* Each Police Station must establish an Electronic Summons Delivery Centre for serving summons via electronic communication.
* Summons can be served through email, WhatsApp, or other instant messaging services as specified by the Court.
* If electronic contact details are unavailable, the Court may order service by a police officer, investigation agency officer, or government official.
Delivery and Execution:

Delhi BNSS (Service of Summons and Warrants) Rules, 2025
F. No. /11/08/2024/HP-II/Part File/2696-2705.— In exercise of the powers conferred under sub-sections (1)
and (2) of section 64(1) and under clause (i) of section 530 and other enabling provisions of the Bharatiya Nagarik
Suraksha Sanhita, 2023, read with Notification bearing S.O. No. 2506(E), dated 28.06.2024 of the Ministry of Home
Affairs, Government of India, New Delhi, the Lieutenant Governor of the NCT of Delhi hereby makes the following
Rules, namely:-
1. Short title and commencement-
(i) These rules may be called the 'Delhi BNSS (Service of Summons and Warrants) Rules, 2025'.
(ii) They shall extend to the District Courts in the whole of the National Capital Territory of Delhi.
(iii) They shall come into force on the date of their publication in the Delhi Gazette.
2. Definitions-
(1) In these rules, unless the context otherwise requires-
(a) "CCTNS" means Crime and Criminal Tracking Network and Systems, a system software used by the Police
for the collection of data and execution of instructions;
(b) "CIS" means Case Information System, a system software used by the District Judiciary in Delhi for the
collection of data and execution of instructions;
(c) "Disclosed Electronic Mail Address" means the email account of a person or organization that is used by the
person or organization to send and receive messages over internet, and is shown to be admitted, or provided
by such person or organization either personally or on a website or portal;
(d) "Electronic Communication" means electronic communication as defined in Section 2(1)(i) of the Sanhita;
(e) "eSign" means authentication of any electronic record by a subscriber or court, by means of the electronic
technique specified in the Second Schedule of the Information Technology Act, 2000 (21 of 2000) and
includes digital signature. Also, when a process or report generated in electronic form is authenticated by
means of electronic signature, it shall be deemed to be authenticated by signature of the person who affixed
the electronic signature;
(f) "High Court" means the High Court of Delhi;
(g) "Process" means summons and warrants;
(h) Sanhita" means the Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023);
(i) "Seal" means image of the seal of the Court;
(j) "Summons" means any summons issued under the Sanhita;
(k) "Warrant" means a warrant issued under the Sanhita and includes bailable warrant and non-bailable warrant.
(2) Words and expressions used but not defined in these rules shall have the same meaning as assigned to them in the
Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023); the Bharatiya Nyaya Sanhita, 2023 (45 of 2023); the
Bharatiya Sakshya Adhiniyam, 2023 (47 of 2023) and the Information Technology Act, 2000 (21 of 2000).
3. Generation of process-
(1) The Courts shall generate and issue process in electronic mode through CIS in such forms as set forth in the
Second Schedule of the Sanhita, with such variations as the circumstances of each case may require.
(2) Every process issued in form of electronic communication under the Sanhita must ordinarily be written in the
language of the court and shall be in an encrypted form of electronic communication.
(3) The process generated in electronic form shall bear the image of the seal of the Court and eSign of the Presiding
Officer of the Court or any other officer authorised in writing by him in this regard. Every warrant of arrest in
electronic form shall be issued by eSign of the Presiding Officer of the Court and shall also bear the image of the seal

(4) Every process issued electronically shall contain eSign in such a manner that the name of the Court and the
capacity in which the signatory or subscriber acts, should be clearly mentioned.
(5) The summons required to be served through electronic communication, wherever required, may be accompanied
by soft copies or scanned copies of the complaint, charge-sheet, documents, etc.
4. Register of details:
(1) The Officer In-charge of every Police Station shall cause to be maintained a register, in electronic form or
otherwise, for entering the requisite particulars in respect of every person qua whom summons and warrants under
Sanhita may be required to be issued, in the form specified in Schedule-I appended to these Rules.
(2) Where during the course of any inquiry, investigation or trial it appears to a police officer or to a Court that there
may arise a situation where any person may have to be served with summons or warrants under the Bharatiya Nagarik
Suraksha Sanhita, 2023 at that stage or at a later stage, whether as an accused or witness or otherwise, such police
officer or Court may ask such person to furnish a declaration addressed to the Officer In-charge of the concerned
Police Station stating the requisite particulars specified in Schedule I with respect to such person along with an
undertaking that such person shall immediately inform the Officer In-charge of the concerned Police Station in case of
change in any of the particulars specified in Schedule-I.
(3) If any of such details are not available, the Officer In-charge of the Police Station shall make an endorsement to
that effect in the Register:
Provided that any such details may be amended on the basis of further verification or on the basis of an application by
such person.
(4) The Officer In-charge of every Police Station shall cause a copy, in electronic form, of such Register, to be
communicated to the concerned Judicial Magistrate or Special Court, as the case may be on a monthly basis through
the official email of the concerned Court and the said information shall be maintained in CIS and may be used for
issuance of process.
(5) The officer In-charge of the Police Station shall also ensure that the verified details as specified in Schedule I are
entered in CCTNS.
5. Details in a complaint case-
Where a case is filed on the basis of a private complaint, the complainant shall provide the details relating to address,
disclosed electronic mail address, phone number and messaging application of the accused and witnesses along with
the complaint. If any of such information is not available, the complaint shall make an endorsement to that effect. The
said details shall also be transmitted in electronic form and maintained in CIS and may be used for issuance of
process.
6. Non-disclosure of details of victim and witnesses-
(1) The details relating to disclosed electronic mail address, phone number and messaging application of the victim
and witnesses shall not be disclosed to the accused.
(2) Where any process is issued in cases relating to offences under sections 64 to 71 of The Bharatiya Nyaya Sanhita
(45 of 2023) or offences against women or children or offences under The Protection of Children from Sexual
Offences Act, 2012 and Juvenile Justice (Care and Protection of Children) Act, 2015, the concerned officer shall
ensure that the identity of the victim is not revealed in any manner during the course of service or execution.
7. Electronic summons Delivery Centre-
(1) The Government of NCT of Delhi and the Delhi Police shall establish an Electronic Summons Delivery Centre in
each Police Station along with requisite infrastructure, for service of summons through electronic communication
under the Sanhita.
(2) Every other investigation agency shall also establish such Electronic Summons Delivery Centre in its office for
service of summons through electronic communication under the Sanhita.
8. Service of Summons through Electronic Communication:
(1) The summons shall be served upon any person through electronic communication by an officer of the court issuing
it.
Explanation: Wherever service is directed to be effected through electronic communication the summons may be
served through e-mail, WhatsApp or any other instant messaging service as the Court may specify by order, enabling
delivery of the summons in digital form on the email ID or WhatsApp number or other instant messaging service ID
of the recipient, as are available in the Register maintained in accordance with Rule 4.[PART IV DELHI GAZETTE : EXTRAORDINARY 9
9. Service of Summons where requisite details are not available:
(1) Where the Court does not possess the required electronic address/ contact details of the person to whom such
summons are intended to be served or where the process issued as per Rule 9 is not served, the Court may order that
the summons be served by a police officer or by an official officer of any other investigation agency or by an official
of the Revenue department or any other department of the Government of NCT of Delhi as the Court may specify in
its order.
(2) Where the summons are required to be served under sub-rule(1), the same shall be transmitted for service to the
Electronic Summons Delivery Centre of the concerned Police Station or the office of the concerned investigation
agency for service.
(3) The Officer In-charge of the Police Station or any other officer deputed by him, upon receipt of such summons
may forward the summons on the disclosed electronic mail address, mobile phone number or messaging application of
the person summoned.
(4) In case the verified details of the email address, mobile phone number or messaging application relating to the
person summoned are not available, the Officer In-charge of the Police Station or any other officer deputed by him
shall make an entry in that regard and after taking printout in duplicate of the summons issued in electronic mode,
shall execute the same in accordance with procedure prescribed under the Sanhita and the Rules made thereunder.
(5) Where the summons generated in electronic form are received on CCTNS through a secured system, in an
encrypted or any other form of electronic communication, it shall be presumed to be issued by the Court. Further, any
printout of such process shall have the same effect as issued in original for the purpose of its execution.
10. Delivery of Summons-
(1) Where summons are served by way of electronic mail, service shall be deemed to have been made if the service
provider generates acknowledgement of the delivery.
(2) When any summons is sent to a person or organization on disclosed electronic mail address, unless the delivery of
the electronic mail is disrupted or bounced back for any reason whatsoever, the delivery may be deemed to have been
effected; and unless the contrary is proved, be deemed to have been effected at the time at which the electronic mail
would be delivered.
(3) Where summons are served by way of any other electronic communication including messaging application, the
acknowledgement shall form of the report of the service and the report shall contain details including mobile number,
messaging application and screenshot/ photo of the application reflecting delivery of communication.Explanation:
Acknowledgement includes an acknowledgement given by-
(a) any communication by the addressee, automated or otherwise; or
(b) any conduct of the addressee, sufficient to indicate to the originator that the electronic record has been received.
(4) The Court may, on being satisfied, regard being had to the mode of service adopted, the common course of human
conduct and public and private business, by order declare the summons to be duly served through electronic
communication.
(5) A copy of the summons/ process along with report of service shall be kept on record as a proof of service of
summons/process.
(6) Where the summons are not served by an electronic mail or other mode of electronic communication, or delivery
is disrupted and undelivered or bounced back for any other reason, the concerned officer shall prepare a report in that
regard containing all details including mobile number, messaging application and screenshot/ photo of the application
and submit the same to the Court.
11. Service of warrants or any process in person-
(1) Where any warrant is issued in electronic mode, the Officer In-charge of the Police Station or any police officer
deputed by him shall take a printout of the warrant and execute the same in accordance with the Sanhita and rules
made thereunder.
(2) Where any process is served or executed other than through electronic mode, the Police Officer while making
service or executing the process shall take acknowledgement of the recipient and may capture photograph, which shall
form part of the report of service.
(3) Upon due service or non-service of the warrant or other process, the serving officer of the concerned Police Station
shall transmit the report along with relevant documents including bail bonds, photographs, acknowledgement, if any,
to the concerned Court in electronic form through CCTNS, unless required to submit the same in physical form.10 DELHI GAZETTE : EXTRAORDINARY PART IV]
(4) The Court, upon receiving the report in electronic form under sub-rule (3), may act upon such report as deemed
appropriate.
(5) A printout of the report supported by a certification under sub-section (4) of Section 63 of the Bharatiya Sakshya
Adhiniyam, 2023 (47 of 2023) shall be deemed to be sufficient for the purpose of satisfaction as to service/ execution
of the process.
12. Saving of the powers of the Court:
Nothing in these rules shall be deemed to limit or otherwise affect the power of the Court relating to service of
summons or notices or other communications as given in the Sanhita or any other law for the time being in force.
13. Repeals and Savings:
(1) "Delhi BNSS (Service of Summons) Rules, 2025 hereby stand repealed.
(2) Notwithstanding such repeal any prior acts done or directions issued under the "Delhi BNSS (Service of
Summons) Rules, 2025" shall be deemed to have been done or issued under the present Rules.
(3) Any rule made shall be in addition to and not in derogation of, any other law or rule for the time being in force for
issuance, service and execution of process by Court.
