Executive Summary & Key Takeaways

## Report on Government of National Capital Territory of Delhi Notification Regarding Special Public Prosecutors **1. Executive Summary:** This report analyzes a notification issued by the Government of the National Capital Territory (NCT) of Delhi, dated July 26, 2021. This notification appoints three additional Law Officers (Senior advocates/advocates) as Special Public Prosecutors. These prosecutors will handle court proceedings, including bail, trials, appeals, and miscellaneous matters related to cases registered in connection with Anti-Citizenship Amendment Act (CAA) protests and law and order situations arising from these protests in Delhi, including riot cases in the North East District. This notification aims to strengthen the prosecution's handling of these specific cases. **2. Introduction:** The purpose of this report is to provide an informative analysis of a government notification regarding the appointment of Special Public Prosecutors in Delhi. The analysis is based solely on the information provided in the policy text. **3. Policy Overview:** This notification can be viewed as an amendment to previous actions, specifically: * Government of India, Ministry of Home Affairs Notification No. 11011274UTL i dated the 20th March, 1974 * The Code of Criminal Procedure, 1973 2 of 1974, section 24 subsection 8 * Notification No. F.8952020HPII2112 dated 24.06.2020, which had previously appointed 11 Special Public Prosecutors. The core objective is to appoint additional Special Public Prosecutors to manage legal proceedings related to specific cases: Anti-CAA protests, resulting law and order issues, and the Delhi riots in the North East District. **4. Background and Rationale:** This notification amends a previous one and adds additional prosecutors. The amendment likely addresses a need for increased prosecutorial capacity to handle the caseload associated with Anti-CAA protests, associated law and order issues, and specifically, the Delhi riots in the North East District. The previous 11 prosecutors are presumed to be insufficient to handle the caseload. **5. Key Provisions / Changes:** This notification introduces the following key changes: * **Appointment of Additional Prosecutors:** Three new Law Officers (Senior advocates/advocates), named Sh. Madhukar Pandey, Sh. Sanjeev Sahay, and Sh. Manu Sharma, are appointed as Special Public Prosecutors. * **Scope of Authority:** These Special Public Prosecutors are authorized to conduct all court proceedings related to specific FIRs, including bail hearings, trials, appeals, miscellaneous matters, applications, and writ petitions. * **Focus on Specific Cases:** The appointed prosecutors will primarily focus on cases connected to Anti-CAA protests, related law and order disturbances in Delhi, and the North East Delhi riots. The key difference is the increase in prosecutorial resources dedicated to these specific cases. This is a direct addition of manpower within the legal process. **6. Target Audience and Stakeholders:** The target audience and stakeholders directly affected by this notification include: * The newly appointed Special Public Prosecutors. * The accused parties and NGOs involved in the specified FIRs (Anti-CAA protests, law and order disturbances, and Delhi riots). * The Courts handling these cases. * Victims of the riots and protests. * The Delhi Police and the Home Department of the NCT of Delhi. * Citizens of Delhi affected by the protests and riots. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Home (Police) Department of the Government of NCT of Delhi is the responsible agency. The Lieutenant Governor of Delhi approves the notification. * **Procedures:** The Special Public Prosecutors are expected to begin conducting court proceedings as assigned. * **Fees and Conditions:** The specific fees, terms, and conditions of the Special Public Prosecutors' appointments will be determined at a later date. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of this amendment are: * **Increased Efficiency:** Accelerate the handling of cases related to the Anti-CAA protests, law and order disturbances, and the Delhi riots. * **Strengthened Prosecution:** Provide more focused and dedicated legal representation for the state in these sensitive cases. * **Potentially Faster Justice:** Expedite the legal process for both the accused and the victims. * **Improved Public Confidence:** Demonstrate a commitment to addressing the legal ramifications of the protests and riots. **9. Conclusion:** The Government of NCT of Delhi's notification appointing three additional Special Public Prosecutors represents a targeted effort to address the legal challenges arising from Anti-CAA protests, subsequent law and order issues, and the Delhi riots in the North East District. The increase in dedicated prosecutorial resources suggests a focus on expediting and strengthening the legal proceedings related to these events. The notification is significant because it directly allocates resources to a politically charged and sensitive area of legal casework.
