## Report on the Implementation of the United Nations Security Council Resolutions on Iraq Second Amendment Order, 2022 **1. Executive Summary:** This report analyzes the “Implementation of the United Nations Security Council Resolutions on Iraq Second Amendment Order, 2022” based solely on the official gazette notification. This amendment modifies the original 2016 Order concerning the implementation of UN Security Council resolutions on Iraq. The core purpose of the amendment is to remove specific individuals listed under Annexure 2, heading A. Individuals, from the sanctions list associated with the original order. This change signals a potential shift in the assessment of these individuals' involvement with activities related to the UN Security Council Resolutions on Iraq. **2. Introduction:** The purpose of this report is to provide an informative analysis of the “Implementation of the United Nations Security Council Resolutions on Iraq Second Amendment Order, 2022,” as published in the Gazette of India. This analysis is based exclusively on the information contained within the provided policy text. **3. Policy Overview:** * **Amendment to:** The Implementation of the United Nations Security Council Resolutions on Iraq Order, 2016. * **Core Objective(s):** The amendment aims to modify the existing list of individuals subject to sanctions under the 2016 Order, presumably to align with evolving assessments and determinations made concerning individuals linked to Iraq-related resolutions. **4. Background and Rationale:** This amendment suggests a reevaluation or reassessment of certain individuals previously identified as warranting sanctions under the 2016 Order. The removal of specific individuals from Annexure 2, A. Individuals implies that these individuals no longer meet the criteria for inclusion on the sanctions list or that their designation is no longer deemed necessary. Without additional context, the reasons for this change cannot be stated definitively, but it is reasonable to infer that new information or a change in circumstances has led to this revision. **5. Key Provisions / Changes:** This amendment focuses on a specific change to the original 2016 Order. * **Specific Part Changed:** The amendment alters "Schedule, in Annexure 2, under the heading A. Individuals" of the 2016 Order. * **New Rule/Provision:** The individuals with entries IQi.042, IQi.008, IQi.041, IQi.053, IQi.018, IQi.040, and IQi.010 are removed from the list of sanctioned individuals. * **Effect of Change:** The individuals removed are no longer subject to the sanctions and restrictions imposed by the original 2016 Order as it relates to the United Nations Security Council Resolutions on Iraq. This could involve the lifting of asset freezes, travel bans, or other restrictions previously in place. **6. Target Audience and Stakeholders:** The immediate target audience is the individuals and entities previously affected by the sanctions outlined in the 2016 Order and who are now removed from the list. Stakeholders include: * Financial institutions that were required to freeze assets. * Immigration authorities responsible for enforcing travel bans. * Any individuals or organizations that were prohibited from engaging in transactions with the listed individuals. * The listed individuals themselves, as they are now removed from the sanctions regime. * The Ministry of External Affairs as the implementing agency. **7. Implementation Aspects (Inferred):** * **Responsible agency/bodies:** The Ministry of External Affairs is responsible for implementing the amendment. The "F. No. U.II152322015 PRAKASH GUPTA, Jt. Secy." indicates the responsible department. * **Timelines or procedures:** The amendment came into force on April 12, 2022, the date of its publication in the Official Gazette. * Financial institutions and relevant government agencies are expected to update their records and procedures to reflect the removal of these individuals from the sanctions list. **8. Expected Outcomes / Impact of Changes:** The intended outcome of these specific changes is the removal of restrictions and sanctions previously imposed on the listed individuals. The potential impact of the amendment includes: * Unfreezing of assets held by the previously sanctioned individuals. * Lifting of travel bans preventing the previously sanctioned individuals from entering certain countries. * Removal of restrictions on financial transactions involving the previously sanctioned individuals. * Potentially, improved relations between these individuals and entities in India. **9. Conclusion:** The “Implementation of the United Nations Security Council Resolutions on Iraq Second Amendment Order, 2022” modifies the 2016 Order by removing specific individuals from the sanctions list related to UN Security Council Resolutions on Iraq. This action likely reflects a reassessment of these individuals' status and involvement. The amendment impacts financial institutions, immigration authorities, and any parties previously restricted from dealing with these individuals. This adjustment aligns India's implementation of UN Security Council Resolutions on Iraq with current assessments and determinations, as of April 12, 2022.
