## Report on the Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Third Amendment Order, 2022 **1. Executive Summary:** This report analyzes the "Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Third Amendment Order, 2022" based on the official gazette notification. This amendment order modifies the 2007 Order by omitting specific individuals, entities, and other groups from Annexure 1, under the Schedule, relating to the ISIL (Da'esh) and Al-Qaida sanctions list. This change aligns domestic policy with updated resolutions from the United Nations Security Council (UNSC) concerning counter-terrorism sanctions. The key finding is that the amendment reflects an ongoing process of refining the list of sanctioned entities to reflect evolving global security concerns as determined by the UNSC. **2. Introduction:** This report aims to provide an informative overview of the "Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Third Amendment Order, 2022," based solely on the text provided in the official gazette notification. The analysis focuses on the amendment's purpose, key changes, and implications, as inferred from the text. **3. Policy Overview:** * **Original Policy Being Amended:** Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Order, 2007. * **Core Objective(s):** The core objective of the original order, as inferred from the amendment's context, is to implement UNSC resolutions related to the prevention and suppression of terrorism, specifically by imposing sanctions (assets freeze, travel ban, and arms embargo) on listed individuals, groups, undertakings, and entities associated with ISIL (Da'esh) and Al-Qaida. **4. Background and Rationale:** This amendment is likely prompted by updated resolutions passed by the UNSC concerning ISIL (Da'esh), Al-Qaida, and associated entities. The text explicitly mentions that the Security Council enacted amendments on its ISIL Daesh and AlQaida Sanctions List of individuals and entities. The rationale for this amendment is to align domestic regulations with these updated international mandates, ensuring that the individuals and entities subject to sanctions reflect the current assessment of terrorist threats by the UNSC. **5. Key Provisions / Changes:** This amendment focuses specifically on removing certain entries from the existing sanctions list. * **Specific Part of the Original Policy Changed:** The Schedule, Annexure 1, under headings "A. Individuals" and "B. Entities and other groups" of the Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Order, 2007. * **New Rule/Provision:** The new rule is the *omission* of the following entries: * Under A. Individuals, paragraph QDi.099 and the entries relating thereto. * Under B. Entities and other groups, paragraphs QDe.071, QDe.072 and QDe.103 and the entries relating thereto. * **Difference/Effect of Change:** The effect of this change is to remove the specified individuals and entities from the list of those subject to sanctions under the Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Order, 2007. This implies that these individuals and entities are no longer considered subject to the asset freeze, travel ban, and arms embargo, *within the jurisdiction of this order*. **6. Target Audience and Stakeholders:** Based on the text, the primary stakeholders affected by this amendment are: * **The individuals and entities being removed from the sanctions list:** The amendment directly affects these parties as they are no longer subject to the sanctions imposed by the original order. * **Financial institutions, businesses, and other entities operating within India:** These organizations are affected as they are no longer required to enforce sanctions against the removed individuals and entities. * **Government agencies responsible for implementing and enforcing sanctions:** These agencies must update their records and procedures to reflect the changes introduced by the amendment. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of External Affairs is the responsible agency, as indicated by the "ORDER" being issued under their authority. * **Timelines/Procedures:** The amendment comes into force on the date of its publication in the Official Gazette, which is March 17, 2022. The specific procedures for updating sanction lists would be managed by the relevant government agencies. **8. Expected Outcomes / Impact of Changes:** The intended outcome of these changes is to align India's counter-terrorism sanctions regime with the latest determinations made by the UNSC. The specific impact of removing these individuals and entities from the sanctions list is that their assets are no longer frozen, they are no longer subject to travel bans, and arms embargoes previously in place are lifted within the jurisdiction of the order. This could potentially allow for financial transactions and other interactions that were previously prohibited. **9. Conclusion:** The "Prevention and Suppression of Terrorism Implementation of Security Council Resolutions Third Amendment Order, 2022" reflects an ongoing effort to maintain alignment with the UNSC's evolving assessment of terrorist threats. By removing specific individuals and entities from the sanctions list, the amendment updates domestic regulations to reflect the current international consensus. This amendment is significant because it demonstrates India's commitment to adhering to international counter-terrorism norms and adapting its policies based on the evolving global security landscape.
