और ईि प्रारूप जनयमों के संबंध म ें जनसाधारण स े प्राप्त अक्षपे ों और सुझािों पर केंद्रीय सरकार द्वारा सम् यक रूप स े जिचार दकया गया ह;ै 7031 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ऄत: ऄब, केंद्रीय सरकार दरू सचं ार ऄजधजनयम, 2023 (2023 का 44) की धारा 56 की ईपधारा (2) के खंड (v) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, जनम्नजलजखत जनयम बनाती ह,ै ऄथावत:् - 1. संजक्षप्त नाम और प्रारंभ — (1) आन जनयमों का संजक्ष‍ त नाम दरू संचार (दरू संचार साआबर सुरक्षा) संिोधन जनयम, 2025 ह।ै (2) य ेराजपत्र म ेंआनके प्रकािन की तारीख को प्रिृत्त होंगे। 2. दरू संचार (दरू संचार साआबर सुरक्षा) जनयम, 2024 (जजसे आसम ें आसके पिच् ात मूल जनयम कहा गया ह)ै म,ें जनयम 2 के ईपजनयम (1) म,ें - (क) खंड (ग) के प‍ चात, जनम्नजलजखत खंड ऄतं :स्ट्थ ाजपत दकया जाएगा, ऄथातव ् ‘(गक) "ऄनुज्ञज‍ तधारी" स े भारतीय तार ऄजधजनयम, 1885 (1885 का 13) के ऄधीन दरू संचार सेिाए ं प्रदान करन े के जलए ऄनुज्ञज‍ त धारण करन े िाला व्यजि ऄजभप्रेत ह;ै (गघ) "एमएनिी ‍लेटफॉमव" स े जनयम 7क के ऄधीन स्ट्थाजपत मोबाआल नंबर जिजधमान् यकरण ‍लेटफॉम व ऄजभप्रेत ह,ै जो प्राजधकृत आकाआयों और ऄनुज्ञज‍ तधायरयों द्वारा जिजधमान् यकरण को आस संबंध म ें समथ व बनाने के जलए ह ै दक क्या टीअइयूइ ग्राहकों या ईपयोगकतावओं द्वारा जिजनर्ददष्ट दरू संचार पहचान संख्या, यथाजस्ट् थजत प्राजधकृत आकाइ या ऄनुज्ञज‍ तधायरयों के डेटाबेस म ें मौजूद ईपयोगकतावओं के ऄनुरूप ह।ैं (ख) खंड (ज) के प‍ चात, जनम्नजलजखत खंड ऄंत:स्ट्थ ाजपत दकया जाएगा: ‘(i) “टीअइयूइ (दरू संचार पहचान संख्या ईपयोगकताव आकाइ)" स े ऄनुज्ञज‍ तधायरयों या प्राजधकृत आकाइ से जभन् न कोइ व्यजि, जो ऄपन े ग्राहकों या ईपयोगकतावओं की पहचान के जलए या सेिाओं के ईपबंध या जितरण के जलए दरू संचार पहचान संख्याओं का ईपयोग करता ह,ै ऄजभप्रेत ह’ै; 3. मूल जनयमों के जनयम 3 म,ें — (क) ईप-जनयम (1) म-ें (i) खंड (क) के ऄतं म ेंअने िाल े“और” िब् द का लोप दकया जाएगा; (ii) खंड (क) के पश्चात ्जनम्नजलजखत खंड ऄंतःस्ट्थाजपत दकया जाएगा, ऄथावत:् - "(कक) पोटवल पर जिजनर्ददषट् प्रारूप और रीजत म ें एक टीअइयूइ द्वारा ईपयोग दकए जाने िाले दरू संचार पहचान संख्याओं से संबंजधत डेटा का पता लगाना; और” (ख) ईप-जनयम (2) के खंड (ख) म,ें "दरू संचार आकाइयों" िब्दों के प‍ चात, "या टीअइयूइ" िब्द और ऄक्षर ऄंत:स्ट् थाजपत दकए जाएंगे। 4. मूल जनयमों के जनयम 4 के ईप-जनयम (3) म,ें "दरू संचार आकाइ" िब्दों के प‍ चात, "और टीअइयइू " िब्द और ऄक्षर ऄंत:स्ट्थ ाजपत दकए जाएंग।े 5. मूल जनयमों के जनयम 5 म,ें — (क) ईप-जनयम (6) के स्ट् थान पर जनम्नजलजखत ईप-जनयम को रखा जाएगा, ऄथावत:् - "(6) जहााँ केन्द्रीय सरकार यह समझती ह ै दक ईप-जनयम (5) के ऄधीन तत्काल कारविाइ लोकजहत म ें अि‍यक या समीचीन ह ै िहा ाँ िह, ईप-जनयम (2) के ऄधीन सूचना जारी दकए जबना, ईसके कारणों को ऄजभजलजखत करत े हुए-[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (क) सुसंगत दरू संचार पहचान संख्या के ईपयोग को ऄस्ट्थायी रूप स े जनलंजबत करन े के जलए दरू संचार आकाइ को; और (ख) ऄपन े ग्राहकों या ईपयोगकतावओं की पहचान के जलए, या सेिाएाँ प्रदान करन े के जलए सुसंगत दरू संचार पहचान संख्या के ईपयोग को ऄस्ट्थायी रूप से जनलंजबत करन े के जलए टीअइयूइ को ईजचत जनदेिों के साथ अदेि पायरत करेगी।” (ख) ईप-जनयम (7) म,ें "दरू संचार आकाइ" िब्दों के प‍ चात, दोनों स्थानों पर जहां िे अते ह,ैं "या टीअइयूइ" िब्द और ऄक्षर ऄंत:स्ट्थ ाजपत दकए जाएंगे। (ग) ईप-जनयम (8) म,ें परंतुक के स्ट् थान पर जनमन् जलजखत परंतुक रखा जाएगा ऄथावत:् "परंत ुईप-जनयम (6) के ऄधीन अदेि के दकसी भी संिोधन म:ें (क) ईप-जनयम (5) के खंड (ख) के ऄधीन यथा जिजनर्ददष्ट सुसंगत दरू संचार पहचान संख्या के ईपयोग को स्ट्थायी रूप स े जियोजन करन ेके जलए दरू संचार आकाइ को; और (ख) ऄपन े ग्राहकों या ईपयोगकतावओं की पहचान के जलए, संदेि या सेिाओं का पयरदान करन े के जलए, आस तरह के अदेि म ें जनर्ददष्ट तरीके स े सुसंगत दरू संचार पहचान संख्याओं के ईपयोग को ईस रीजत में जो आस प्रकार के अदेि में जिजनर्ददष् ट की जाए, प्रजतबंजधत या पयरसीजमत करने के जलए, सुसंगत दरू संचार पहचान संख्याओं के पुन: ईपयोग को सक्षम करने के जलए टीअइयूइ को जनदेजित करते हुए कोइ अदेि भी सजम्मजलत हो सकेगा।”; (घ) ईप-जनयम (11) में, (i) “दरू संचार पहचान संख्याओं स े जुडी सेिाएं प्रदान करन े िाले दकसी व्यजि” िब्दों के स्ट्थान पर “दकसी टीअइयूइ” िब् द और ऄक्षर रखे जाएंग;े और (ii) “ऄपन े ईपभोिा” िब्दों के पश्चात “या ईपयोगकताव” िब्द ऄंतःस्ट्थाजपत दकए जाएंगे। 6. मूल जनयमों के जनयम 7 के पश्चात जनम्नजलजखत जनयम ऄंतःस्ट्थाजपत दकए जाएंग,े ऄथावत:् “7क. दरू सचं ार पहचान सख्ं याओं का जिजधमान्य करण- (1) केंद्रीय सरकार दरू संचार साआबर सुरक्षा सुजनजश्चत करन े तथा सुरक्षा घटनाओं को रोकने के ईद्दे‍य से स्ट्िय ं या ईसके द्वारा प्राजधकृत दकसी ऄजभकरण के माध्यम स े एमएनिी ‍लेटफॉमव स्ट्थाजपत करेगी तथा प्राजधकृत आकाआयों और ऄनुज्ञज‍ तधायरयों को ऐस े ‍लेटफॉम व पर सहभाजगता करने के संबंध म ेंजनदेि जारी करेगी। (2) जनमन् जलजखत आकाइयां एमएनिी प्लेटफॉम व पर ऄनुरोध कर सकती ह ैं और ईसम ें यथा जिजनर्ददष्ट फीस का संदाय करके, यह जिजधमान् यकरण प्राप्त कर सकती ह ैं दक क्या ईनके ग्राहकों या ईपयोगकतावओं द्वारा जिजनर्ददष्ट दरू संचार पहचान सख्ं या, दकसी प्राजधकृत आकाइ या ऄनुज्ञज‍ तधायरयों के डेटाबेस म ें मौजदू ईपयोगकताओंव के ऄनुरूप ह:ैं- (क) कोइ टीअइयूइ, या तो स्ट्िप्रेरणा स,े या केंद्रीय सरकार या राज्य सरकार या केंद्रीय सरकार या राज्य सरकार द्वारा प्राजधकृत दकसी ऄजभकरण के दकसी जनदेि पर; या (ख) केंद्रीय सरकार या राज्य सरकार या केंद्रीय सरकार या राज्य सरकार द्वारा प्राजधकृत कोइ ऄजभकरण: परंतु जहां कोइ टीअइयूइ एमएनिी ‍लेटफॉम व पर स्ट्िप्रेरणा स े ऄनुरोध करता ह,ै ऐसे ‍लेटफाम व के ईपयोग को ऄनुज्ञ‍ त करन ेका जिजन‍ चय केंद्रीय सरकार का होगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) एमएनिी ‍लेटफॉमव के ईपयोग के जलए प्रभायरत फीस केंदीय सरकार या ईसके ऐसे ऄजभकरण, जजसने एमएनिी ‍लेटफॉमव की स्ट्थापना एि ं रख-रखाि दकया ह ै और पोटवल पर यथा जिजनर्ददष्ट जिजधमान् यकरण सेिाए ं प्रदान करन े िाली प्राजधकृत आकाइ या ऄनुज्ञज‍ तधायरयों के बीच साझा दकया जाएगा। (4) एमएनिी ‍लेटफॉमव ईप-जनयम (2) या ईप-जनयम (3) के ऄधीन प्राप्त दकसी भी ऄनुरोध को जिजधमान् यकरण के प्रयोजन स े प्राजधकृत आकाइयों और ऄनुज्ञज‍ तधायरयों को भेजेगा और ऐसी आकाइ ऐसा जिजधमान् यकरण करेंगी और आसमें यथा जिजनर्ददष्ट एमएनिी ‍लेटफॉम वपर ऄपनी प्रजतदिया देंगी। (5) आस जनयम के ऄधीन मोबाआल नंबर जिजधमान् यकरण ऐसी पहचान संख्या से जुडी सेिाओं के प्रयोजन के जलए दरू संचार पहचान संख्या से जुड े ईपभोिाओं या ईपयोगकतावओं के जिजधमान् यकरण को असान करेगा और यथाजस्ट् थजत टीअइयूइ, प्राजधकृत आकाइ और ऄनुज्ञज‍ तधारी, आस प्रयोजन के जलए डेटा सुरक्षा से संबंजधत लाग ू जिजधयों का ऄनुपालन सुजनजश्चत करेंगे।” 7. मूल जनयम के जनयम 8 म,ें — (क) ईप-जनयम (4) के पश्चात जनम्नजलजखत ईप-जनयम ऄंतःस्ट्थाजपत दकया जाएगा, ऄथावत:् - “(4क) केंद्रीय सरकार ऄंतरावष्ट्रीय मोबाआल ईपकरण पहचान संख्या (अइएमइअइ) िाले दरू संचार ईपकरणों के जिजनमावताओं को केन्द्रीय सरकार द्वारा पोटवल पर जिजनर्ददष्ट तारीख स े भारत म ें दरू संचार नेटिकव म ें पहल े स े ईपयोग म ें अन े िाले अइएमइअइ को भारत म ें जिजनर्ममत या भारत म ें अयात दकए जा रह े नए दरू संचार ईपकरणों को प्रदान न दकए जाने का जनदेि जारी कर सकती ह।ै ” (ख) ईप-जनयम (5) के पश्चात जनम्नजलजखत ईप-जनयम ऄंतःस्ट्थाजपत दकया जाएगा, ऄथावत्: - “(6) केन्द्रीय सरकार, सीधे या ईसके द्वारा प्राजधकृत दकसी ऄजभकरण के माध्यम स े ईन अइएमइअइ का डाटाबेस रखेगी जजनके साथ छेडछाड की गइ ह ैया जजनका ईपयोग प्रजतबंजधत दकया गया ह।ै (7) भारत म ें अइएमइअइ नंबर िाले प्रयुि दरू संचार ईपकरणों के जििय और िय म ें लगे हुए व्यजि या ईसके द्वारा प्राजधकृत ऄजभकरण, ऐसी जििय और िय से पहले पोटलव पर यथा जिजनर्ददष् ट फीस के संदाय पर ईप-जनयम (6) म ें जिजनर्ददष्ट डाटाबेस तक पहुचाँ बनाएगा और यह सुजनजश्चत करेगा दक िह अइएमइअइ संख् या जो ऐसे डाटाबेस म ें जिजनर्ददष्ट ह,ैं िाल े दकसी भी दरू संचार ईपकरण का जििय या िय प्रत्यक्ष या ऄप्रत्यक्ष रूप से नहीं करेगा। (8) दकसी दरू संचार ईपकरण का प्रत्येक जिजनमावता या अयातकता,व जजसके पास ऄंतरावष्ट्रीय मोबाआल ईपकरण पहचान संख्या (अइएमइअइ) ह,ै आन जनयमों को प्रभािी करन े के प्रयोजनाथव केन्द्रीय सरकार द्वारा यथा जारी दकए गए जनदेिों का ऄनुपालन सुजनजश्चत करेगा।” 8. मूल जनयम के जनयम 10 म,ें — (क) ईप-जनयम (2) म,ें दोनों स्ट्थानों पर अन े िाल े "दरू संचार आकाइ" िब्दों के पश्चात, "या टीअइयूइ" िब्द और ऄक्षर ऄंतःस्ट्थाजपत दकए जाएंगे; (ख) ईप-जनयम (3) म,ें "दरू संचार आकाइ" िब्दों के पश्चात, ", टीअइयूइ" ऄक्षर ऄंतःस्ट्थाजपत दकए जाएंगे। [फा. स.ं 24-07/2024-यूबीबी] देिेंद्र कुमार राय, संयुि सजचि नोट : मूल जनयम भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3, ईप-खंड (i) म ें ऄजधसूचना संख्यांक सा.का.जन. 720(ऄ) तारीख 21 निबं र, 2024 द्वारा प्रकाजित दकए गए थे।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 MINISTRY OF COMMUNICATIONS (Department of Telecommunications) NOTIFICATION New Delhi, the 22nd October, 2025 G.S.R. 771(E).—Whereas a draft of the Telecommunications (Telecom Cyber Security) Amendment Rules, 2025, which the Central Government proposes to make in exercise of the powers conferred by clause (v) of sub section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), was published as required by sub-section (1) of section 56 of the said Act vide notification of the Government of India in the Ministry of Communication, Department of Telecommunication number G.S.R. 411(E), dated 24th June, 2025 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 24th June, 2025, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Gazette containing the said notification were made available to the public; And whereas copies of the said Gazette were made available to the public on the 25th June, 2025; And whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by clause (v) of sub section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), the Central Government hereby makes the following rules, namely: – 1. Short title and commencement. — (1) These rules may be called the Telecommunications (Telecom Cyber Security) Amendment Rules, 2025 (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Telecommunications (Telecom Cyber Security) Rules, 2024 (hereinafter referred to as the principal rules), in rule 2, in sub-rule (1),— (a) after clause (c), the following clauses shall be inserted, namely: - ‗(ca) ―licensee‖ means a person holding a license to provide telecommunication services under the Indian Telegraph Act, 1885 (13 of 1885); (cb) ―MNV platform‖ means the mobile number validation platform established under rule 7A to enable validation by authorised entities and licensees as regards whether telecommunication identifiers specified by TIUE customers or users, correspond to the users as present in the database of an authorised entity or licensee, as the case may be‘; (b) after clause (h), the following clause shall be inserted, namely:— ‗(i) ―TIUE (telecommunication identifier user entity)‖ means a person, other than a licensee or authorised entity, which uses telecommunication identifiers for the identification of its customers or users, or for provisioning, or delivery of services‘. 3. In the principal rules, in rule 3,— (a) in sub-rule (1),— (i) in clause (a), the word ―and‖ at the end shall be omitted; (ii) after clause (a), the following clause shall be inserted, namely:— ―(aa) seek data related to telecommunication identifiers used by a TIUE in the form and manner as specified on the portal; and‖; (b) in sub-rule (2), in clause (b), after the words ―telecommunication entities‖, the word and letters ―or TIUE‖ shall be inserted. 4. In the principal rules, in rule 4, in sub-rule (3), after the words ―telecommunication entity‖, the word and letters ―and TIUE‖ shall be inserted. 5. In the principal rules, in rule 5,— (a) for sub-rule (6), the following sub-rule shall be substituted, namely:— ―(6) Where the Central Government considers that immediate action under sub-rule (5) is necessary or expedient in the public interest, it shall without issuing a notice under sub-rule (2), pass an order recording the reasons thereof, with appropriate direction—6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (a) to the telecommunication entity to temporarily suspend use of the relevant telecommunication identifier; and (b) to the TIUE to temporarily suspend use of the relevant telecommunication identifier for identification of or for delivery of message or services to its customers or users.‖; (b) in sub-rule (7), after the words ―telecommunication entity‖, occurring at both the places, the word and letters ―or TIUE‖ shall be inserted; (c) in sub- rule (8), the following proviso shall be substituted, namely:— ―Provided that any modification of the order under sub-rule (6) may also include an order directing: (a) the telecommunication entity to permanently disconnect the use of the relevant telecommunication identifier as specified under clause (b) of sub-rule (5); and (b) the TIUE to prohibit or circumscribe the use of relevant telecommunication identifiers for identification of its customers or users, or for delivery of message or services, in the manner as may be specified in such order to enable the reuse of relevant telecommunication identifiers.‖; (d) in sub-rule (11),— (i) for the words ―any person providing services that are linked to telecommunication identifiers‖, the word and letters ―a TIUE‖ shall be substituted; and (ii) after the words ―their customers‖, the words ―or users,‖ shall be inserted. 6. In the principal rules, after rule 7, the following rule shall be inserted, namely:— ―7A. Validation of telecommunication identifiers. — (1) The Central Government, for ensuring telecom cyber security and preventing security incidents, shall either by itself, or through an agency authorised by it, establish a MNV platform and issue directions to authorised entities and licensees to participate on such platform. (2) The following entities may place a request on the MNV platform and upon payment of fees, as specified therein, seek validation as to whether the telecommunication identifiers as specified by their customers or users, correspond to the users as available in the database of an authorised entity or licensee:— (a) a TIUE, either suo moto, or upon a direction from Central or State Government or an agency authorised by the Central or State Government; or (b) the Central Government or State Government or any agency authorised by the Central Government or State Government: Provided that where a TIUE places a request suo moto on the MNV platform, the decision to allow use of such platform shall rest with the Central Government. (3) The fees charged for use of the MNV platform shall be shared between the Central Government or its agency that has established and maintains the MNV platform and the authorised entity or licensee providing the validation services, as specified on the portal. (4) The MNV platform shall transmit any request received under sub-rule (2) or sub-rule (3) to authorised entities and licensees for the purpose of validation, and such entities shall undertake such validation and provide their response to the MNV platform, as specified therein. (5) The mobile number validation under this rule shall facilitate validation of customers or users associated with a telecommunication identifier for the purpose of services linked to such identifier, and the TIUE, authorised entity and licensee, as the case may be, shall ensure compliance with applicable laws relating to data protection for this purpose.‖. 7. In the principal rules, in rule 8,— (a) after sub-rule (4), the following sub-rule shall be inserted, namely:— ―(4A) The Central Government may issue directions to manufacturers of telecommunication equipment bearing International Mobile Equipment Identity (IMEI) number not to assign IMEIs that are already in use in telecommunication networks in India to new telecommunication equipment that are manufactured in India or imported to India from the date as specified by the Central Government on the portal.‖; (b) after sub-rule (5), the following sub-rules shall be inserted, namely:— ―(6) The Central Government shall, either directly or through an agency authorised by it, maintain a database of IMEIs which are tampered, or whose use has been restricted.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 (7) A person engaged in the sale and purchase in India of used telecommunication equipment bearing IMEI numbers or its authorised agency shall, prior to such sale or purchase access the database specified in sub-rule (6) on payment of fees as specified on the portal and ensure that it shall not directly or indirectly undertake sale or purchase of any telecommunication equipment bearing IMEI number that is specified in such database. (8) Every manufacturer or importer of any telecommunication equipment that bears an International Mobile Equipment Identity (IMEI) number shall ensure compliance with the directions as may be issued by the Central Government for the purpose of giving effect to these rules.‖. 8.
