## Policy Analysis Report: Appointment of Special Public Prosecutor in Delhi
**1. Executive Summary:**
This report analyzes a notification issued by the Government of the National Capital Territory of Delhi (GNCTD) regarding the appointment of a Special Public Prosecutor. The notification concerns an amendment to legal representation in specific criminal cases. The core purpose is to replace the existing advocate, Mr. S. K. Saxena, with Mr. Ravinder Chadha as the Special Public Prosecutor for representing the state in FIR No. 2772001 and FIR No. 2722001 at the Court of competent jurisdiction, Delhi. This report details the background, rationale, and implications of this change, based solely on the provided notification text.
**2. Introduction:**
The purpose of this report is to provide a comprehensive analysis of the notification issued by the Government of the National Capital Territory of Delhi (GNCTD) on May 2nd, 2022, regarding the appointment of a Special Public Prosecutor. This analysis is based exclusively on the information contained within the provided policy text.
**3. Policy Overview:**
* This policy represents an amendment to the legal representation within ongoing criminal cases.
* **Core Objective:** The primary objective, as derived from the text, is to change the legal representative for the state in specific cases, by appointing Mr. Ravinder Chadha as the Special Public Prosecutor in place of Mr. S. K. Saxena.
**4. Background and Rationale:**
This is an amendment. The rationale for this specific amendment is not explicitly stated in the text. However, it can be inferred that the authorities deemed a change in legal representation necessary or beneficial for the state's case in the specified FIRs. The document doesn't explain why Mr. Saxena is being replaced.
**5. Key Provisions / Changes:**
This section focuses on the changes introduced by the amendment text.
* **Specific Part of Original Policy Changed:** The amendment concerns the appointment of a specific individual to the role of Special Public Prosecutor. The original policy being amended is inferred to be existing procedures and protocols for legal representation in criminal cases, likely including provisions for appointing public prosecutors.
* **New Rule/Provision:** The *new* provision is the appointment of Mr. Ravinder Chadha, Advocate, as Special Public Prosecutor to represent the state in FIR No. 2772001 Us 302120B34 IPC P. S. Shahdara and FIR No. 2722001 Us 275459 Arms Act, P. S. Bhajanpura, NorthEast District., Delhi on behalf of the State. Mr. Chadha will receive a nominal fee of Rs. 1 per appearance.
* **Difference/Effect of Change:** The effect of this change is to replace Mr. S. K. Saxena with Mr. Ravinder Chadha as the legal representative for the state in the specified cases. This indicates a change in the legal strategy or preference of the prosecuting authority in those cases.
**6. Target Audience and Stakeholders:**
Based on the provided text, the directly affected stakeholders include:
* **Mr. Ravinder Chadha:** The newly appointed Special Public Prosecutor.
* **Mr. S. K. Saxena:** The replaced Special Public Prosecutor.
* **The Courts of competent jurisdiction in Delhi:** Where the specified cases are being heard.
* **Parties involved in FIR No. 2772001 and FIR No. 2722001:** Defendants, victims, and their families.
* **The Home Police II Department, GNCTD:** The department responsible for issuing the notification.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Home Police II Department of the GNCTD is responsible for the notification and presumably for overseeing the implementation of this change.
* **Timelines or Procedures:** No specific timelines are mentioned in the text beyond the date of the notification (May 2nd, 2022). It's implied that Mr. Chadha's appointment is effective immediately or soon after the notification date.
* The fee of Rs. 1 per appearance suggests a pre-existing agreement or established standard for such appointments, even if nominal.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this change is to improve the state's representation in the specified cases. The reasons for expecting improved representation are not explicit in the text, but it is reasonable to assume the authorities believe Mr. Chadha will be more effective in prosecuting these cases. The appointment might lead to a different legal strategy, potentially influencing the outcome of the cases.
**9. Conclusion:**
The notification signifies a change in legal representation for the state in FIR No. 2772001 and FIR No. 2722001 through the appointment of Mr. Ravinder Chadha as the Special Public Prosecutor, replacing Mr. S. K. Saxena. This amendment suggests a strategic decision by the GNCTD regarding the handling of these specific criminal cases. While the exact reasons for the change remain unstated within the document, the alteration holds significance for the affected parties and the legal proceedings involved.
