध एफिीएस या राष्ट्र या अंतरााष्ट्रीय, क्षेत्रीय या उप-क्षेत्रीय संगठन िो सहायता
प्रदान करत े ह ैंद्वारा कम से कम पांच काय ा ददिस पहल े प्रस्ट्ततु दकए िाएंगे;
24. पुन: पुजि करता ह ै दक सोमाजलयाई लोगों को सुरक्षा प्रदान करन े के जलए एसएनएसएफ के जिकास के जलए इस संकल्प
के अनुबंध ख म ें िस्ट्तुओं की जडलीिरी, एफिीएस या राष्ट्र या अंतरराष्ट्रीय, क्षेत्रीय या उप-क्षेत्रीय संगठन द्वारा सहायता

25. पुजि करता ह ै दक सोमाली लोगों को सुरक्षा प्रदान करन े के जलए एसएसएसआई के जिकास के जलए इस संकल्प के
अनुबंध क म ें िस्ट्तुओं की आपुर्ता के जलए मामला-दर-मामला आधार पर सजमजत द्वारा अजग्रम अनुमोदन की आिश्यकता

26. पुजि करता ह ै दक सोमाजलयाई लोगों को सुरक्षा प्रदान करन े के जलए एसएसएसआई के जिकास के जलए इस संकल्प के
जलए अनुबंध ख म ें िस्ट्तुओं की आपूर्त ा या तकनीकी सलाह, जित्तीय और अन्य सहायता और सैन्य गजतजिजधयों स े संबंजधत
प्रजिक्षण, आपूर्ता करन े िाले राष्ट्र या अंतरराष्ट्रीय, क्षेत्रीय और उप-क्षेत्रीय संगठन स े अजधसूचना प्राप्त करन े के पांच काया
ददिसों के भीतर सजमजत के नकारात्मक जनणाय की अनुपजस्ट्र्जत म ें प्रदान दकया िाता ह ै और राष्ट्रों या अंतरराष्ट्रीय, क्षेत्रीय
और उप-क्षेत्रीय संगठनों को एफिीएस को कम से कम पांच काय ा ददिस पहल ेऐसी दकसी भी आपूर्त ाके सार् सार् सूजचत
करन े का अनरुोध करता ह ै;
27. पुन: पुजि करता ह ैदक केिल मानिीय या सुरक्षात्मक उपयोग के जलए अजभप्रेत गैर-घातक सैन्य उपकरणों की जडलीिरी
के जिषय म ें आपूर्ता करन े िाल े राष्ट्र या अंतराष्ट्रा ीय, क्षेत्रीय या उप-क्षेत्रीय संगठन द्वारा सजमजत को पांच ददन पहल े
अजधसूजचत की िाएगी;
स्ट्िीकृजतयों और अजधसचू नाओं के बारे म ेंअजधक िानकारी
28. पुजि करता ह ै दक एफिीएस का प्रार्जमकता ह ै दक िह कम से कम पांच ददन पहल े एसएनएसएफ को हजर्यारों और
सैन्य उपकरणों की दकसी भी जडलीिरी के जलए अनुछछेद 23 या 24 के अनुसार सजमजत स े अनुमोदन प्राप्त करे या सूजचत
करे, और यह दक सभी अनुमोदन और अजधसूचनाओं के अनुरोधों में: हजर्यारों और सैन्य उपकरणों के जनमााता और
आपूर्ताकता ा का जििरण, प्रकार, कैजलबर और गोला-बारूद सजहत हजर्यारों और गोला-बारूद का जििरण, प्रस्ट्ताजित जतजर्
और जितरण की िगह और एसएनएसएफ म ें गंतव्य इकाई या भंडारण स्ट्र्ान की सभी प्रासंजगक िानकारी िाजमल होनी
चाजहए;
29. पुन: पुजि करता ह ै दक अनछु छेद 23 या 24 के अनुसरण म ें एसएनएसएफ को हजर्यार और सैन्य उपकरण की आपुर्त ा
करन े िाला राष्ट्र या अंतराष्ट्रा ीय, क्षेत्रीय या उप-क्षेत्रीय संगठन, िैकजल्पक रूप स,े एफिीएस के परामि ा स े अनुमोदन या
अजधसूचना के जलए अजग्रम अनरु ोध कर सकता ह,ै िैसा दक लागू हो, दफर स ेपुजि करता ह ैऐसा करन े के जलए चुनन े िाल े
राष्ट्र या अंतरराष्ट्रीय, क्षेत्रीय या उप-क्षेत्रीय संगठन को अनुमोदन या अजधसूचना के जलए अजग्रम अनुरोध के एफिीएस के
भीतर उपयुक्त राष्ट्रीय समन्िय जनकाय को सूजचत करना चाजहए और एफिीएस को अजधसूचना प्रदक्रयाओं के सार् तकनीकी
सहायता प्रदान करना चाजहए और सजमजत स े अनुरोध करना चाजहए दक राष्ट्रों या अंतरराष्ट्रीय, क्षेत्रीय या उप-क्षेत्रीय
संगठनों स े अनुमोदन और अजधसूचना के जलए अजग्रम अनुरोध एफिीएस म ें उपयुक्त राष्ट्रीय समन्िय जनकाय को प्रेजषत
दकया िाय;े
30. पुन: पुजि करता ह ै दक अनुछछेद 25 या 26 के अनुसरण म,ें एसएसएसआई को दकसी भी हजर्यार और सैन्य उपकरण,
तकनीकी सलाह, जित्तीय और अन्य सहायता और सैन्य गजतजिजधयों स े संबंजधत प्रजिक्षण देने िाले राष्ट्र या अंतरराष्ट्रीय,
क्षेत्रीय या उप-क्षेत्रीय संगठन को सजमजत से अनुमोदन प्राप्त करन े की जिम्मेदारी ह ै या उसे सूजचत करना ह,ै िसै ा लाग ू हो,
उन िस्ट्तुओं की दकसी भी जडलीिरी, सलाह, सहायता या प्रजिक्षण के जलए और एफिीएस को समानांतर म ें कम स े कम
पांच काया ददिस पहल े सूजचत करना और जनणाय लेना दक अनुमोदन और अजधसूचना के सभी अनरु ोधों म:ें जनमााता का
जििरण और सीररयल नंबर सजहत हजर्यारों और सैन्य उपकरणों के आपूर्ताकताा, प्रकार, कैजलबर और गोला-बारूद सजहत[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11
हजर्यारों और गोला-बारूद का जििरण, प्रस्ट्ताजित जतजर् और जडलीिरी की िगह और इजछछत गंतव्य इकाई, या भंडारण
के इजछछत स्ट्र्ान से संबंजधत सभी प्रासंजगक िानकारी िाजमल होनी चाजहए ;
31.चचंतािनक ररपोट ाको नोट करता ह ैदक राष्ट्र पूिा प्रस्ट्तािों म ें जनधााररत अजधसूचना प्रदक्रयाओं का पयााप्त रूप से पालन
नहीं कर रह े ह,ैं राष्ट्रों को अजधसूचना प्रदक्रयाओं के अनुसार उनके दाजयत्िों की याद ददलात े ह,ैं िो ऊपर पैरा 23-30 म ें
जनधााररत ह ैं और आग े राष्ट्रों स े एसएसएसआई को सहायता प्रदान करन े की प्रदक्रया म ें एफिीएस को सूजचत करने सजहत
सख्ती से इस अजधसूचना का पालन करने का आग्रह दकया ह;ै
32. पुजि करता ह ै दक िहां अनुछछेद 23 या 24 लाग ू होते ह ैं िहां एफिीएस हजर्यारों और सैन्य उपकरणों की आपूर्त ा के
30 ददन तक, एसएनएसएफ को दकसी भी आपूर्त ा के होने की जलजखत पुजि के रूप म ें एक पोस्ट्ट-जडलीिरी अजधसूचना
सजमजत को प्रस्ट्तुत करेंग,े जिसम ें हजर्यारों और सैन्य उपकरणों के जलए सीररयल नंबर, जिचपंग िानकारी, लदान का जबल,
कागो मैजनफेस्ट्ट या पैककंग सूजचयााँ और भंडारण का जिजिि स्ट्र्ान िाजमल ह ैतर्ा यह एफिीएस के सहयोग स े आपूर्त ाकरने
िाले राष्ट्र या अंतराष्ट्रा ीय, क्षेत्रीय या उप-क्षेत्रीय संगठन के महत्ि को मान्यता देता ह;ै
33. जनणाय करता ह ै दक अनुछछेद 25 या 26 के अंतगात आपूर्ता करने िाले राष्ट्र या अंतरााष्ट्रीय, क्षेत्रीय या उप-क्षेत्रीय
संगठन, एसएसएसआई को हजर्यारों और सैन्य उपकरणों की जडलीिरी के 30 ददनों तक, सजमजत को एक पोस्ट्ट-जडलीिरी
अजधसूचना प्रपत्र म ें प्रस्ट्तुत करेंग े जिसमें दकसी भी आपूर्त ा के पूरा होने की जलजखत पुजि,जिसमें हजर्यारों और सैन्य
उपकरणों के जलए सीररयल नंबर, जिचपंग िानकारी, लदान जबल, कागो मैजनफेस्ट्ट या पैककंग सूची और भंडारण की जिजिि
िगह िाजमल ह ैऔर इसके सार् सार् एफिीएस को भी सूजचत करेंग;े
िस्त्र प्रजतबधं के जलए अजतररक्त छूट
34. पजुि करता ह ैदक िस्त्र प्रजतबधं जनम्न पर लाग ूनहीं होगा:
(1) सोमाजलया म ें संयुक्त राष्ट्र सहायता जमिन (यूएनएसओएम) सजहत अफ्रीकी संघ जमिन (एएमआईएसओएम) के
सैन्य कायों के जलए संयुक्त राष्ट्र कर्मायों के सहयोग या इनके उपयोग के जलए हजर्यारों या सैन्य उपकरणों की
आपूर्त ा करना या तकनीकी सलाह देना, प्रजिक्षण देना; एएमआईएसओएम के रणनीजतक साझेदार ,िो इसके
सहयोग और समन्िय म ें निीनतम अफ्रीकी संघ रणनीजतक अिधारणा के संचालन म ें ही कायारत ह;ैं और संकल्प
2111 (2013) के पैरा 10 (क)- (घ) के अनुसार सोमाजलया में यूरोपीय संघ प्रजिक्षण जमिन (ईयूटीएम)
(2) एफिीएस के अनुरोध पर और जिसके जलए एफिीएस न े महासजचि को अजधसूजचत दकया ह,ै सोमाजलया के तट
पर समुद्री डकैती और सिस्त्र डकैती के कृत्यों को रोकन े के उपाय करन े िाल े राष्ट्रों या अंतरराष्ट्रीय, क्षेत्रीय और
उप-क्षेत्रीय संगठनों के एकमात्र उपयोग के जलए जनधााररत हजर्यारों और सैन्य उपकरणों की आपूर्त,ा परन्त ु दकए
गए कोई भी उपाय लाग ू अंतरााष्ट्रीय मानिीय और अंतरााष्ट्रीय मानिाजधकार कानून होने के अनुरूप हों;
(3) संयुक्त राष्ट्र के कर्मायों, मीजडया के प्रजतजनजधयों और मानिीय एि ं जिकास कायाकतााओं और संबंजधत कर्मायों के

35. अपन े संकल्प 1844 (2008) के जनणायों जिसके द्वारा लजक्षत प्रजतबंध लगाए गए ह ैं और संकल्प 2002 (2011) और
2093 (2013) िो सूचीबद्ध मानदंड का जिस्ट्तार करते ह ैंऔर अपन े संकल्प 2060 (2012) और 2444 (2018) के जनणायों
को स्ट्मरण करता ह ैऔर इसके अलािा स्ट्मरण करता दक सूचीबद्ध मानदंड म ें यौन और चलगं आधाररत चहसं ा से संबंजधत
काया करन,े योिना बनान,े जनदजे ित करने या काया करने के जलए िाजमल ह,ै लेदकन ये यहीं तक सीजमत नहीं ह ै और सदस्ट्य
राष्ट्रों की िांच म ें जििेषज्ञों के पैनल की सहायता करने के जलए उनके सार् और एफिीएस, एफएमएस और
एएमआईएसओएम और सहभाजगयों के सार्, जििेष रूप से अल-िबाब की गजतजिजधयों, िहां सूचीबद्ध मानदंड द्वारा
िाजमल दकया गया ह,ै के आचरण या उनकी िानकारी साझा करन े के जलए अपन े अनुरोध को दोहराता ह;ै
36. सजमजत को संकल्प 1960 (2010) के अनुछछेद 7 और संकल्प 1998 (2011) के अनुछछेद 9 के अनुसार बच्चों और
सिस्त्र संघषा के जलए महासजचि के जििेष प्रजतजनजध स े और संघषा म ें यौन चहसं ा के जलए जििेष प्रजतजनजध के सार् प्रासंजगक
िानकारी साझा करन े के जलए अनरुोध करता ह ै और संयुक्त राष्ट्र उच्चायुक्त कायाालय को मानिाजधकारों के जलए उपयुक्त
प्रासंजगक िानकारी साझा करन ेके जलए आमंजत्रत करता ह;ै
37. पुजि करता ह ै दक कहीं भी आयोजित मानिीय सहायता कायाक्रमों पर प्रजतकूल प्रभाि डाल े जबना, इसके संकल्प 1844
(2008) के अनछु छेद 3 द्वारा लगाए गए उपाय संयुक्त राष्ट्र, इसकी जिजिि एिेंजसयां या कायाक्रमों संयुक्त राष्ट्र महासभा के
सार् पयािेक्षक का दिाा रखने िाले मानिीय संगठन िो मानिीय सहायता प्रदान करत े ह ैं और उनके कायाान्ियन म ें
भागीदार जद्वपक्षीय या बहुपक्षीय रूप स े जित्त पोजषत गैर-सरकारी संगठन, िो सोमाजलया के जलए संयुक्त राष्ट्र मानिीय
सहायता योिना म ें भाग ले रह े हैं द्वारा सोमाजलया म ें तत्काल आिश्यक मानिीय सहायता के समय पर जितरण को
सुजनजश्चत करने के जलए आिश्यक धन, अन्य जित्तीय संपजत्तयों या आर्र्ाक संसाधनों के भुगतान पर लाग ू नहीं होंगे;

38. इस संकल्प को अंगीकार करन े की तारीख स1े 5 ददसंबर 2022 तक, सोमाजलया पर पैनल को निीकृत करन े का जनणाय
करता ह ै और पैनल के अजधदेि इसके संकल्प 2444 (2018) के पैराग्राफ 11 और के पैराग्राफ 2 म ें संदर्भात काया िाजमल
होंगे, महासजचि स े इसके संकल्प 2467 (2019) के अनुछछेद 11 के अनुरूप समर्पात मजहला पुरुष जििेषज्ञता को िाजमल
करन े का अनुरोध करता ह ैऔर आग ेअनुरोध करता ह ैदक पैनल अपनी िांच और ररपोर्टिंग म ेंिेंडर को एक क्रॉस-कटटंग मुद्दे
के रूप म ें िाजमल करे और पैनल के अजधदेि की समीक्षा करे और 15 निंबर 2022 तक अजधदेि के दकसी भी जिस्ट्तार के
संबंध म ेंउजचत कारािाई करे;
39. एफिीएस और पैनल के बीच पूण ा सहयोग के महत्ि को स्ट्मरण करता ह,ै जहरासत म ें जलए गए अल-िबाब और
आईएसआईएल के संददग्ध सदस्ट्यों के पैनल साक्षात्कार की सुजिधा के जलए एफिीएस स े अनुरोध करता ह ै और दस्ट्तािेज़
एस/2006/997 के अनुरूप अपने आदेि को पूरा करन े िाले पैनल के महत्ि को नोट करता ह ै तर्ा पैनल स े अनुरोध करता
ह ै दक हजर्यारों म ेंएफिीएस का समर्ान करने के तरीके पर सजमजत को जसफाररिें और राष्ट्रीय लघ ु िस्त्र तर्ा हल्के हजर्यार
आयोग की स्ट्र्ापना के प्रयासों सजहत गोला-बारूद प्रबंधन करे;
40. राष्ट्रों, एफिीएस, एफएमएस और एएमआईएसओएम के जलए पैनल को िानकारी प्रदान करन े और िांच म ें उनकी
सहायता के जलए अपना अनुरोध दोहराता ह ै और सुरक्षा पररषद को इस संकल्प के कायाान्ियन की जनगरानी और मूल्यांकन
करन े म ें सक्षम बनाने के जलए एफिीएस और एफएमएस से पैनल के जलजखत अनुरोध पर एफिीएस को मोगददिु म ें सभी
एफिीएस िस्त्रागार, सभी एफिीएस -आयाजतत पैनल की सुजिधा, जितरण स े पहल े हजर्यार और गोला बारूद,
सोमाजलया राष्ट्रीय सेना (एसएनए) क्षेत्रों म ें सभी एफिीएस सैन्य भंडारण सुजिधाएं और एफिीएस और एफएमएस के
कब्िे िाले हजर्यार और एफिीएस और एफएमएस के पास मौिूद हजर्यारों और गोला-बारूद की तस्ट्िीरों और एफिीएस

बारूद प्रबंधन क्षमता के तकनीकी मूल्यांकन को पूरा करने के बाद, इस े और बेहतर बनाने और स्ट्पि एि ं यर्ार्ािादी
बेंचमाका के जलए जिकल्पों को स्ट्पि करन े के जलए जसफाररि ें प्रदान करें िो सुरक्षा पररषद को आि की तारीख तक की गई
प्रगजत और इस संकल्प के अनपु ालन और जििेष रूप स े उन उपायों के संभाजित संिोधन, जनलंबन या इन्ह ें उठान े पर
जिचार के आलोक म ेंिस्त्र प्रजतरोध के उपायों की समीक्षा म ें मागादिान करन े म ें सहायता कर सकते ह;ैं
43. सोमाजलया म ें मानिीय सहायता प्रदान करन े और सोमाजलया म ें मानिीय सहायता प्रदान करन े म ेंदकसी भी प्रकार की
बाधा पर आपातकालीन राहत समन्ियक स े 15 अक्टूबर 2022 तक सुरक्षा पररषद को ररपोट ाकरने का अनुरोध करता ह;ै
44. एफिीएस स े अनुरोध करता ह ैदक िह संकल्प 2182 (2014) के पैरा 9 के अनुसार और िैसा दक संकल्प 2244
(2015) के पैरा 7 म ेंअनुरोध दकया गया ह ैिह 1 फरिरी 2022 तक और या दफर 1 अगस्ट्त 2022 तक सुरक्षा पररषद को
ररपोटा करे, जिसमें जनमन् जलजखत िाजमल ह:ैं

(ख) घरेल ू जित्तीय संस्ट्र्ानों द्वारा सूजचत संददग्ध गजतजिजध का अद्यतन सारांि, आतंकिाद के जित्तपोषण का
मुकाबला करन े और संिेदनिील िानकारी की गोपनीयता की रक्षा के जलए जित्तीय ररपोर्टिंग केंद्र द्वारा की गई
िांच और कारािाई;

सोमाजलया की जस्ट्र्जत पर राष्ट्रपजत के जपछले संकल्पों और बयानों को दोहराते हुए, और सोमाजलय की संप्रभुता, क्षेत्रीय
अखंडता, रािनीजतक स्ट्ितंत्रता और एकता के जलए अपन े सम्मान की पुजि करते हुए,
यह दोहराते हुए दक सोमाजलया की संघीय सरकार (एफिीएस) की प्रार्जमक जिम्मेदारी सोमाजलया में सुरक्षा सुजनजश्चत

प्रस्ट्तुत दकए गए प्रस्ट्ताि की सराहना करत े हुए,
8 माचा 2022 को अफ्रीकी संघ िांजत और सुरक्षा पररषद की अपनी 1068िीं बैठक की जिज्ञजप्त, और सोमाजलया म ें
एएमआईएसओएम को अफ्रीकी यूजनयन रांजििन जमिन (एटीएमआईएस) के रूप म ें पुनर्िाचाररत करन े के अपन े जनणाय को
ध् यान म ेंरखते हुए,
अफ्रीकी संघ द्वारा तैनात सैन्य टुकजड़यों तर्ा पुजलस दल और सोमाजलया के बल जनमााण तर्ा एकीकरण के प्रयासों, दोनों के
बीच मिबूत कमान और जनयंत्रण और पररचालन समन्िय सुजनजश्चत करन े की आिश्यकता पर बल देते हुए;
एकीकृत सोमाली सुरक्षा बलों और संस्ट्र्ानों को सुरक्षा खतरों का प्रभािी ढंग स े ििाब देने के जलए क्षमता जनमााण और
सुरक्षा क्षत्रे म ेंसुधार के महत्ि पर बल देत ेहुए, और क्षमता जनमााण और सुरक्षा सुधार का एकीकरण सुजनजश्चत करने के जलए
एफिीएस, सोमाजलया के संघीय सदस्ट्य राज्यों (एफएमएस), संयुक्त राष्ट्र, अफ्रीकी संघ, और सोमाजलया के अंतरराष्ट्रीय[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 17
साझेदार के बीच समन्िय के महत्ि और सोमाजलया को अपनी सुरक्षा के जलए पूरी जिम्मेदारी लेन े में सक्षम बनाने पर
अजधक बल देते हुए,
यह स्ट् िीकार करत ेहुए दक सोमाजलया म ें िांजत और सुरक्षा के जलए खतरों का समाधान करन े के जलए अकेल े सैन्य कारािाई
पयााप्त नहीं होगी, इस बात पर बल देते हुए दक स्ट्र्ायी िांजत के जनमााण के जलए नागररकों की सुरक्षा महत्िपूणा ह,ै और
िांजत तर्ा जस्ट्र्रता की नींि को मिबूत करन े िाले समग्र दजृ िकोण को आग े बढ़ाने की आिश्यकता को दोहरान े के सार्
सोमाजलया द्वारा पररभाजषत प्रार्जमकताओं म ेंजनम्न भी िाजमल ह:ैं
(i) प्रभािी िासन और लोक प्रिासन,
(ii) भ्रिाचार जिरोधी,
(iii) संगरठत अपराध को रोकना,
(iv) कानून का िासन,
(v) न्याय और कानून प्रितान,
(vi) आतंकिाद की रोकर्ाम करन े के प्रयास,
(vii) आतंकिादी जिघटन और दलबदल को बढ़ािा देने के प्रयास,
(viii) आतंकिाद को बढ़ािा देन ेिाले चहसं क कट्टरिाद को रोकना और उसका मुकाबला करना,
(ix) सुरक्षा क्षत्रे म ेंसुधार, और
(x) समािेिी रािनीजत और सुलह,
सोमाजलया म ें िांजत जनमााण और संघषोपरांत पुनर्नामााण और जिकास के जलए अंतरराष्ट्रीय सहयोग और समर्ान, यदद
सोमाजलया के प्राजधकाररयों द्वारा पररभाजषत प्रार्जमकताओं के अनरूु प प्रदान दकया िाता ह,ै की संभािना को देखत े हुए,
और इस संबंध म ें अफ्रीकी संघ संघषोपरांत पुनर्नामााण और जिकास (एयूपीसीआरडी) नीजत और काजहरा म ें एयूपीसीआरडी
समर्पात केंद्र को आग ेध्यान म ें रखते हुए,
समािेिी रािनीजतक समझौतों पर पंहुच रह े एफिीएस और एफएमएस के जिजिि महत्ि को रेखांदकत करते हुए, सुरक्षा
और अन्य राष्ट्रीय प्रार्जमकताओं पर सहयोग का आग्रह करत े हुए, सभी दलों द्वारा सहयोग म ें सुधार की जिम्मेदाररयों और
सभी सोमाजलयों के लाभ के जलए चचाा म ें िाजमल होना, और यह देखते हुए दक सभी दलों का पूणा सहयोग जनम्नजलजखत के
सार् राष्ट्रीय प्रार्जमकताओं की प्रगजत को आग े बढ़ाएगा:
(i) राष्ट्रीय सुरक्षा िास्ट्तुकला का कायाान्ियन,
(ii) एसटीपी का कायाान्ियन,
(iii) पूरी तरह से कायािील संघीय व्यिस्ट्र्ा सुजनजश्चत करना, और
(iv) सोमाजलया की सरकार और संस्ट्र्ानों के जलए कानूनी और रािनीजतक आधार के रूप म ें संजिधान को अंजतम
रूप देना,
इस संबंध म ें सोमाजलया (यूएनएसओएम) म ें संयुक्त राष्ट्र सहायता जमिन द्वारा प्रदान की गई सहायता का स्ट्िागत करत े
हुए, और ितामान चुनािी प्रदक्रया के पूरा होने के बाद यूएनएसओएम की रणनीजतक समीक्षा के जलए संकल्प 2592
(2021) म ें अपन ेअनुरोध को याद करत ेहुए,18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
ध्यान देत ेहुए दक यूएनएसओएम और एटीएमआईएस के पास सोमाजलया म ें िांजत और सुलह का समर्ान करन े के जलए
पूरक िनादेि ह,ैं और यह दक एटीएमआईएस सोमाजलया की सुरक्षा क्षमता को मिबूत करके और सुरक्षा प्रदान करके
न्याय, स्ट्र्ानीय िासन, िांजत और सुलह में महत्िपूणा योगदान देगा,
संयुक्त राष्ट्र पैनल के जििेषज्ञों द्वारा सोमाजलया के जलए दकए गए पूरक काया और संयुक्त राष्ट्र सुरक्षा पररषद द्वारा लगाए
गए प्रजतबंधों की भूजमका, अन्य बातों के अलािा, सोमाजलया और सोमाजलयाई क्षत्रे गैर-सैन्य तरीकों द्वारा अल-िबाब की
गजतजिजधयों के अजस्ट्र्र प्रभाि को कम करन े और सुरक्षा क्षत्रे म,ें जििेष रूप से हजर्यार और गोला बारूद प्रबंधन, सुधार के
जलए सोमाजलया का समर्ान करन े को मान्यता देत ेहुए,
सोमाली मजहला चाटार के संकल्प 1325 (2000) और उसके बाद के प्रस्ट्तािों म ें पररकजल्पत संघषों की रोकर्ाम और
समाधान तर्ा िांजत जनमााण म ें मजहलाओं की महत्िपूणा भूजमका को मान्यता देते हुए, और िांजत तर्ा सुरक्षा को बनाए
रखन े और बढ़ािा देने के जलए सभी स्ट्तरों पर सभी प्रयासों में मजहलाओं की पूण,ा समान और सार्ाक भागीदारी के महत्ि पर
बल देते हुए, और संघषा की रोकर्ाम और समाधान के संबंध म ें जनणाय लेन े और नेतृत्ि म ें मजहलाओं की भूजमका बढ़ाने की
आिश्यकता को याद करते हुए,
सोमाजलया म ें मानिाजधकारों का उल्लंघन तर्ा हनन और अंतरााष्ट्रीय मानिीय कानून के उल्लंघन की चनंदा करत े हुए, सभी
पक्षों स े अंतराष्ट्रा ीय मानिाजधकार कानून और अंतराष्ट्रा ीय मानिीय कानून के अधीन अपन े दाजयत्िों के पूण ा अनपु ालन के जलए
काया करन े का आह्िान करत ेहुए,
सोमाजलया म ें मानिीय जस्ट्र्जत के बारे म ें गंभीर चचंता व्यक्त करत ेहुए संघष ा के सभी पक्षकारों स े लाग ू अंतरराष्ट्रीय मानिीय
कानून सजहत अंतरराष्ट्रीय कानून के संबंद्ध प्रािधानों के अनुसार तर्ा मानिता, तटस्ट्र्ता, जनष्पक्षता तर्ा स्ट्ितंत्रता सजहत
संयुक्त राष्ट्र के मानिीय आपदा सहायता मागादिान जसद्धांतों (संयुक्त राष्ट्र महासभा संकल्प, 46/182) के अनुरूप तरीकों स े
सोमाजलया के समर्ान के जलए आिश्यक मानिीय सहायता प्रािधानों को लाग ू करना और सुजिधािनक बनाना,
सोमाजलया के िलिाय ु पररितना , अन्य पाररजस्ट्र्जतक पररितना , प्राकृजतक आपदाओं और सोमाजलया की जस्ट्र्रता पर अन्य
कारकों पर एफिीएस और संयुक्त राष्ट्र की पयााप्त िोजखम मूल्यांकन और िोजखम प्रबंधन रणनीजतयो ाँ की आिश्यकता पर
िोर देते हुए,
यह जनधााररत करते हुए दक सोमाजलया की जस्ट्र्जत क्षेत्रीय और अंतराष्ट्रा ीय िांजत और सुरक्षा के जलए खतरा बनी हुई ह,ै
संयुक्त राष्ट्र चाटार के अध्याय VII के अधीन काया कर रहा है,
सोमाजलया
1. 27 जसतंबर 2020, 27 मई 2021 और 09 िनिरी 2022 को हुए समझौतों का स्ट्िागत करता ह,ै और एफिीएस और
एफएमएस स े इन समझौतों के कायाान्ियन पर दकसी भी जििाद को िांजतपूिाक हल करन े का आग्रह करता ह ै तादक चुनािी
प्रदक्रया को जबना दकसी देरी के पूरा दकया िा सके, और यह रेखांदकत करता है दक चुनािी प्रदक्रया का पूरा होना और सत्ता
के िांजतपूणा हस्ट्तांतरण का प्राप्त होना, राष्ट्रीय प्रार्जमकताओं की प्रगजत म ें मदद करेगा और एसटीपी तर्ा एनएसए के
अनुरूप अंतरराष्ट्रीय सुरक्षा सहायता के पररितान का समर्ान करेगा;
2. राष्ट्रीय प्रार्जमकताओं पर प्रगजत के महत्ि को रेखांदकत करता ह,ै जिसम ें िाजमल ह:ैं एनएसए, एसटीपी, नौिीं राष्ट्रीय
जिकास योिना, एक संघीय पुजलस और न्याय प्रणाली पर समझौता, जित्तीय संघिाद, िजक्त और संसाधन-साझाकरण,
संिैधाजनक समीक्षा, और स्ट्र्ानीय और राष्ट्रीय सुलह, और इस संबंध म ें 27 मई 2021 को सहमत रोडमैप का स्ट्िागत करता
ह,ै और सोमाजलया स ेजबना देरी के इसे लाग ूकरने का आग्रह करता ह;ै
3. मजहलाओं की पूण,ा समान, सार्ाक और प्रभािी भागीदारी के महत्ि की पुजि करता है, और सभी सोमाजलयाई
नागररकों, जिसमें युिा, जिकलांग व्यजक्त, आंतररक रूप स े जिस्ट्र्ाजपत व्यजक्त (आईडीपी) और िरणार्ी िाजमल ह,ैं को[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19
संघषों के रोकर्ाम एि ं समाधान, सुलह प्रदक्रयाओं, िांजत जनमााण और चुनाि तर्ा अन्य रािनीजतक प्रदक्रयाओं को िाजमल
करता ह,ै और इस संबंध म ें जसजिल सोसायटी द्वारा दकए िा सकने िाले योगदान को स्ट्िीकार करता ह ै और सोमाजलया स े
नागररक समाि संगठनों को स्ट्ितंत्र रूप से काम करन े और उन्ह ें खतरों और प्रजतिोध स े बचाने के जलए एक सुरजक्षत
िातािरण प्रदान करने का आह्िान करता ह;ै
4. सोमाजलया को अपनी सुरक्षा की पूरी जिम्मेदारी लेन े म ें सक्षम बनाने के अपन े उद्देश्य को दोहराता है, जिसम ें अल-िबाब
द्वारा उत्पन्न खतरे का मुकाबला करन े और उसे जनपटाने म ें अग्रणी भूजमका िाजमल ह,ै जिसमें अल-िबाब की क्षमताओं को
कम करने के जलए सैन्य अजभयानों के संचालन िाजमल ह,ैं और सोमाजलया स े दढ़ृतापूिाक आग्रह करता है दक अंतराष्ट्रा ीय
समुदाय द्वारा प्रदान दकए गए अिसर और समर्ान का उपयोग कर एसटीपी और एनएसए का कायाान्ियन और ििाबदेह,
सस्ट्ती और सक्षम सुरक्षा बलों के जनमााण को प्रार्जमकता दे तादक एटीएमआईएस अपन े चरणबद्ध जगरािट को िारी रख
सके, और सोमाजलया अपनी सुरक्षा के जलए पूरी जिम्मेदारी ल ेसके;
5. एसटीपी और एनएसए का प्रजतपादन सुजनजश्चत करने के जलए सोमाजलयाई अजधकाररयों स े आह्िान उजचत रूप स े
संसाजधत ह,ै जिसम ें आिश्यक लॉजिजस्ट्टक समर्ान क्षमताओं के जिकास के सार्-सार् एटीएमआईएस के सार् कमांड,
जनयंत्रण और योिना के प्रचालन हते ु समन्िय तंत्र, संयुक्त ऑपरेिनों का संचालन और कायाान्ियन िाजमल ह।ै
6. सोमाली प्राजधकरणों के नागररकों की सुरक्षा के जलए प्रार्जमक जिम्मेदारी को रेखांदकत करता ह,ै और अंतरराष्ट्रीय
मानिाजधकार कानून और अंतरराष्ट्रीय मानिीय कानून के प्रासंजगक प्रािधानों के अनुसार नागररकों की सुरक्षा के महत्ि को
आग ेरेखांदकत करता ह;ै
7. अंतरराष्ट्रीय समुदाय के समजन्ित समर्ान स े सोमाली अजधकाररयों स ेआह्िान, राष्ट्रीय सुरक्षा के जलए उत्तरोत्तर अजधक
जिम्मेदारी ग्रहण करन े के जलए, और नए सुरक्षा बलों के जनमााण के जलए एक रणनीजतक योिना को जिकजसत करन े और
लाग ू करन े के जलए, िहां उपयुक्त हो, मौिूदा बलों को एकीकृत करन े के जलए, और ितामान और नि जनर्मात सुरक्षा बलों को
प्रजिजक्षत और सजित करन े के जलए, स्ट्पि लक्ष्यों और समय-सीमा के सार् और इस संबंध म,ें एफिीएस के जनम्न सुरक्षा
बलों के जनमााण के इरादों का स्ट्िागत करता ह-ै
(क) ददसंबर 2022 तक 3850 सुरक्षा बल;
(ख) जसतंबर 2023 तक 8525 सुरक्षा बल;
(ग) िून 2024 तक 10450 सुरक्षा बल;
8. बढ़ी हुई क्षमता और योग्यताओं की आिश्यकता को ध्यान म ें रखत े हुए, संयुक्त प्रस्ट्ताि और सीओएनओपी के अनुकूल
समय सीमा के भीतर, क्षेत्रीय बलों के जनमााण और एकीकरण की प्रदक्रया पर एफिीएस द्वारा एफएमएस के सार् काम करन े
का आह्िान करता ह;ै
9. सोमाली अजधकाररयों स े नागररक जनगरानी बढ़ाने और उनके सुरक्षा तंत्र की ििाबदेही और मानिाजधकारों की पुनरीक्षा
सजहत सभी रक्षा और सुरक्षा कर्मायों की उजचत िांच प्रदक्रयाओं को अपनाना और लाग ू करना िारी रखन े का आह्िान
करता ह;ै
10. चुनािों के स्ट्र्ायीकरण और तैयार और संचालन म ें पुजलस और न्याय क्षत्रे की आिश्यक भूजमका की पुजि करता है,
सोमाजलया स े प्रभािी प्रजिक्षण, उपकरणों के प्रािधान और जनरंतर समर्ान के माध्यम से राज्य और संघीय पुजलस का पूरी
तरह स े समर्ान करने का आह्िान करता है, क्षत्रे को सुरजक्षत रखन े में पुजलस की महत्िपूणा भूजमका को दोहराता ह ै और,
नागररक आबादी के जलए सरु क्षा प्रदान करन े म ें योग्य एक पेिेिर और सक्षम पुजलस बल, िो एसटीपी और एनएसए को
पूरी तरह से लाग ू करन े हते ु सोमाजलया के जलए आिश्यक ह,ै पर िोर देता है, और सोमाली समाि के सभी िगों स े
समािेिी और प्रजतजनजध सोमाली सुरक्षा और पुजलस बल की भती को प्रोत्साजहत करता है;20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
11. सोमाजलया स े यह सुजनजश्चत करने का आह्िान करता है दक सभी सुरक्षा और पुजलस बल अंतरराष्ट्रीय मानिाजधकार
कानून और अंतरााष्ट्रीय मानिीय कानून का पूरी तरह स े सम्मान करें और यह सुजनजश्चत करें दक मानिाजधकारों और
अंतराष्ट्रा ीय मानिीय कानूनों के उल्लघं न के जलए जिम्मेदार लोगों को ििाबदेह ठहराया िाए, इसके अजतररक्त संयुक्त राष्ट्र
संघ, अफ्रीकी संघ और अन्य अंतरााष्ट्रीय साझेदारों स े सोमाली अजधकाररयों का उजचत समर्ान करने के जलए आह्िान करता
है और अनुरोध करता है दक एटीएमआईएस नागररक हताहत रैककंग जिश्लेषण और प्रजतदक्रया सेल (सीसीटीएआरसी) के
संचालन स े सीखे गए अनुभि और सबक को राष्ट्रीय प्राजधकाररयों के सार् साझा करे, जिसम ें सोमाली नागररक हताहत
जनगरानी, िमन, और रोकर्ाम नीजतयों और तंत्रों के जिकास का समर्ान भी िाजमल हो;
12. यूएनएमएएस सजहत, एटीएमआईएस, अंतरराष्ट्रीय भागीदारों और सुसंगत संयुक्त राष्ट्र इकाईयों के सार् समन्िय स े
सोमाजलया के प्राजधकाररयों ने छोटे हजर्यारों और हल्के िस्त्रों के अिैध व्यापार, अंतरण, दरुु पयोग और संग्रहण, और
सोमाजलया म ें सभी प्रकार के जिस्ट्फोटकों और संबंजधत सामजग्रयों की अनजधकृत प्राप्तकतााओं तक पंहुच को रोकन े और उनकी
सुरक्षा तर्ा प्रभािी प्रबंधन एिं भण्डारण को सुजनजश्चत करन े का आह्िान दकया;
13. एटीएमआईएस से सोमाजलया तक सुरक्षा जिम्मेदाररयों के बदलाि के दौरान हर एक िगह की सुरक्षा जस्ट्र्जत पर
जिचार करने के जलए सोमाजलया और उसके अंतरराष्ट्रीय भागीदारों की आिश्यकता को रेखांदकत करता ह,ै और बल देता ह े
दक जनयोिन तर्ा जनणाय नागररकों को धमकी के एक व्यापक मूल्यांकन द्वारा जलया िाना चाजहए और सैन्य कारािाई के
दौरान और इसके पश्चात िोजखमों को कम करने के जलए प्रभािी उपाय, जिसमें पहल े सुरक्षा और जहफाित जनरंतर
सुजनजश्चत करने के जलए उपयुक्त आकार, योग्य और ििाबदेह सीमा की सुरक्षा और पुजलस बल की उपजस्ट्र्जत स्ट्र्ाजपत
करना िाजमल ह,ै दकए िाने चाजहए;
14. संकल्प 1612 (2005) और बच्चों एि ं सिस्त्र संघष ा पर उसके बाद के संकल्पों को याद करत े हुए और सिस्त्र संघष ा म ें
बच्चों के जखलाफ हत्या, अपांगन, बलात्कार और यौन चहसं ा के अन्य प्रकारों के सार्-सार् गैरकानूनी भती और गैर-लड़ाकू
भूजमकाओं सजहत उनके उपयोग, पुनः भती, और बच्चों के अपहरण की ररपोटों पर अपनी गंभीर चचंता व्यक्त करत े हुए,
सोमाली प्राजधकाररयों स े जनम्नजलजखत का आिाह्न करता ह:ै
(क) बाल संरक्षण पर कानूनी ढांच े को मिबूत करना और बाल संरक्षण पर क्षमता जनमााण की आिश्यकता को
रेखांदकत करना;
(ख) बच्चों के जखलाफ सभी प्रकार की चहसं ा को रोकने और इसके जिम्मेदार लोगों को दोषी ठहराने के जलए कारािाई
करना;
(ग) स्ट्कूलों और अस्ट्पतालों सजहत नागररक अिसंिरचना के जखलाफ हमलों को रोकने और उनके सैन्य उपयोग को
रोकने के जलए उजचत उपाय करना;
(घ) राष्ट्रीय सुरक्षा के आरोपों म ें उन सभी बच्चों की निरबंदी को रोकना िहां लाग ू अंतरराष्ट्रीय कानून का उल्लघं न
हो रहा हो और इसके बिाय बाल अजधकारों पर संयुक्त राष्ट्र अजभसमय के अधीन सोमाजलया के दाजयत्िों के अनुरूप
बच्चों के सार् प्रार्जमक तौर पर पीजड़त के रूप म ें व्यिहार करना; तर्ा
(ङ) 2012 की अपनी काया योिनाओं, सिस्त्र समूहों से अलग हुए बच्चों को सौंपने के जलए 2014 की मानक संचालन
प्रदक्रयाओं, 2018 रोडमैप और सोमाजलया म ें बच्चों एि ं सिस्त्र संघषा पर काया समूह के जनष्कषों को पूरी तरह स े
कायााजन्ित करन े के जलए कारािाई करना (एस/एसी.51/ 2020/6);[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21
15. सोमाजलया म ें सिस्त्र संघष ाम ें िाजमल सभी दलों को यौन और मजहला/पुरुष आधाररत चहसं ा को समाप्त करन े के जलए
आह्िान करना और आग े सोमाली प्राजधकाररयों को जनम्नजलजखत के जलए संबंजधत भागीदारों के सार् काम करन े का
आह्िान करना:
(क) सभी के जलए यौन और मजहला/पुरुष आधाररत चहसं ा, और संघष-ा संबंधी यौन चहसं ा से सुरक्षा सुजनजश्चत
करना;
(ख) यौन और मजहला/पुरुष आधाररत चहसं ा को रोकन े और उस पर प्रजतदक्रया करने के जलए िीिनरक्षा-केंदद्रत
और चलंग- एिं उम्र-संिेदनिील दजृ िकोण सुजनजश्चत करना;
(ग) कजर्त दव्यु ािहारों की िांच के जलए उजचत कदम उठाना और दण्ड स े मुजक्त को रोकने के जलए कजर्त
अपराजधयों पर मुकदमा चलना;
(घ) संकल्प 2467 (2019) और अन्य प्रासंजगक संकल्पों के अनुरूप ििाबदेही का समर्ान करन े के जलए कानून को
मिबूत करना; तर्ा
(ङ) संघषा म ें यौन चहसं ा की रोकर्ाम और प्रजतदक्रया पर संयुक्त जिज्ञजप्त और राष्ट्रीय काया योिना के कायाान्ियन म ें
तेिी लाना;
16. स्ट्कूलों और स्ट्कूलों स े िुड़े नागररकों के जखलाफ हमलों और हमलों की धमकी, िो अतं रराष्ट्रीय मानिीय कानून के
उल्लघं न में ह,ै की कड़ी चनंदा करना और सिस्त्र संघष ा के सभी दलों से ऐसे हमलों और हमलों की धमदकयों को तुरंत बंद
करन े और जिक्षा म ेंबाधा डालने िाले कायों को करन ेसे बचने का आग्रह करना;
17. अपन े संकल्प 2417 (2018) को याद करना और सोमाजलया म ें चल रह े मानिीय संकट और सोमाजलया के लोगों पर
इसके प्रभाि पर गंभीर चचंता व्यक्त करना, दानकतााओं सजहत सभी भागीदारों को 2022 म ें मानिीय सहायता प्रदान करत े
रहन े के जलए प्रोत्साजहत करना, अल-िबाब सजहत अन्य द्वारा मानिीय और जचदकत्सा कर्मायों तर्ा नागररक अिसंिरचना
के जखलाफ दकसी अजििेकपूणा या प्रत्यक्ष हमल,े और सार् ही मानिीय सहायता के दकसी भी दरुु पयोग या उसमें बाधा
डालन े की कड़ी चनंदा करना, अंतरराष्ट्रीय कानून के संगत प्रािधानों के अनुसार और मानिीय जसद्धांतों के अनुरूप, पूरे
सोमाजलया म ें िरूरतमंद व्यजक्तयों को समय पर मानिीय सहायता प्रदान करन े के जलए सभी पक्षकारों को पूण,ा सुरजक्षत,
तीव्र और जनबााध पहुचं प्रदान दकए िाने की अपनी मांग को दोहराता ह,ै और अंतराष्ट्रा ीय मानिीय सहायता के उजचत
लेखांकन के महत्ि को रेखांदकत करना;
अल-िबाब और आईएसआईएल स ेिड़ु े सहयोगी
18. अल-िबाब द्वारा सुरक्षा बलों को जनिाना बनाने िाल े हमलों और सोमाजलया तर्ा व्यापक क्षत्रे म ें सरकारी
अजधकाररयों, नागररकों और नागररक अिसंिरचना के जखलाफ इसके आतंकिादी हमलों के सार्-सार् नागररकों को बंधक
बनाने और अपहरण, उनकी भती, प्रजिक्षण और जिदेिी आतकं िादी लड़ाकों के उपयोग की घटनाओं की कड़े िब्दों म ें चनंदा
करना और चचंता व्यक्त करता ह ै दक ये गजतजिजधयााँ सोमाजलया म ें िांजत और सुरक्षा, क्षेत्रीय जस्ट्र्रता, एकीकरण और
जिकास के जलए खतरा ह,ैं और मानिीय पीड़ा को बढ़ाती ह;ैं
19. यह दोहराता ह ै दक सोमाजलया म ें सुरक्षा सुजनजश्चत करन े की प्रार्जमक जिम्मेदारी एफिीएस की ह,ै और अल-िबाब
और आईएसआईएल स े िुड़ े सहयोजगयों का व्यापक तरीके स े मुकाबला करने के प्रयासों को प्रार्जमकता देन,े उसका समन्िय
करन े और उसे मिबूत करने के जलए सोमाजलया स े आह्िान करता ह,ै जिसमें यर्ालाग ू अंतरराष्ट्रीय मानिीय कानून और
अंतरराष्ट्रीय मानिाजधकार कानून सजहत अंतरराष्ट्रीय कानून के अधीन अपन े दाजयत्िों के पूण ा अनुपालन में, सैन्य अजभयानों22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
के उपयोग के माध्यम स े उनकी क्षमताओं को कम करना और जित्तीय संसाधनों, हजर्यारों और गोला-बारूद तक पहुचं न े की
उनकी क्षमता को बाजधत करना िाजमल ह ैपरंत ु यह प्रयास यहीं तक सीजमत नहीं होंगे;
20. यह पुनःपुजि करता ह ै दक सभी राष्ट्र आतंकिादी कृत्यों को रोकेंग े और उसका अंत करेंग,े सभी राज्यों स े यह आग्रह
करता ह ै दक िे आतंकिाद से जनपटन े िाले अजभसमय के सार्-सार् संकल्प 1373 (2001) सजहत लाग ू संयुक्त राष्ट्र सुरक्षा
पररषद संकल्पों के अनुसार सोमाजलया म ें अल-िबाब और आईएसआईएल स े िुड़े सहयोजगयों के जखलाफ कारािाई करेंग,े
और आग े यह पुजि करता ह ैदक सदस्ट्य राष्ट्र यह सुजनजश्चत करेंग े दक आतंकिाद का मुकाबला करन े के जलए दकए गए कोई भी
उपाय संयुक्त राष्ट्र चाटार और अंतराष्ट्रा ीय मानिीय कानून, अंतरााष्ट्रीय मानिाजधकार कानून और अंतरााष्ट्रीय िरणार्ी कानून
सजहत अंतरााष्ट्रीय कानून के अधीन अन्य सभी दाजयत्िों के अनरूु प होंग;े
21. सोमाजलया स े संकल्प 1373 (2001), संकल्प 2178 (2014), संकल्प 2462 (2019) का अनुपालन सजहत आतंकिाद
के जित्तपोषण को रोकने और उसका मुकाबला करन े के जलए अन्य सदस्ट्य राष्ट्रों, जििेष रूप स े क्षत्रे के अन्य सदस्ट्य राष्ट्रों के
सार् सहयोग और समन्िय को मिबूत करन े का अनुरोध करता ह,ै और सोमाजलया स े अफ्रीकी संघ, संयुक्त राष्ट्र और अन्य
सदस्ट्य राष्ट्रों के समर्ान स े अल-िबाब और आईएसआईएल स े िुड़ े संगठनों को कमिोर करने के जलए गैर-सैन्य गजतजिजधयों
को बढ़ाने के जलए जमलकर काम करन े का आग्रह करता ह,ै तादक उन्ह ें सोमाजलया की संप्रभुता, क्षेत्रीय अखंडता, रािनीजतक
स्ट्ितंत्रता और एकता को नुकसान पहुचं ाने िाली गजतजिजधयों का संचालन करन े स े रोका िा सके, उनकी आतंकिादी
गजतजिजधयों, अिैध जित्त, संगरठत अपराध, बंदकू ों और हल्के हजर्यारों सजहत हजर्यारों और गोला-बारूद की तस्ट्करी,
आईईडी जनमााण, न्याय और प्रचार गजतजिजधयों का जिरोध दकया िा सके, और 2607 (2021) म ें जनधााररत उपायों को
लाग ू करन े के जलए अंतरराष्ट्रीय समुदाय के सार् जमलकर काम दकया िा सके, जिसमें संकल्प 751 (1992) के अनुसार
सुरक्षा पररषद सजमजत द्वारा नाजमत व्यजक्तयों और समूहों के जखलाफ लगाए गए उपाय िाजमल ह;ैं
एटीएमआईएस
22. सोमाजलया (एटीएमआईएस) म ें अफ्रीकी संघ पररितना जमिन म ें एएमआईएसओएम को पुन: कॉजन्फगर करन े के
अफ्रीकी संघ िांजत और सुरक्षा पररषद के जनणाय का समर्ान करता ह,ै और 12 महीने की प्रारंजभक अिजध के जलए, अफ्रीकी
संघ के सदस्ट्य राज्यों को अंतरााष्ट्रीय मानिीय कानून और अंतराष्ट्रा ीय मानिाजधकार कानून सजहत अंतरााष्ट्रीय कानून के
अधीन भाग लेन े िाले राज्यों के दाजयत्िों के पूण ा अनुपालन म,ें और सोमाजलया की संप्रभुता, क्षेत्रीय अखंडता, रािनीजतक
स्ट्ितंत्रता और एकता के पूण ा सम्मान म ें जनम्नजलजखत के जलए सभी आिश्यक उपाय करने के जलए अजधकृत करता ह:ै
(क) अल-िबाब द्वारा उत्पन्न खतरे को कम करने के जलए अपन ेअजधदेि को पूरा करना;
(ख) एकीकृत सोमाली सुरक्षा और पुजलस बलों की क्षमता जनमााण का समर्ान;
(ग) सोमाजलया को चरणबद्ध रूप से सुरक्षा उत्तरदाजयत्ि सौंपना; तर्ा
(घ) सोमाजलया म ें एसटीपी और एनएसए के अनुरूप, एक जस्ट्र्र, संघीय, संप्रभु और संयुक्त सोमाजलया के जिकास
के समर्ान में िांजत और सुलह प्रयासों का समर्ान करना;
23. संयुक्त प्रस्ट्ताि म ें उजल्लजखत जनम्नजलजखत रणनीजतक उद्देश्यों को आग े बढ़ाने के जलए एटीएमआईएस को अजधकृत करन े
का जनणाय लेता ह:ै
(क) अल-िबाब और आईएसआईएल स े िुड़े संगठनों को कमिोर करने के जलए सोमाली सुरक्षा बलों के सार् संयुक्त
रूप स े जनयोजित और लजक्षत अजभयान चलाना;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23
(ख) प्रार्जमकता िाले िनसंख्या केंद्रों को संयुक्त रूप स े आयोजित करके और स्ट्र्ानीय समुदायों, संयुक्त राष्ट्र कर्मायों
और प्रजतष्ठानों के जलए सुरक्षा प्रदान करके, एफिीएस द्वारा पहचाने गए मुख्य आपूर्त ा मागों को सुरजक्षत करके, और
सोमाली राष्ट्रीय जस्ट्र्रीकरण रणनीजत और राष्ट्र जस्ट्र्रीकरण योिनाओं के कायाान्ियन का समर्ान करने के जलए
सोमाली सुरक्षा बलों के सहयोग स े जस्ट्र्रीकरण और सुलह सहभाजगयों के सार् समन्िय करके सोमाली सुरक्षा बलों
का समर्ान करना;
(ग) सामुदाजयक िसूली और राज्य प्राजधकरण के जिस्ट्तार और ििाबदेही (क्रेस्ट्टा/ए) और अन्य जस्ट्र्रीकरण सहायकों
के समन्िय म ें सभी बरामद क्षेत्रों के जलए जस्ट्र्रीकरण प्रयासों के कायाान्ियन म ें एफिीएस की सहायता करना;
(घ) सोमाजलया म ें सुरक्षा जिम्मेदाररयों के प्रगजतिील अजधग्रहण की सुजिधा के जलए बल उत्पादन, पररचालन
दक्षताओं और सैन्य समर्ान क्षमताओं को प्रार्जमकता के सार् सोमाली सुरक्षा बलों के क्षमता जिकास का समर्ान
करना;
(ङ) एसटीपी के अनरूु प, और संघीय सरकारी संस्ट्र्ानों के सहयोग से मानिीय संपका, सामुदाजयक िुड़ाि को
सुजिधािनक बनाकर और सार्-सार् अंतरराष्ट्रीय मानिीय कानून और अंतरााष्ट्रीय मानिाजधकार कानून का पालन
करन े के जलए सोमाली सुरक्षा बलों की सहायता करके और इसके उल्लघं न के जलए जिम्मेदार लोगों को दोषी
ठहराकर सोमाली सुरक्षा बलों को स्ट्पि, अजधकार और जनमााण चरणों म ें समर्ान करना;
24. संयुक्त प्रस्ट्ताि के पैरा 33 स े 39 म ें उजल्लजखत कायों के संचालन के जलए एटीएमआईएस के सैन्य, पुजलस और नागररक
घटकों को अजधकृत करने का जनणाय लेता ह,ै और स्ट्मरण करता ह ैदक सीओएनओपी जनम्नजलजखत काया प्रदान करता ह:ै
(क) अल-िबाब और आईएसआईएल स े िुड़े संगठनों को कमिोर करने के जलए सोमाली सुरक्षा बलों के समन्िय म,ें
सभी क्षेत्रों म ेंएक सार् लजक्षत आक्रामक अजभयान चलाना;
(ख) जस्ट्र्रीकरण प्रयासों, सुलह और िांजत जनमााण सजहत सभी स्ट्तरों पर रािनीजतक प्रदक्रया के जलए सुरक्षा प्रदान
करन े म ेंसोमाली सुरक्षा बलों का समर्ान करना;
(ग) सोमाली सुरक्षा बलों को सुरक्षा जिम्मेदारी सौंपने का सिोत्तम समर्ान करने के जलए संयोिन, संरचना, स्ट्िभाि
और उपकरण के संदभा म ें एटीएमआईएस को कॉजन्फगर करना;
(घ) अल-िबाब स े बरामद क्षेत्रों सजहत मुख्य आपूर्ता मागों को साफ करन े म ें सोमाली सुरक्षा बलों का समर्ान करना;
सोमाली राष्ट्रीय सेना को युद्ध परामि ा प्रदान करना; नागररक-सैन्य समन्िय गजतजिजधयों का संचालन करन े के जलए
सोमाली राष्ट्रीय सेना की क्षमता म ें िृजद्ध करना;
(ङ) संयुक्त रूप स े भागीदारों के सार्, काउंटर इम्प्रोिाइज्ड जिस्ट्फोटक उपकरणों के संचालन के जलए सोमाली राष्ट्रीय
सेना की क्षमता म ेंिृजद्ध करना;
(च) संपका के जनयमों, अंतरराष्ट्रीय मानिीय कानून, अंतरराष्ट्रीय मानिाजधकार कानून और सभी अंतरराष्ट्रीय
सिोत्तम प्रर्ाओं का अनुपालन सुजनजश्चत करना;
(छ) सोमाली पररितान योिना के अनुरूप सोमाली पुजलस को जििेष प्रजिक्षण, परामि ा और सलाह देना और संयुक्त
गश्त और महत्िपूणा प्रजतष्ठानों की सुरक्षा सजहत पररचालन सहायता प्रदान करना;
(ि) पुजलस जनमााण और तैनाती के माध्यम से सोमाजलया म ें पुजलस सेिाओं के प्रािधान म ें सोमाली पुजलस की सेिा

(झ) सामुदाजयक पुजलस व्यिस्ट्र्ा के माध्यम से चहसं ा के प्रजत कट्टरता, आतंकिाद के जलए अनुकूल चहसं क उग्रिाद और
सामाजिक अव्यिस्ट्र्ा के जलए पुजलस-सािािजनक भागीदारी का समर्ान करना और अंतरााष्ट्रीय मानिीय कानून,
अंतराष्ट्रा ीय मानिाजधकार कानून, मजहला िांजत और सुरक्षा संकल्प और आचरण और अनिु ासन मानकों के अनुपालन
म ेंसोमाली पुजलस बलों के प्रयासों का समर्ान करना;
(ञ) एटीएमआईएस संचालन के स्ट्पि-होल्ड-जबल्ड चरणों में, एटीएमआईएस िदीधारी घटकों के सार्-सार्
एटीएमआईएस के सार् संयक्तु रूप स े संचाजलत सोमाली सुरक्षा बलों का समर्ान करने के जलए गजतजिजधयों का
संचालन करना, अंतरराष्ट्रीय मानिीय कानून, अंतरराष्ट्रीय मानिाजधकार कानून के अधीन दाजयत्िों के पूण ा
अनुपालन म ें और गैर-संयुक्त राष्ट्र सुरक्षा बलों को संयुक्त राष्ट्र समर्ान पर मानिाजधकारों के कारण पररश्रम नीजत
(एचआरडीडीपी) के अनुपालन म,ें सार् ही सार् िांजत समर्ान संचालन के जलए अफ्रीकी संघ अनुपालन और
ििाबदेही ढांचे के अनुपालन म ेंअपन े कायों को पूरा करना;
(ट) नए बरामद क्षेत्रों और मानिीय संपका म ेंिीघ्र िसूली की पहल का समर्ान करना;
(ठ) सोमाली राष्ट्रीय जस्ट्र्रीकरण रणनीजत के कायाान्ियन का समर्ान करना;
(ड) सोमाली पररितान योिना प्रार्जमकताओं को लाग ू करन े के जलए प्रासंजगक सोमाली मंत्रालयों और संस्ट्र्ानों का
समर्ान करें और एटीएमआईएस के उद्देश्यों को साकार करने म ेंआिश्यक सहायता प्रदान करना;
25. यह पुजि करता ह ै दक िहां संकल्प 2607 (2021) "एमीसोम" को संदर्भात करता ह,ै उसे एटीएमआईएस के संदभा म ें
पढ़ा िाएगा;
26. अफ्रीकी संघ के सदस्ट्य राज्यों को 31 ददसंबर 2022 तक पांच गरठत पुजलस इकाइयों सजहत न्यूनतम 1040 पुजलस
कर्मायों सजहत, 19,626 िदीधारी कर्मायों को तैनात करने के जलए अजधकृत करता ह ै और इस तारीख तक 2000 कर्मायों
को िापस लेन ेके अफ्रीकी संघ िांजत और सुरक्षा पररषद के जनणाय का समर्ान करता ह;ै
27. 1 िनिरी 2023 और 31 माचा 2023 के बीच अफ्रीकी संघ के सदस्ट्य राज्यों को 17,626 िदीधारी कर्मायों को तैनात
करन े के जलए अजधकृत करता ह,ै जिसमें पांच गरठत पुजलस इकाइयों सजहत न्यूनतम 1040 पुजलस कमी िाजमल ह;ैं
28. यह नोट करता ह ै दक संयुक्त प्रस्ट्ताि और सीओएनओपी म ें 14,626 िदीधारी कर्मायों को और कम करन े की
पररकल्पना की गई ह,ै जिसमें चरण 2 (जसतंबर 2023) के अतं तक 1040 पुजलस की न्यूनतम संख्या िाजमल ह,ै चरण 3
(िून 2024) के अंत तक, 1040 पुजलस कर्मायों की न्यूनतम संख्या सजहत 10,626 िदीधारी कमी िाजमल ह,ै और, चरण
4 के अंत तक (ददसंबर 2024) िून्य कमी िाजमल ह ै और सोमाजलया की जस्ट्र्जत और इस संकल्प के अनछु छेद 51 म ें
उजल्लजखत जनयजमत, संयुक्त तकनीकी आकलन, इन कटौती को ध्यान म ें रखत े हुए अजधकृत करन े का अपना इरादा व्यक्त
करता ह;ै
29. अफ्रीकी संघ से यह सुजनजश्चत करन े का अनुरोध करता ह ैदक जनम्नजलजखत के जलए संरचनाएं उपलब्ध ह:ैं
(क) एटीएमआईएस की स्ट्पि जनगरानी, और जमिन एिं उसके दलों के जलए ििाबदेही तंत्र;
(ख) जमिन की स्ट्पि कमान और जनयंत्रण और इसके दल के बीच पररचालन समन्िय;
(ग) फोसा कमांडर और सेक्टर कमांडरों के अधीन समजन्ित पररचालन जनणायन;
(घ) हिाई संपजत्त सजहत जमिन को सक्षम करन े िाली इकाइयों की कमान, जनयंत्रण और ििाबदेही;
(ङ) एटीएमआईएस क्षेत्रों म ेंमोबाइल बलों का जनमााण और तैनाती; तर्ा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25
(च) एटीएमआईएस जनदेि रािनीजतक रूप से तटस्ट्र् रहने तर्ा नागररकों की सुरक्षा को प्रार्जमकता देने के जलए ह;ैं
30. अफ़्रीकी संघ, संयुक्त राष्ट्र के समर्ान के सार्, यूजनट आिश्यकताओं के जििरण (एसयूआर) को ध्यान म ें रखत े हुए, और
मौिूदा संसाधनों के भीतर, एटीएमआईएस की पररचालन क्षमताओं की जनरंतर समीक्षा करन े का आग्रह करता ह:ै
(क) अजनिाय ाकायों को पूरा करन े के जलए सुरक्षा बल बढ़ाने; और
(ख) संसाधन आिश्यकताओं म ेंअंतर की पहचान और स्ट्िैजछछक योगदान के माध्यम से संसाधनों तर्ा उपकरणों
की आपूर्त ाके जलए जिजिि अनरु ोध करना;
31. सोमाली सुरक्षा और पुजलस बलों के सार् संयुक्त या समजन्ित संचालन के संदभा म ें ऑपरेिनों के प्रारंजभक संचालन और
समीक्षा चरणों म ें यूएनएसओएम और एचआरडीडीपी को लाग ू करने म ें यूएनएसओएस के सार् एटीएमआईएस बलों के
सहयोग को िारी रखन े के महत्ि पर िोर देता ह।ै
32. अफ्रीकी संघ,एटीएमआईएस बलों द्वारा मानिाजधकारों का उल्लघं न और अंतरराष्ट्रीय मानिीय कानूनों का उल्लघं न
एिं इन आरोपों की जनयजमत जनगरानी तर्ा त्िररत और गहन िांच एिं ररपोर्टिंग सुजनजश्चत करन े के सार्-सार् पारदर्िाता,
आचरण और अनुिासन के उच्चतम मानकों को सुजनजश्चत करने तर्ा िहां उपयुक्त हो, यूएनएसओएम के सार् इन प्रदक्रयाओं
के बीच सामंिस्ट्य बनाने के जलए एटीएमआईएस से उत्तरदाजयत्ि लेन े का आह्िान करता ह ै तर्ा अफ्रीकी संघ के सार् सेना
और पुजलस योगदान देने िाले देिों से उनके सहयोग को मिबूत करन े तर्ा एटीएमआईएस के अनुपालन और उत्तरदायी
साधनों की प्रभाििीलता सुजनजश्चत करन े के जलए संयुक्त राष्ट्र स े आग्रह करता ह।ै
33. एटीएमआईएस स े यह अनुरोध करता ह ै दक सीसीटीएआरसी के सार् सभी क्षेत्रों म ें जमलकर काम करे और यह
सुजनजश्चत करन े के महत्ि पर िोर देता ह ै दक संयुक्त राष्ट्र सजहत सभी प्रासंजगक सदस्ट्यों के सार् सूचना प्रदान की िाए, िो
एटीएमआईएस की ररपोर्टिंग म ें एकीकृत दकया गया ह ै एि ं पररचाजलत ददिाजनदेिों और योिनाओं म ें दिााया गया ह ै तर्ा
मानितािादी मानिाजधकारों और संरक्षक सदस्ट्यों के सहयोग स े सेना तर्ा पुजलस योगदानकतााओं के पूणा समर्ान का
अनुरोध करता ह।ै
34. एटीएमआईएस स े यह अनुरोध करता ह ै दक संघषा म ें यौन उत्पीड़न को रोकने और उस पर प्रजतदक्रया करन े के जलए
संयुक्त जिज्ञजप्त और राष्ट्रीय काय ा योिना के कायाान्ियन का समर्ान करे तर्ा सभी एटीएमआईएस घटकों की गजतजिजधयों म ें
इन जिजिि मुद्दों को ध्यान म ें रखते हुए यह सुजनजश्चत करने के जलए दक संघषा म ें यौन चहसं ा के खतरे के मामलों म ें आंकड़ा
संग्रह, खतरे का जिश्लेषण और पूिा चेतािनी प्रणाली को सजम्मजलत दकया िाता ह ैतर्ा यौन िोषण एिं दव्यु ािहार पर िून्य-
सहनिीलता नीजत की पुजि की िाती ह,ै इस तरह के िोषण और दव्यु ािहार को रोकने की आिश्यकता पर बल ददया िाता
ह,ै अफ्रीकी संघ और सेना तर्ा पुजलस-योगदानकताा देिों स े कार्माकों की स्ट्क्रीचनंग करन,े िोजखम मूल्यांकन करन,े सभी
कार्माकों को प्रासंजगक प्रजिक्षण देन,े दव्यु ािहार की ररपोट ा दिा कराने िाल े पीजड़तों को राहत पहुचाँ ाने, देखभाल करन े तर्ा
सुरक्षा एि ं समर्ान करन,े आरोपों की समय पर िांच करन,े अपराजधयों को जिम्मेदार ठहराने और उन इकाइयों को
प्रत्यािर्तात करन े के जलए अनरु ोध करता ह,ै िहां सदस्ट्यों द्वारा व्यापक अर्िा जनयजमत यौन िोषण या दव्यु ािहार के
जिश्वसनीय सबूत पाए गए ह ैंऔर इस संबंध म ेंअफ्रीकी संघ स े संयुक्त राष्ट्र के सार् जमलकर काम करन े का अनरुोध करता है
35. सेना और पुजलस योगदानकताा देिों द्वारा एटीएमआईएस म ें मजहला िदीधारी कार्माकों की तैनाती सुजनजश्चत करन े के
प्रयासों को प्रोत्साजहत करता ह ै और एटीएमआईएस से उसके अजभयानों म ें मजहलाओं की पूणा, प्रभािी और सार्ाक
भागीदारी सुजनजश्चत करने और अपन े िनादेि िारी करत े समय समान स्त्री-पुरुष दजृ िकोण को समाजहत करन े का आग्रह
करता ह;ै
36. अफ्रीकी संघ स े एटीएमआईएस नागररक कार्माक पदों पर सोमाली नागररकों की भती के जलए सोमाजलया के अनरु ोध

37. महासजचि से संभार तंत्र सहायता पैकेि प्रदान करना िारी रखन े और अफ्रीकी संघ एि ं एफिीएस के परामि ा स,े
एचआरडीडीपी के पूण ा अनुपालन म,ें यूएनएसओएम के जलए यूएनएसओएस के माध्यम स,े इस संकल्प के अनुछछेद 26 और
27 के अनुरूप एटीएमआईएस िदीधारी कर्मायों के आधार पर, एक उपयुक्त संभार तंत्र सहायता योिना जिकजसत करन े का
अनुरोध करता ह।ै संकल्प 2245 (2015) के अनछु छेद 2 म ें 1 िनिरी, 2023 स े 70 एटीएमआईएस नागररकों से 85
एटीएमआईएस नागररकों तक बढ़ाने, एटीएमआईएस के सैन्य और पुजलस कायों का समर्ान करन े तर्ा संयुक्त राष्ट्र, अफ्रीकी
संघ और एफिीएस के बीच समन्िय बढ़ाने के जलए संयुक्त राष्ट्र रस्ट्ट कोष के माध्यम स े सोमाजलया म ें 13,900 सोमाली
सुरक्षा बलों का समर्ान करता ह ै जिनमें राज्य और संघीय पुजलस का यर्ोजचत जहस्ट्सा िाजमल ह,ै िो राष्ट्रीय सुरक्षा
अिसंरचना की तरह औपचाररक रूप स े सोमाली सुरक्षा बलों म ें एकीकृत ह ैं और एटीएमआईएस, िो एसटीपी का सीधा
कायाान्ियन करता ह,ै के सार् संयुक्त या समजन्ित अजभयानों म ेंसदक्रय रूप से भाग ले रह ेह।ैं
38. अनुछछेद 37 म ें जनधााररत यूएनएसओएस के माध्यम स े समर्ान के जलए उपयुक्त सोमाली सुरक्षा बलों की संख्या बढ़ान े
पर जिचार करता ह ै िो अनुछछेद 7 और 8 म ें जनधााररत बल एकीकरण और उत्पादन म ें प्रगजत तर्ा इस संकल्प के अनछु छेद
26 और 27 म ें जनधााररत एटीएमआईएस िदीधारी कार्माकों की संख्या म ें कमी करन े के अधीन ह;ै
39. संभार तंत्र सहायता के जितरण के सार्-सार् अन्य जितरण िस्ट्तुओं िैसे सैन्य अजभयानों की योिना बनाने के जलए
यूएनएसओएस को एकीकृत करना, कादफले और हिाई क्षत्रे की सुरक्षा सुजनजश्चत करन,े नागररकों की सुरक्षा और मुख्य
आपूर्त ा मागों की सुरक्षा सजहत यूएनएसओएस के सार् एटीएमआईएस और सोमाली सुरक्षा बलों के संयुक्त रूप से काय ा
करन े के महत्ि पर िोर देता ह।ै
40. इस बात पर िोर दते ा ह ै दक संयुक्त राष्ट्र के संचालन सहायता जिभाग की पयाािरण रणनीजत (जद्वतीय चरण) के
कायाान्ियन स े िांजत बनाए रखने और सुरक्षा समर्ान की जस्ट्र्जत म ें सुधार दकया गया ह ै िो ससं ाधनों के अछछे प्रबंधन और
जमिन की सकारात्मक जिरासत पर बल देता ह ै और सुरक्षा बढ़ाने के जलए जमिनों म ें जिस्ट्ताररत निीकरणीय ऊिाा उपयोग
के लक्ष्य की पहचान करता ह।ै यूएनएससीएपी लक्ष्यों को पूरा करने के जलए 2030 तक क्षत्रे संचालन के जलए निीकरणीय
ऊिाा स े स्ट्र्ानांतररत करन े के जलए महासजचि के आह्िान को ध्यान म ें रखत े हुए लागत कम करन,े दक्षता प्रदान करने और
जमिन को लाभाजन्ित करन े पर िोर दते ा ह।ै
41. तात्काजलक जिस्ट्फोटक उपकरणों (आईईडी) के खतरे का मुकाबला करने के जलए सोमाली सुरक्षा बलों के प्रजिक्षण,
उपकरण और परामि ाके जलए महासजचि स ेसंयुक्त राष्ट्र का समर्ान िारी रखने का अनुरोध करता ह।ै
42. संयुक्त राष्ट्र, अफ्रीकी संघ और सोमाजलया के बीच जििेष रूप से एचआरडीडीपी के अनुपालन म ें भागीदारी की
आधारजिला जनगरानी और ििाबदेही होनी चाजहए। महासजचि से यह सुजनजश्चत करने का अनुरोध करता ह ैदक गैर-संयुक्त
राष्ट्र सुरक्षा बल को कोई भी सहायता एचआरडीडीपी के सख्त अनुपालन म ें प्रदान की िाए और सोमाजलया को संयुक्त राष्ट्र
समर्ान के प्रािधान की ितों पर संयुक्त राष्ट्र के सार् अद्यतन समझौता ज्ञापन पर सोमाजलया और अफ्रीकी संघ स े सहमत
होने का अनुरोध करता ह।ै
43. महासजचिने अफ्रीकी संघ को संयुक्त राष्ट्र कायाालय के अजधदेि के अनुरूप एटीएमआईएस की योिना, पररजनयोिन
और रणनीजतक प्रबंधन पर तकनीकी और जििेषज्ञ सलाह प्रदान करन े के सार्-सार् इस संकल्प के कायाान्ियन का समर्ान
करन े म ेंअफ्रीकी संघ के सार् जमलकर काम करने का अनुरोध करता ह।ै

44. जपछल े 15 िषों म ें यूरोपीय संघ द्वारा प्रदान की िा रही जनरंतर जित्तीय सहायता का स्ट्िागत करता है सोमाजलया म ें
अफ्रीकी संघ जमिन, जििेष रूप स,े एटीएमआईएस के रणनीजतक जनणाय लेन े की प्रदक्रया म ें जित्तीय भागीदारों को िाजमल[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27
करन े के महत्ि पर िोर देता ह ै तर्ा जित्तीय और भौजतक सहायता के जलए कड़ी जनगरानी और ििाबदेही के महत्ि पर
िोर देता ह;ै
45. तकनीकी सहायता तर्ा सीसीटीएआरसी के प्रभािी कामकाि और संिोधनों के संजितरण का समर्ान करन े के जलए
सार् ही सार् सेना एि ं पुजलस ििीफा, उपकरण और नए दाताओं सजहत सदस्ट्य राज्यों स े एटीएमआईएस के जलए
अनुमाजनत, रटकाऊ और बहु-िषीय समर्ान प्रदान करन े पर जिचार करन े का आग्रह करता ह,ै जिसमें एटीएमआईएस के
नागररक घटक के जलए अफ्रीकी संघ को अजतररक्त जित्तीय सहायता का प्रािधान िाजमल ह ै तादक एसटीपी, एनएसए और
व्यापक जस्ट्र्रीकरण प्रयास के कायाान्ियन के जलए इसके समर्ान को सक्षम बनाया िा सके।
46. सदस्ट्य देिों स े संयुक्त राष्ट्र रस्ट्ट कोष को धन उपलब्ध करान े पर जिचार करन े का आग्रह करता ह।ै जिसम ें सोमाली
सुरक्षा और पुजलस बलों के प्रजिक्षण, उपकरण और सलाह के जलए धन िाजमल ह।ै आईईडी के खतरे का मुकाबला करना
एिं छोटे और हल्के हजर्यारों के अिैध प्रसार म ें िीषा पर लान े तर्ा एटीएमआईएस के जलए आिश्यक संसाधनों और
उपकरणों को िुटाने म ें अफ्रीकी संघ का समर्ान पाना ह,ै जिसम ें जित्तीय योगदान के माध्यम स े संसाधन िरूरतों के अंतराल
को जनधााररत करन े तर्ा संसाधनों और उपकरणों के जलए जिजिि अनरु ोध िाजमल ह;ै
47. संकल्प 2246 (2015) के अनुरूप समुद्री पुजलस बल के जलए क्षमता जनमााण के सार्-सार् सदस्ट्य राज्यों से जित्तीय
सहायता प्रदान करन े पर जिचार करने का आग्रह करता ह,ै तादक राष्ट्रीय और राज्य-स्ट्तरीय संस्ट्र्ान एक एकीकृत सोमाली
सुरक्षा क्षत्रे जिकजसत कर सकें।
48. सोमाजलया और उसके भागीदारों को एक समजन्ित कदम उठाने की आिश्यकता पर बल देता है सोमाजलया के नेतृत्ि
िाले रािनीजतक और सुरक्षा सुधारों का समर्ान करते हुए जस्ट्र्रता सुजनजश्चत करने, अजधकतम प्रभाि डालन े और
सोमाजलया की सुरक्षा जिम्मेदारी के पररितान को प्रगजतिील एि ं सक्षम बनाए रखन े के जलए:
(क) एफिीएस स े सोमाली संक्रमण योिना सामररक संचालन सजमजत, सुरक्षा और न्याय सजमजत तर्ा सोमाजलया
जिकास और पुनर्नामााण सुजिधा सजमजत की जनयजमत उच्च-स्ट्तरीय बैठकों के माध्यम स े रणनीजतक समन्िय का
नेतृत्ि करने का आग्रह करता ह।ै
(ख) एफिीएस स ेएटीएमआईएस और संयुक्त राष्ट्र तर्ा अन्य अंतरराष्ट्रीय भागीदारों के समन्िय म ें एफएमएस के
सार् सोमाली सुरक्षा बल जनमााण सजहत सभी संयुक्त या समजन्ित संचालन, और रणनीजतक और पररचालन
जनणायों पर सहमत होने का आग्रह करता ह;ै
(ग) एफिीएस, एफएमएस, एटीएमआईएस, यूएनएसओएम, यूएनएसओएस तर्ा संयुक्त राष्ट्र के देिों के समूह
और सोमाजलया के अन्य बहुपक्षीय, क्षेत्रीय और जद्वपक्षीय भागीदारों के बीच समन्िय और सहयोग बढ़ाने के जलए
तकनीकी साझेदारी समन्िय कायाक्रम स्ट्र्ाजपत करने के जलए एफिीएस, यूरोपीय संघ और अफ्रीकी संघ के
समन्िय म ेंसंयुक्त राष्ट्र संघ सअे नुरोध करता है:
(i) प्रमुख प्रदिान संकेतकों के क्षत्रे -दर-क्षत्रे डैिबोड ा के जनमााण सजहत िानकारी साझा करना;
(ii) जिश्लेषण, योिना और प्रदिना मूल्यांकन करना;
(iii) क्षमता जनमााण सहायता, प्रजिक्षण, देखरेख के जद्वपक्षीय प्रािधान का समन्िय करना, सोमाली सुरक्षा और
पुजलस बलों को उपकरण और आपूर्ताया ाँ प्रदान करना;
(iv) यह सुजनजश्चत करना दक इस तरह की सहायता और सहायता प्रासंजगक के अनरूु प प्रदान की िाती ह ै संकल्प
2607 (2021) के प्रािधान; तर्ा

49. सुरक्षा पररषद द्वारा अजधकृत और चाटार के VIII अध्याय के अनुरूप सुरक्षा पररषद के अजधकार के अधीन अफ्रीकी संघ
के नेतृत्ि िाले िांजत समर्ान कायों के जलए पूिाानुमेयता, जस्ट्र्रता और जित्तीय लचीलापन बढ़ाने की आिश्यकता पर िोर
देता है और संयुक्त राष्ट्र, अफ्रीकी संघ, यूरोपीय संघ और अन्य भागीदारों के जलए उपलब्ध जिकल्पों की पूरी श्रृंखला को
ध्यान म ें रखत े हुए और स्ट्िैजछछक जित्त पोषण की सीमाओं पर जिचार करत े हुए एटीएमआईएस के सुरजक्षत भजिष्य के जलए
जित्तीय व्यिस्ट्र्ा स्ट्र्ाजपत करने के जलए महासजचि, अफ्रीकी संघ तर्ा सदस्ट्य राज्यों स े एटीएमआईएस के जलए अजग्रम
धनराजि व्यिस्ट्र्ा खोिने के प्रयासों को िारी रखन े के जलए प्रोत्साजहत करता ह।ै
मल्ू याकं न और ररपोर्टिंग
50. संयुक्त राष्ट्र अफ्रीकी संघ, एफिीएस, यूरोपीय संघ तर्ा अन्य दाताओं सजहत संयुक्त रूप स े एक समािेिी, परामिी
प्रदक्रया के माध्यम स े प्रासंजगक, स्ट्पि और यर्ार्ािादी बेंचमाका की पहचान करने के जलए अनुरोध करता ह,ै जिसम ें सुरक्षा
पररितान के जलए भूजमकाएं और जिम्मेदाररयां तर्ा आकलन योग्य संकेतक िाजमल ह ैं और सुरक्षा पररितान के कायाान्ियन
का आकलन करन,े अफ्रीकी संघ द्वारा प्रस्ट्ताजित एटीएमआईएस की प्रभाििीलता के जलए बेंचमाका और 30 जसतंबर 2022
तक के 2594 (2021) संकल्प को ध्यान म ें रखत े हुए एफिीएस द्वारा प्रस्ट्ताजित एसटीपी और एनएसए के कायाान्ियन के
जलए बेंचमाका िाजमल ह,ैं िो आबादी के सभी िगों की िरूरत को ध्यान म ें रखत ेह।ैं
51. अफ्रीकी यूजनयन एफिीएस, यूरोपीय संघ और अन्य दाताओं के सार्संयुक्त रूप स ेकी गई प्रगजत की जनयजमत, संयुक्त
तकनीकी मूल्यांकन करन,े और इस संकल्प के अनुछछेद 50 म ें अनरु ोध दकए गए मापदंडों के अनरूु प एटीएमआईएस म ें
चरणबद्ध तरीके से कमी लाने के अगल े कदमों के जिषय म ें आग े के जनणाय लेन े हते ु सुरक्षा पररषद का मागादिान और
यूएनएसओएस द्वारा उपलब्ध कराए गए समर्ान तर्ा इस जिषय म ें सुरक्षा पररषद को 15 फरिरी 2023 तक ररपोट ा करने
काअनुरोध करता है;
52. एफिीएस स े सुरक्षा पररषद को क्रमिः 10 िुलाई 2022, 10 अक्टूबर 2022 और 10 िनिरी 2023 तक अद्यतन
सूचना प्रदान करन े का अनुरोध करता है :
(क) इस संकल्प के पैरा 7 और 8 म ें जनधााररत एसटीपी और एनएसए और बल उत्पादन और एकीकरण को लाग ू
करन े म ेंहुई प्रगजत;
(ख) 27 मई 2021 को स्ट्िीकृत रोडमैप को लाग ू करन े म ेंप्रगजत;
53. एटीएमआईएस के आदेि पत्र के कायाान्ियन पर महासजचि के माध्यम स े 10 िुलाई 2022, 10 अक्टूबर 2022 और
10 िनिरी 2023 तक सुरक्षा पररषद को सूजचत करत े रहन े के जलए अफ्रीकी संघ स ेअनुरोध करता ह ैऔर इस संबंध म ें यह
भी अनुरोध करता ह ैदक इन ररपोटों म ेंजनम्नजलजखत जिजिि ररपोर्टिंग िाजमल हों:
(क) एफिीएस के सार् समन्िय तंत्र के उपयोग और प्रभाििीलता सजहत एसटीपी और एनएसए के समर्ान म ें
संयुक्त संचालन पर प्रगजत;
(ख) एटीएमआईएस के आदेि और जनयंत्रण तंत्र का मूल्यांकन;
(ग) पैरा 23 म ें उजल्लजखत रणनीजतक उद्देश्यों म ेंहुई प्रगजत;
(घ) संयुक्त प्रस्ट्ताि और सीओएनओपी म ेंउजल्लजखत कायों म ें हुई प्रगजत का मात्रात्मक और गुणात्मक मूल्यांकन;
(ङ) आदेि और जनयंत्रण तर्ा आचरण एिं अनुिासन सजहत पूिा जचजह्नत न्यून जनष्पादन को संबोजधत के

(2021) के पैरा 18 म ेंउजल्लजखत यूएनएसओएम की रणनीजतक समीक्षा प्रस्ट्तुत करने के जलए महासजचि के अनरु ोध को
दहु राता ह ैतर्ा सोमाजलया म ेंितामान चुनािी प्रदक्रया के समापन के बाद इसके पूरा होने की एक नई तारीख प्रदान करने
की इछछा व्यक्त करता ह।ै

New Delhi, the 30th November, 2022
S.O. 5556(E).— In exercise of the powers conferred by section 2 of the United Nations (Security Council)
Act, 1947 (43 of 1947), the Central Government hereby makes the following Order further to amend the
Implementation of the United Nations Security Council Resolutions on Somalia and Eritrea Order, 2016, namely :-
(1) This Order may be called the Implementation of the United Nations Security Council Resolutions on
Somalia and Eritrea (Second Amendment) Order, 2022.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the Implementation of the United Nations Security Council Resolutions on Somalia and Eritrea Order, 2016,
(hereinafter referred to as the said Order), in the preamble, for the word, figures and brackets “and 2244 (2015)”, the
figures, brackets and word “2244 (2015), 2607 (2021) and 2628 (2022)” shall be substituted.
3. In paragraph 2 of the said Order, in sub-paragraph (1), in clause (a), for the word, figures and brackets “and 2244
(2015)”, the figures, brackets and word “2244 (2015), 2607 (2021) and 2628 (2022)” shall be substituted.
4. In paragraph 4 of the said Order, under the heading “I. Arms Embargo” in clause (c), in the proviso,-
(a) in item (ii), after the brackets, words and figures “{reference paragraph 10 (a) of resolution 2111
(2013)}”, the following shall be inserted namely:-
“and Annex A and Annex B of resolution 2607 (2021) [reference paragraphs 24-25 of resolution 2607
(2021)]”.
(b) in item (iii), after sub-item (d), the following sub–items shall be inserted, namely:-
“(e) African Union Mission in Somalia (AMISOM) shall be substituted by the African Union Transition
Mission in Somalia (ATMIS) [paragraphs 22 and 25 of Resolution 2628(2022)];
(f) Somali Security Sector Institutions other than those of the FGS (SSSI);”
(c) after item (vii), the following items shall be inserted, namely:-
“(viii) Entry into Somali ports for temporary visits of vessels carrying weapons and military equipment for
defensive purposes provided that such items remain at all times aboard such vessels [Paragraph 34(d) of

(ix) deliveries of weapons and military equipment, or the provision of technical advice, financial and other
assistance, and training related to military activities, intended solely for the development of:
(i) the Somali National Security Force of FGA (SNSF), to provide security for the Somali people, except in
relation to items in Annexes A and B to the resolution 2607, which are subject to prior approval of the
Committee on case-by-case basis and advance notification for information to the Committee, respectively. in
paragraphs 21(a), 23 and 24 of Resolution 2607];
(ii) the Somali Security Sector Institutions other than those of the FGS (SSSIs), to provide security for the
Somali people, except in relation to items in Annexes A and B to Resolution 2607, which are subject to the
applicable approvals and notification procedures [as set out in paragraphs 21(b)&(c), 25 and 26 of Resolution
2607].
5. After Annexure 5 of the said Order, the following Annexures shall be inserted namely –

The Security Council,
Recalling all its previous resolutions and statements of its President on the situation in Somalia,
Reaffirming its respect for the sovereignty, territorial integrity, political independence and unity of Somalia, and
underscoring the importance of working to prevent destabilising effects of regional disputes from spilling over into
Somalia,
Welcoming the agreements reached between the Federal Government of Somalia (FGS) and Somalia’s Federal
Member States (FMS) on 17 September 2020 and 27 May 2021, urging the FGS and FMS to implement these
agreements and conduct peaceful, credible and inclusive elections in 2021,
Believing that sustained progress in state-building in Somalia will prevent terrorist groups, including Al-Shabaab from
exploiting the situation in Somalia, expressing concern about continued delays in consolidating Somalia’s federal
system, underscoring the importance of progress on national priorities, including the National Security Architecture,
the Somalia Transition Plan (2021) (STP), the ninth National Development Plan and the jointly-agreed Mutual
Accountability Framework, and reaching agreement on a federated police and justice system, fiscal federalism, power
- and resource-sharing, and the constitutional review, in this regard welcoming the roadmap agreed on 27 May 2021,
and urging the FGS and the FMS to implement it without delay,
Encouraging the FGS to coordinate with international and regional partners regarding its needs in developing its
National Security Forces, noting that these forces require access to weapons and specialist equipment, in accordance
with the measures in this resolution, in order to perform their functions effectively,
Welcoming progress made by the FGS on weapons and ammunition management (WAM), including the adoption of
the National WAM Strategy, urging continued work codifying and implementing weapons and ammunition
management policies including developing an accountable weapons distribution and tracing system for all Somali
security forces, recognising that effective weapons and ammunition management is the responsibility of the FGS and
FMS, and encouraging Somalia’s partners to support the FGS and FMS with this, and in line with Somalia’s National
Security Architecture and the STP,
Condemning the supply of weapons and ammunition to and through Somalia in violation of the arms embargo,
especially when they reach Al-Shabaab and affiliates linked to ISIL, and when they undermine the sovereignty and
territorial integrity of Somalia, as a serious threat to peace and stability in the region, and further condemning
continued illegal supply of weapons, ammunition and IED components from Yemen to Somalia,
Condemning Al-Shabaab’s terrorist attacks in Somalia and beyond, expressing grave concern that Al-Shabaab
continues to pose a serious threat to the peace, security and stability of Somalia and the region, particularly through its
increased use of improvised explosive devices (IEDs) and exploitation of the licit financial system, and further
expressing grave concern at the continued presence in Somalia of affiliates linked to Islamic State in Iraq and the
Levant (ISIL also known as Da’esh),
Reaffirming the need to combat by all means, in accordance with the Charter of the United Nations and international

threats to international peace and security caused by terrorist acts,
Recognising that the threat posed by Al-Shabaab to peace, security and stability in Somalia and the region goes
beyond the group’s conventional military action and asymmetric warfare, expressing serious concern at Al-Shaabab’s
ability to generate revenue as documented in the final report of the Panel of Experts (the Panel) on Somalia
(S/2021/849) welcoming the FGS’ efforts to strengthen the Somali Financial Sector to identify and monitor money
laundering risks and combat terrorist financing, noting the steps set out by the FGS in the STP on institutional capacity
building, which seek to develop these capabilities, noting the importance of financial services in enabling Somalia’s
economic future, further welcoming efforts by the FGS, the United Nations Office on Drugs and Crime (UNODC) and
the Panel to develop a plan to disrupt Al-Shabaab finances, and urging engagement from the FGS, FMS, Somali
financial institutions, the private sector and the international community to support this process,
Expressing concern at the continued reports of corruption and diversion of public resources in Somalia, welcoming
efforts made by the FGS to reduce corruption including the enactment of the Anti-Corruption Law on 21 September
2019 and the establishment of the Anti-Corruption Commission, as well as the ratification of the United Nations
Convention Against Corruption, welcoming progress made by the FGS and FMS in strengthening public financial
management and the positive work of the Financial Reporting Centre, and calling for the FGS and FMS to continue
efforts to address corruption, and to continue to accelerate the pace of reform,
Welcoming measures taken by the FGS, FMS and United Nations Member States with charcoal destination markets to
reduce the export of charcoal, urging monitoring and control of existing charcoal stockpiles at export points,
encouraging further development of Somalia’s National Policy on Charcoal, which aims to develop the sustainable
management of domestic charcoal use, to address disposal of stockpiles,
Expressing concern at the reported ability of Al-Shabaab to exploit the trade in sugar and urging the FGS, FMS and
regional stakeholders to address this,
Expressing concern at continued reports of illegal and unregulated fishing in waters where Somalia has jurisdiction,
noting the link between illegal fishing and Al-Shabaab’s ability to generate revenue, encouraging the Somali
authorities, with support from the international community, to ensure fishing licenses are issued in accordance with the
appropriate Somali legislation, further encouraging the FGS, FMS and Somali authorities to work with the UNODC,
their international partners and other stakeholders to improve maritime domain awareness and enforcement
capabilities,
Expressing concern at the situation in Galmadug, reiterating the importance of peaceful dispute resolution both in the
run-up to elections in 2021 and beyond, and reaffirming the importance of inclusive politics, and democratic elections
in ensuring long-term peace and stability in Somalia,
Expressing serious concern at the humanitarian situation in Somalia, noting the combined threat posed by flooding,
drought, locust infestation, forced displacement, and COVID-19, and condemning in the strongest terms any party
obstructing the safe delivery of humanitarian assistance, any misappropriation or diversion of any humanitarian funds
or supplies, and acts of violence against or harassment of humanitarian workers,
Noting with concern reports, including from the Secretary-General, which document worrying levels of sexual and
gender-based violence in Somalia, further noting with concern that Somalia remains one of the deadliest conflict areas
for children, as outlined in the 2021 Report of the Secretary-General on Children and Armed Conflict, further noting
with concern the high levels of recruitment of children in armed conflict in violation of international law and high
levels of abductions, with Al-Shabaab continuing to be the main perpetrator, and urging the Somali authorities to
further strengthen efforts to address these “six grave violations” against children as identified by the Secretary-
General, including by implementing measures in line with resolution 2467 (2019),
Reiterating the importance of inclusive dialogue and local reconciliation processes for stability in Somalia,
reaffirming the importance of both the FGS and FMS engaging in constructive dialogue to de-escalate tensions
between them, and further reiterating that the successful and peaceful conduct of elections in 2021 as planned and
agreed can enable Somalia to refocus on addressing pressing problems, including among other things, the threat posed
by Al-Shabaab, trafficking of weapons and ammunition, humanitarian needs, floods, drought, and COVID-19 and
enable all parties to advance Somalia’s national priorities,
Taking note of the final report of the Panel, welcoming the increased cooperation between the Panel and the FGS, and
recalling that panels of experts operate pursuant to mandates from the Security Council,32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Expressing support for the FGS in its efforts to reconstruct the country, counter the threat of terrorism, and stop the
trafficking of weapons and ammunition, further expressing its intention to ensure the measures in this resolution will
enable the FGS in the realisation of these objectives, noting that the security situation in Somalia continues to
necessitate these measures, including strict controls on the movement of arms but affirming that it shall keep the
situation in Somalia under constant review and that it shall be prepared to review the appropriateness of the measures
contained in this resolution, including any modification, possible benchmarks, suspension or lifting of the measures,
as may be needed in light of the progress achieved and compliance with this resolution,
Recalling paragraphs 1 to 8 of resolution 2444 (2018), reaffirming that it will continue to follow developments
towards the normalisation of relations between Eritrea and Djibouti and will support the two countries in the
resolution of these matters in good faith,
Underscores its objective in this resolution is to support state- and peace- building in Somalia including by reducing
the threat to peace and security posed by Al-Shabaab and by reducing the destabilising impact of Al-Shabaab’s
activities, in Somalia and the region, and by supporting Somalia with security sector reforms, especially weapons and
ammunition management, and through the measures and mechanisms outlined in the following operative paragraphs,
Determining that the situation in Somalia continues to constitute a threat to international peace and security in the
region,
Acting under Chapter VII of the Charter of the United Nations,
Part 1: Degrading Al-Shabaab
1. Reiterates that Al-Shabaab poses a threat to peace and security, and that its terrorist and other activities have a
destabilising impact in Somalia and the region, and underscores the need to target Al-Shabaab’s finances, improve
maritime domain awareness, prevent illicit revenue generation, including from the sale of charcoal, and reduce the
threat posed by IEDs;
1a: Targeting illicit finances
2. Notes with concern Al-Shabaab’s ability to generate revenue and launder, store and transfer resources, calls upon
the FGS to continue working with Somali financial authorities, private sector financial institutions and the
international community to identify, assess and mitigate money laundering and terrorist financing risks, improve
compliance (including enhanced Know Your Customer and due diligence procedures) and strengthen supervision and
enforcement, including through increased reporting to the Central Bank of Somalia and Financial Reporting Centre in
line with the Anti-Money Laundering and Counter the Financing of Terrorism Act (2016) as well as the Mobile Money
Regulations (2019), commends the FGS for signing a National Identification (ID) bill and encourages the
development of a unique Somali ID as a matter of priority to improve financial access and compliance and counter the
financing of terrorism, further encourages support from the international community in addressing these risks and
requests the FGS, UNODC and the Panel to continue exchanging information about Al-Shabaab’s finances and to
continue working with stakeholders to develop a plan to disrupt Al -Shabaab’s finances and exploitation of the licit
financial system;
3. Requests the FGS to strengthen cooperation and coordination with other United Nations Member States,
particularly other Member States in the region, and with international partners to prevent and counter the financing of
terrorism, including compliance with resolution 1373 (2001), resolution 2178 (2014), resolution 2462 (2019), and
relevant domestic and international law, and requests the FGS to submit, in its regular reporting to the Council, an
update on specific actions taken by the Somali authorities to counter the financing of terrorism;
1b: Maritime Interdiction and improving maritime domain awareness
4. Encourages the UNODC, within its current mandate, under the Indian Ocean Forum on Maritime Crime, to bring
together relevant States and international organisations, including European Naval Force Operation Atalanta,
Combined Maritime Forces (CMF) and other naval forces in the region to enhance regional cooperation on responding
to illicit maritime flows and disrupt all forms of trafficking in licit and illicit goods that may finance terrorist activities
in Somalia, and support the FGS and FMS to improve their maritime domain awareness and enforcement, including in
relation to the role of fishing vessels in trafficking and illicit trade;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33
5. Decides to renew and expand the provisions set out in paragraph 15 of resolution 2182 (2014) until 15 November
2022 and authorises Member States, acting nationally or through voluntary multinational naval partnerships such as
“Combined Maritime Forces,” in cooperation with the FGS and which the FGS has notified to the Secretary-General
and which the Secretary-General has subsequently notified to all Member States, in order to ensure strict
implementation of the arms embargo on Somalia, the charcoal ban, and the IED components ban, to inspect, without
undue delay, in Somali territorial waters and on the high seas off the coast of Somalia extending to and including the
Arabian sea and Persian Gulf, vessels bound to or from Somalia which they have reasonable grounds to believe are:
(i) carrying charcoal from Somalia in violation of the charcoal ban;
(ii) carrying weapons or military equipment to Somalia, directly or indirectly, in violation of the arms embargo on
Somalia;
(iii) carrying weapons or military equipment to individuals or entities designated by the Committee pursuant to
resolution 751 (1992); or
(iv) carrying IED components identified in Part I of Annex C to this resolution in violation of the IED components
ban;
1c: Somalia Charcoal ban
6. Condemns any exports of charcoal from Somalia in violation of the total ban on the export of charcoal, reaffirms its
decision regarding the ban on the import and export of Somali charcoal, as set out in paragraph 22 of its resolution
2036 (2012) (“the charcoal ban”), and paragraphs 11 to 21 of resolution 2182 (2014);
7. Welcomes measures taken by the FGS, FMS and Member States to reduce the export of charcoal from Somalia,
reiterates its requests that the African Union Mission in Somalia (AMISOM) support and assist the FGS and FMSs in
implementing the total ban on the export of charcoal from Somalia, encourages further development of Somalia’s
National Policy on Charcoal to develop the sustainable management of domestic charcoal use, encourages the Food
and Agriculture Organization (FAO) to provide the FGS with data and enhanced analysis on domestic charcoal
production to inform the development of the FGS National Policy on Charcoal and calls upon AMISOM to facilitate
regular access for the Panel to charcoal exporting ports;
8. Reaffirms the importance of the efforts of the UNODC and its international partners to monitor and disrupt the
export and import of charcoal to and from Somalia;
1d: IED components restrictions
9. Noting the increase in IED attacks undertaken by Al-Shabaab, decides that all States shall prevent the direct or
indirect sale, supply or transfer of the items in part I of Annex C to this resolution to Somalia from their territories or
by their nationals outside their territories, or using their flag vessels or aircraft if there is sufficient evidence to
demonstrate that the item(s) will be used, or a significant risk they may be used, in the manufacture in Somalia of
improvised explosive devices;
10. Further decides that, where an item in part I of Annex C to this resolution is directly or indirectly sold, supplied or
transferred to Somalia consistent with paragraph 9, the State shall notify the Committee of the sale, supply or transfer
no more than 15 working days after the sale, supply or transfer takes place, and stresses the importance that
notifications pursuant to this paragraph contain all relevant information, including the purpose of the use of the
item(s), the end user, the technical specifications and the quantity of the item(s) to be shipped;
11. Calls upon Member States to undertake appropriate measures to promote the exercise of vigilance by their
nationals, persons subject to their jurisdiction and firms incorporated in their territory or subject to their jurisdiction
that are involved in the sale, supply, or transfer of explosive precursors and materials to Somalia that may be used in
the manufacture of improvised explosive devices, including inter alia items in part II of Annex C, to keep records of
transactions and share information with the FGS, the Committee and the Panel regarding suspicious purchases of or
enquiries into these chemicals by individuals in Somalia and to ensure that the FGS and FMS are provided with
adequate financial and technical assistance to establish appropriate safeguards for the storage and distribution of
materials;
12. Encourages international and regional partners of Somalia to implement continued specialist training of FGS
Explosive Ordnance Disposal teams and to provide appropriate equipment and coordinate support to reinforce Somali
capacity in the analysis of explosives;34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Part 2: supporting state- and peace-building in Somalia
2a: Security sector reform and compliance with international law
13. Calls upon the FGS, in coordination with the FMS, to accelerate the implementation of the National Security
Architecture and STP, and urges the FGS and FMS to implement the 27 May 2021 roadmap;
14. Further calls upon the FGS and FMS to enhance civilian oversight of their security apparatus, to continue to adopt
and implement appropriate vetting procedures of all defence and security personnel, including human rights vetting,
and to investigate and, as appropriate, prosecute individuals responsible for violations of international law, including
international humanitarian law and human rights law, and sexual and gender-based violence in conflict and post-
conflict situations, and in this context recalls the importance of the Secretary-General’s Human Rights and Due
Diligence Policy in relation to the support provided by the United Nations to Somali security forces and AMISOM;
15. Calls upon the international community to support implementation of the STP to help develop credible,
professional and representative Somali security forces;
16. Calls upon all parties to the conflict in Somalia to comply with international humanitarian law, and urges them to
continue conducting prompt and full investigations when reports of civilian casualties resulting from military
operations arise;
2b: Weapons and ammunition management and preventing illegal movement of weapons to and within Somalia
17. Welcomes progress on weapons and ammunition management and underlines the responsibility of the FGS and
FMS to ensure the safe and effective management, storage and security of their stockpiles of weapons, ammunition
and other military equipment and their distribution, including implementation of a system which allows tracking of all
such military equipment and supplies to the unit level;
18. Reaffirms that the FGS, in cooperation with the FMS and AMISOM, shall document and register all weapons and
military equipment captured as part of offensive operations or in the course of carrying out their mandates, including
recording the type and serial number of the weapon and/or ammunition, photographing all items and relevant
markings and facilitating inspection by the Panel of all military items before their redistribution or destruction;
19. Calls upon the international community to provide additional and coordinated support to continue to develop the
weapons and ammunition management capacity of the FGS and FMS, with a particular focus on training, storage,
support for infrastructure and distribution, technical assistance and capacity building and encourages international and
regional partners to coordinate their efforts to support the strengthening of FGS bodies in charge of implementing the
requirements of this resolution;
20. Emphasises that effective weapons and ammunition management will reduce the ability of Al-Shabaab and other
armed groups to obtain weapons and reduce the threat to peace and security posed by them, in Somalia and the region,
and reaffirms that all States shall, for the purposes of establishing peace and stability in Somalia, implement a general
and complete embargo on all deliveries of weapons and military equipment to Somalia, including prohibiting the
financing of all acquisitions and deliveries of weapons and military equipment and the direct or indirect supply of
technical advice, financial and other assistance, and training related to military activities, until the Council decides
otherwise (as initially imposed by paragraph 5 of its resolution 733 (1992) and paragraphs 1 and 2 of resolution 1425
(2002), hereafter “the arms embargo”;
21. Recognises that Somali National Security Forces (SNSF) and Somali Security Sector Institutions other than those
of the FGS (SSSIs) will require access to weapons and specialist equipment, in line with Somalia’s National Security
Architecture and the STP, in order to perform their functions effectively and reaffirms that the arms embargo shall not
apply to:
(a) deliveries of weapons and military equipment, or the provision of technical advice, financial and other assistance,
and training related to military activities, intended solely for the development of the SNSF, to provide security for the
Somali people, except in relation to items in Annexes A and B to this resolution, which are subject to the applicable
approvals and notification procedures as set out in paragraphs 23 and 24 to this resolution;
(b) to deliveries of weapons and military equipment, intended solely for the development of SSSIs, to provide security[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 35
for the Somali people, except in relation to items in Annexes A and B to this resolution, which are subject to the
applicable approvals and notification procedures as set out in paragraphs 25 and 26 below;
(c) the provision of technical advice, financial and other assistance, and training related to military activities, intended
solely for the development of SSSIs, to provide security for the Somali people, which are also subject to the applicable
approvals and notification procedures as set out in paragraph 26 below;
22. Reaffirms that weapons and military equipment sold or supplied in accordance with the exemption in paragraph 21
of this resolution shall not be resold to, transferred to, or made available for use by any individual or entity not in the
service of the Somali National Security Forces or Somali security sector institution to which it was originally sold or
supplied, or the selling or supplying State or international, regional or subregional organisation;
Approvals and notifications required under the arms embargo
23. Reaffirms that deliveries of items in Annex A to this resolution, intended solely for the development of SNSF, to
provide security for the Somali people, require an advance approval by the Committee on a case-by-case basis,
requests for which shall be submitted at least five working days in advance by the FGS or the State or international,
regional or subregional organisation delivering assistance;
24. Reaffirms that deliveries of items in Annex B to this resolution, intended solely for the development of SNSF, to
provide security for the Somali people, are subject to notifications to the Committee for information submitted at least
five working days in advance by the FGS or the State or international, regional or subregional organisation delivering
assistance;
25. Reaffirms that deliveries of items in Annex A to this resolution, intended solely for the development of SSSIs, to
provide security for the Somali people, require an advance approval by the Committee on a case-by-case basis,
requests for which shall be submitted at least five working days in advance by the supplying State or international,
regional or sub-regional organisation and requests States or international, regional and sub-regional organisations to
inform the FGS in parallel of any such deliveries at least five working days in advance;
26. Reaffirms that deliveries of items in Annex B to this resolution or the delivery of technical advice, financial and
other assistance, and training related to military activities, intended solely for the development of SSSIs, to provide
security for the Somali people, may be provided in the absence of a negative decision by the Committee within five
working days of receiving a notification from the supplying State or international, regional and sub-regional
organisation, and requests States or international, regional and sub-regional organisations to inform the FGS in
parallel of any such deliveries at least five working days in advance;
27. Reaffirms that the delivery of non-lethal military equipment intended solely for humanitarian or protective use
shall be notified to the Committee five days in advance for its information only, by the supplying State or
international, regional or subregional organisation;
Further information on approvals and notifications
28. Reaffirms that the FGS has the primary responsibility to seek approval from or notify the Committee pursuant to
paragraph 23 or 24, as applicable, of any deliveries of weapons and military equipment to the SNSF, at least five days
in advance, and that all requests for approvals and notifications should include: details of the manufacturer and
supplier of the weapons and military equipment, a description of the arms and ammunition including the type, calibre
and ammunition, proposed date and place of delivery, and all relevant information concerning the intended destination
unit in the SNSF, or the intended place of storage;
29. Reaffirms that the State or international, regional or subregional organisation delivering weapons and military
equipment to the SNSF pursuant to paragraph 23 or 24, may alternatively, make an advance request for approval or
notification, as applicable, in consultation with the FGS, reaffirms that a State or international, regional or subregional
organisation choosing to do so should inform the appropriate national coordinating body within the FGS of the
advance request for approval or notification and provide the FGS with technical support with notification procedures
where appropriate, and requests the Committee to transmit advance requests for approval and notifications from States
or international, regional or subregional organisations to the appropriate national coordinating body in the FGS;36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
30. Reaffirms that a State or international, regional or subregional organization delivering any weapon and military
equipment, technical advice, financial and other assistance, and training related to military activities to SSSIs,
pursuant to paragraph 25 or 26, has responsibility for seeking approval from or notifying the Committee, as
applicable, for any deliveries of those items, advice, assistance or training, and informing the FGS in parallel at least
five working days in advance and decides that all requests for approvals and notifications should include: details of the
manufacturer and supplier of the weapons and military equipment including serial numbers, a description of the arms
and ammunition including the type, calibre and ammunition, proposed date and place of delivery, and all relevant
information concerning the intended destination unit, or the intended place of storage;
31. Notes with concern reports that States were not adequately following the notification procedures set out in prior
resolutions, reminds States of their obligations pursuant to the notification procedures, set out in paragraphs 23–30
above, and further urges States to follow strictly the notification procedures for providing assistance to SSSIs
including informing the FGS;
32. Reaffirms that where paragraphs 23 or 24 apply the FGS shall no later than 30 days after the delivery of weapons
and military equipment, submit to the Committee a post-delivery notification in the form of written confirmation of
the completion of any delivery to the SNSF, including the serial numbers for the weapons and military equipment
delivered, shipping information, bill of lading, cargo manifests or packing lists, and the specific place of storage, and
recognises the value of the supplying State or international, regional or subregional organisation doing the same, in
cooperation with the FGS;
33. Decides that where paragraphs 25 or 26 apply the supplying State or international, regional or sub-regional
organisation shall, no later than 30 days after the delivery of weapons and military equipment, submit to the
Committee a post-delivery notification in the form of written confirmation of the completion of any delivery to the
SSSI, including the serial numbers for the weapons and military equipment delivered, shipping information, bill of
lading, cargo manifests or packing lists and the specific place of storage, and inform the FGS in parallel;
Further exemptions to the arms embargo
34. Reaffirms that the arms embargo shall not apply to:
(a) Supplies of weapons or military equipment or the provision of technical advice, financial and other assistance, and
training related to military activities intended solely for the support of or use by United Nations personnel, including
the United Nations Assistance Mission in Somalia (UNSOM), the African Union Mission in Somalia (AMISOM);
AMISOM’s strategic partners, operating solely under the latest African Union Strategic Concept of Operations, and in
cooperation and coordination with AMISOM; and the European Union Training Mission (EUTM) in Somalia, all as
per paragraph 10 (a)–(d) of resolution 2111 (2013);
(b) Supplies of weapons and military equipment destined for the sole use of States or international, regional and
subregional organisations undertaking measures to suppress acts of piracy and armed robbery at sea off the coast of
Somalia, upon the request of the FGS and for which the FGS has notified the Secretary -General, and provided that
any measures undertaken shall be consistent with applicable international humanitarian and international human rights
law;
(c) Supplies of protective clothing, including flak jackets and military helmets, temporarily exported to Somalia by
United Nations personnel, representatives of the media and humanitarian and development workers and associated
personnel for their personal use only;
(d) Entry into Somali ports for temporary visits of vessels carrying weapons and military equipment for defensive
purposes provided that such items remain at all times aboard such vessels (as previously affirmed by paragraph 3 of
resolution 2244 (2015));
Part 3: Targeted Measures
35. Recalls its decisions in its resolution 1844 (2008) which imposed targeted sanctions and its resolutions 2002
(2011), and 2093 (2013) which expanded the listing criteria, and recalls its decisions in its resolutions 2060 (2012) and
2444 (2018), and further recalls that the listing criteria includes, but is not limited to, planning, directing or
committing acts involving sexual and gender-based violence, and reiterates its request for Member States to assist the
Panel of Experts in its investigations, and for the FGS, FMS and AMISOM and partners to share information with the
Panel of Experts regarding conduct or activities, in particular Al –Shabaab activities, where covered by listing criteria;
36. Requests the Special Representative of the Secretary-General for Children and Armed Conflict and the Special
Representative for Sexual Violence in Conflict to share relevant information with the Committee in accordance with
paragraph 7 of resolution 1960 (2010) and paragraph 9 of resolution 1998 (2011), and invites the Office of the United
Nations High Commissioner for Human Rights to share relevant information with the Committee, as appropriate;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 37
37. Reaffirms that without prejudice to humanitarian assistance programmes conducted elsewhere, the measures
imposed by paragraph 3 of its resolution 1844 (2008) shall not apply to the payment of funds, other financial assets or
economic resources necessary to ensure the timely delivery of urgently needed humanitarian assistance in Somalia, by
the United Nations, its specialised agencies or programmes, humanitarian organisations having observer status with
the United Nations General Assembly that provide humanitarian assistance, and their implementing partners including
bilaterally or multilaterally funded non -governmental organisations participating in the United Nations Humanitarian
Response Plan for Somalia;
Panel of Experts on Somalia
38. Decides to renew, with effect from the date of adoption of this resolution, until 15 December 2022, the Panel on
Somalia and that the mandate of the Panel shall include the tasks referred to in paragraph 11 of resolution 2444 (2018)
and paragraph 2 of this resolution, requests the Secretary-General to include dedicated gender expertise, in line with
paragraph 11 of its resolution 2467 (2019) and further requests the Panel to include gender as a cross-cutting issue in
its investigations and reporting, and expresses its intention to review the mandate of the Panel and take appropriate
action regarding any extension to the mandate no later than 15 November 2022;
39. Recalls the importance of full co-operation between the FGS and the Panel, requests the FGS to facilitate for the
Panel interviews of suspected members of Al-Shabaab and ISIL held in custody, notes the importance of the Panel
carrying out their mandate in line with document S/2006/997, and requests the Panel to give recommendations to the
Committee on how to support the FGS in weapons and ammunition management, including efforts towards
establishing a National Small Arms and Light Weapons Commission;
40. Reiterates its request for States, the FGS, the FMS and AMISOM to provide information to the Panel, and assist
them in their investigations, urges the FGS and the FMS to facilitate access for the Panel, on the basis of written
requests to the FGS by the Panel, to all FGS armouries in Mogadishu, all FGS -imported weapons and ammunition
prior to distribution, all FGS military storage facilities in Somalia National Army (SNA) sectors and all captured
weaponry in FGS and FMS custody, and to allow photographs of weapons and ammunition in FGS and FMS custody
and access to all FGS and FMS logbooks and distribution records, in order to enable the Security Council to monitor
and assess implementation of this resolution;
Reporting
41. Requests the Panel to provide regular updates to the Committee, including a minimum of four different thematic
reports delivered on a quarterly basis, including one of smuggling and trafficking on weapons and military equipment,
a comprehensive mid-term update and, for the Security Council’s consideration, through the Committee, a final report
by 15 October 2022 and urges the Panel to seek feedback from the Committee on the findings of their reporting;
42. Requests the Secretary-General to provide to the Council, no later than 15 September 2022, and following
completion of a technical assessment of Somalia’s weapons and ammunition management capability,
recommendations to improve it further and to articulate options for clear, well identified, and realistic benchmarks that
could serve in guiding the Security Council in its review of the arms embargo measures in light of progress achieved
to date and compliance with this resolution, and particularly its consideration of possible modification, suspension or
lifting of those measures;
43. Requests the Emergency Relief Coordinator to report to the Security Council by 15 October 2022 on the delivery
of humanitarian assistance in Somalia and on any impediments to the delivery of humanitarian assistance in Somalia;
44. Requests the FGS to report to the Security Council in accordance with paragraph 9 of resolution 2182 (2014) and
as requested in paragraph 7 of resolution 2244 (2015), by 1 February 2022 and then by 1 August 2022, including:
(a) the structure, composition, strength and disposition of its security forces, and the status of regional and
militia forces,
(i) including as annexes the reports of the Joint Verification Team (JVT) requested in paragraph 7 of resolution
2182 (2014) and para 37 of resolution 2551 (2020), and
(ii) incorporating the notifications regarding the destination unit in the SNSF or the place of storage of military
equipment upon distribution of imported arms and ammunition;
(b) an update summarising suspicious activity documented by domestic financial institutions, and investigations and
actions undertaken by the Financial Reporting Centre to counter the financing of terrorism and in a manner so as to38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
protect the confidentiality of sensitive information;
(c) an update on the status of individuals designated by the Committee, where information is available;
45. Requests the Secretary-General to provide the Security Council with an update, no later than the 31 July 2022 on
any further developments towards the normalisation of relations between Eritrea and Djibouti;
46. Decides to remain seized of the matter.

The Security Council,
Recalling all its previous resolutions and statements of its President on the situation in Somalia, and reaffirming its
respect for the sovereignty, territorial integrity, political independence, and unity of Somalia,
Recalling that the Federal Government of Somalia (FGS) has primary responsibility for ensuring security in Somalia,
and recognising Somalia’s request for continued international support to enable it to achieve progressively its aim of a
secure, stable, peaceful, united and democratic country,
Stressing that international support should be provided in-line with the strategic direction set out by Somalia in the
Somalia Transition Plan (STP), and National Security Architecture (NSA) and urging enhanced partnership and
coordination between all stakeholders in support of stabilisation and state-building processes in Somalia,
Commending the contribution of the African Union Mission in Somalia (AMISOM) to building lasting peace and
stability in Somalia since it was first authorised 15 years ago, and paying tribute to all AMISOM personnel, and
Somali forces, especially those who gave their lives to their mission,40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Welcoming the support provided by the United Nations Support Office in Somalia (UNSOS) to AMISOM,
appreciating the financial support provided to AMISOM by the European Union and other donors, and noting the
bilateral support provided by Member States to Somalia,
Recognising that the security situation in Somalia has changed significantly since AMISOM was first authorised, and
noting improvements in Somalia’s capacity and capability to respond to security challenges,
Reaffirming the need to combat terrorist threats by all means, in accordance with the Charter of the United Nations
and other obligations under international law, including applicable international human rights law, international
refugee law, and international humanitarian law, and reaffirming that any acts of terrorism are criminal and
unjustifiable, regardless of their motivations, whenever, wherever and by whomsoever committed,
Expressing grave concern that Al-Shabaab continues to pose a serious threat to the peace, security and stability of
Somalia and the region, and noting its increased use of improvised explosive devices (IEDs) and exploitation of the
licit financial system,
Expressing grave concern at the continued presence in Somalia of affiliates linked to Islamic State in Iraq and the
Levant (ISIL also known as Da’esh),
Recognising that the nature of the threat posed by Al-Shabaab has evolved, and that international support to Somalia
must adapt accordingly to consolidate the security gains achieved to date and ensure continued progress towards a
more stable, secure and peaceful Somalia,
Recalling the need for a reconfigured African Union mission in Somalia, which is focussed on enabling and
supporting Somalia to take primary responsibility for its security, and expressing appreciation for Somalia and the
African Union’s joint effort to update AMISOM’s Concept of Operations (CONOPS) in line with the STP and in
close cooperation with the United Nations and international partners, to help inform decisions about the size and shape
of the future mission, including its logistical requirements,
Noting with appreciation the proposal submitted to the Security Council on 7 March 2022 by the Secretary-General,
and produced jointly with the African Union, in consultation with the FGS and donors, for the strategic objectives,
size and composition of a reconfigured African Union mission in Somalia, as requested in resolution 2568 (2021)
(hereafter Joint Proposal),
Noting the African Union Peace and Security Council’s communique of its 1068th meeting on 8 March 2022, and its
decision to reconfigure AMISOM into the African Union Transition Mission in Somalia (ATMIS),
Stressing the need to ensure robust command and control and operational coordination, both among African Union
deployed troop and police contingents and in the force generation and integration efforts of Somalia,
Emphasising the importance of capacity building and security sector reform to enable integrated Somali security
forces and institutions to respond effectively to security threats, and further emphasising the importance of
coordination between the FGS, Somalia’s Federal Member States (FMS), United Nations, African Union, and
Somalia’s international partners, to ensure capacity building and security reform is joined-up, and enables Somalia to
assume full responsibility for its security,
Recognising that military action alone will not be sufficient to resolve threats to peace and security in Somalia,
emphasising that the protection of civilians is critical to build sustainable peace, and reiterating the need to pursue a
holistic approach that reinforces the foundations of peace and stability, in line with priorities defined by Somalia
including through enhancing:

(ii) anti-corruption,
(iii) preventing organised crime,
(iv) the rule of law,
(v) justice and law enforcement,
(vi) efforts to counter terrorism,

(ix) security sector reform, and
(x) inclusive politics and reconciliation,
Noting the potential of international cooperation and support for peacebuilding and post-conflict reconstruction and
development in Somalia, if provided in line with priorities defined by the Somali authorities, and further noting in this
regard the African Union Post-Conflict Reconstruction and Development (AUPCRD) policy and the AUPCRD
dedicated centre in Cairo,
Underlining the critical importance of the FGS and FMS reaching inclusive political agreements, urging them to
collaborate on security and other national priorities, noting the responsibilities of all parties to improve cooperation
and engage in discussions for the benefit of all Somalis, and underscoring that full cooperation of all parties would
advance progress on national priorities including:
(i) implementation of the National Security Architecture,
(ii) implementation of the STP,
(iii) ensuring a fully functioning federal system, and
(iv) finalising the constitution as the legal and political foundation for Somalia’s government and institutions,
Welcoming the support provided by the United Nations Assistance Mission in Somalia (UNSOM) in this regard, and
recalling its request in resolution 2592 (2021) for a strategic review of UNSOM after the completion of the current
electoral process,
Noting that UNSOM and ATMIS have complementary mandates to support peace and reconciliation in Somalia, and
that by providing security and strengthening Somalia’s security capacity, ATMIS will make a critical contribution to
justice, local governance, peace and reconciliation,
Recognising the complementary work of the United Nations Panel of Experts for Somalia and the role of sanctions
imposed by the United Nations Security Council, as, among other things, a non-military means of reducing the
destabilising impact of Al-Shabaab’s activities in Somalia and the region, and supporting Somalia with security sector
reforms, especially weapons and ammunition management,
Recalling its resolution 1325 (2000) and subsequent resolutions, recognising the important role of women in the
prevention and resolution of conflicts and in peacebuilding, and stressing the importance of the full, equal and
meaningful participation and involvement of women in all efforts at all levels for the maintenance and promotion of
peace and security, and the need to increase the role of women in decision-making and leadership regarding conflict
prevention and resolution, as envisaged in the Somali Women’s Charter,
Condemning violations and abuses of human rights and violations of international humanitarian law in Somalia,
calling on all parties to act in full compliance with their obligations under international human rights law and
international humanitarian law,
Expressing serious concern about the humanitarian situation in Somalia, and calling for all parties to the conflict to
allow and facilitate, in accordance with relevant provisions of international law, including applicable international
humanitarian law, and in a manner consistent with the United Nations guiding principles of humanitarian emergency
assistance (United Nations General Assembly resolution 46/182), including humanity, neutrality, impartiality and
independence, the provision of humanitarian assistance necessary to support Somalia
Emphasising the need for adequate risk assessment and risk management strategies by the FGS and the United
Nations, of climate change, other ecological changes, natural disasters and other factors on the stability of Somalia,
Determining that the situation in Somalia continues to constitute a threat to regional and international peace and
security,

Somalia
1. Welcomes the 27 September 2020, 27 May 2021 and 09 January 2022 agreements, and urges the FGS and FMS to
ensure any disputes over implementation of these agreements are resolved peaceably so the electoral process can be
completed without further delay, and underscores that completing the electoral process, and achieving a peaceful
transition of power, will help to progress national priorities and support transition from international security support
in line with the STP and NSA;
2. Underscores the importance of progress on national priorities, including: the NSA, STP, the ninth National
Development Plan, reaching agreement on a federated police and justice system, fiscal federalism, power and resource
-sharing, the constitutional review, and local and national reconciliation, and in this regard welcomes the roadmap
agreed on 27 May 2021, and urges Somalia to implement it without delay;
3. Reaffirms the importance of the full, equal, meaningful and effective participation of women, and the inclusion of
all Somalis, including, youth, persons with disabilities, Internally Displaced Persons (IDPs) and refugees in the
prevention and resolution of conflicts, reconciliation processes, peacebuilding and elections and other political
processes, and acknowledges the contribution that civil society can make in this regard and calls on Somalia to
provide a safe environment for civil society organisations to work freely and protect them from threats and reprisals;
4. Reiterates its objective of enabling Somalia to take full responsibility for its own security, including through
assuming the leading role in countering and addressing the threat posed by Al-Shabaab, including through the conduct
of military operations to degrade Al-Shabaab’s capabilities, and strongly urges Somalia to use the opportunity and
support provided by the international community to prioritise the implementation of the STP and NSA and the
generation of accountable, affordable and able security forces so that ATMIS can continue its phased drawdown, and
Somalia can assume full responsibility for its own security;
5. Calls on the Somali authorities to ensure the delivery of the STP and NSA is properly resourced, including the
command, control and coordination mechanisms required to enable the planning, conduct and delivery of joint
operations with ATMIS as well as the development of necessary logistical support capabilities;
6. Underscores the primary responsibility for protecting civilians of the Somali authorities, and further underscores
the importance of protecting civilians in accordance with relevant provisions of international human rights law and
international humanitarian law;
7. Calls on the Somali authorities, with the coordinated support of the international community, to assume
progressively greater responsibility for national security, and to develop and implement a strategic plan to generate
new security forces, integrate existing forces where appropriate, and train and equip current and
newly generated forces, with clear targets and timelines and, in this regard, welcomes the FGS’ intention to generate a
further
(a) 3850 security forces by December 2022;
(b) 8525 security forces by September 2023;
(c) 10450 security forces by June 2024;
8. Calls on the FGS to work with the FMS on the process for force generation and integration of regional forces,
noting the need for enhanced capacity and capabilities, within timelines that are compatible with the Joint Proposal
and CONOPs;
9. Calls on the Somali authorities to enhance civilian oversight and accountability of their security apparatus and to
continue to adopt and implement appropriate vetting procedures of all defence and security personnel, including
human rights vetting;
10. Reaffirms the essential role of the police and justice sector in stabilization efforts and the preparation and conduct
of elections, calls on Somalia to fully support the state and federal police through effective training, provision of
equipment, and sustainment support, reiterates the critical role police play in securing and holding territory and
emphasises that a professional and capable police force, able to contribute to providing security for civilian
populations, is necessary for Somalia to fully implement the STP and NSA, and encourages inclusive and

11. Calls on Somalia to ensure all security and police forces fully respect international human rights law and
international humanitarian law and to ensure that those responsible for violations and abuses of human rights and
violations of international humanitarian law are held accountable, further calls on the United Nations, African Union
and other international partners to support the Somali authorities with this as appropriate and requests that ATMIS
share the experience and lessons-learnt from the operation of the Civilian Casualty Tracking Analysis and Response
Cell (CCTARC) with national authorities, including with a view to supporting the development of Somali civilian
casualty monitoring, mitigation, and prevention policies and mechanisms;
12. Calls on the Somali authorities, in coordination with ATMIS, international partners, and relevant United Nations
entities, including UNMAS, to combat the illicit trade, transfer, diversion and accumulation of small arms and light
weapons, to prevent access of unauthorised recipients to all types of explosives and related materials in Somalia, and
to ensure their safe and effective management and storage;
13. Underlines the need for Somalia and its international partners to consider the security situation in each location
during transition of security responsibilities from ATMIS to Somalia, and emphasises that planning, and decision-
making should be guided by a comprehensive assessment of the threat to civilians, and that proactive measures to
mitigate risks should be taken, including by establishing an appropriately sized, qualified and accountable Somali
security and police force presence to ensure continued security and protection before, during and after military action;
14. Recalls resolutions 1612 (2005) and subsequent resolutions on Children and Armed Conflict and expresses its
grave concern over reports of killing, maiming, rape and other forms of sexual violence used against children in
armed conflict as well as unlawful recruitment and use, re-recruitment, including in non-combatant roles, and the
abduction of children, and calls on the Somali authorities to:
(a) strengthen the legal framework on child protection and underscores the need for capacity building on child
protection;
(b) take action to prevent all forms of violence against children and to hold those responsible to account;
(c) take appropriate measures to prevent attacks against civilian infrastructure including against schools and hospitals,
and to prevent their military use;
(d) cease detentions of all children on national security charges where this is in violation of applicable international
law and instead to treat children primarily as victims, consistent with Somalia’s obligations under the United Nations
Convention on the Rights of the Child; and
(e) take action to fully implement their 2012 Action Plans, the 2014 standard operating procedures for the handover of
children separated from armed groups, the 2018 Roadmap and the Working Group Conclusions on Children and
Armed Conflict in Somalia (S/AC.51/2020/6);
15. Calls on all parties to armed conflict in Somalia to end sexual and gender- based violence and further calls on
Somali authorities to work with relevant partners to:
(a) ensure protection for all from sexual and gender-based violence, and conflict-related sexual violence;
(b) ensure a survivor-centred and gender- and age-sensitive approach to preventing and responding to sexual and
gender-based violence;
(c) take appropriate steps to investigate alleged abuses and prosecute alleged perpetrators to stop impunity;
(d) strengthen legislation to support accountability in line with resolution 2467 (2019) and other relevant resolutions;
and
(e) accelerate the implementation of the Joint Communiqué and the National Action Plan on prevention of, and
response to sexual violence in conflict;
16. Strongly condemns attacks as well as threats of attacks that are in contravention of international humanitarian law
against schools and civilians connected with schools and urges all parties to armed conflict to immediately cease such
attacks and threats of attacks and to refrain from actions that impede access to education;
17. Recalls its resolution 2417 (2018) and expresses grave concern at the ongoing humanitarian crisis in Somalia and
its impact on the people of Somalia, encourages all partners including donors to maintain humanitarian assistance in
2022, strongly condemns any indiscriminate or direct attacks against humanitarian and medical personnel and civilian
infrastructure, including by Al-Shabaab, as well as any misuse or obstruction of humanitarian assistance, reiterates its44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
demand that all parties allow, in accordance with relevant provisions of international law and in line with
humanitarian principles, full, safe, rapid and unhindered access for the timely delivery of humanitarian assistance to
persons in need across Somalia, and underlines the importance of proper accounting of international humanitarian
support;
Al-Shabaab and affiliates linked to ISIL
18. Condemns in the strongest terms the attacks by Al-Shabaab targeting security forces, and its terrorist attacks
against government officials, civilians, and civilian infrastructure in Somalia and the wider region, as well as incidents
of hostage-taking and kidnapping of civilians, its recruitment, training and use of foreign terrorist fighters, and notes
with concern that these activities constitute a threat to peace and security in Somalia, regional stability, integration and
development, and exacerbate humanitarian suffering;
19. Reiterates that the FGS has the primary responsibility for ensuring security in Somalia, and calls on Somalia to
prioritise, coordinate and strengthen efforts to counter Al-Shabaab and affiliates linked to ISIL in a comprehensive
manner, including through but not limited to the use of military operations to deg rade their capabilities and disrupt
their ability to access financial resources, weapons and ammunition, in full compliance with its obligations under
international law, including international humanitarian law and international human rights law as applicable;
20. Reaffirms that all States shall prevent and suppress terrorist acts, urges all States to take action against Al-Shabaab
and affiliates linked to ISIL in Somalia, in accordance with conventions dealing with terrorism, as well as applicable
United Nations Security Council resolutions, including resolution 1373 (2001) and further reaffirms that Member
States must ensure that any measures taken to counterterrorism comply with the Charter of the United Nations and all
other obligations under international law, including international humanitarian law, international human rights law,
and international refugee law;
21. Requests Somalia to strengthen cooperation and coordination with other Member States, particularly other
Member States in the region, to prevent and counter the financing of terrorism, including compliance with resolution
1373 (2001), resolution 2178 (2014), resolution 2462 (2019), and urges Somalia, with the support of the African
Union, the United Nations and other Member States to work closer together to increase the delivery of non-military
activities to degrade Al-Shabaab and affiliates linked to ISIL, to prevent them conducting activities that harm the
sovereignty, territorial integrity, political independence and unity of Somalia, to counter their terrorist activities, illicit
finance, organised crime, access to, and trafficking in, arms and ammunition, including small arms and light weapons,
IED manufacture, justice and propaganda activities, and to work, together with the international community, to
implement the measures set out in 2607 (2021), including those measures imposed against individuals and groups
designated by the Security Council Committee pursuant to resolution 751 (1992);
ATMIS
22. Endorses the African Union Peace and Security Council’s decision to reconfigure AMISOM into the African
Union Transition Mission in Somalia (ATMIS), and authorises, for an initial period of 12 months, the Member States
of the African Union to take all necessary measures, in full compliance with participating States’ obligations under
international law, including international humanitarian law and international human rights law, and in full respect of
the sovereignty, territorial integrity, political independence and unity of Somalia, to:
(a) carry out its mandate to reduce the threat posed by Al-Shabaab;
(b) support the capacity building of the integrated Somali security and police forces;
(c) conduct a phased handover of security responsibilities to Somalia; and
(d) to support peace and reconciliation efforts in Somalia, in line with the STP and NSA, in support of the
development of a stable, federal, sovereign and united Somalia;
23. Decides to authorise ATMIS to pursue the following strategic objectives as outlined in the Joint Proposal:
(a) conducting jointly planned and targeted operations with Somali security forces to degrade Al-Shabaab and
affiliates linked to ISIL;
(b) support Somali security forces by jointly holding priority population centres and providing protection for the local
communities, United Nations personnel and installations, securing main supply routes identified by the FGS, and
coordinating with stabilisation and reconciliation actors in collaboration with Somali security forces, to support the

(c) assisting the FGS in the implementation of stabilisation efforts for all recovered areas in coordination with
Community Recovery and Extension of State Authority and Accountability (CRESTA/A) and other stabilisation
actors;
(d) supporting the capacity development of the Somali security forces with priority given to force generation,
operational competencies and logistical support capabilities to facilitate progressive takeover of security
responsibilities in Somalia;
(e) supporting Somali security forces across the clear, hold and build phases, in line with the STP, and in collaboration
with federal government institutions by facilitating humanitarian liaison, community engagement as well as assisting
Somali security forces with complying with international humanitarian law and international human rights law and
holding accountable those responsible for violations thereof;
24. Decides to authorise ATMIS’ military, police and civilian components to conduct the tasks outlined in paragraphs
33 to 39 of the Joint Proposal, and recalls the CONOPs provides the following tasks:
(a) conduct joint simultaneous targeted offensive operations across all sectors, in coordination with Somali security
forces to degrade Al -Shabaab and affiliates linked to ISIL;
(b) support Somali security forces in providing security for the political process at all levels, including stabilisation
efforts, reconciliation and peacebuilding;
(c) configure ATMIS in terms of composition, structure, disposition and equipment, to best support the handover of
security responsibility to Somali security forces;
(d) support Somali security forces in clearing main supply routes, including to areas recovered from Al-Shabaab;
provide combat mentorship to the Somali National Army; enhance Somali National Army capacity to conduct civil-
military coordination activities;
(e) jointly with partners, enhance Somali National Army capacity to conduct counter improvised explosive devices
operations;
(f) ensure compliance with the rules of engagement, international humanitarian law, international human rights law
and all international best practices;
(g) support specialized training, advising and mentoring and provide operational support, including joint patrols and
protection of vital installations, to the Somali police in line with the Somali Transition Plan;
(h) support the service delivery capacity of the Somali police in the provision of policing services, across Somalia
through police generation and deployments;
(i) support police-public partnerships for increased resilience to radicalisation to violence, violent extremism
conducive to terrorism and social disorder through community policing and to support the efforts of the Somali police
forces in the compliance of international humanitarian law, international human rights law, women peace and security
resolutions and conduct and discipline standards;
(j) across the clear-hold-build phases of ATMIS operations, undertake activities to support the ATMIS uniformed
components, as well as Somali security forces operating jointly with ATMIS, to carry out their operations in full
compliance with obligations under international humanitarian law, international human rights law, and in compliance
with the Human Rights Due Diligence Policy on United Nations support to Non-United Nations security forces
(HRDDP), as well as in compliance with the African Union Compliance and Accountability Framework for Peace
Support Operations;
(k) support early recovery initiatives in newly recovered areas, and humanitarian liaison;
(l) support the implementation of the Somali National Stabilisation Strategy;
(m) support relevant Somali ministries and institutions to implement the Somali Transition Plan priorities and provide
necessary support in realising the objectives of ATMIS;
25. Affirms that where resolution 2607 (2021) refers to “AMISOM”, it shall be read as referring to ATMIS;
26. Authorises the Member States of the African Union to deploy up to 19,626 uniformed personnel, inclusive of a
minimum of 1040 police personnel including five Formed Police Units, until 31 December 2022 and endorses the
African Union Peace and Security Council’s decision to drawdown 2000 personnel by this date;
27. Authorises the Member States of the African Union, between 1 January 2023 and 31 March 2023, to deploy up to
17,626 uniformed personnel, inclusive of a minimum of 1040 police personnel including five Formed Police Units;46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
28. Notes the Joint Proposal and CONOPs envisage further reductions to 14,626 uniformed personnel, inclusive of a
minimum number of 1040 police by the end of phase 2 (September 2023), 10,626 uniformed personnel, inclusive of a
minimum number of 1040 police personnel by the end of phase 3 (June 2024), and zero personnel, by the end of phase
4 (December 2024), and expresses its intention to authorise, taking into account the situation in Somalia and the
regular, joint technical assessments outlined in paragraph 51 to this resolution, these reductions;
29. Requests the African Union to ensure structures are in place to provide:
(a) clear oversight of ATMIS, and accountability mechanisms for the mission and its contingents;
(b) clear command and control of the mission and operational coordination between its contingents;
(c) coordinated operational decision making under the Force Commander and Sector Commanders;
(d) command, control and accountability of mission enabling units, including air assets;
(e) the creation, and deployment of mobile forces in ATMIS sectors; and
(f) that ATMIS instructions are to remain politically neutral and prioritise the protection of civilians;
30. Urges the African Union, with United Nations support, taking into consideration Statement of Unit Requirements
(SURs), and within existing resources, to continuously review ATMIS’ operational capabilities to:
(a) enhance force protection to carry out mandated tasks; and
(b) identify gaps in resource requirements, and produce specific requests for resources and
equipment to be fulfilled through voluntary contributions;
31. Underlines the importance of ATMIS forces continuing to cooperate with UNSOM and UNSOS in implementing
the HRDDP across the preparatory, conduct and review phases of operations, including in the context of joint or
coordinated operations with Somali security and police forces, and recognises the role that the African Union
Compliance Framework and its operationalisation in ATMIS can play in enhancing compliance with international
human rights law and international humanitarian law;
32. Calls on ATMIS to undertake, and on the African Union to ensure, regular monitoring and prompt and thorough
investigations into and reporting on allegations of human rights violations and abuses and violations of international
humanitarian law by ATMIS forces, as well as ensuring the highest standards of transparency, and conduct and
discipline, and, where appropriate, harmonisation of their procedures with UNSOM, and urges troop- and police-
contributing countries to strengthen their cooperation with the African Union and the United Nations to ensure the
effectiveness of the ATMIS compliance and accountability measures;
33. Requests ATMIS to work closely with the CCTARC across all sectors, and underlines the importance of ensuring
information is shared with relevant actors including the United Nations, is integrated into ATMIS reporting, and feeds
into operational guidelines and plans, and requests the full support of troop and police contributors to the CCTARC,
in collaboration with humanitarian, human rights and protection actors;
34. Requests ATMIS to support the implementation of the Joint Communique and National Action Plan to prevent and
respond to sexual violence in conflict, and to take into account these specific concerns throughout the activities of all
ATMIS components, and to ensure that risks of sexual violence in conflict are included in data collection, threat
analysis and early warning systems, reaffirms the importance of a zero-tolerance policy on Sexual Exploitation and
Abuse, stresses the need to prevent such exploitation and abuse, requests the African Union and troop- and police-
contributing countries to screen personnel, undertake risk assessments, deliver all relevant training to personnel, to
protect and support the relief and recovery of survivors who report abuse, carry out timely investigations into
allegations, to hold perpetrators accountable, and to repatriate units where there is credible evidence of widespread or
systemic sexual exploitation or abuse by members of those units, and further requests the African Union to work
closely with the United Nations in this regard;
35. Encourages efforts to ensure female uniformed personnel are deployed to ATMIS by the troop- and police-
contributing countries, and urges ATMIS to ensure the full, effective and meaningful participation of women across
its operations and to integrate a gender perspective throughout the delivery of its mandate;
36. Notes Somalia’s request to the African Union on the recruitment of Somali nationals to ATMIS civilian staff

UN Support Office in Somalia (UNSOS)
37. Requests the Secretary-General to continue to provide a logistical support package, and, in consultation with the
African Union and FGS, develop an appropriate logistical support plan, in full compliance with HRDDP, through
UNSOS for UNSOM, ATMIS uniformed personnel in line with paragraphs 26 and 27 to this resolution, and on the
basis set out in paragraph 2 of resolution 2245 (2015), 70 ATMIS civilians, increasing to 85 ATMIS civilians from 1
January 2023, to support ATMIS’ military and police tasks and enhance coordination between the United Nations,
African Union and FGS, and, through the United Nations Trust Fund in Somalia, support up to 13,900 Somali security
forces, including an appropriate share of the state and federal police who are formally integrated into the Somali
security forces in line with the National Security Architecture and who are actively participating in joint or
coordinated operations with ATMIS that directly implement the STP;
38. Expresses its intention to consider increasing the number of Somali security forces eligible for support through
UNSOS as set out in paragraph 37, subject to progress in force integration and generation as set out in paragraphs 7
and 8 and drawdown of ATMIS uniformed personnel as set out in paragraphs 26 and 27 of this resolution;
39. Underscores the importance of ATMIS and the Somali security forces working jointly with UNSOS on the
delivery of logistics support, including, among other things, integrating UNSOS into planning for military operations,
ensuring convoy and airfield security, protection of civilians and protecting main supply routes;
40. Underscores that the sustainability of peace and security support is improved by the implementation of the United
Nations Department of Operational Support’s Environment Strategy (Phase II), which emphasises good stewardship
of resources and a positive legacy of the mission, and identifies the goal of expanded renewable energy use in
missions to enhance safety and security, save costs, offer efficiencies and benefit the mission, mindful of the Secretary
-General’s call for field operations to shift to renewable energy by 2030 to meet UNSCAP goals;
41. Requests the Secretary-General to continue United Nations support to Somali security forces with training,
equipment and mentorship to counter the threat of improvised explosive devices (IEDs);
42. Underscores that oversight and accountability, in particular compliance with HRDDP, should be the cornerstone
of the partnership between the United Nations, the African Union, and Somalia, requests the Secretary-General to
ensure that any support provided to non-United Nations security forces is provided in strict compliance with the
HRDDP, and requests Somalia and African Union to agree an updated memorandum of understanding with the United
Nations on the conditions of provision of United Nations support to Somalia;
43. Requests the Secretary-General to work closely with the African Union in supporting the implementation of this
resolution, including to provide technical and expert advice on the planning, deployment and strategic management of
ATMIS in line with the mandate of the United Nations office to the African Union;
International Support
44. Welcomes the continued financial support provided to the African Union mission in Somalia, especially from the
European Union over the past 15 years, stresses the importance of including financial partners in ATMIS’s strategic
decision - making process and stresses the importance of stringent monitoring of and accountability for financial and
materiel support;
45. Urges Member States, including new donors, to consider providing predictable, sustainable and multi-year support
for ATMIS, including through the provision of additional funding to the African Union for ATMIS’ civilian
component to enable its support for the implementation of the STP, NSA and broader stabilization efforts, as well as
for troop and police stipends, equipment and technical assistance and to support the effective functioning of the
CCTARC and disbursement of amends;
46. Urges Member States to consider providing funding to the United Nations Trust Fund in Somalia, including
funding for training, equipment and mentoring of the Somali security and police forces, including to counter the threat
of IEDs, and to top the illicit proliferation of small arms and light weapons, and support for the African Union in
mobilising the required resources and equipment for ATMIS, including through financial contributions to address
identified gaps in resource requirements, and specific requests for resources and equipment;48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
47. Urges Member States to consider providing bilateral funding to support national and state-level institutions
develop an integrated Somali security sector, including capacity building for the maritime police force in line with
resolution 2246 (2015);
48. Underlines the need for Somalia and its partners to take a coordinated approach towards supporting Somali-led
political and security reforms, to ensure consistency, maximise impact and enable sustained, progressive transition of
security responsibility to Somalia and therefore:
(a) Urges the FGS to lead strategic coordination through regular high-level meetings of the Somali Transition Plan
Strategic Steering Committee, the Security and Justice Committee and the Somalia Development and Reconstruction
Facility Committee;
(b) Urges the FGS to agree all joint or coordinated operations, and strategic and operational decisions, including
Somali security force generation with FMS, in coordination with ATMIS and the United Nations and other
international partners where relevant;
(c) Requests the United Nations, in coordination with the FGS, African Union and European Union, to establish a
technical partnership coordination function to increase coordination and collaboration between the FGS, FMS,
ATMIS, UNSOM, UNSOS, the United Nations Country Team and Somalia’s other multilateral, regional and bilateral
partners including by:
(i) sharing information, including the creation of a sector-by-sector dashboard of Key Performance Indicators;
(ii) conducting analysis, planning and performance assessment;
(iii) coordinating bilateral provision of capacity building support, training, mentoring and donations of equipment and
supplies to Somali security and police forces;
(iv) ensuring that such support and assistance is provided in line with relevant provisions of resolution 2607 (2021);
and
(v) ensuring that such support and assistance is compliant with the HRDDP;
49. Underlines the need to enhance the predictability, sustainability and flexibility of financing for African Union-led
peace support operations authorised by the Security Council and under the Security Council’s authority consistent
with Chapter VIII of the Charter, and encourages the Secretary-General, African Union and Member States to
continue efforts to explore in earnest funding arrangements for ATMIS, bearing in mind the full range of options
available to the United Nations, African Union, the European Union, and to other partners, and considering the
limitations of voluntary funding, in order to establish secure future funding arrangements for ATMIS;
Evaluation and Reporting
50. Requests the United Nations, jointly with the African Union, FGS, European Union and other donors, to identify
through an inclusive, consultative process: relevant, clear and realistic benchmarks, which include roles and
responsibilities and measurable indicators for security transition, and that take into account the needs of all segments
of the population, in order to assess the implementation of security transition, including benchmarks for the
effectiveness of ATMIS, proposed by the African Union and benchmarks for the implementation of the STP and NSA
proposed by the FGS, by 30 September 2022, taking into account resolution 2594 (2021);
51. Requests the United Nations, jointly with the African Union FGS, European Union and other donors, to undertake
regular, joint technical assessments of progress made, and against the benchmarks requested in paragraph 50 to this
resolution, to guide the Security Council as it further decides on the next steps of the phased drawdown of ATMIS and
support provided by UNSOS, and to report to the Security Council by 15 February 2023;
52. Requests the FGS to provide an update to the Security Council, by 10 July 2022, 10 October 2022, and 10 January
2023 on:
(a) progress in implementing the STP and NSA and force generation and integration, as set out in paragraphs 7 and 8
of this resolution;
(b) progress in implementing the roadmap agreed on 27 May 2021;
53. Requests the African Union to keep the Security Council informed, through the Secretary-General, on the
implementation of ATMIS’ mandate, by 10 July 2022, 10 October 2022 and 10 January 2023 and further requests in
this regard, these reports contain specific reporting on:
(a) progress on joint operations in support of the STP and NSA including the use and effectiveness of coordination

(b) evaluation of ATMIS’ command and control mechanisms;
(c) progress against strategic objectives outlined in paragraph 23;
(d) quantitative and qualitative assessment of progress against tasks outlined in the Joint Proposal and CONOPs;
(e) accountability measures taken to address previously identified underperformance, including command and control,
and conduct and discipline;
(f) the effectiveness of measures taken to protect civilians;
(g) equipment review outcomes and use of force assets;
54. Requests the Secretary-General to keep the Security Council regularly informed on the implementation of this
resolution, in their regular reports requested in paragraph 17 of resolution 2592 (2021) and recalls its request for the
Secretary- General to submit to the Security Council a strategic review of UNSOM, as outlined in paragraph 18 of
resolution 2592 (2021) and expresses its intention to provide a new date for its completion following the conclusion of
the current electoral process in Somalia;
55. Decides to remain actively seized of the matter.”
