NOTIFICATION
Right to FaiR Compensation and tRanspaRenCy in Land aCquisition, RehabiLitation and ResettLement
aCt, 2013.
No. SIA/SR-16/2026.— WHEREAS, section 10A of the Right to Fair Compensation And
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013),
(hereinafter referred to as ‘the said Act’) in its application to the State of Maharashtra, provides that
the State Government may, in the public interest, by notification in the Official Gazette, exempt any
of the projects mentioned in the said section 10A from the application of the provisions of Chapter
II and Chapter III of the said Act;
AND WHEREAS, as per Standing order No. SIA/2023/C.R.105/A-2 Dated 17.11.2025 issued by
the Revenue and Forest Department, Government of Maharashtra, the power of the State Government
under section 10 A to grant exemption from application of the provisions of Chapter II and III of the
said Act, have been delegated to the Divisional Commissioner;
AND WHEREAS, it appears to the Divisional Commissioner, Nashik that the lands mentioned
in Schedule I appended hereto are required or likely to be required for the project mentioned in the
Schedule II appended hereto, which is covered under clause (f) of the said section 10A (hereinafter
referred to as "the said project");
AND WHEREAS, the Divisional Commissioner, Nashik has ensured the extent of the said lands
for the proposed acquisition being bare minimum land required for the said project;
AND WHEREAS, the Divisional Commissioner, Nashik considers it expedient in the public
interest to exempt the said project under section 10A of the said Act from the application of the
provisions of Chapter II and Chapter III of the said Act.
NOW, THEREFORE, in exercise of the powers conferred by section 10A of the said Act, and
Standing Order No. SIA/2023/C.R.105/A-2 dated 17.11.2025 issued by State Government and all
other powers enabling it in that behalf, the Divisional Commissioner, Nashik hereby, in the public
interest, exempts the said project from the application of provisions of Chapter II and Chapter III
of the said Act.
